The True Meaning Of "Going Armed" In The Statute Of Northampton: A Response To Patrick J. Charles, Richard E. Gardiner Jun 2023

The True Meaning Of "Going Armed" In The Statute Of Northampton: A Response To Patrick J. Charles, Richard E. Gardiner

Cleveland State Law Review

In the debate over the meaning of the right to keep and bear arms guaranteed by the Second Amendment, some writers have argued that the prohibition in the 1328 English Statute of Northampton on "going armed" referred to carrying weapons, thus purportedly showing that regulation of carrying weapons was well known and established when the Second Amendment was adopted. For the first time, this Article reveals, through a thorough analysis of medieval royal proclamations and acts of parliament, well-regarded legal treatises, literature of the time, and English case law, that "going armed" did not refer to carrying weapons, but rather …

Stories That Kill: Masculinity And Capital Prosecutors' Closing Arguments, Pamela A. Wilkins Jun 2023

Stories That Kill: Masculinity And Capital Prosecutors' Closing Arguments, Pamela A. Wilkins

Cleveland State Law Review

The American death penalty is a punishment by, for, and about men: Both historically and today, most capital prosecutors are men, most capital defendants are men, and killing itself is strongly coded male. Yet despite—or perhaps because of—the overwhelming maleness of the institution of capital punishment, the subject of masculinity is largely absent from legal discourse about the death penalty. This Article addresses that gap in the legal discourse by applying the insights of masculinities theory, an offshoot of feminist theory, to capital prosecutors’ closing arguments. This Article hypothesizes that capital prosecutors’ masculinity is strongly influenced both by white Southern …

Behavioral And Physiologic Relationships Between Sensory Processing, Attention, And Prediction In Autistic Children: An Eye Tracking Study, Courtney Hunter Jun 2023

Behavioral And Physiologic Relationships Between Sensory Processing, Attention, And Prediction In Autistic Children: An Eye Tracking Study, Courtney Hunter

Theses and Dissertations

Autism spectrum disorder (ASD) prevalence has risen to one out of every 36 children born in the United States being diagnosed. Many individuals diagnosed experience sensory processing difficulties that make life challenging for them and their caregivers. However, there is no clear consensus on why sensory processing issues occur. Previous research has linked attention function to atypical sensory processing. Our study aimed to understand potential underlying mechanisms and correlates of this relationship. We theorized that prediction is a key contributing factor to how attention and sensory processing interact. The purpose of this study was to examine the relationship between sensory …

A Structural Analysis Of The Simpson Mountains, Hyrum A. Briscoe Jun 2023

A Structural Analysis Of The Simpson Mountains, Hyrum A. Briscoe

Theses and Dissertations

The Simpson Mountains have long been of economic interest and have renewed interest in their potential value. Field mapping of the project area redefined structural relationships between stratigraphic units. Geometric and kinematic analysis of structures in the Simpson Mountains show the range is deformed by the three most recent tectonic events: the Sevier Orogeny, the Laramide Orogeny, and Basin and Range Extension. Laramide structures define the range with a significant E-W normal fault and an E-W thrust fault, which are both likely related to Eocene-age igneous intrusions. Principal component analysis (PCA) of regional quartzite X-ray Fluorescence (XRF) data resulted in …

The Use Of Point Cloud Data To Support Concrete Bridge Deck Condition Assessment, Issa Nidal Al Shaini Jun 2023

The Use Of Point Cloud Data To Support Concrete Bridge Deck Condition Assessment, Issa Nidal Al Shaini

Theses and Dissertations

Bridge deck condition assessments are typically conducted through visual physical inspections, utilizing traditional contact sensors for Non-Destructive Evaluation techniques such as hammer Sounding and chain dragging which require the expertise of trained inspectors. However, the accuracy of these inspections is limited by the level of deterioration of the bridge deck, as the ability of the inspectors is proportional to the apparent level of damage. This study aims to improve the accuracy of bridge deck inspection processes by utilizing non-destructive evaluation techniques, including the analysis of point cloud data gathered via Light Detection and Ranging (LiDAR) as a geometry-capturing tool. The …

Water Report

This report from the Indiana Climate Change Impacts Assessment (IN CCIA) applies climate change projections for the state to explore how continued changes in Indiana’s climate are going to affect all aspects of water resources, including soil water, evaporation, runoff, snow cover, streamflow, drought, and flooding. As local temperatures continue to rise and rainfall patterns shift, managing the multiple water needs of communities, natural systems, recreation, industry, and agriculture will become increasingly difficult. Ensuring that enough water is available in the right places and at the right times will require awareness of Indiana’s changing water resources and planning at regional …

Seeing Politics Through Popular Culture, Dan Chen

Political Science Faculty Publications

This essay surveys the scholarship on Chinese cultural politics in the reform era and argues that popular culture is a crucial realm where politics is manifested, shaped, and challenged. Based on an overview of this literature, this essay finds that Chinese popular culture remains subversive despite evolving political rule and changing socioeconomic structures. Meanwhile, the state has kept up with popular culture and managed to dominate various cultural spaces ranging from television, film, literature, music, and comedy, to celebrities and public discussions on morality.

