Navigating Life With Hiv As An Older Adult On The Kenyan Coast: Perceived Health Challenges Seen Through The Biopsychosocial Model, Patrick Mwangala, Ryan G. Wagner, Charles Newton, Amina Abubakar
Institute for Human Development, East Africa
Objectives: This study explores the perceptions of adults living with HIV aged ≥50 years (recognized as older adults living with HIV—OALWH), primary caregivers and healthcare providers on the health challenges of ageing with HIV at Kilifi, a low literacy setting on the coast of Kenya.
Methods: We utilized the biopsychosocial model to explore views from 34 OALWH and 22 stakeholders on the physical, mental, and psychosocial health challenges of ageing with HIV in Kilifi in 2019. Data were drawn from semi-structured in-depth interviews, which were audio-recorded and transcribed. A framework approach was used to synthesize the data.
Results: Symptoms of …
Storytelling And Racial Identity: How First-Generation Students Of Color Navigate Their Identities At Predominately White Institutions, Kimberly Garcia Cruz
Storytelling And Racial Identity: How First-Generation Students Of Color Navigate Their Identities At Predominately White Institutions, Kimberly Garcia Cruz
Communication Studies
Utilizing the Narrative Paradigm (Fisher, 1984) and thematic analysis (Braun & Clarke, 2006) the present study seeks to explore and further understand the ways in which first-generation students of color navigate, and thus make meaning, of their race and class identities at a Predominantly White Institution (PWI). Through qualitative interviews with 14 first-generation students of color (henceforth, FGSOC), themes that emerged included: (1) being used to “it”, (2) financial differences cause a clash with belonging, and (3) cultural spaces bring welcoming feelings. Findings were consistent with previous research regarding barriers faced by first-generation students of color. The current study adds …

A mathematics teacher educator’s (MTE) use of self-based methodologies goes beyond developing MTE professional knowledge by contributing scholarly inquiry into MTE work. Existing discussions of MTEs’ use of self-based methodologies have provided descriptions of the methodologies and examples of their use by MTEs to unpack their practice. What is less clear is why MTEs elect to use self-based methodologies. Yet central to understanding and validating self-based methodologies as a means of developing knowledge in mathematics teacher education is understanding the aims of MTEs who use such methodologies. On the basis of author interviews, drafts, and final papers for this special …

Partisan Gerrymandering: The Promise And Limits Of State Court Judicial Review, Norman R. Williams
Partisan Gerrymandering: The Promise And Limits Of State Court Judicial Review, Norman R. Williams
Marquette Law Review
In 2021, the Oregon Legislature succeeded in redrawing the state’s legislative and congressional districts, but the new redistricting plans were immediately challenged in state court as partisan gerrymanders. The Oregon Supreme Court rejected the challenge to the state legislative map, but its analysis, which accorded significant deference to the legislature’s choices, raised more questions than answers about the appropriate level of scrutiny for state redistricting plans. A special, five-judge court likewise rejected the gerrymandering challenge to the congressional map, and, while its analysis was less deferential, its decision also left unanswered the fundamental question regarding at what point a redistricting …

Game On—Copyrighted Tattoos In Video Games As Fair Use, Emilie Smith
Marquette Law Review
With its fact-intensive inquiries and limited bright-line rules, copyright law is known for its ambiguity, and courts often differ in their interpretations of various doctrines. The fair use doctrine is no different, and was in fact designed to grant courts discretion in making their determinations, all with the aim of maintaining the true purpose of the copyright law. Recent technologies and popularized forms of art only complicate things, adding rougher terrain to an already confusing landscape.

The main objective of infrastructure design codes is to protect the public’s welfare, health, and safety, none of which appear directly related to the current sustainability movement that has focused on protecting the natural environment, conserving resources, and minimizing the toxicity of construction materials and processes. Some United States jurisdictions have adopted language related to sustainability based on the United States Green Building Council to curtail adverse effects of global climate change, minimize environmental impact of new construction of built assets (i.e., buildings and infrastructure), and in some cases, improve air quality in the community. The focus of this paper …

Expanding State Parent Registry Laws, Jeffrey A. Parness
Expanding State Parent Registry Laws, Jeffrey A. Parness
Nebraska Law Review
As with state recognized voluntary acknowledgements of parentage (VAPs) and state recognized assisted reproduction pacts (SRARPs) on childcare parentage for future or current children, state parent registries (PRs), often labeled putative paternity registries or putative father registries, embody declarations of expecting or current legal parenthood.1 Yet declarations on children in PRs often involve unilateral assertions, unlike dual parenthood declarations in VAPs. Actual parenthood under law for many PR declarants is never recognized because there are no simultaneous assertions by a second expecting or existing legal parent on the declarant’s parenthood, as with an assertion by an expecting or existing birth …

