(Wp 2023-01) Objectivity In Economics And The Problem Of The Individual, John B. Davis Mar 2023

(Wp 2023-01) Objectivity In Economics And The Problem Of The Individual, John B. Davis

Economics Working Papers

This paper addresses objectivity in economics. It criticizes a closed science, ‘view from nowhere’ conception of economics and defends an open science, ‘view from somewhere’ conception of objective science. It ascribes the first conception to mainstream economics, associates it with its principle practices – reductionist modeling, formalization, limited interdisciplinarity, and value neutrality – and argues their foundation is the Homo economicus individual conception. Two problematic consequences of adopting this stance are: (i) value blindness regarding the range and complexity of human values; (ii) fatalism regarding human behavior associated with employing a tenseless representation of time. The paper contrasts the principle …

Carceral Socialization As Voter Suppression, Danieli Evans Mar 2023

Carceral Socialization As Voter Suppression, Danieli Evans

Articles

In an era of mass incarceration, many people are socialized through interactions with the carceral state. These interactions are poweful learning experiences, and by design, they are contrary to democratic citizenship. Citizenship is about belonging to a community of equals, being entitled to mutual respect and concern. Criminal punishment deliberately harms, subordinates, and stigmatizes. Encounters with the carceral system are powerful experiences of anti-democratic socialization, and they impact peoples' sense of citizenship and trust in government. Accordingly, a large body of social science research shows that eligible voters who have carceral contact are significantly less likely to vote or to …

Modalities Of Social Change Lawyering, Christine N. Cimini, Doug Smith Mar 2023

Modalities Of Social Change Lawyering, Christine N. Cimini, Doug Smith

Articles

The last decade has seen the rise of new kinds of grassroots social movements. Movements including Occupy Wall Street, Black Lives Matter, Sunrise, and #MeToo pushed back against long-standing political, economic, and social crises, including income inequality, racial inequality, police violence, climate change, and the widespread culture of sexual abuse and harassment. As these social change efforts evolve, a growing body of scholarship has begun to theorize the role of lawyers within these new social movements and to identify lawyering characteristics that contribute to sustaining social movements over time. This Article surveys this body of literature and proposes a typology …

In this interactive session, librarians from public, academic, and school settings explore the topic through a variety of lenses, including the individual impetus, institutional or structural impact, legal implications, issues of equality between front-line workers and administration, and the possible political solution to worker burnout.

Documents and Publications of the Institute for Pastoral Initiatives

In 1972, the Marianists established the Marianist Institute for Christian Renewal, later called the Center for Christian Renewal (CCR), under the auspices of the University of Dayton. The goal of the Center was to be a bridge between the University and the Catholic Church in dialogue and pastoral service. During the next fifty years to the present, the centers and institutes established under the initial CCR connected the University with the Catholic Church in the spirit and charism of the Marianist tradition. The areas of connection include support for social justice issues in Africa and West Dayton; Catholic elementary …

Faculty, Staff and Student Publications

Health disparities in multiple myeloma (MM) disproportionately affect minorities. Characterization of health disparities encountered by Hispanic Americans with MM is necessary to identify gaps and inform future strategies to eliminate them. We performed a systematic review of publications that described health disparities relevant to Hispanic Americans with MM through December 2021. We included all original studies which compared incidence, treatment, and/or outcomes of Hispanic Americans with other ethnic groups. Eight hundred and sixty-eight articles were identified of which 22 original study articles were included in our systematic review. The number of publications varied over time with the highest number of …

The Mass Exodus Of Black Millennials From The Black Church: In Search Of Biblical Blackness, Jacqueline A. Trim

Doctor of Ministry

A mass exodus of Black millennials away from the Black churches of the African diaspora has taken place in recent years. There is a plethora of reasons for this given by the Black millennials, spiritual authors/researchers, and the spiritual leadership of the Black church. The most important of these reasons has been put forward by Black millennials that the Bible and Christianity are irrelevant to the social, economic, and political issues of their lives and they want no part of it. This research is undertaken to investigate the real cause(s) of this exodus and to determine where the responsibility lies …

Sola Scriptura: Slavery, Federalism And The Textual Power To Provide For The General Welfare, Calvin H. Johnson Mar 2023