The studies reviewed here collectively illustrate a fragmented yet vigorous popular culture that actively responds to …

Problems In The Copyright Industry: Making The Case For A Corrected Case Act, Megan Grantham Jun 2023

Problems In The Copyright Industry: Making The Case For A Corrected Case Act, Megan Grantham

Et Cetera

In 2020, Congress passed the Copyright Alternative in Small-Claims Enforcement Act, which established a small claims court system within the United States Copyright Office, called the Copyright Claims Board. This new board hears cases of copyright violations involving damages of $30,000 or less. President Donald Trump signed the bill into law on December 27, 2020, and the board officially began hearing claims in June 2022. This was meant to benefit smaller creators who do not have the means to pursue their copyright claims in costly federal court. While small or independent creators should indeed have access to a means of …

Globalization And Transnational Organized Crime: Family Disintegration In Africa And The Impact On Women And Girls, Oluremi Alapo

Open Educational Resources

Documented incidents of trafficking in women and children in West Africa date as far back as the 1960s. Significant public recognition and focus only happened around the 1990s. Although no exact figures and data on the number of trafficked victims, there are indicators to show that the incident in the sub-region is reaching alarming proportions. One of such indicators is the growing number of women and children, especially children in cities and big towns of West African states and European countries who are in these places as a result of urban and illegal transborder migration as well as a growing …

In Pursuit Of A Modern Standard: The Constitutional Proportions Of Collateral Harm From Pursuits And Police High-Speed Driving, Julian Gilbert Jun 2023

In Pursuit Of A Modern Standard: The Constitutional Proportions Of Collateral Harm From Pursuits And Police High-Speed Driving, Julian Gilbert

Cleveland State Law Review

Police chases and high-speed driving are common practices that pose a substantial amount of harm and are often unjustified. The benefits of such chases are questionable, and rapid police action at all costs is often unnecessary. When bystanders are injured as a result of police high-speed driving, there are few avenues to have their rights vindicated, and federal court cases require plaintiffs to meet an almost impossible burden. However, under the United States Supreme Court case of County of Sacramento v. Lewis, a plaintiff can put forth evidence that their substantive due process right to life under the Fourteenth …

The New Dread, Part Ii: The Judicial Overthrow Of The Reasonableness Standard In Police Shooting, Kindaka J. Sanders Jun 2023

The New Dread, Part Ii: The Judicial Overthrow Of The Reasonableness Standard In Police Shooting, Kindaka J. Sanders

Cleveland State Law Review

This Article series argues that the Supreme Court’s jurisprudence on excessive force from Graham v. Connor to the present has undermined the objectivity of the reasonableness standard. In its place, the Court has erected a standard that reflects modern conservative political ideology, including race conservatism, law and order, increased police discretion, and the deconstruction of the Warren Court’s expansion of civil rights and civil liberties. Indeed, the Court, dominated by law-and-order conservatives, is one of the greatest triumphs of conservatism. Modern conservatism developed as a backlash against various social movements like the Civil Rights Movement and spontaneous urban rebellions during …

Most firms are finding that knowledge management is a crucial instrument for preserving their reputation and standing in the global marketplace. This paper therefore aims to explore knowledge management among health professionals. Using the PRISMA approach, a systematic search was conducted on PUBMED and Google Scholar databases. The eligibility criteria include both qualitative and quantitative studies …

A Rhetorical Analysis Of Motivational Speeches In Sports Films, Brenna Seeman Jun 2023

A Rhetorical Analysis Of Motivational Speeches In Sports Films, Brenna Seeman

Theses and Dissertations

This paper applies Aristotle's historic modes of persuasion, namely ethos, logos, and pathos, to the motivational speeches found in 20 popular sports films. Through this analysis, major themes concerning how coaches utilized persuasive tactics were found and used to compile a list of important characteristics of motivational speeches. This initial analysis found pathos to be the most effective form of persuasion among motivational speeches in sports films. Because of this finding, a deeper analysis took place with five of the speeches, focusing specifically on how the visual, sound and other thematic elements contributed to the overall pathos of those rhetorical …

