ปัญญาประดิษฐ์เข้ามามีบทบาทต่อการดำเนินชีวิตของบุคคลอย่างมาก ทำให้เกิดปัญหาความรับผิดจากความบกพร่องของปัญญาประดิษฐ์ จากคุณสมบัติเฉพาะที่มีความซับซ้อนและความเป็นอิสระจากการควบคุมของมนุษย์ ทำให้การใช้ทฤษฎีความผิดที่มุ่งหาตัวผู้กระทำผิดมารับผิดชอบต่อความบกพร่องของปัญญาประดิษฐ์นั้นไม่เหมาะสมอีกต่อไป เนื่องจากทฤษฎีความผิดมุ่งหาผู้กระทำความผิดโดยเจตนาหรือประมาท โดยมุ่งเน้นที่ตัวบุคคลผู้กระทำผิด ทำให้ผู้เสียหายไม่ได้รับความเป็นธรรม ต้องพิสูจน์ต่อศาลว่ามีการกระทำผิดโดยเจตนาหรือประมาทเกิดขึ้น ทั้งที่โดยคุณสมบัติของปัญญาประดิษฐ์นั้นมีความซับซ้อนทางเทคโนโลยี ผู้เสียหายไม่อาจพิสูจน์ความผิดหรือความเกี่ยวข้องระหว่างเหตุและผลของการกระทำและการตัดสินใจของปัญญาประดิษฐ์ได้โดยง่าย ด้วยเหตุนี้จึงจำเป็นต้องนำทฤษฎีความรับผิดขององค์กรมาใช้ เพื่อให้ผู้ผลิตปัญญาประดิษฐ์รับผิดต่อความบกพร่องของปัญญาประดิษฐ์แม้ไม่มีความผิดเกิดขึ้นก็ตาม โดยเป็นการรับผิดในความบกพร่องชำรุดของปัญญาประดิษฐ์โดยตรง ทั้งนี้ผู้เสียหายจะมีภาระการพิสูจน์เพียงว่าปัญญาประดิษฐ์นั้นมีความชำรุดบกพร่องและก่อให้เกิดความเสียหายต่อผู้เสียหายเท่านั้น ซึ่งหลักทฤษฎีความรับผิดขององค์กรมุ่งเน้นที่การกระจายความเสี่ยงและการคิดต้นทุนการผลิตภายในองค์กร หลักการนี้จะทำให้ผู้ผลิตสามารถคำนวณต้นทุนความเสียหายได้ล่วงหน้าและสามารถกระจายความเสี่ยงไปยังผู้มีส่วนได้เสียหรือผู้บริโภคในตลาด ไม่จำต้องแบกรับภาระของต้นทุนสินค้าและความเสียหายแต่เพียงผู้เดียว ความรับผิดขององค์กรจึงเป็นความรับผิดเด็ดขาดของผู้ผลิต ซึ่งมีความเหมาะสมกับปัญญาประดิษฐ์มากกว่าการใช้ทฤษฎีความผิดแบบดั้งเดิม

สิทธิและเสรีภาพของพระภิกษุในระบบกฎหมายไทยถูกจำกัดหลายประการด้วยกัน ในรัฐธรรมนูญแห่งราชอาณาจักรไทยทุกฉบับที่ผ่านมามีบทบัญญัติว่าพระภิกษุเป็นผู้ไม่มีสิทธิเลือกตั้งมาโดยตลอด ทำให้พระภิกษุไม่มีสิทธิประเภทอื่น ๆ ตามมา เช่น สิทธิในการลงประชามติ สิทธิในการเข้าชื่อเสนอร่างกฎหมายหรือแก้กฎหมาย ไม่เพียงเท่านี้ ยังมีพระราชบัญญัติคณะสงฆ์ พ.ศ. 2505 มาตรา 29 กำหนดให้เจ้าหน้าที่ราชอาณาจักร คือ พนักงานสอบสวนมีอำนาจสละสมณเพศพระภิกษุผู้ถูกกล่าวหาในคดีอาญาได้ และกำหนด ให้องค์กรคณะสงฆ์ คือ “มหาเถรสมาคม” ออกกฎ คำสั่ง มติ ระเบียบต่าง ๆ มาบังคับใช้กับพระภิกษุ ทำให้เกิดการจำกัดสิทธิภายในคณะสงฆ์มากขึ้นเรื่อย ๆ ปรากฏว่ากฎหมายเหล่านั้นบางฉบับไม่สอดคล้องกับหลักสากลว่าด้วยสิทธิมนุษยชน บางฉบับไม่สอดคล้องกับหลักการการจำกัดสิทธิและเสรีภาพตามรัฐธรรมนูญ และบางฉบับไม่สอดคล้องกับหลักพระธรรมวินัยของสงฆ์ บทความนี้จึงมุ่งพิจารณาว่ากฎหมายที่ตราขึ้นมาเพื่อจำกัดสิทธิและเสรีภาพนั้นเป็นไปสอดคล้องตามหลักสิทธิมนุษยชน รัฐธรรมนูญ กฎหมายบ้านเมือง และหลักพระธรรมวินัย มีผลสัมพันธ์กันหรือไม่ และได้ศึกษาเปรียบเทียบกับพระภิกษุในประเทศพม่า และประเทศศรีลังกา ซึ่งเป็นพุทธศาสนาเถรวาทเช่นเดียวกับพระภิกษุในประเทศไทย เพื่อแก้ไขกฎหมายให้เหมาะสมกับพระภิกษุในสังคมไทยต่อไป