Sola Scriptura: Slavery, Federalism And The Textual Power To Provide For The General Welfare, Calvin H. Johnson

William & Mary Bill of Rights Journal

This Article argues specifically that under the text of the Constitution, Congress has the general power to provide for the welfare through tax and any other necessary and appropriate means. Clause 1 of the description of powers of Congress in Article I, Section 8, gives Congress the power to tax and spend to provide for the common defense and general welfare. Common defense and domestic welfare are parallel in the text and equally plenary, subject only to restrictions protecting individual rights. The final clause of Section 8 then allows Congress to reach the goal of general welfare by any necessary …

This study aims to discuss disaster crisis communication policies for non tectonic tsunami in Indonesia. The case study was selected from the Sunda Strait tsunami that occurred in December 2018 and claimed more than 400 lives. The disaster is unusual since it is included as a non-tectonic tsunami and unable to be detected by the current tsunami early warning system. This study was conducted at the macro level, namely an analysis of disaster communication policies, specifically Law No. 24/2007 on Disaster Management. The data were collected through big data analysis of the word disaster, textual network analysis of disaster laws, …

The Limits Of Church Autonomy, Lael Weinberger Mar 2023

The Limits Of Church Autonomy, Lael Weinberger

Notre Dame Law Review

American courts apply “church autonomy doctrine” to protect the self-governance of religious institutions, based on both of the First Amendment’s religion clauses. Church autonomy’s defenders have sometimes described the doctrine as establishing distinct spheres of sovereignty for church and state. But critics have argued that church autonomy puts religious institutions above the law. They contend that church autonomy doctrine lacks limiting principles and worry that the “sphere sovereignty” theory of church and state leaves no room for accountability for wrongdoing in religious institutions. The courts, for their part, have recognized that church autonomy must have limits but have struggled to …

Autism In The Workplace, Gundars Kaupins Mar 2023

Autism In The Workplace, Gundars Kaupins

Management Faculty Publications and Presentations

Autism is a lifelong, genetic disorder that creates communication challenges, including social-emotional reciprocity, nonverbal communicative behavior deficits, and relationship struggles; restricted or repetitive behavior patterns and interests; and sensitivity to sensory inputs.1 This disorder presents a range of conditions, known as the autism spectrum, which spans from “low-functioning” individuals, who have significant speech challenges, to “high-functioning” individuals, who can communicate but have other social and behavioral challenges; high-functioning autism has traditionally been called Asperger’s syndrome. This disorder has become more of a mainstream topic, with television shows and movies, such as The Good Doctor and Rainman, depicting characters on …

Transformative Experiences Of Beginner L2 Learners In The Italian Classroom For Social Justice, Giulia Negretto, Borbala Gaspar

Dimensions

Focusing on two beginner Italian courses, this study demonstrates participants’ perceptions of and engagement with social justice topics and materials in a semesterlong project. A quantitative and qualitative analysis of surveys, triangulated with interviews and artifacts, such as comments by students during lessons and in their video responses, provide us with a better understanding of students’ previous expectations, perceptions and experiences with learning Italian; their background knowledge on social justice; and their reactions to the activities implemented throughout the course. Our findings indicate that learners value classroom activities and learning tools that allow them to share, collaborate, and reflect together. …

Forgotten Parties: Shifting The Focus Of Donor Conception To Donor-Conceived Persons Through Reasonable Regulation, Tiffany D. Gardner Mar 2023

Forgotten Parties: Shifting The Focus Of Donor Conception To Donor-Conceived Persons Through Reasonable Regulation, Tiffany D. Gardner

Mercer Law Review

In an age in which information is at our fingertips with a few keystrokes, members of the fertility industry are increasingly confronting the reality that anonymous sperm and egg donation is no longer realistic—and has not been for some time. With the advent of at-home commercial DNA testing, multiple generations are not only learning they were conceived through the use of reproductive material provided by third parties (“donors”) but also identifying those formerly anonymous donors. These revelations, and increasing advocacy by the people born of such donations (i.e., donor-conceived people) are changing the landscape of third-party reproduction around the world. …

Quasi Tripartism: Limits Of Co-Regulation And Sectoral Bargaining In The United States, César F. Rosado Marzán Mar 2023

Quasi Tripartism: Limits Of Co-Regulation And Sectoral Bargaining In The United States, César F. Rosado Marzán

University of Chicago Law Review

Disproportionate employer power is at least partly responsible for the sharp increase in economic inequality in the United States, which threatens the fabric of the Republic. Workplace law reform could provide workers with an institutional source of power that countervails employer power and compresses inequality. Ideas for workplace law reform include modest ones, such as instituting “co-enforcement,” and more ambitious ones, such as “sectoral bargaining.” According to their adherents, both require tripartite arrangements where capital, labor, and government provide inputs on how to regulate work.

