Democratizing New York’S Eminent Domain Regime, Gregory Wagner Jan 2024

Democratizing New York’S Eminent Domain Regime, Gregory Wagner

Brooklyn Law Review

Since the Supreme Court’s landmark eminent domain decision in Kelo v. City of New London, forty-three states have amended their eminent domain laws to constrain their own eminent domain powers. New York, however, was not one of them. In Goldstein v. N.Y. State Urban Development Corp., New York’s highest court decided firmly in favor of the state’s broad eminent domain powers, yet counseled New York lawmakers to act to legislatively limit the state’s unbridled eminent domain authority. Again, New York did not do so—allowing an eminent domain regime that leads to systemic deprivation of public participation to remain fully in …

Preambles Before The Preamble: Rediscovering The Preamble’S Role In Constitutional Interpretation, Stuart Ford Jan 2024

Preambles Before The Preamble: Rediscovering The Preamble’S Role In Constitutional Interpretation, Stuart Ford

Brooklyn Law Review

This article explores how the Preamble to the Constitution (Preamble) would have been viewed when it was drafted by looking at how preambles were used in America in the seventeenth and eighteenth centuries. It offers the first comprehensive look at how preambles were viewed by lawyers, judges, politicians, and the public in the years before the Constitution was ratified. It demonstrates that courts’ modern treatment of the Preamble is at odds with its original meaning. Eighteenth-century Americans viewed the Preamble as an important tool for understanding and interpreting the Constitution. They would have expected courts to interpret the Constitution’s terms …

Balancing Preservation With Growth: How Less Judicial Deference To Decisions Made By The Landmarks Preservation Commission Can Save New York City, Amy Cushman Jan 2024

Balancing Preservation With Growth: How Less Judicial Deference To Decisions Made By The Landmarks Preservation Commission Can Save New York City, Amy Cushman

Brooklyn Law Review

The New York City Landmarks Law of 1965, envisioning the preservation of historical treasures, empowered the New York City Landmarks Preservation Commission (LPC) with the authority to designate and regulate landmarks and historic districts. Originally established in response to public outcry over the loss of iconic architectural structures, the LPC aimed to safeguard the city's cultural, social, and architectural legacy. However, this note contends that recent LPC decisions, particularly the issuance of Certificates of Appropriateness for luxury residential construction involving partial demolition of landmarks, betray the original preservation goals. Delving into the legal recourse available under the New York Civil …

Critical Thinking Skills In Pre-Service Teachers And Their Coursework: Investigating The Preparation Of Teachers In The Rural Midwest With Humans, Ai, And Cyborg Researchers, Tiffany Shonerd Jan 2024

Critical Thinking Skills In Pre-Service Teachers And Their Coursework: Investigating The Preparation Of Teachers In The Rural Midwest With Humans, Ai, And Cyborg Researchers, Tiffany Shonerd

Dissertations and Theses

Despite the plethora of research and literature regarding the relationship of critical thinking and its key role in promoting learning, little research investigated the teaching of critical thinking to pre-service teachers in their coursework along with how they facilitate it in their students. As future teachers worked towards completing their teaching degrees, student teaching permitted them to work in live classroom settings with veteran teachers as mentors. Markedly, scholars argued that future teacher programs needed to understand the importance of critical thinking and utilize facilitation strategies in classroom settings. In this way, the live classroom setting could then create students …

Differences In Personality Pathology Among Non-Suicidal Self- Injury And Suicidal Behavior Patterns: A Latent Class Analysis, Rachel Chavin Jan 2024

Differences In Personality Pathology Among Non-Suicidal Self- Injury And Suicidal Behavior Patterns: A Latent Class Analysis, Rachel Chavin

Dissertations and Theses

Nonsuicidal self-injury (NSSI) is present among a range of personality disorders (PDs) and, though distinct from suicide (Whitlock et al., 2015). Individuals who engage in NSSI and/or suicidal behavior, tend to have similar symptomology consistent with PDs, like rumination (Bowen et al., 2019), impulsivity (Hamza et al., 2015), and greater sensitivity and emotional reactivity within social situations (Selby et al., 2012). Similarly, maladaptive personality traits have shown to positively relate to NSSI and suicide (Jimenez-Treviño et al., 2011; Turner et al., 2018). Yet, research also indicates that NSSI is a heterogenous behavior that varies in severity related to frequency, age …

