Threading The Needle In Extreme Partisan Gerrymandering Cases, Michael Gentithes

Cleveland State Law Review

Recent Supreme Court jurisprudence paints a grim picture for future reform to address extreme partisan gerrymandering. The decisions in Rucho v. Common Cause and Moore v. Harper appear to foreclose progress at both the federal and state level. Reformers must neither create unmanageable legal standards for adjudication in federal litigation, nor ask state courts to transgress ordinary bounds of judicial review when interpreting state laws that might address gerrymandering.

But there remains a path forward that focuses on clear and detailed state constitutional mandates to curb gerrymandering practices. Beneath their rhetoric, these decisions support clear legal rules over broader democratic …

Patrol-Level Law Enforcement Experiences With Gray Area Mental Health Crises, Stephanie Louise Schilling

Law enforcement officers (LEOs) often find themselves responding to mental health crises that are gray area situations that neither clearly warrant arrest nor hospitalization but still require intervention. This qualitative study involved addressing the critical issue of how patrol-level officers in California manage such crises despite limited mental health training and restrictive legal frameworks. The study involved filling a gap in literature by focusing on nuanced challenges officers face in these situations, rather than use of force or racial disparities. Grounded in Bronfenbrenner’s bioecological model, the research involved exploring lived experiences of six patrol-level officers using interpretative phenomenological analysis (IPA). …

Hale's (2008) relational theory posits that when less politically relevant ethnic groups experience marginalization and exploitation from the dominant ethnic groups, it creates an orientation in which these groups trust only their co-ethnics in distributing patronage and public goods. To what extent do variations in institutional trust among ethnic groups influence co-ethnic voting behavior? I argue that levels of trust in the president can be understood as one of the conditions under which voters use ethnic identity to decide their vote choice. Maternal mortality in the United States is significantly higher than in most developed nations and has been increasing since 2000. Persistent between-group disparities among White, Black, and Hispanic women occur in terms of maternal mortality; however, the reason for this is largely unknown. Using the intersectionality theory, this quantitative study examined if racial groups predicted maternal mortality and to what extent relationships were moderated by geographic area and health risk factors. This nonexperimental correlational historical research design addressed three research questions. The Healthcare Cost and Utilization Project dataset was used for the analysis. Purpose: Because some stakeholders within medicine seek to diversify and attain greater workforce equity, it is critical to understand gender-based divisions within specialization. Radiation oncology (RO) has one of the smallest proportions of women representation of all specialties, and to our knowledge, no prior studies have investigated gender differences in all the disease site specializations within RO. Thus, we analyzed the relationship between gender and disease site(s) treated in academic RO (ARO).

The Malaysian healthcare system emphasizes patient satisfaction and technological advancements to enhance treatment and operations. Despite progress, not all aspects are fully addressed. The study analyzes the role of technology and stakeholders in economic growth, constructing a research framework to understand theoretical perspectives and identify gaps in the literature. A quantitative survey investigates challenges and opportunities in digital transformation, using positivism, a deductive approach, and an explanatory design. Through the years, research has described the importance of community-based approaches in the management of coastal and marine ecosystems. Coastal and marine issues are multifaceted and require place-specific approaches developed in partnership with vulnerable communities who are impacted by environmental stressors. Place-based conservation, a management approach that focuses on unique, place-specific characteristics, and other similar methods. It considers the need to integrate human dimensions and location-centered approaches, which are often lacking in typical natural resource management. Meaningful engagement with underrepresented communities can holistically account for socioeconomic factors and cultural knowledge that inform best management practices. As the health of marine …

An Analysis Of The Learning Activity System Of An Elementary Education Program For The Development Of Social And Emotional Competence In Preservice Teachers, Lisa Sheldon Brown

This mixed-methods descriptive case study examined how a public research university's elementary education teacher preparation program develops social and emotional competence (SEC) in preservice teachers. Using Engeström's Expansive Learning Theory framework, the study analyzed the tools and mediating artifacts within the program's learning activity system, specifically focusing on activities known to develop SEC. Through semi-structured interviews with 18 instructors and comprehensive document analysis, the study found that SEC development is extensively integrated throughout the program's coursework and field experiences. Three primary types of SEC development activities were identified: self-reflection/self-awareness, active listening, and collaboration. The study revealed a significant correlation between …

The purpose of this qualitative case study was to examine how smartphones impacted the behavioral, academic, and emotional intelligence of middle school students. This study applied the theoretical framework of self-regulation theory and social learning theory to determine how smartphones impacted students. Background: During the past several decades, enterococci are emerging as an important cause of healthcare-associated infections. They have developed resistance to various antimicrobials previously used for the treatment of urinary tract infections (UTIs). This study was aimed to determine the prevalence of Enterococcus species among urinary tract-infected patients in a tertiary care hospital, in Karnataka, India. Material and Methods: We have analyzed 4341 culture-positive urine samples received by microbiology laboratory during the year 2021. The bacterial identification was done by matrix-assisted laser desorption ionization-time of flight mass spectrometry. When exposed to information about a demographic shift towards a non-White majority in America, White individuals tend to prefer interactions and settings within their own ethnic group over minority ethnic groups. This behavior may suggest that future inter-racial dynamics in the U.S. could be characterized by resistance from White individuals. Psychological challenges can influence injured athletes’ speed of recovery and readiness to return to sport. In this study, 485 National Collegiate Athletic Association (NCAA) Division I (DI) athletic trainers (ATs) self-reported their use and perceptions of confidence, effectiveness, familiarity, and qualification toward seven psychological techniques (i.e., effective communication, goal setting, time management, attentional control, self-talk, relaxation, and imagery) during injury rehabilitation on rating scales ranging from 1 (never or not at all) to 7 (always or very). In recent years, there has been an influx of Australian college punters receiving significant media attention. This media coverage often emphasizes these athlete’s “foreignness” by relying on cultural stereotypes. Existing research has shown that the framing of athletes – both text and image frames – can influence individuals’ attitudes and perceptions. This narrative inquiry explored the lived experiences of clinical nurse educators who taught at community colleges during the COVID-19 global pandemic, contributing to the growing body of literature about what nurses endured during the pandemic. The pandemic and the ensuing havoc it caused occurred when the profession faced significant staffing shortages. In the early months of 2020, when the virus was spreading rapidly, many states issued stay-at-home orders requiring nursing programs to pivot to remote learning platforms.