Rethinking The Status And Temporal Occurrence Of The American Woodcock In Nebraska Because Of Its Unusual Life History, Joel G. Jorgensen, Stephen J. Brenner
Nebraska Bird Review
Historical distribution and range expansion -- We reviewed existing information to evaluate conclusions by previous authors (e.g., Sharpe et al. 2001, Silcock and Jorgensen 2023) that woodcock have expanded their range west since settlement of Nebraska by Euro-Americans. We also provide additional context about the species’ distribution over time using regional resources.
Temporal occurrence and abundance -- We used data from woodcock outfitted with satellite transmitters 2021-2022 and compared it with occurrence data from two sources, eBird (eBird.org 2023) from all years through 2022 and the SFRs in the Nebraska Bird Review 1994–2019. We chose not to use SFR data …

First off, I want to reiterate that reports compiled for this Spring Seasonal Report are evaluated against current knowledge as presented in Birds of Nebraska-Online (“BONO”; https://birds.outdoornebraska.gov/). Species whose reports do not add new information on distribution, early or late dates, etc., are listed as having “Routine reports”. Please let me know at [email protected] if you have information that is not in BONO, or if you have additions and/or corrections of information in BONO. Another reminder: if evidence of breeding is observed, please enter the appropriate descriptor in your eBird checklist under “Breeding and Behavior Code”. These descriptors can be …

The Effect Of Firm-Controlled Store Type Touchpoints On Customer’S Discrete Emotions: An Exploratory Study On Physical Store & Online Store, Jyro B. Triviño
Leadership and Strategy Faculty Publications
Customer experience is a broad and multi-dimensional phenomenon, which currently divides academic scholars in terms of constructs and measurement. This study aims to examine some acceptable yet under-measured customer experience constructs already developed. The comparative exploration of the physical store and online store firm-controlled touchpoints seeks to identify differences or similarities in customers’ perceived affective response, which can help firms improve their current touchpoint design. Set in a business-to-customer context in the Philippines during a Covid-19 community quarantine, a total sample of 338 respondents evaluated their recent interaction during the purchase stage. A causal-comparative exploratory research design was utilized using …
The Effects Of Time Pressure On Speech Fluency In Aging Adults: Comparisons With Divided Attention, Caleb Henderson Sanford
The Effects Of Time Pressure On Speech Fluency In Aging Adults: Comparisons With Divided Attention, Caleb Henderson Sanford
Theses and Dissertations
This study investigated the impacts of dual task and time pressure conditions on the speech fluency of 60 neurotypical adults between the ages of 26 and 85. Participants retold short stories in baseline, time pressure, dual task, and combined dual task and time pressure conditions. Dependent variables included five measures of speech fluency: words per minute (WPM), fillers per verbalization, false starts and repetitions per verbalization, extended pauses per utterance, and speech naturalness. Each of these variables was compared between age groups of younger, older, and elderly adults and across conditions. Results reveal that time pressure causes speech rate to …

Marine microbial communities in coastal environments are subject to both seasonal fluctuations and anthropogenic alterations of environmental conditions. The separate influences of temperature and resource-dependency on phytoplankton growth, community, and ecosystem metabolism are relatively well understood. However, winners and losers in the ocean are determined based on the interplay among often rapidly changing biological, chemical and physical drivers. The direct, indirect, and interactive effects of these conditions on planktonic food web structure and function are poorly constrained. Here, we investigated how simultaneous manipulation of temperature and nutrient availability affects trophic transfer from phytoplankton to herbivorous protists, and their resulting implications …

Group Therapeutic Relationships Codevelopment In Short-Term Therapy: A Conceptual Replication And Extension Of Lo Coco Et Al. (2019), Tate M. Paxton
Theses and Dissertations
Objective: The empirical study of member-group mutual influence in group therapy is an emerging area of study. However, few replications have tried to generalize prior findings related to mutual influence. The aim of this study is to conceptually replicate the longitudinal group actor-partner interdependence models (LGAPIM) employed by Lo Coco et al. (2019) measuring how mutual influence and other factors affect the codevelopment of the group therapeutic relationships. Method: 343 clients were included in this archival analysis. Group Questionnaire (GQ) main subscales, positive bond (PB), positive work (PW), and negative relationship (NR), were gathered from early, middle, and late timepoints. …

