Exploring The Importance Of Criminal Legal Aid: A Canadian Perspective, Trevor C. W. Farrow, Marcus Pratt Nov 2023

Exploring The Importance Of Criminal Legal Aid: A Canadian Perspective, Trevor C. W. Farrow, Marcus Pratt

Articles & Book Chapters

There is a growing global recognition that, in order to address the current access to justice crisis, more research, together with a better understanding of data, is needed. This article, through an examination of existing legal aid research primarily in the area of criminal law, explores some of what we know and do not know about the relative benefits and costs of providing different kinds of criminal legal aid services. Although not a comprehensive review of all available research, this article identifies data strengths and gaps and the need for further research and reforms.

Restorative Practices Interrupted, Celeste Kellar Nov 2023

Restorative Practices Interrupted, Celeste Kellar

USF Tampa Graduate Theses and Dissertations

The initial critical event precipitating the problem of practice at my school was the repercussions of the mass shooting at Marjorie Stoneman Douglas High School, Parkland, Florida on February 14, 2018. This shooting and the resulting legislative mandates of Florida Senate Bill 7026, led to my administrative decision to adopt Restorative Practices at my school, a school for students with disabilities. Restorative Practices purport to encourage the development of positive relationships, repair and restore existing relationships thereby decreasing the chance of a repeated offense and improving school climate (Zehr, 2015). Additional rationale for the adoption was to address the disproportionality …

Wireless Emergency Alerts And Organisational Response: Instructing And Adjusting Information In Alerts, Lauren B. Cain, Jeannette Sutton, Michele K. Olson Nov 2023

Wireless Emergency Alerts And Organisational Response: Instructing And Adjusting Information In Alerts, Lauren B. Cain, Jeannette Sutton, Michele K. Olson

Emergency Preparedness, Homeland Security, and Cybersecurity Faculty Scholarship

In the United States, alerting authorities are authorized by the Federal Emergency Management Agency (FEMA) to notify the public of imminent hazards and threats by sending Wireless Emergency Alerts (WEAs) through the Integrated Public Alert and Warning System (IPAWS). Although recent efforts have been made to examine historical WEA compliance with frameworks such as Mileti and Sorenson's (1990) Warning Response Model, less attention has been paid to information included in WEAs that is not prescribed by message design frameworks from risk communication scholarship. This paper explores the presence of Situational Crisis Communication Theory's (SCCT) instructing and adjusting information in terse …

Legal Human Rights And Tanzania Human Rights Defenders Coalition V Tanzania, Application No. 039/2020 (13 June 2023), Kafula M. Kasonde Nov 2023

Legal Human Rights And Tanzania Human Rights Defenders Coalition V Tanzania, Application No. 039/2020 (13 June 2023), Kafula M. Kasonde

SAIPAR Case Review

This judgement is a milestone in the Tanzanian jurisprudence as it subjects the Tanzanian legal system to scrutiny by an international court with regards to a provision in a domestic statute providing for non-bailable offenses. The legal system of Tanzania overlooked an opportunity in this case to examine the compatibility of national legislations with international human rights standards. This judgement highlights the critical role of human rights non-governmental organisations (NGOs) and their efforts to challenge domestic laws that may infringe upon fundamental rights through emphasizing the need for alignment and adherence to international human rights standards.

Recalibrating Bruen: The Merits Of Historical Burden-Shifting In Second Amendment Cases, Kevin G. Schascheck Ii Nov 2023

Recalibrating Bruen: The Merits Of Historical Burden-Shifting In Second Amendment Cases, Kevin G. Schascheck Ii

Belmont Law Review

After Bruen, the prevailing assumption was that the Second Amendment framework shifted radically for all gun laws. Courts throughout the country have already invalidated key gun safety statutes while applying the new test. However, such holdings fail to grapple with the full weight of Second Amendment doctrines. A proper application of the doctrine in toto will result in no significant changes to the constitutionality of the vast majority of gun laws after Bruen.