เสรีภาพในการบันทึกทัศนียภาพ (freedom of panorama) เป็นหลักการที่ถูกพัฒนาขึ้นในลักษณะของการเป็นข้อยกเว้นการละเมิดลิขสิทธิ์ เพื่อทำให้บุคคลสามารถบันทึกภาพอาคารสิ่งปลูกสร้าง ประติมากรรม หรืองานศิลปกรรมอันมีลิขสิทธิ์ที่ตั้งอยู่ถาวรในที่สาธารณะได้โดยไม่ต้องขออนุญาตจากเจ้าของลิขสิทธิ์ หลักการนี้มุ่งที่จะสร้างสมดุลระหว่างสิทธิของเจ้าของผลงานที่ตั้งอยู่ในที่สาธารณะกับประโยชน์ของสาธารณชนและคุณค่าทางศิลปะในทัศนียภาพ แม้เสรีภาพในการบันทึกทัศนียภาพจะได้รับการยอมรับและบัญญัติเป็นข้อยกเว้นการละเมิดลิขสิทธิ์ในกฎหมายหลายประเทศทั่วโลก แต่กลับไม่มีนิยามและขอบเขตที่แน่ชัดและเป็นหนึ่งเดียวกัน ทั้งนี้การกำหนดขอบเขตของเสรีภาพในการบันทึกทัศนียภาพให้กว้างย่อมเป็นการจำกัดสิทธิของเจ้าของลิขสิทธิ์ แต่การให้ขอบเขตของเสรีภาพในการบันทึกทัศนียภาพที่แคบเกินไปก็จะเป็นการจำกัดเสรีภาพของปัจเจกชนและกระทบต่อประโยชน์สาธารณะ บทความวิจัยนี้นำเสนอที่มา หลักการและแนวคิดที่เกี่ยวข้องกับเสรีภาพในการบันทึกทัศนียภาพ โดยศึกษาวิเคราะห์บทบัญญัติข้อยกเว้นการละเมิดลิขสิทธิ์ที่เกี่ยวกับเสรีภาพในการบันทึกทัศนียภาพตามกฎหมายในต่างประเทศจำนวน 20 ประเทศและบทบัญญัติของประเทศไทย บทความวิจัยนี้เสนอบทวิเคราะห์ในประเด็นการกำหนดขอบเขต การปรับใช้และการตีความบทบัญญัติเพื่อให้สอดคล้องกับหลักคิดพื้นฐานของเสรีภาพในการบันทึกทัศนียภาพและหลักการกำหนดข้อยกเว้นการละเมิดลิขสิทธิ์ โดยคำนึงถึงการถ่วงดุลอย่างเหมาะสมระหว่างสิทธิของเจ้าของลิขสิทธิ์กับคุณค่าของเสรีภาพในการบันทึกทัศนียภาพในประเด็นสำคัญ 5 ประการ ได้แก่ การกำหนดประเภทของงานอันมีลิขสิทธิ์ที่อยู่ภายใต้ข้อยกเว้นการละเมิดลิขสิทธิ์ ลักษณะการตั้งอยู่ของงานนั้น ลักษณะการกระทำที่อนุญาตให้กระทำต่องานเหล่านั้น ขอบเขตการนำงานไปใช้ในทางพาณิชย์ และการกำหนดเงื่อนไขอื่นเพิ่มเติม

Diversifying modalities or modes of program delivery inside prisons is necessary and important to increase access to programs; however, this also demands that learning is intended to occur in most places of a prison. In this paper I present the concept prison-less places, relational, temporary places where the prison is less noticeable and where learning becomes possible. Exploring three dimensions of learning, I argue that the existence of prison-less places brings balance to these dimensions and is crucial for learning to occur inside prisons. Capitalism began in murder. Bodies were marked by slavery, colonialism, and genocide, white to have, and black to have not. Capitalism, “covered in dirt and dripping with blood,” was born of these three “primitive accumulations.” Slavery is death, and just like colonialism and genocide, it is a capital sentence. The law of capital punishment continues this legacy of murder and racism, as if on “rails to infinity.” This article uses insights from the critique of political economy to examine the death penalty, and the role of law generally, in maintaining racial and other inequalities. This essay describes how the Judicial Conference of the United States elected to reform the provision of transcripts to indigent persons appealing criminal convictions in federal court. A conviction cannot be appealed without a transcript, but, by definition, indigent persons cannot afford to purchase them. A series of Supreme Court decisions held that indigent persons had to be provided transcripts without charge. However, the practical implementation of that right was blocked. In the federal system, appointed counsel had to request production of transcripts using Criminal Justice Act Form 24. That form required special permission for the court reporter to produce …

