The Climate Whisperers, Cale Jaffe Apr 2025

The Climate Whisperers, Cale Jaffe

Michigan Journal of Environmental & Administrative Law

Environmental groups and their allies have seen two of the bedrock statutes of modern environmental law (the Clean Air Act, Clean Water Act) eroded through recent decisions from the Supreme Court. At the same time, political polarization around climate policy- the gap between Republicans and Democrats on whether worsening global warming merits a response- is wider than it has ever been.

Despite these dispiriting headwinds, there are some encouraging counterpoints of recent climate progress in politically conservative communities. The heart of this essay is simply sharing these stories so we can learn from them. I label the advocates who succeeded …

Drawing Lines In The Sand: Armed Conflict, Climate Damage And Setbacks To Climate Action, Beatrice L. Hamilton Apr 2025

Drawing Lines In The Sand: Armed Conflict, Climate Damage And Setbacks To Climate Action, Beatrice L. Hamilton

Michigan Journal of Environmental & Administrative Law

Armed conflicts have a significant and detrimental effect on the climate system, with considerable implications for efforts to mitigate and adapt to climate change and the civilian population. Yet the environmental provisions under the law of armed conflict (LOAC), drafted some half a century ago, struggle to adequately address these concerns. This article assesses the capacity of LOAC to address conflict-driven climate damage and its cascading impacts by characterizing these harms as environmental damage and as injury to civilians. The analysis highlights opportunities for broadening LOA C's scope and offers recommendations to enhance its capacity to address climate damage and …

The Modern-Day Discovery Doctrine: Reforming Property Law's "Productive Use" Doctrine For The Age Of Climate Change, Shanthi M. Chackalackal Apr 2025

The Modern-Day Discovery Doctrine: Reforming Property Law's "Productive Use" Doctrine For The Age Of Climate Change, Shanthi M. Chackalackal

Michigan Journal of Environmental & Administrative Law

When European settlers first colonized the Americas, claiming Native land as their own, they largely believed their actions to be justified. To Europeans, property rights over land emanated from putting one's labor into that land, "improving" it by removing it from a state of nature. Absent such ''productive use," land had not been claimed and was therefore ripe for the taking. Yet while Native Americans had labored significantly and fundamentally shaped the land around them, European settlers deemed the Americas to be in a state of nature. Such attitudes towards Native American labor and property rights reveal a strikingly limited …

Making Super Soldiers: Command Authority And The Implications Of “Getting To Yes”, Christopher J. Lin Apr 2025

Making Super Soldiers: Command Authority And The Implications Of “Getting To Yes”, Christopher J. Lin

Health Matrix: The Journal of Law-Medicine

The capability and will to enhance soldiers’ minds and bodies for warfare have existed throughout the centuries and across nations, from Ancient Greek hoplites partaking in wine before battle to calm nerves, to American servicemembers consuming amphetamines to remain awake during long-range reconnaissance missions in the Vietnam War. With advancements in biomedical technology, certain types of enhancements entail modifications with varying degrees of permanence to enhance battlefield performance. This Article explores the historical context and contemporary developments of biomedical enhancements, with a focus on the longstanding deference to military command authority regarding issues of individual autonomy. By examining the impacts …

At What Cost: Medicare’S Cost- Saving Measures In Skilled Nursing Facilities And Their Impact On Vulnerable Populations, Julia Mcdermott

Health Matrix: The Journal of Law-Medicine

As the highest spender of health care in the world, the United States continues to look for ways to reduce its spending. As the main health insurance provider for the elderly and disabled, Medicare shares this mission. Unfortunately, some of Medicare’s cost-saving initiatives in one of its most critical care settings, Skilled Nursing Facilities, cause disproportionately negative impacts on vulnerable populations. This Note analyzes three of Medicare’s cost-saving measures in Skilled Nursing Facilities, namely value-based purchasing programs, the twenty-day limit on full coverage, and the practical matter provision. This Note highlights how these measures have a disparate negative effect on …

Sacrificing Financial Health For Physical Health: The Implications Of Medical Credit Cards, Emma Kerro Apr 2025

Sacrificing Financial Health For Physical Health: The Implications Of Medical Credit Cards, Emma Kerro

Health Matrix: The Journal of Law-Medicine

Rising healthcare costs have contributed to significant medical debt increases for Americans in recent years. One way patients are paying these charges is with a medical credit card. The increase in popularity of medical credit cards can, in part, be attributed to non-profit hospitals’ insufficient charity care offerings. Some hospitals are— themselves—offering healthcare financing products to patients rather than offering charity care. As a result, low income patients often become trapped in a cycle of medical debt. While patients may need help paying for their care, a predatory lending option should not be their first or only choice. Non-profit hospitals …

Preface: The Field Of International Economic Law, Gregory Shaffer, Michael Waibel Apr 2025

Preface: The Field Of International Economic Law, Gregory Shaffer, Michael Waibel

Georgetown Law Faculty Publications and Other Works

This is the preface to our forthcoming book Advanced Introduction to International Economic Law for Edward Elgar Publishing. The book is unique in multiple ways. It is the first book that addresses the breadth of international economic law thematically, instead of serially by sub-field of law. We examine the history of key sub-fields, their contested functions, and the ways that they disparately address issues of liberalization and market access, discrimination, state regulatory policy space, fairness, governance and dispute resolution. Unlike law and economic accounts, we do not naturalize the “functions” of international economic law. Rather, we note how different actors …

Expanding The Framework Of Childhood Adversity: Structural Violence And Aggression In Childhood, L. Petrovic, C.N. Baker, Samantha Francois, M. Wallace, S. Overstreet Apr 2025

Expanding The Framework Of Childhood Adversity: Structural Violence And Aggression In Childhood, L. Petrovic, C.N. Baker, Samantha Francois, M. Wallace, S. Overstreet