But can the United States, with its liberal market economy typically devoid of meaningful tripartism, …

Solving Slapp Slop, Nicole J. Ligon Mar 2023

Solving Slapp Slop, Nicole J. Ligon

University of Richmond Law Review

In a substantial minority of states, wealthy and powerful individuals can, without much consequence, bring defamation lawsuits against the press and concerned citizens to silence and intimidate them. These lawsuits, known as “strategic lawsuits against public participation” (“SLAPP”s), are brought not to compensate a wrongfully injured person, but rather to discourage the defendants from exercising their First Amendment rights. In other words, when well resourced individuals feel disrespected by public criticism, they sometimes sue the media or concerned citizens, forcing these speakers to defend themselves in exorbitantly expensive defamation actions. In states without anti-SLAPP statutes—statutes aimed at protecting speakers from …

Resolving Regulatory Threats To Tenure, Joseph W. Yockey Mar 2023

Resolving Regulatory Threats To Tenure, Joseph W. Yockey

University of Richmond Law Review

Many lawmakers and public university governing boards are looking to curb faculty tenure. Driven by both ideological and economic motives, recent efforts range from eliminating tenure systems altogether to interfering when schools seek to tenure individual, often controversial scholars. These actions raise serious questions about higher education law and policy and have important implications for the future of academic freedom. Indeed, if they gain further traction, current regulatory threats to tenure will jeopardize the ability of American universities to remain at the forefront of global research and intellectual progress.

This Article examines the growing anti-tenure sentiment among state officials and …

Pure And Undefiled Religion: Ministry To Widows In The American Church Today, Holli R. Reeves Mar 2023

Pure And Undefiled Religion: Ministry To Widows In The American Church Today, Holli R. Reeves

Theology Undergraduate Work

Within the more than 300,000 Christian congregations in the United States, very few ministries exist for the marginalized, especially for widows. Considering that over 900,000 adults in the United States are widowed each year, the lack of care and support available within Christian congregations for widows is alarming. The neglect of care and support available for widows within Christian congregations in the United States today is specifically important to address as care for the marginalized—the orphan, the widow, and the foreigner—is a frequent topic in the Bible and, therefore, a subject especially near to the heart of God. This research …

A Second Bite At The Apple: An Analysis Of In Re Jackson And Attempting To Use The Right Of Publicity As A Quasi Remedy To Copyright Preemption, Reyna Herrera

Southern Illinois University Law Journal

The Second Circuit recently decided the case of In Re Jackson, where famous rapper Curtis Jackson ("50 Cent") brought suit against William Roberts ("Rick Ross") asserting a state law right of publicity claim, involving Jackson's song "In Da Club." Currently, many circuits are divided as to whether the federal Copyright Act preempts such a claim. This note discusses the history of both the federal Copyright Act and the right of publicity, and explores past circuit court decisions regarding both laws, noting an exception many circuits chose to adopt: the commercial use exception. This note analyzes the commercial use exception …

"Woman, Life, Freedom": A Movement In Progress In Iran, Arastoo Dabiri Mar 2023

"Woman, Life, Freedom": A Movement In Progress In Iran, Arastoo Dabiri

Dignity: A Journal of Analysis of Exploitation and Violence

On September 16, 2022, a new movement began in Iran. It shows the potential to be a serious uprising. The death of an Iranian woman in the street in Tehran, the capital of Iran, due to being beaten by morality police because she was wearing an unappropriated hijab sparked the uprising. Her death was a result of wearing an “inappropriate” hijab. This was an excuse that turned on people’s anger not only because of hijab but also because there are many other combinations of causes to bring out people for protest. This movement was started because people were dissatisfied with …
