Antibiotics are among the most important discoveries of the 20th century, having saved millions of lives from infectious diseases. Microbes have developed acquired antimicrobial resistance (AMR) to many drugs due to high selection pressure from increasing use and misuse of antibiotics over the years. The transmission and acquisition of AMR occur primarily via a human-human interface both within and outside of healthcare facilities. A huge number of interdependent factors related to healthcare and agriculture govern the development of AMR through various drug-resistance mechanisms. The emergence and spread of AMR from the unrestricted use of antimicrobials in livestock feed has been …

California’S Failure To Protect Families: Statutory Reform To Better Serve Families Experiencing Domestic Violence, Cecilia Bobbitt
California’S Failure To Protect Families: Statutory Reform To Better Serve Families Experiencing Domestic Violence, Cecilia Bobbitt
Loyola of Los Angeles Law Review
Los Angeles County is home to the largest child dependency system in the world. A significant portion of the families involved in this system have experienced domestic violence. Because the system is ineffective in responding to domestic violence, families experiencing domestic violence are especially vulnerable to the harms of the family regulation system. The harm that results is the separation of families, leading to irreparable harm and trauma which hurts, rather than helps, families.
This Article’s findings are based on qualitative legal and social science research, including deidentified data from a 2021 UCLA Pritzker Center for Strengthening Families study regarding …
Allocating Deference In Shared Administrative Space, Juan Caballero
Allocating Deference In Shared Administrative Space, Juan Caballero
Loyola of Los Angeles Law Review
How do courts allocate deference when multiple agencies propose conflicting interpretations? While the Supreme Court has a clearly established Chevron-Mead paradigm for a single agency engaging in statutory interpretation, it has yet to articulate a method for applying deference in “shared administrative spaces,” legal jurisdictions wherein statutes task multiple agencies with implementing their provisions. The Court’s silence in this arena has allowed lower courts and scholars to develop competing and conflicting approaches to applying deference in shared administrative spaces.
This Article challenges the previously proposed rules for shared administrative spaces and proposes a new one. Courts should reframe Chevron “step …
The (Ir)Relevance Of Positivist Arguments For Originalism, Andrew Jordan
The (Ir)Relevance Of Positivist Arguments For Originalism, Andrew Jordan
Loyola of Los Angeles Law Review
Some constitutional theorists have started looking to jurisprudential accounts of the nature of law for help in resolving disputes in constitutional theory. Most prominent is the “positive turn” defended by William Baude and Stephen Sachs. According to Baude and Sachs, ongoing debates in constitutional theory can be resolved by looking to positive law—that is, to the convergent social practices of legal officials. As a result, they claim that we can avoid the normative debates that have traditionally occupied constitutional theorists. Here, I argue that any attempt to settle substantive debates in constitutional theory via jurisprudential accounts of the nature of …

Too Close To Home?: The Constitutionality Of California’S S.B. 9, Stefan Ecklund
Loyola of Los Angeles Law Review
In 2022, Senate Bill 9 went into effect in California. This law allows owners of single-family-zoned parcels to split their lots in two and build at most two units on each parcel, regardless of local land use ordinances, but subject to detailed conditions. This law is one recent attempt to encourage housing development in a state where local opposition to denser housing has been blamed for the state’s current housing affordability problem. This Note will discuss S.B. 9 and the test courts apply to determine when a state law infringes too much on a charter city’s control over “municipal affairs” …

