"Background Principles" In The Law Of Takings, David A. Dana

The Supreme Court appears to be on a mission to enhance the scope of liability under the Takings Clause, the result of which could be the chilling of federal, state, and local regulation. However, the Court has acknowledged that there is no takings liability when, under “background principles,” the property owner lacked the very right she is claiming the government has taken via regulation. The rationale for, and hence proper scope of, the background principles exception to takings liability is opaque in the case law. Introduction

The World Health Organization (WHO) called for the expansion of all nursing roles, including advanced practice nurses (APNs), nurse practitioners (NPs) and clinical nurse specialists (CNSs). A clearer understanding of the impact of these roles will inform global priorities for advanced practice nursing education, research, and policy.

Objective

To identify gaps in advanced practice nursing research globally.

Materials and methods

A review of systematic reviews was conducted. We searched CINAHL, Embase, Global Health, Healthstar, PubMed, Medline, Cochrane Library, DARE, Joanna Briggs Institute EBP, and Web of Science from January 2011 onwards, with no restrictions on jurisdiction or language. Grey …

This study evaluates the perceived effectiveness of an alternative education program, specifically the structure and mission. The program focused on three groups for the evaluation: staff, students, and stakeholders. The conformity of each of the three groups thoughts and beliefs outlined the perception of the program’s effectiveness. The evaluation sought to determine the positive or negative impact of the program’s mission and core values of academics, counseling, employment, and transition services. The present study examines the impact of the national culture on the country-level governance effi ciency index. The dimensions of culture as an independent variable is measured using three different cultural frameworks: Hofstede, Globe and Trompenaar. Based on a secondary data collection, the governance efficien cy is the dependent variable adopted in the analysis. As the current study is examining whether the national culture has an impact on the governance efficiency index, it is an attempt to understand the determinants of governance. This paper proposes a systematic multi-step design procedure for highly efficient printed circuit board (PCB) stator coreless axial flux permanent magnet (AFPM) machines with minimal eddy and circulating current losses. The process begins with initial sizing, providing specific coefficients based on experience with multiple design projects. It continues with the optimization of the machine envelope design using an evolutionary algorithm and computationally efficient 3D finite element analysis (FEA) models. Bird’S Nest Drawing: Exploring The Attachment Of Left-Behind Children In China, Ziyi Su

Expressive Therapies Dissertations

To explore the attachment of left-behind children (LBC), this mixed-methods study analyzed the Bird’s Nest Drawings (BND) and narratives from 117 fourth graders from Shaanxi and Gansu, China. Overall, the BND of LBC showed less secure-attachment features. These distinctions can be seen in several pictorial elements, and manifest differently across gender groups and rural versus urban groups. Drawings and narratives revealed eight underlying themes of absence, longing, and support from parent and peer attachment. Children creatively communicated complex emotions and attachment experiences through the metaphor of the bird’s nest, ranging from abandonment, loneliness, and vulnerability, to coping, hope, and resilience. …

This capstone thesis looks into the concept of attunement within the context of Contact Improvisation (CI), a movement form distinguished by spontaneous, in-the-moment interaction and interpersonal connection. Through a synthesis of theoretical frameworks and personal narrative, this literature review explores how CI cultivates attunement—a resonant interpersonal process, fostering shared understanding and synchronicity. The thesis reveals that attunement within CI involves self-attunement and contact attunement along with refining awareness and attention to kinesthetic and proprioceptive sensations. The therapeutic implications of attunement within CI extends to aspects such as body-mind alignment, emotional growth, enhanced mobility, and interpersonal skills. Aligned with principles of …

Shelby County, Tennessee, has the highest number of HIV cases in the state. Despite the initial approval of Pre-Exposure Prophylaxis (PrEP) for HIV prevention by the FDA in 2012, the adoption of PrEP has been low due to various barriers. Delirium is one of the most common adverse outcomes of hospitalization in adults of age 65. It has been linked with extended length of stay, higher death rates, increased morbidity, and chronic cognitive impairment. In the United States, human papillomavirus is the most persistently occurring sexually acquired infection. Nearly all human papillomavirus-associated cancers are the result of human papillomavirus infection. The human papillomavirus vaccine is a safe and effective public health intervention to prevent human papillomavirus-associated cancers and reduce morbidities and deaths. Human papillomavirus vaccine uptake falls below the benchmark, which is to attain 80% vaccination in adolescents. Diabetes is a chronic health problem. When adequately controlled, the patient can live an active and high-quality life. Poorly controlled diabetes increases the risk of the development of diabetes-related complications. Despite evidence of the success of diabetes education programs in improving diabetes self-care skills and outcomes, many barriers limit patients’ access to these services. This quality improvement project implemented diabetes self-management education for adult patients aged 18 and older with poorly controlled diabetes. Persuasive attempts often fail. One theory that attempts to explain when and why people resist persuasion is psychological reactance theory (PRT; J. W. Brehm, 1966; S. S. Brehm & J. W. Brehm, 1981). According to the theory, people have an inherent desire to maintain their autonomy, or freedom. When they perceive that a persuasive message threatens their freedom, they experience psychological reactance, an aversive motivational state, which motivates them to restore their freedom by resisting the persuasive message. When the Supreme Court’s decision in Dobbs v. Jackson Women’s Health Organization referred future decisions about abortion policies to “elected representatives and the people,” there is no doubt that local governments were included in the designation. In fact, since the 1970s, local governments have been active in pursuing a range of abortion policies in their jurisdictions—both for and against abortion access—that may be in tension with their state governments.