The Effects And Reversibility Of Combination Inhaled Corticosteroids On Phonation Threshold Pressure (Ptp) And Phonation Threshold Flow (Ptf) In Ex Vivo Rabbit Larynges, Melanie Elizabeth Blauer Jun 2023

The Effects And Reversibility Of Combination Inhaled Corticosteroids On Phonation Threshold Pressure (Ptp) And Phonation Threshold Flow (Ptf) In Ex Vivo Rabbit Larynges, Melanie Elizabeth Blauer

Theses and Dissertations

Although combination inhaled corticosteroids (ICs) are known to cause voice disorders in otherwise vocally healthy individuals, it is unknown whether those adverse effects can be reversed by the cessation of treatment. Quantitative aerodynamic measures such as phonation threshold pressure (PTP) and phonation threshold flow (PTF) can be used to identify the development of, and recovery from, vocal pathologies. We examined the effects and reversibility of ICs on laryngeal aerodynamics. This study was a mid-project investigation as part of a larger ongoing project. The 18 larynges were from rabbits that received ICs, a control condition, or no treatment. Experimental group rabbits …

Emotion, Sensory Processing, And Prosody In Neurotypical And Autistic Young Adults, Annika Henderson Jun 2023

Emotion, Sensory Processing, And Prosody In Neurotypical And Autistic Young Adults, Annika Henderson

Theses and Dissertations

There is a paucity of research regarding autistic adults, yet as autistic individuals grow to adulthood, they are often met with several barriers because of their differences from the neurotypical (NT) population. Given the demands of adult social interaction, some of the social difficulties experienced by autistic adults are likely related to emotion processing and prosody function. With sensory processing differences added as a diagnostic criterion for autism within the last decade, an investigation into its relationship with emotional processing, another marked difficulty for this population, is warranted. There are logical connections between sensory processing, emotion, and prosody, such that …

Exploring Posttraumatic Growth In Aphasia: A Qualitative Investigation, Camille Williams Jun 2023

Exploring Posttraumatic Growth In Aphasia: A Qualitative Investigation, Camille Williams

Theses and Dissertations

This study explored posttraumatic growth (PTG) in people with aphasia and is the qualitative arm of a larger mixed-methods study. After an initial experimental session, 23 people with aphasia (PWA; 12 females and 11 males) completed a 60-minute semi-structured interview during which participants expanded on previously-given questionnaire responses and then answered five additional open-ended questions about communication in their daily life. Interviews were transcribed orthographically and coded using reflexive codebook analysis. A stakeholder with aphasia was consulted to gain insight from an insider's perspective about whether codes and themes captured the experiences of aphasia. Reflexive codebook analysis revealed two themes. …

The Adoption And Use Of Smart Assistants In Residential Homes: The Matching Hypothesis, Nathanael Johnson, Torsten Reimer Jun 2023

The Adoption And Use Of Smart Assistants In Residential Homes: The Matching Hypothesis, Nathanael Johnson, Torsten Reimer

Purdue University Libraries Open Access Publishing Fund

An increasing number of residential homes are equipped with smart assistants such as Cortana, Alexa, and Siri. Adoption rates and the frequency of the usage of smart assistants vary across users and residential homes. Building on the theory of uses and gratifications (UGT) and the unified theory of acceptance and use of technology 2 (UTAUT2), the objective of this paper was to examine whether the intended use of a digital assistant would moderate the effects of performance expectancy and hedonic motivation on its adoption. Two experiments (N = 345 and N = 351) tested the hypothesis that, for utilitarian purposes, …

A Novel Driver Emotion Recognition System Based On Deep Ensemble Classification, Khalid Zaman, Sun Zhaoyun, Babar Shah, Tariq Hussain, Sayyed Mudassar Shah, Farman Ali, Umer Sadiq Khan

All Works

Driver emotion classification is an important topic that can raise awareness of driving habits because many drivers are overconfident and unaware of their bad driving habits. Drivers will acquire insight into their poor driving behaviors and be better able to avoid future accidents if their behavior is automatically identified. In this paper, we use different models such as convolutional neural networks, recurrent neural networks, and multi-layer perceptron classification models to construct an ensemble convolutional neural network-based enhanced driver facial expression recognition model. First, the faces of the drivers are discovered using the faster region-based convolutional neural network (R-CNN) model, which …