Stare Decisis And The Status Of California’S Super Pension Contract, T. Leigh Anenson, Jennifer K. Gershberg
Stare Decisis And The Status Of California’S Super Pension Contract, T. Leigh Anenson, Jennifer K. Gershberg
Loyola of Los Angeles Law Review
A fundamental principle of law is that courts stand by their decisions. Under the principle of stare decisis, judicial action strives for stability and coherence by setting precedents for the future in deciding current cases. This Article presents an original inquiry into the overruling expression and criteria for stare decisis in the public pension reform context of California’s constitutional contract law. While there is a lively debate among commentators and judges about the role of stare decisis theory and doctrine in federal law, our study extends that conversation to state law for the first time. We develop a new decision-making …
Beyond The “Model Minority” Mirage: How Does Positive Bias Affect Asian Students And Other Students Of Color?, Ying Shi, Maria Zhu
Beyond The “Model Minority” Mirage: How Does Positive Bias Affect Asian Students And Other Students Of Color?, Ying Shi, Maria Zhu
Center for Policy Research
Asian Americans are often perceived as a “model minority” in classrooms. While this stereotype seems positive, it may raise expectations for Asian students and bolster negative stereotypes for students in other minority groups due to teacher bias. This brief summarizes findings from a study that used data from the North Carolina Education Research Data Center (NCERDC) from 2007 to 2013 to identify the presence of positive bias in teachers’ assessments towards Asian American students in grades 3-8 and its effects on other minority groups. The authors find that teachers rate Asian students’ academic skills more favorably than similar White students …
Why China Cares About Canada’S Indigenous Residential Schools: From Whataboutism To Internal Denial, Xiyuan (Marvin) Xia
Why China Cares About Canada’S Indigenous Residential Schools: From Whataboutism To Internal Denial, Xiyuan (Marvin) Xia
Genocide Studies and Prevention: An International Journal
This article examines how the Chinese government and its propaganda departments use genocide-related discourses to fulfil different political purposes at home and abroad. By criticizing Western colonialist regimes’ assimilation policies, especially Canada’s Indigenous residential schools, the Chinese diplomats apply the rhetoric of whataboutism to dodge the international community’s questions about China’s systematic persecution of Uyghur Muslims. Domestically, China’s state media intensively cover Canada’s residential school system and the colonial genocide against Indigenous people, trying to distract the audience from the state atrocities in Xinjiang and mislead the public to distrust Canada and other countries’ motives for accusing China of committing …
Interpreting “Knowingly” To Establish Criminal Liability In Environmental Law: A Modified Public Welfare Approach, Jesse Harte Edelman
Interpreting “Knowingly” To Establish Criminal Liability In Environmental Law: A Modified Public Welfare Approach, Jesse Harte Edelman
Loyola of Los Angeles Law Review
Now, more than ever, environmental disasters occur on an unprecedented scale. The main objective of environmental law is to protect the environment and human health from harm. In recognition of the role that businesses and corporations play in causing such harm, many environmental laws have been amended to criminalize their harmful conduct.
Focusing on the criminal provisions in the Clean Air Act, Clean Water Act, and Resource Conservation and Recovery Act that target offenders who engage in conduct “knowingly,” this Note addresses the split regarding the intent required for a criminal conviction, and the resultant weight accorded these statutes. Courts …

Early Antiretroviral Therapy Not Associated With Higher Cryptococcal Meningitis Mortality In People With Human Immunodeficiency Virus In High-Income Countries: An International Collaborative Cohort Study, Suzanne M Ingle, Elvin Geng, Et Al.
2020-Current year OA Pubs
BACKGROUND: Randomized controlled trials (RCTs) from low- and middle-income settings suggested that early initiation of antiretroviral therapy (ART) leads to higher mortality rates among people with HIV (PWH) who present with cryptococcal meningitis (CM). There is limited information about the impact of ART timing on mortality rates in similar people in high-income settings.
METHODS: Data on ART-naive PWH with CM diagnosed from 1994 to 2012 from Europe/North America were pooled from the COHERE, NA-ACCORD, and CNICS HIV cohort collaborations. Follow-up was considered to span from the date of CM diagnosis to earliest of the following: death, last follow-up, or 6 …

Context modulates sensory neural activations enhancing perceptual and behavioral performance and reducing prediction errors. However, the mechanism of when and where these high-level expectations act on sensory processing is unclear. Here, we isolate the effect of expectation absent of any auditory evoked activity by assessing the response to omitted expected sounds. Electrocorticographic signals were recorded directly from subdural electrode grids placed over the superior temporal gyrus (STG). Subjects listened to a predictable sequence of syllables, with some infrequently omitted. We found high-frequency band activity (HFA, 70-170 Hz) in response to omissions, which overlapped with a posterior subset of auditory-active electrodes …

Prophylactic vaccines for SARS-CoV-2 have lowered the incidence of severe COVID-19, but emergence of viral variants that are antigenically distinct from the vaccine strains are of concern and additional, broadly acting preventive approaches are desirable. Here, we report on a glycolipid termed 7DW8-5 that exploits the host innate immune system to enable rapid control of viral infections in vivo. This glycolipid binds to CD1d on antigen-presenting cells and thereby stimulates NKT cells to release a cascade of cytokines and chemokines. The intranasal administration of 7DW8-5 prior to virus exposure significantly blocked infection by three different authentic variants of SARS-CoV-2, as …

