Hiding Elephants In Mouseholes: Judicial (Mis)Application Of The Federal Arbitration Act To Attorney-Client Arbitration Agreements, Gregory L. Smith

Pepperdine Dispute Resolution Law Journal

This article criticizes cases and commentary that assume, without argument, that the Federal Arbitration Act (FAA) and its decidedly pro-arbitration jurisprudence apply to determine the enforceability of private attorney-client arbitration agreements, thus preempting state bar rules governing disclosures that lawyers must otherwise provide to clients when proposing private, binding arbitration in place of bar-sponsored arbitration regimes. The author argues that applying the FAA and its jurisprudence to attorney-client arbitration agreements raises significant constitutional issues regarding the states’ recognized authority to regulate the legal profession—an issue that courts and commentators have simply ignored.

Dispute Review Boards (DRBs) are a unique form of alternative dispute resolution (ADR) used on large and complex construction projects across the country. Although largely ignored by legal scholars, DRBs have been highly successful in resolving costly, time-consuming disputes involving hundreds of billions of dollars’ worth of projects since their advent in 1975. DRBs are a hybrid form of ADR that combine facilitative and evaluative as well as coercive and non-coercive features of more common forms of ADR. In Scattered and Fugitive Things: How Black Collectors Created Archives and Remade History, historian and archivist Laura E. Helton tells the story of six individuals – Arturo Schomburg, Alexander Gumby, Virginia Lee, Dorothy Porter, Vivian Harsh, and Lawrence Reddick – whose practices of radical collecting revalued and recast the importance of Black history. Background: Public interest in vision health is growing, yet ophthalmology remains underemphasized in medical education due to time constraints associated with in-person instruction.

Purpose: To demonstrate effectiveness of self-guided e-learning modules for ocular examination skills and to determine whether self-assessments can reliably assess medical student proficiency in these skills.

Methods: Medical students at a single institution participated in a skills workshop. Group 1 completed self-guided modules for visual acuity, confrontational visual field testing, pupil examination, and extraocular motility evaluation. Background: Matching into an ophthalmology residency program has become increasingly competitive, with a 66% overall match rate reported by the San Francisco Match in 2024. Early exposure to ophthalmology is critical for students to develop an interest in the field, build robust research experiences, and find mentors to create a competitive ophthalmology residency application. These experiences can often be difficult to acquire at institutions that lack an ophthalmology department. Such institutions face unique challenges in providing mentorship and exposure in this medical specialty, underscoring the need for innovative solutions to support interested students.

Background: Eight Global Ophthalmology (GO) fellowship programs are available in the United States, and more than 30 U.S. GO fellows are now alumni. There are no standardized learning objectives for these programs, and fellows’ experiences vary widely between institutions.

Purpose: To survey GO fellowship program directors in the United States to elucidate differences in learning objectives, duration of time abroad, funding sources, and other differences between GO fellowships.

Background: Increased outsourcing of ophthalmology surgeries has negative consequences for patients, who lose continuity of care, and for ophthalmology trainees, who experience reduced surgical volume.

Purpose: To examine the utilization and outsourcing of ophthalmic surgeries at the Greater Los Angeles Veterans Affairs (VA) before, during, and after the COVID-19 pandemic, with a focus on implications for surgical training and patient outcomes.

The transition of the USMLE Step 1 exam to pass/fail scoring has increased the emphasis on research productivity in competitive specialties such as urology and neurosurgery, yet its impact on ophthalmology bears further investigation. Additionally, the San Francisco Match provides no publicly available data on the research output of matched ophthalmology residency applicants, highlighting a critical gap in understanding the academic profiles of these candidates.

Background: Enhancing gender diversity in leadership can boost overall female participation in the workforce. Gender diversity in the workplace improves innovation, collaboration, and performance.

Purpose: To investigate gender disparities in ophthalmology leadership roles.

Methods: This cross-sectional study of the United States ophthalmology residency programs included chairpersons, residency program directors, and service directors. Data on gender, academic background, and clinical and research experience of leaders were systematically gathered from publicly available sources, including institutional websites, Doximity profiles, Scopus databases, and direct inquiries to each program, from September to November 2023.
