“The Game Was Ruined For Me There:” Examining The Mental Health Byproducts Of The Transfer Portal And Nil On Student-Athletes, Ethan Madden, Brendan O'Hallarn
Journal of Athlete Development and Experience
Two rule changes have brought seismic changes to collegiate sports in the United States—the right for college athletes to monetize their Name, Image, and Likeness (NIL), and the Transfer Portal for athletes looking to switch schools. Qualitative interviews with 16 college athletes, explored the mental health byproducts of these new athlete opportunities. The interviews suggest that many athletes are hesitant to participate in NIL due to a lack of guidance. The study also found that college athletes believe entering the Transfer Portal to be a highly stressful experience, comparing the process to being recruited out of high school. However, the …

The Populist Discourse On The Environment: Framework And Evidence From Europe And The Americas, Francesco Duina, Hermione Xiaoqing Zhou
The Populist Discourse On The Environment: Framework And Evidence From Europe And The Americas, Francesco Duina, Hermione Xiaoqing Zhou
All Faculty Scholarship
What is the relationship between populism and the environment? Existing research answers this question by identifying empirical patterns emerging from the positions of specific populist parties. These patterns, however, are not leveraged to propose an overall framework for how populism itself relates to environmental positions. We adopt a deductive approach that draws from populism’s essence to articulate what we should expect. Populism is an ideologically ‘thin’ discursive approach centered on people-centrism and anti-elitism. The environment, as other substantive matters, is therefore a second-order issue. Given this, we should expect considerable variations across populists in their environmental positions. At the same …

(Hidden) In Plain Sight: Migrant Child Labor And The New Economy Of Exploitation, Shefali Milczarek-Desai
Arkansas Law Review
Oppressive child labor in America is both an age-old problem and one that is relatively new. Part I presents the tumultuous history of child labor regulation in the United States—a history that provides clues as to why contemporary child labor laws fall far short of comprehensively addressing oppressive, migrant child labor. It then pivots to the contemporary child labor crisis by describing the new economy of exploitation and the unaccompanied migrant children upon which it relies. Part II sets forth the current U.S. legal landscape surrounding child labor laws, including these laws’ failure to protect migrant children. Next, Part II …