Characterizing Sex Differences In Hpv Negative Head And Neck Squamous Cell Carcinoma, Sarah Barclay Jan 2024

Characterizing Sex Differences In Hpv Negative Head And Neck Squamous Cell Carcinoma, Sarah Barclay

Dissertations and Theses

It is now widely accepted that peripheral solid tumors are infiltrated by nerves. This infiltration of malignancies by nerves is referred to as tumor innervation. The Vermeer laboratory studies tumor innervation primarily in head and neck squamous cell carcinoma using a syngeneic cell line representing a mutationally-induced form of the disease; these cells are called MOC2-7 cells. In addition to defining the molecular consequences of tumor-infiltrating nerves on disease, the lab also focuses on their influence on behavior. This is important as cancer patients have a significantly higher incidence of depression and anxiety as compared to the population at large. …

Adapting Community-Based Psychological First Aid To A Palliative/Hospice Care Team: A Community-Based Participatory Research Approach, Kathryn Olivia Moore

Dissertations and Theses

Palliative and hospice care patients face serious or life-limiting illnesses; as a result, patients and their caregivers often have to overcome challenges related to psychological distress. Furthermore, stress related to individuals’ medical and psychosocial concerns can lead to crises. While current literature acknowledges patients’ and caregivers’ experience of depression, anxiety, adjustment disorders, traumatic stress, and other disorders, there remains a gap in addressing these challenges through interventions that are tailored to the unique needs of this complex population. Additionally, professionals that comprise palliative and hospice care teams are often not trained to implement interventions to help prevent and intervene in …

Advancing Anti-Counterfeiting Approach Via The Development Of Functional Optical Materials, Zishen Yang Jan 2024

Advancing Anti-Counterfeiting Approach Via The Development Of Functional Optical Materials, Zishen Yang

Dissertations and Theses

Counterfeiting poses a significant threat to public health and safety, necessitating robust measures to combat it. Addressing this challenge requires the development of advanced materials and techniques, coupled with a comprehensive understanding of the obstacles inherent in anti-counterfeiting endeavors. Our study delved into two approaches for crafting anti-counterfeiting technologies: plasmonic and luminescence materials. We thoroughly examined the challenges associated with each method and proposed viable solutions. Notably, we devised a streamlined process for producing inkjet printable Surface-enhanced Raman Scattering (SERS) ink, enabling the creation of low-cost covert quick response (QR) codes with a high storage capacity. Access to the encoded …

American Eyes, Heather Phillips Jan 2024

American Eyes, Heather Phillips

Dissertations and Theses

American Eyes, a memoir in essays in the vein of Elisabeth Eave’s Wanderlust: A Love Affair with Five Continents and Rebecca Solnit’s A Field Guide to Getting lost, examines how the desire to travel, quest, and be transformed is complicated by conventional notions of home, gender, success, and culture. In a collection that spans twenty-five years in Thailand, Indonesia, the United Arab Emirates, and the U.S., the author ponders the ramifications for women who eschew traditional notions of home and family to instead live life “on the road.” Exploring themes of travel, transformation, culture, identity, and (dis)embodiment as an American …

Exploring The Experience And Identity Of Associated Faculty Teaching In A Doctor Of Physical Therapy Program, Catherine A Bilyeu Jan 2024

Exploring The Experience And Identity Of Associated Faculty Teaching In A Doctor Of Physical Therapy Program, Catherine A Bilyeu

Dissertations and Theses

Doctor of Physical Therapy (DPT) program faculty often enter academia as expert clinicians or researchers, but rarely as expert educators. Recommendations for faculty development exist, yet many physical therapy faculty still enter academia with little or no formal preparation for teaching and limited understanding of academe. This lack of preparation can impact faculty performance and identity, which ultimately can influence student outcomes. This is particularly true for associated faculty, who have very limited access to development opportunities due to the nature of their academic positions. Framed in social constructivism and transition theory, this study explored the experience and identity of …

