Beyond Capitalist Law: A Commentary On Katharina Pistor, The Law Of Capitalism And How To Transform It, Martijn W. Hesselink

In her powerful new book, Katharina Pistor, grounded in the argument that capitalism is a legal regime, outlines a pathway beyond capitalist law: the transformation of private law in accordance with constitutional principles and the human capabilities approach. This short essay questions whether existing constitutions and the capabilities approach have the normative resources to overcome capitalism. Given existing corporate power entrenched in private rights, the paper also wonders who could be effective and legitimate agents of change able to transform private law into post-capitalist law. The prevalence of autistic students being taught in general education classrooms continues to rise, which emphasizes the need for strong and purposeful inclusive education. The characteristics of autism spectrum disorder (e.g., resistance to change and routines, difficulty in relationship building, sensitivity to environmental stimuli, etc.) can create challenges in the classroom setting that ultimately may impede social and academic growth. Having adequate knowledge and understanding about these challenges is important for teachers as they plan high-quality, differentiated instruction. The Unsovereign Citizen: The Reconfiguration Of Rights And Belonging In Fascist Italy, Roberta Pergher

Modern political thought tends to associate citizenship with democracy, equality, and political participation. This article demonstrates that citizenship can be profoundly important also for authoritarian rule. In Fascist Italy, citizenship remained central to political life, not as a vehicle of democratic participation, to be sure, but as a category through which the regime redefined belonging, hierarchy, and sovereignty. Drawing on citizenship legislation, imperial ordinances, racial laws, police reports, and ministerial commentary between 1912 and 1943, this article shows how the dictatorship hollowed out liberal citizenship within the peninsula, stratified it across imperial territories, consolidated it across diasporic populations, and ultimately …

How Gender Impacts Mock Jurors’ Receptiveness To Aggravating And Mitigating Evidence In Capital Trials, Jolie E. Parker

This study examines how gender influences mock jurors’ receptiveness to aggravating and mitigating evidence in capital trials. Drawing on prior research that highlights the critical role of mitigation in reducing death sentences and persistent gender differences in death penalty attitudes, this study addresses a gap in the literature by analyzing how gender shapes responses to specific types of evidence rather than general support for capital punishment. Using a quantitative survey of 209 participants, the research analyzes Likert-scale responses measuring how various aggravating and mitigating factors impact sentencing preferences. Gender And Emotional Expression In The Courtroom: Mock Juror Perceptions Of Attorney Effectiveness, Emma Cantrell

This quantitative study examines how gender and emotional expression influence mock jurors' perceptions of an attorney's courtroom effectiveness. Using mock jurors, this study extends previous research suggesting that assertiveness and emotional displays are evaluated differently by gender. Participants were randomly assigned to view one of four closing statements in a mock burglary trial. The videos were of either a male or a female attorney delivering a passive or an aggressive argument. Participants then evaluated the attorney’s effectiveness across four categories: competence, persuasiveness, ability to instill confidence, and emotionality. Male participants generally rated female attorneys as less effective than female participants …

Is Home Birth A Choice? Racial And Geographic Differences In Unintended Home Births In The U.S., Anna De La Paz
Population Health Research Brief Series
Home births that happen without planning or medical support (i.e., unintended home births) carry a higher likelihood of adverse outcomes, such as low birth weight, preterm birth, and hypothermia. This data slice summarizes findings using data from CDC WONDER (2017–2023) on racial, regional, and metropolitan status differences in home births among women ages 15–44 in the U.S. Findings show that unintended home births are disproportionately concentrated among non-Hispanic Black women, with rates varying substantially by region and metropolitan status.

The U.S. district courts have emerged as a critical site of contested terrain amid the chaos and controversies consuming American law and politics since the start of the second Trump administration. This article examines these frontline courts through the theoretical lens of populism, arguing that they have become a critical institutional flashpoint in the populist assault on constitutional democracy in the United States. Hurdles To Retirement Security: Exploring Race, Religion, And Savings Behavior, Mamoud A. Jalloh, Sedefka Beck

Retirement savings have become increasingly central to household financial security as defined contribution plans replace traditional pensions. Using nationally representative data from the 2019 Panel Study of Income Dynamics, this study applies a double‑hurdle model to examine the distinct factors shaping participation in retirement plans and contribution intensity. Results reveal persistent racial and ethnic inequalities: Hispanic, Black, and Mixed‑Race workers are significantly less likely to save and contribute markedly less than White workers, even after accounting for income, wealth, and employment characteristics. Religious affiliation also influences savings behavior, with Jewish contributors saving more and several other groups saving less than …

The purpose of this study was to evaluate gaps in healthcare training that lead to healthcare access inequalities and the role of the pathway programs' effectiveness in the pathway process in Virginia. The problem addressed in this study was to assess how healthcare education pathway programs impact access to care in rural and underserved areas of Virginia. This thesis examined the problem of the tendency for older adults to slow down in spiritual growth. The project instituted relationships between older and younger individuals in a Cross-Generational Co-Mentorship system, which allowed two individuals from different generations to engage in spiritual disciplines in a one-on-one format in a small church context. The purpose of this study was to foster spiritual growth and wellness through individual interactions and to enhance their engagement in various ministry opportunities. Despite research demonstrating a significant correlation between social and academic development with participation in a youth orchestra, few studies have examined whether participation directly affects students’ note-reading skills, the accuracy of pitch production, and musical expression. This information matters because students often join a youth orchestra to develop these and other playing skills beyond what school programs and private lessons teach. This applied research study examined youth orchestra participation by comparing teachers’ perceptions with demonstrated performance outcomes on middle school students’ development in note-reading, pitch production accuracy, and musical expression. This study entailed an investigation of the underutilization of executive coaching as a leadership development tool in the financial sector of Sub-Saharan Africa, where leadership challenges have hindered organizational growth and transformation. The researcher aimed to identify barriers to coaching adoption, examine leaders’ perceptions of its value compared to other development initiatives, and propose strategies to enhance its acceptance and effectiveness. The purpose of this phenomenological study is to describe African American millennial married couples’ experiences with unresolved trauma in the North Texas Region, Texas. The theory guiding this study is John Bowlby’s Attachment Theory. Multiple traumatic experiences and relationship fractures that inhibit marital satisfaction among African American millennials are also examined. Trauma, viewed from a generalized perspective and conceptual form, is defined as an uncontrollable and sudden event with highly adverse outcomes that may persist. This study examined the qualitative phenomenon associated with perceived fluctuation of millennials’ church attendance. The researcher sought to explore lived experiences of African American millennials within the context of Baptist churches in Washington, DC, who experienced a period of childhood and adolescence in the Baptist church. This study examined the underlying factors influencing millennials’ church attendance, known as lived experiences. The purpose of this phenomenological study was to understand how Christian pastors serving congregations throughout the United States utilize religious and secular coping strategies to address occupational stress and achieve work-life balance. The theory guiding this study was Lazarus and Folkman’s (1984) transactional model of stress and coping, as it provided a framework for understanding how pastors cognitively and emotionally respond to ministry-related challenges, and how their coping choices, whether spiritual or secular, reflect an ongoing process of adaptation, meaning-making, and resilience within complex realities of pastoral life.