Romanticism’S Fellow Creatures, Alastair Hunt, Ron Broglio, Katey Castellanos, Mario-Ortiz Robles
English Faculty Publications and Presentations
This panel opens up innovative ways of thinking about Romanticism and “the problem of sharing our earth with other creatures.” Over the last couple of decades, the crisis in human relations with animals has deteriorated to the point that it has become increasingly recognized as a constitutive part of the global environmental crisis. Like the climate crisis, the “animal crisis” originates with the emergence of the industrial form of capitalism in Britain around the turn of the nineteenth century. Appreciation of this historical constellation can and should become the basis of a renewed Romantic animal studies. However, reading Romanticism as …

From Bridge To Destination? Ethical Considerations Related To Withdrawal Of Ecmo Support Over The Objections Of Capacitated Patients, Andrew Childress, Trevor Bibler, Bryanna Moore, Ryan H Nelson, Joelle Robertson-Preidler, Olivia Schuman, Janet Malek
Faculty and Staff Publications
Extracorporeal membrane oxygenation (ECMO) is typically viewed as a time-limited intervention-a bridge to recovery or transplant-not a destination therapy. However, some patients with decision-making capacity request continued ECMO support despite a poor prognosis for recovery and lack of viability as a transplant candidate. In response, critical care teams have asked for guidance regarding the ethical permissibility of unilateral withdrawal over the objections of a capacitated patient. In this article, we evaluate several ethical arguments that have been made in favor of withdrawal, including distributive justice, quality of life, patients' rights, professional integrity, and the Equivalence Thesis. We find that existing …

Tigers Or Strawberries: Seizing The New Mission Opportunities Before Us For Church And Campus, Ronald Pickell
Journal of Adventist Youth and Young Adult Ministries
T he context of my ministry is LIFE Adventist Church in Berkeley, California, a campus church near the University of California, Berkeley. I also provide leadership direction for Adventist Public Campus Ministry across the North American Division. This paper addresses the ministry challenge and opportunity for our mission forward following the COVID-19 Pandemic. For many churches and mission programs, the COVID-19 Pandemic was a huge interruption of their entire operation. In many ways, for us COVID-19 was more of a disruption rather than a complete interruption of ministry. This paper discusses the factors that contributed to the continuation of our …

The "Parental" Push: A "Parenting" Approach To Young Adult Ministry, Andrew Stojanavic
Journal of Adventist Youth and Young Adult Ministries
Discipling young adults to become spiritually mature, capable, and confident leaders in the church requires intentionality. It does not take place naturally, no matter how attractive the setting may be. This is especially important due to the worldwide COVID-19 pandemic and its effect on young people in our church. This intentionality must be exercised by spiritual parents within the church, and only if they have an investment in and personal relationship with the young adults themselves. Giving young adults a “parental” push to get seriously involved in the life of the church asks them do something they might find uncomfortable, …

Covid. Crisis, Conflict, And The Cross: Making Disciples During A Pandemic, Omwocha Nyaribo
Journal of Adventist Youth and Young Adult Ministries
Intimate desires characterize one’s last moments with family, friends, or colleagues, often expressed verbally to the hearers. John 17 is one such moment. Jesus passionately, through prayers, shared the desire that His followers be united, for unity in Christ is the essence of soul-winning— the world believing in Jesus (Jn 17:21,23). The disciples of Jesus also contended among themselves concerning greatness. In the history of the Christian Church, unity among the brethren has been elusive. Within the Seventh-day Adventist church, we have witnessed strife among the brethren because of divergent views throughout our history. Such strife is not an emerging …

Evaluation Of 3d Printing Technologies And 3d Printed Materials In The Use Of Orthotic And Prosthetic Devices, Cory Larson
Master of Science in Kinesiology
Additive Manufacturing (AM) is disrupting fabrication techniques, bringing new design possibilities with associated benefits of less waste, improved design, improved time management, and less cost. The field of Orthotics and Prosthetics (O&P) is investigating how 3D printing, a subset of AM, can be used for fabrication of O&P devices. Before this technology is fully accepted, it needs to go through rigorous testing to ensure the safety of the individuals using the devices and the longevity of the devices themselves to ensure long term-use as a viable option. Research needs to define which type of 3D printing technology and what printed …