Psychology

Background: Structural violence harms youth by preventing them from meeting basic needs for safety, belonging, dignity, and agency, leading to negative outcomes like increased aggression. Such behaviors harm children's social and emotional well-being and academic success, particularly affecting Black youth who disproportionately experience structural violence. Although predictors of student aggression have been explored, the specific influence of structural violence—as measured through socioeconomic and racial disparities—remains under examined in the literature. This gap highlights the need for further investigation into how these external factors contribute to aggressive behaviors in school settings, Objective: This study sought to examine the relationship between structural …

Insurance represents an important but underappreciated part of our lives. Both individuals and corporations gain from purchasing coverage from insurers to manage and hedge their risks. It is a necessary mechanism in modern society to support innovation while ensuring that its unavoidable victims will be compensated. The innovation of emerging technologies alters the existing risk landscape, challenging insurance companies, innovators, and individuals' ability to manage their risks. The current emerging technology of Artificial Intelligence (Al) significantly emphasizes this trend. Insurance companies are grappling with the notion of Al. They are exploring different traditional and novel insurance products that they can …

Like A Good Neighbor, State Courts Are There: The Case For Remanding Covid-19 Business Interruption Actions To State Court, Gabriel L. Johnson Apr 2025

Like A Good Neighbor, State Courts Are There: The Case For Remanding Covid-19 Business Interruption Actions To State Court, Gabriel L. Johnson

Connecticut Insurance Law Journal

Following the emergence of COVID-19 and resulting civil orders seeking to stop its spread, many businesses filed claims with their insurance providers for “business interruption” coverage, a type of insurance intended to compensate businesses for income lost during a temporary forced closure. When insurance companies roundly denied these claims, many small-business owners filed lawsuits in state courts. Insurance company defendants largely removed these cases to federal courts, and business owner plaintiffs filed to remand back to state court. In one consolidated appeal heard by the Third Circuit, DiAnoia’s Eatery, LLC v. Motorist Mutual Insurance Co., businessowner plaintiffs seeking remand to …

An Exploration Of Serum 25-Hydroxyvitamin D Levels After Unstable Femoral Intertrochanteric Fractures In Community-Dwelling Elderly, Hakan Zora, Gökhan Bayrak Apr 2025

An Exploration Of Serum 25-Hydroxyvitamin D Levels After Unstable Femoral Intertrochanteric Fractures In Community-Dwelling Elderly, Hakan Zora, Gökhan Bayrak

Saudi Medical Journal

ABSTRACT Objectives: Inadequate vitamin D is related to increased fall risk, which leads to hip fractures among the elderly. Therefore, this study aimed to explore vitamin D levels and the variables potentially influencing the total hospitalization time of community-dwelling elderly patients with unstable femoral intertrochanteric fractures. Methods: Between 2020-2024, 75 elderly patients treated with total hip replacement (THR) were retrospectively analyzed. Patients were divided into the deficient (<20 ng/mL, n=46), insufficient (20 to 29.99 ng/mL, n=16), and normal (≥30 ng/mL, n=13) serum 25-hydroxyvitamin D (25(OH)D) groups. Presence of delirium status, postoperative intensive care entrance, number of chronic diseases, preoperative waiting, and total hospitalization time after THR were recorded. Results: The cohorts’ mean serum 25(OH)D level was 20.11ng/mL. The deficient, insufficient, and normal serum 25(OH)D level groups displayed no significant difference in the postoperative intensive care entrance ( p =0.547) and the presence of delirium ( p =0.947). The multiple linear regression model indicated that elderly patients’ total hospitalization increases with the coefficients as the preoperative waiting time (β=0.466, p =0.001) and the number of chronic diseases (β=0.263, p =0.011) increase. Serum 25(OH)D level did not impact patients’ total hospitalization time (β=-0.072, p =0.474). Conclusion: This study indicated that community-dwelling elderly patients with unstable femoral intertrochanteric fractures had significantly decreased serum 25(OH)D levels. Reducing preoperative waiting time and monitoring and addressing chronic diseases may decrease total hospitalization. Efforts should focus on achieving and maintaining adequate vitamin D levels through supplementation post-hospitalization.

Can Advanced Chatbots Help Us Navigate Educational Advocacy? Understanding The Potential Of Large Language Models As Assistants And Guides Within An Iep (Individualized Education Program) Meeting Context, Nava Bahrampour

IPHS 300: AI for Humanity

Hundreds of thousands of parents and students in New York City’s school district alone (Fancsali and Farley 2018) go through the Individualized Education Program (IEP) process every year, attending meetings and evaluations in order to determine adequate services and students with disabilities’ educational trajectories. However, most parents, especially those new to public education policy, report difficulty navigating the system or acquiring the resources necessary to successfully advocate for their children at IEP meetings (Advocates for Children 2025, Kurth et al. 2020). The rise of generative artificial intelligence and increased linguistic capabilities of interactional chatbots provokes questions about such technologies’ ability …

Following The Crowd? A Topic Modeling Analysis Of Twitter Discourse And Supreme Court Decisions, Jessica Daughterty Apr 2025

Following The Crowd? A Topic Modeling Analysis Of Twitter Discourse And Supreme Court Decisions, Jessica Daughterty

IPHS 300: AI for Humanity

This project uses topic modeling to compare the top topics from Twitter posts with the text of the Supreme Court’s Dobbs v. Jackson ruling, which overturned Roe v. Wade in 2022. I analyzed whether the Court’s reasoning reflected public concerns or was disconnected. While some analysis of the Twitter data exists on the Kaggle dataset I used, I conducted this research independently of those results. By putting the Court’s language and public sentiment side by side, this project explores whether institutions are responding to what people care about.
