Gender Identity And Birth Certificates: The Surrogacy Nexus, Richard F. Storrow Jan 2024

Gender Identity And Birth Certificates: The Surrogacy Nexus, Richard F. Storrow

Michigan Journal of Gender & Law

This Article confronts and responds to the weaponization of birth certificates in recent controversies around gender identity by drawing parallels between gender identity and intentional parentage. A juxtaposition of gender identity with parentage identity reveals that they share the common underpinning of self-identification, raising the question why birth certificates are permitted to reflect one’s parentage identity but, as has been suggested in numerous controversies involving transgender litigants, not one’s gender identity. This Article argues that, for the same reasons that a surrogacy arrangement permits the parties to it to define for themselves who are the legal parents of the child …

Placing Legal Context In Context, Chad Squitieri Jan 2024

Placing Legal Context In Context, Chad Squitieri

Scholarly Articles

In Biden v. Nebraska, Justice Barrett authored a concurrence in which she characterized the major questions doctrine as a linguistic canon that accounts for the “legal context” surrounding delegations of power. Some scholars have critiqued Justice Barrett's concurrence on the grounds that empirical research suggests that ordinary readers do not account for “majorness” in the way that the major questions doctrine requires. This Essay argues that those critiques miss the mark because they conflate factual context with legal context. Justice Barrett's concurrence should be considered within the broader textualist tradition of understanding “ordinary meaning” as a legal concept, and not …

Critical Theories, Justice, And The Rule Of Law, Adam J. Macleod Jan 2024

Critical Theories, Justice, And The Rule Of Law, Adam J. Macleod

Scholarly Articles

An increasing number of legal scholars and activists now identify law as an impediment to justice that must be deconstructed. The deconstructionists tear down the resources we need to sustain the rule of law. And as they deconstruct law, they also deconstruct justice itself. Against deconstructionism, the classical tradition of jurisprudence that gave us our fundamental law affirms that we can know justice and that we can achieve justice through the establishment of law.

That classical tradition made possible the conviction that law is not a mere product of power, as the deconstructionists assert. And that conviction made the rule …

The primary outcomes were patient-reported time in severe pain measured on a numerical analogue scale from 0 to 100% and patient-reported satisfaction with pain relief during the first week following discharge. Data were collected by in-hospital chart review and patient telephone interview …

The First Amendment, Discrimination, And Public Accommodations At Common Law, Adam J. Macleod Jan 2024

The First Amendment, Discrimination, And Public Accommodations At Common Law, Adam J. Macleod

Scholarly Articles

Many recent cases of constitutional conflict have pitted First Amendment liberties of speech, religious exercise, and association against nondiscrimination rules and policies, especially laws governing public accommodations and public forums. To resolve these cases and to understand how civil rights fit together, courts and scholars need a logical and satisfying account of the foundations of public accommodations law. But the law seems to be confused and legal scholars are of different minds. Some assert that proprietors who open their premises and services to the public have no right at common law to exclude or refuse service to anyone. Others find …

Group Ownership And The Ends Of Legal Fictions, Adam J. Macleod Jan 2024

Group Ownership And The Ends Of Legal Fictions, Adam J. Macleod

Scholarly Articles

The march of the progressive societies was, as we all know, from status to contract. And now? And now that forlorn old title is wont to introduce us to ever new species and new genera of persons, to vivacious controversy, to teeming life; and there are many to tell us that the line of advance is no longer from status to contract, but through contract to something that contract cannot explain, and for which our best, if an inadequate, name is the personality of the organized group.

What Matters Most: A Phenomenological Study On The Experiences Of Engagement And Inclusion Of Online Part-Time Faculty In Christian Higher Education, Eleisha Garland

Dissertations

Higher education institutions significantly rely on part-time faculty members to meet course demands. The growth of part-time faculty has grown over 250% since the 1970s. Part-time faculty are now seen as the majority over tenured and tenure-track faculty. Due to the changes in higher education and the crucial role online part-time faculty play in higher education institutions, online bachelor-level program deans must learn to support and engage these faculty members more effectively. The leadership problem identified for this study is that online bachelor-level program deans are being challenged to deliver the support needed to online part-time faculty members to ensure …

Chaney Step Zero: Judicial Review Of Fec Deadlock Dismissals, Natalie R. Schmidt Jan 2024

Chaney Step Zero: Judicial Review Of Fec Deadlock Dismissals, Natalie R. Schmidt

Scholarly Articles

Partisan polarization has infected our politics at levels not seen in decades. But what happens when the contamination spreads to the institutions responsible for regulating the political process itself? At the Federal Election Commission, nothing. Under the FEC’s governing statute, the Federal Election Campaign Act, any serious action the agency undertakes must be supported by a bipartisan supermajority of commissioners. When the six commissioners fail to reach such consensus—or “deadlock”—due to partisanship or otherwise, nothing happens at all: no investigations, no regulations, no enforcement of federal campaign finance laws. For the first few decades of the FEC’s existence, these deadlocks …