Shame And Social Interaction Quantity And Quality In Daily Life: The Moderating Effect Of Social Anxiety, Rachel C Bock Jan 2024

Shame And Social Interaction Quantity And Quality In Daily Life: The Moderating Effect Of Social Anxiety, Rachel C Bock

Dissertations and Theses

Frequent and fulfilling engagement in social interaction is paramount to human success and wellbeing. Yet, many individuals do not engage in social interactions of sufficient quantity and/or quality. Though some research indicates shame influences social behavior, the nature of this effect is unclear. Some research suggests shame is associated with effective engagement in social interaction, whereas other work indicates shame is associated with maladaptive avoidance of social interaction. One potential explanation for equivocal results may be a lack of accounting for mental health concerns, such as social anxiety. Social anxiety is positively associated with social impairments and shame, yet research …

Exploring Online Feminist Communities And The Male Allyship Experience, Josephine Saighoe Jan 2024

Exploring Online Feminist Communities And The Male Allyship Experience, Josephine Saighoe

Dissertations and Theses

There has been a growing involvement of men in the feminist cause. Nonetheless, their own experiences as self-identified feminist allies have received inadequate attention within the academic research. Just like female activists, men who identify as feminist activists also make use of such digital platforms to support the activism and make significant contributions to the feminist discourse. In view of this, this study explores the experiences of Ghanaian male feminist allies in addition to delving into their experiences as feminist activists in the digital world and how they navigate the challenges that come with aligning themselves with this cause. Through …

Implementing The Science Of Reading Concepts: A Case Study On Perceptions Of Pre-Service Preparations And Readiness Levels At Midwest Universities, Jerri L. Birger

Dissertations and Theses

In 2000, the National Reading Panel published a report stating that reading instruction should include phonemic awareness, phonics, fluency, vocabulary, and comprehension instruction that is explicit and systematic. Despite this recommendation, more than half of fourth graders in the US continue to lack proficiency in reading each year. Further, studies showed that pre-service teachers lacked the training and preparation to demonstrate mastery of the concepts and provide effective literacy instruction. This study employed a case study design to explore the programming surrounding pre-service teacher preparation over the last ten years, their relationships with cooperating teachers, and how that affects perceived …

A Method Of Measuring Hot Charge Carrier Drift Mobility In Germanium Detectors, Kyler Kooi Jan 2024

A Method Of Measuring Hot Charge Carrier Drift Mobility In Germanium Detectors, Kyler Kooi

Dissertations and Theses

High purity germanium is a popular radiation detecting medium due to the excellent energy resolution that is achieved. The unique semiconducting properties of germanium allow a small amount of energy to create free charges in the germanium, which are then collected as a signal. Germanium detectors also have good spatial resolution. The shape of the signal can be used to identify the location of energy deposition in the crystal. Both of these properties make germanium detectors a popular choice in many felds, including security, medical, astrophysics, and particle physics. The properties of a germanium crystal should be well understood and …

The Evolution Of The Iowa Living History Farms (Lhf) From The 1960s Through The 1980s, Ryan Moore Jan 2024

The Evolution Of The Iowa Living History Farms (Lhf) From The 1960s Through The 1980s, Ryan Moore

Dissertations and Theses

This master’s thesis examines the emergence and evolution of the Living History Farms (LHF) and the living history farm museum movement in the Midwest region during the decades of the 1960s, 1970s, and 1980s. Originally envisioned as institutions that preserved the knowledge of a form of farming that had largely disappeared due to the rise of post-WWII mechanized commercial agriculture, most Midwestern living history farm museum organizations in the 1970s and 1980s reacted to both societal and museum industry developments and made their exhibit site programming more inclusive of various demographic groups. The LHF responded to this trend by including …

Goodwill Elasticity And The Opportunity For Favorable Financial Reporting, Drew Stevenson Jan 2024

Goodwill Elasticity And The Opportunity For Favorable Financial Reporting, Drew Stevenson