From the late 18th until the early 20th century, emigrants to the United States (men) who returned to their country of origin for what was intended to be a brief visit could find themselves forced into military service. At first, the U.S. reaction was sporadic. However, with mounting calls for the country to take systemic action, after the Civil War the United States finally negotiated a series of treaties. This Note analyzes the role of religious exemptions in federal and state child welfare statutes in facilitating abuse within the Troubled Teen Industry (TTI), a loosely defined network of residential treatment programs, wilderness camps, and therapeutic boarding schools. Although religious exemptions were originally intended to safeguard religious liberty and parental rights, their statutory design has produced significant regulatory gaps that permit certain faith-affiliated institutions to operate with minimal oversight. By tracing the historical development of these exemptions and examining their contemporary application across multiple jurisdictions, this Note demonstrates how religious status can function as a shield against meaningful accountability. Using the Living Here exhibition as a case study, the project demonstrates how university museums can function as community-centered spaces that foster dialogue, belonging, and civic participation. งานวิจัยนี้มีวัตถุประสงค์เพื่อ (1) ศึกษาความเป็นมา แนวคิด และทฤษฎีที่เกี่ยวข้องกับกระบวนการอนุญาโตตุลาการของประเทศไทย โดยเปรียบเทียบกับหลักการในอนุสัญญาว่าด้วยการยอมรับและการบังคับตามคำชี้ขาดของอนุญาโตตุลาการต่างประเทศ ค.ศ. 1958 (อนุสัญญานิวยอร์ก) กฎหมายแม่แบบว่าด้วยการอนุญาโตตุลาการพาณิชย์ระหว่างประเทศของคณะกรรมาธิการกฎหมายการค้าระหว่างประเทศแห่งสหประชาชาติ กฎหมายว่าด้วยการอนุญาโตตุลาการของสหราชอาณาจักร และกฎหมายว่าด้วยการอนุญาโตตุลาการของสาธารณรัฐสิงคโปร์ (2) ศึกษาและเปรียบเทียบกระบวนการอนุญาโตตุลาการของประเทศไทยกับแนวปฏิบัติสากล (3) วิเคราะห์ปัญหาในการบังคับใช้พระราชบัญญัติอนุญาโตตุลาการ พ.ศ. 2545 ที่เป็นอุปสรรคต่อประสิทธิภาพและความน่าเชื่อถือของกระบวนการอนุญาโตตุลาการในประเทศไทย และ (4) เสนอแนะแนวทางปรับปรุงกฎหมายให้เหมาะสมและทันสมัยยิ่งขึ้น งานวิจัยนี้เป็นการวิจัยเชิงคุณภาพ โดยใช้วิธีการศึกษาค้นคว้าเอกสารจากอนุสัญญาว่าด้วยการยอมรับและการบังคับตามคำชี้ขาดของอนุญาโตตุลาการต่างประเทศ ค.