Yes-associated protein-1 (YAP-1) is a Hippo system transcription factor, which serves as an oncogene in squamous cell carcinoma, and several solid tumors when the Hippo pathway is dysregulated. Yet, the activity of YAP-1 in ocular surface squamous neoplasia (OSSN) has not been determined. Here, we investigate the relationship between YAP-1 overexpression and OSSN. Using a cross-sectional study design, we recruited 227 OSSN patients from the University Teaching Hospitals in Lusaka, Zambia. Immunohistochemistry was used to assess YAP-1 protein overexpression in tumor tissue relative to surrounding benign squamous epithelium. OSSN patient samples (preinvasive, n = 62, 27% and invasive, n = …

The SARS-CoV-19 pandemic overwhelmed multiple healthcare systems across the world. Patients with underlying medical conditions such as obesity or diabetes were particularly vulnerable, had more severe symptoms, and were more frequently hospitalized. To date, there have been many studies on the severity of SARS-CoV-2 in patients with metabolic disorders, but data on the efficiency of vaccines against COVID-19 are still limited. This paper aims to provide a comprehensive overview of the effectiveness of COVID-19 vaccines in individuals with diabetes, insulin resistance, and obesity. A comparison is made between the immune response after vaccination in patients with and without metabolic comorbidities. …
Exploration Of Shared Passenger Urban Air Mobility – Integrated Network Design, Operation Scheduling And System Configuration, Zhiqiang Wu
USF Tampa Graduate Theses and Dissertations
Urban air mobility (UAM) is an emerging concept proposed in recent years that uses electric vertical take-off and landing vehicles (eVTOLs). UAM is expected to offer an alternative way of transporting passengers and goods in urban areas with significantly improved mobility by making use of low-altitude airspace. Considering the high capital investment of eVTOLs and relative high fee of using UAM passenger service, a viable UAM format is shared passenger service. Such a service is usually station-based, i.e., with vertiport located in popular sites where potential passengers can access. To understand the viability of such use cases, the vertiport owners …
Estimation Of The Kelvin–Helmholtz Unstable Boundary, Xuanye Ma
Estimation Of The Kelvin–Helmholtz Unstable Boundary, Xuanye Ma

The Kelvin–Helmholtz (KH) instability is one of the most important mechanisms of the viscous like interaction between the solar wind and the magnetosphere (MSP), which transport the mass, energy, momentum, and magnetic flux. Thus, it is important to examine whether the magnetopause boundary is KH unstable or not. Based on the KH onset conditions, this report proposes to use a matrix to identify the most KH unstable direction based on the in-situ measurements of the density, velocity, and magnetic field in the MSP and magneto sheath. The range of the KH unstable direction can be easily estimated based on the …

Ferrocene is useful in modern organometallic chemistry due to its versatile applications in material sciences, catalysis, medicinal chemistry, and diagnostic applications. The ferrocene moiety can potentially serve many purposes in therapeutics and diagnostics. In the course of this study, (6-bromo-1-oxohexyl)ferrocene was combined with dimercaptomaleonitrile sodium salt to yield a novel maleonitrile derivative. Subsequently, this compound was subjected to an autocyclotetramerization reaction using the Linstead conditions in order to obtain an octaferrocenyl-substituted magnesium(II) sulfanyl porphyrazine. Following that, both compounds—the maleonitrile derivative and the porphyrazine derivative—were subjected to physicochemical characterization using UV-Vis, ES-TOF, MALDI-TOF, and one-dimensional and two-dimensional NMR spectroscopy. Moreover, the …

Fibrosis-The Tale Of H3k27 Histone Methyltransferases And Demethylases, Morgan D. Basta, Svetlana Petruk, Alexander Mazo, Janice L. Walker
Department of Biochemistry and Molecular Biology Faculty Papers
Fibrosis, or excessive scarring, is characterized by the emergence of alpha-smooth muscle actin (αSMA)-expressing myofibroblasts and the excessive accumulation of fibrotic extracellular matrix (ECM). Currently, there is a lack of effective treatment options for fibrosis, highlighting an unmet need to identify new therapeutic targets. The acquisition of a fibrotic phenotype is associated with changes in chromatin structure, a key determinant of gene transcription activation and repression.