This Article explains the underdeveloped interaction between two principal Second Amendment doctrines - presumptions of legal validity and historical analyses. That interaction, framed in its simplest terms, …

Perceptions Of Childcare In Nonmetropolitan Nebraska, Rebecca J. Vogt, Heather Akin, Cheryl A. Burkhart-Kriesel, Bradley D. Lubben, L. J. Mcelravy, Timothy Meyer, Steven A. Schulz Nov 2023

Perceptions Of Childcare In Nonmetropolitan Nebraska, Rebecca J. Vogt, Heather Akin, Cheryl A. Burkhart-Kriesel, Bradley D. Lubben, L. J. Mcelravy, Timothy Meyer, Steven A. Schulz

Nebraska Rural Poll

Lack of childcare is an issue in many rural Nebraska communities. According to a report from Voices for Children, most counties in the state (91%) do not have enough available licensed childcare slots to meet the current demand there. Furthermore, 11 counties in the state have no licensed childcare facilities. Many communities are exploring options of how to address these shortages to maintain their current residents or to be able to attract new residents. Given these challenges, what types of childcare are rural Nebraskans currently using? How far do they drive to get to their childcare? And how do rural …

Police Officers, Policy, And Personnel Files: Prosecutorial Disclosure Obligations Above And Beyond Brady, Lauren Giles Nov 2023

Police Officers, Policy, And Personnel Files: Prosecutorial Disclosure Obligations Above And Beyond Brady, Lauren Giles

Fordham Law Review

Police officers play a significant role in the criminal trial process and are unlike any other witness who will take the stand. They are trained to testify, and jurors find them more credible than other witnesses, even though officers may have more incentive to lie than the ordinary witness. Despite the role of police officers in criminal proceedings, state statutes say virtually nothing about evidence used to impeach police officers, often contained in the officer’s personnel file. Worse still, the standard for disclosing information in an officer’s personnel file varies among and within states, resulting in inconsistent Brady disclosures. This …

Prevention Program Sustainability And Associated Determinants: A Literature Review, Version 1.0, Andrea Walker, Sarah Steele, Matt Allen, Nicholas J. Arreola

Reports, Projects, and Research

The Department of Homeland Security (DHS) has made millions of dollars available through the Targeted Violence and Terrorism Prevention (TVTP) Grant Program to help communities across the United States develop capabilities to combat terrorism and targeted violence. Given this investment, a key objective is ensuring the long-term impact of these programs, which depends on their sustainment beyond the initial grant. Thus, the purpose of this report is to review the relevant literature on program sustainability and discuss implications for the TVTP Grant Program. We began the review by exploring definitions of sustainability as well as similar social programming concepts, such …

Towards Critical Reflexivity In Gifted Education Teacher Preparation, Inna Kruvi Nov 2023

Towards Critical Reflexivity In Gifted Education Teacher Preparation, Inna Kruvi

Theses and Dissertations

Ever since the emergence of gifted education in the United States in the beginning of the twentieth century, the concept of giftedness has been used to marginalize, segregate, and exclude students of particular backgrounds from specialized academic programs. Among the factors that contribute to unequal access to gifted education for ethnically, culturally, linguistically, and economically diverse (ECLED) students, teacher bias, deficit thinking, and insufficient teacher preparation have been identified as especially significant (Coleman et al., 2015; DeWet & Gubbins, 2011; Mansfield, 2015). Among various approaches to mitigate underrepresentation of ECLED students, the concept of cultural humility (Tervalon and Murray-Garcia, 1998) …

Limited Clinical Utility Of Routine Mycobacterial Cultures For The Management Of Diabetic Foot Infections, Laila M. Castellino, Clare Mccormick-Baw, Tyler Coye, Peter A. Crisologo, John J. Hanna, Francesca Lee, Andrew Clark, Michael Fanning, Amanda L. Killeen Nov 2023

Limited Clinical Utility Of Routine Mycobacterial Cultures For The Management Of Diabetic Foot Infections, Laila M. Castellino, Clare Mccormick-Baw, Tyler Coye, Peter A. Crisologo, John J. Hanna, Francesca Lee, Andrew Clark, Michael Fanning, Amanda L. Killeen

School of Podiatric Medicine Publications

Mycobacterial infections of the foot and ankle are uncommon. In a cohort of 2340 patients with diabetic foot infection (DFI) in a region with increased prevalence of mycobacterial disease, we identified no clinically significant positive cultures over a 3-year period. Routine mycobacterial culture of DFIs is of limited clinical utility.