ศ. 1958 กฎหมายแม่แบบว่าด้วยการอนุญาโตตุลาการพาณิชย์ระหว่างประเทศของคณะกรรมาธิการกฎหมายการค้าระหว่างประเทศแห่งสหประชาชาติ กฎหมายว่าด้วยการอนุญาโตตุลาการของสหราชอาณาจักร และกฎหมายว่าด้วยการอนุญาโตตุลาการของสาธารณรัฐสิงคโปร์ ตลอดจนตำรา บทความวิชาการ คำพิพากษา งานวิจัย และวิทยานิพนธ์ทั้งภาษาไทยและต่างประเทศ โดยมุ่งวิเคราะห์เปรียบเทียบประเด็นสำคัญเพื่อเสนอข้อเสนอแนะในการพัฒนากฎหมายไทย ผลการวิจัยพบว่า (1) แนวคิดและทฤษฎีที่เกี่ยวข้องกับกระบวนการอนุญาโตตุลาการ เช่น ทฤษฎีอำนาจรัฐ ทฤษฎีสัญญา และทฤษฎีความเป็นเอกเทศ รวมถึงหลักความเป็นอิสระของคู่กรณีและหลักพันธกรณีตามสัญญา ยังไม่ถูกประยุกต์ใช้อย่างเหมาะสมในประเทศไทย ทำให้กระบวนการอนุญาโตตุลาการขาดความยืดหยุ่น (2) ข้อพิพาทที่ไม่อาจเข้าสู่กระบวนการอนุญาโตตุลาการตามมาตรา 40 วรรคสอง (2) (ก) ยังไม่มีการบัญญัติให้ชัดเจน ส่งผลให้เกิดความไม่แน่นอนในการตีความ (3) หลักเกณฑ์การเพิกถอนคำชี้ขาดที่ขัดต่อความสงบเรียบร้อยหรือศีลธรรมอันดีของประชาชนตามมาตรา 40 วรรคสอง (2) (ข) ยังขาดแนวทางการตีความที่แน่นอน และเปิดช่องให้ใช้ดุลพินิจเกินจำเป็น (4) มาตรการคุ้มครองชั่วคราวตามมาตรา 16 ยังไม่มีประสิทธิภาพเพียงพอ เนื่องจากต้องอาศัยข้อตกลงของคู่กรณีและขาดกลไกรองรับจากศาล และ (5) เมื่อเปรียบเทียบกับกฎหมายของประเทศที่มีกระบวนการอนุญาโตตุลาการที่พัฒนาแล้ว เช่น สหราชอาณาจักร สาธารณรัฐสิงคโปร์ รวมถึงอนุสัญญาว่าด้วยการยอมรับและการบังคับตามคำชี้ขาดของอนุญาโตตุลาการต่างประเทศ ค.ศ. 1958 กฎหมายแม่แบบว่าด้วยการอนุญาโตตุลาการพาณิชย์ระหว่างประเทศของคณะกรรมาธิการกฎหมายการค้าระหว่างประเทศแห่งสหประชาชาติ พบว่า ประเทศเหล่านี้มีแนวทางที่ส่งเสริมกระบวนการอย่างมีประสิทธิภาพ ทั้งในด้านบทบาทของศาล การตีความนโยบายสาธารณะ และการบังคับใช้มาตรการคุ้มครองชั่วคราว ซึ่งประเทศไทยควรนำมาเป็นแนวทาง โดยเฉพาะการกำหนดข้อยกเว้นของข้อพิพาทให้ชัดเจน การจำกัดขอบเขตของความสงบเรียบร้อยตามหลักนิติธรรม และการส่งเสริมบทบาทของศาลในการสนับสนุนมาตรการคุ้มครองชั่วคราว เพื่อยกระดับกระบวนการอนุญาโตตุลาการของไทยให้สอดคล้องกับมาตรฐานสากล

Introduction: Health professional academic programs require interprofessional education (IPE) to meet accreditation standards and better prepare students for collaborative patient care. The Interprofessional Education Collaborative (IPEC) includes the roles and responsibilities of the health professions as a key domain of IPE curricula. A learning module focusing on this domain was developed for an interprofessional introductory course involving 12 health professions. Adaptations to this module over time aimed to enhance content and student knowledge. Methods: Students were assigned to small interprofessional teams throughout the course and completed modules aligned with the IPEC core competencies. This study aims to shed light on the reality of government investment spending in Iraq by analyzing its indicators and estimating the government investment spending index and its impact on economic growth for the period 2004-2024, based on theoretical and applied frameworks. The study concluded that the contribution of investment spending to GDP was determined to be between (5.7%) and (69.6%), with an average rate of (17.75%), indicating government involvement in socio-economic fields. There is no financial approach worldwide that reduces the scope of public spending in favor of investment spending in a way that leads to increased economic growth.