Dissertations and Theses

ASC 350-20 grants public business entities (PBEs) the discretion to determine timely recognition of goodwill impairment charges, which likely introduces managerial ambiguity in the goodwill impairment process. Consequently, this paper explores whether the ambiguity in goodwill accounting standards allows managers to engage in favorable financial reporting during economic disruption, such as the global financial crisis of 2008 and 2009 or the COVID-19 pandemic beginning in 2020. The study introduces an indicator variable to identify PBEs with highly elastic goodwill changes, providing insight into a PBE's internal processes and how its management practices for goodwill impairment differ from standard industry practices. …

A Catholic Defense Of Corporate Law And Practice, Julian Velasco Jan 2024

A Catholic Defense Of Corporate Law And Practice, Julian Velasco

Journal Articles

In this essay, I provide a defense of corporate law and of pursuing a career therein from the perspective of Catholic teaching. I argue that Catholicism is not incompatible with the pursuit of wealth as such, but rather insists upon the appropriate use of wealth. I also argue that it is appropriate for corporate actors to pursue the interests of shareholders, provided that they do not break the law or otherwise sin in doing so. I also explain why I found transaction practice personally fulfilling.

Irish Journal of Applied Social Studies

The relationship between familiarity with mental health conditions and mental health stigma is complex, with mixed findings reported in the literature and little research conducted in Ireland to date. This pilot study examined knowledge, attitudes, and behaviours towards schizophrenia, bipolar disorder, and autism in Ireland, between individuals personally familiar with these conditions (by having a diagnosis themselves, or a loved one having a diagnosis) and individuals unfamiliar with these conditions. The study used a correlational, cross-sectional design, recruiting 307 adults in Ireland to complete a survey examining knowledge, attitudes, and behaviours towards schizophrenia, bipolar disorder, and autism. To examine the …

Assessing The Utility Of Breast Cancer Polygenic Risk Scores And Association With Clinical Factors In A Population Of Breast Cancer Patients, John L. Slunecka

Dissertations and Theses

INTRODUCTION: Breast cancer (BC) is the most common cancer among women and is classified as a complex disease. Advances in population genomics have led to the development of polygenic risk scores (PRSs) with the potential to enhance current risk models, but replication is often limited. OBJECTIVE: We sought to assess the predictive capabilities of two high-powered BC PRSs in a sample population selected for breast cancer. In addition, the capacity of the PRSs to predict clinical variables that could improve BC screening and treatments was explored. METHODS: Two published PRS algorithms (313 vs 3820) were used to score female subjects …

Political Ideology As Determinative Of Higher Education Funding: Exploring The Distinctions Between Community College And University Funding Under Differing Political Regimes, Paul Brown

Dissertations and Theses

Adequacy of funding for public institutions of higher education in the United States is significantly important to an array of stakeholders, including, state legislative bodies, decision-makers in the arena of higher education, and notably, consumers of higher education. State allocation of resources for higher education demonstrates variability, complicating accurate programmatic planning and budgeting. To assist higher education officials in the task of budget forecasting and resource adequacy, this study will help fill the void in understanding the connections between the political composition of the states’ legislative bodies and funding levels for differing types of higher education institutions. While significant prior …

Traumatic Stress, Sexual Abuse-Related Shame Severity, And Participation In Commercialized Sex Based On Childhood Sexual Abuse, Barbara Ann Bailey Jan 2024

Traumatic Stress, Sexual Abuse-Related Shame Severity, And Participation In Commercialized Sex Based On Childhood Sexual Abuse, Barbara Ann Bailey

Dissertations and Theses

Any sexual act performed under the condition that one person will receive or provide something of value to another in exchange for the sexual act is referred to as commercial sex. Some research suggests that those who engage in commercial sex are more likely to be victimized or physically assaulted. Moreover, a frequently cited risk associated with engaging in commercial sex is a history of childhood sexual abuse (CSA). Because commercial sex and CSA are often unreported, there is limited understanding regarding symptom severity experienced by survivors of both. It was hypothesized that individuals who had experiences of both CSA …