Standalone photovoltaic (PV) systems are essential for off-grid applications but suffer from solar intermittency, resulting in an unreliable power supply. Batteries are commonly integrated into PV systems to provide energy storage; however, they are less effective in handling rapid power fluctuations. To overcome this limitation, hybrid energy storage systems (HESS) combining batteries and supercapacitors are employed to utilise their complementary characteristics. The rapid rise of generative artificial intelligence (AI) tools presents new opportunities for higher education, particularly in designing courses that are rigorous, engaging, and adaptable. This poster demonstrates how generative AI tools can improve teaching and learning through a case study of developing an online course: Fundamentals of Program Evaluation. In this poster, we illustrate how generative AI can be utilized to support brainstorming, content generation, visual design, assessments, and inclusive adaptations. We also discuss risks, ethical considerations, and practical strategies for thoughtful integration. Background: Educating scientists on Dual-Use Research of Concern (DURC) and Responsible Use of Life Science Research (RULSR) requires innovative approaches that overcome geographic and expertise barriers while maintaining engagement and educational rigor. This project utilized a novel IPE approach engaging scientists and researchers across multiple health professions disciplines within a One Health framework. We developed and implemented the world's first national-level DURC capacity-building program using a hybrid educational model. Background: In 2020, Nebraska’s HIV prevalence was 146 per 100,000 individuals, with 107 new diagnoses in 2021. Of the 2,497 people living with HIV (PWH) statewide, 23% resided in rural areas. Rural diagnoses nearly doubled in 2021, accounting for 35% of new cases. At presentation, rural PWH had significantly lower mean CD4 counts compared to their urban counterparts (378 vs. 953 cells/mm³), suggesting delays in diagnosis and care. In response, the University of Nebraska Medical Center (UNMC) Specialty Care Clinic implemented the Extension for Community Healthcare Outcomes (ECHO) model to enhance rural provider support through virtual lectures and case-based learning. …

In 2023, 13.5% of U.S. households and 12.9% of Nebraska households experienced food insecurity. The negative effect of food insecurity on the health of patients is well known and includes decreased intake of nutritious foods, increased intake of carbohydrate‑dense foods, and having to choose between paying for food versus other health needs. Food insecurity has also been associated with multiple chronic conditions (asthma, bronchitis, COPD, chronic pain, diabetes, kidney disease, sleep disorders) and lower overall health status. Asian countries face the dual challenge of fulfilling ambitious climate commitments under the Paris Agreement while simultaneously advancing the United Nations Sustainable Development Goals (SDGs). This study develops an integrated analytical framework that links decarbonization pathways with SDG indicators across energy, air quality, health, and the food-water-land nexus, as well as policy cost-effectiveness, explicitly incorporating national circumstances. Our findings indicate that current climate pledges primarily deliver gains in SDG indicators related to energy and air quality. Achieving broader progress across other SDG dimensions requires combining more ambitious climate targets with diverse, sustainability-oriented mitigation measures tailored to domestic contexts. There is a burgeoning literature arguing that addressing grand challenges, such as de-globalization, requires a set of complementary actors to build innovation ecosystems (IE), which are also strategically integrated into the national innovation system (NIS). We conceptualize this specific systemic phenomenon as a new type of IE—NIS-catalysed IE—whose sustainable growth is said to be constantly hindered by dependent yet opposing tensions. Mathematical Modelling and Numerical Simulation with Applications
The main objective of this work is to obtain exact soliton solutions for a nonlinear time-fractional equation model describing wave profiles arising in various physical systems. To derive different wave structures associated with the considered model, two analytical techniques are employed: the extended G'\G^2-expansion method and the modified auxiliary equation (MAE) approach. A wave transformation is applied to reduce the nonlinear time-fractional equation to a nonlinear ordinary differential equation (NLODE) by means of the M-truncated and Atangana-Baleanu (AB) fractional operators. Mathematical Modelling and Numerical Simulation with Applications
This study develops a mathematical model of Mpox transmission that combines stratified susceptibility (low-risk and high-risk groups) with vaccinated and asymptomatically infected compartments. The analysis of the model begins with examining the well-posedness, boundedness, and nonnegativity conditions for the solutions. The local stabilities of the equilibria are examined through the Jacobian matrix and phase plane analysis, while the global stabilities are provided through Lyapunov functions. The estimated parameters are verified using epidemiological data on Mpox cases in the United States, with an MAPE of 2.20% and R_0 > 1, indicating that Mpox remains endemic.
