The right of refugees to seek asylum is undisputedly provided by international instruments but traditionally, the right to grant asylum has been the prerogative of the state concerned. States have a duty of non-refoulement under Article 33 of the Refugee Convention, prohibiting the expulsion or return of refugees. Given the correlation between International Human Rights Law and International Refugee Law, non-refoulement comprises non-rejection at the frontiers as well. Despite the principle being a part of customary international law, due to the ambiguity prevailing in its application, it is constantly flouted by the member-states. Immigration is a regular feature of American life; President Obama once described the U.S. as “a nation of immigrants.” Even as the host of more immigrants than any other nation, the American public has historically found immigration contentious. Since Congress has failed to agree on comprehensive immigration reform, this responsibility has moved to the executive and judicial branches of government. In 2016, the Department of Homeland Security (DHS) began working on the Homeland Advanced Recognition Technology (HART) Program, a new biometric information management system, to replace IDENT (Automated Biometric Identification System), DHS’s current biometrics database. Family Violence And Child Support: Abuse, Shared Parenting, And Special Expenses, Joanna Radbord

This article addresses specific sections of the Federal Child Support Guidelines which are particularly problematic for survivors of family violence: (a) section 9 in relation to child support in circumstances of shared parenting time, and (b) section 7 dealing with special or extraordinary expenses. Child support in Canada currently functions as an application-based system within an adversarial context, which creates significant barriers to child support for victims of abuse. In relation to shared parenting, a presumptive reduction in the quantum of child support is likely to exacerbate systemic inequalities and further disadvantage survivors of family violence—disproportionately women and children. Worthless? Victims Of Family Violence And The (Non)Payment Of Child Support, Joanna Radbord

This article details the profound challenges experienced by victims of family violence seeking to access child support. Survivors face physical, mental, and financial barriers to obtaining support. Despite its recognition as the “right of the child,” many survivors forego an application for support altogether. For those victims who bravely attempt to make a claim, they generally confront further abuse and disempowerment within the adversarial litigation process. They often face an overwhelming power imbalance in negotiation, undermining their psychological and financial well-being. If survivors obtain an agreement or order for child support, child support regularly goes unpaid. Given the flaws in …

The Drone Medical Package Delivery for Improved Transportation and Better Patient Outcomes planning and prototyping grant involves five partners, including Accomack-Northampton Planning District Commission (A-NPDC), Riverside Health System, Old Dominion University (ODU), Virginia Institute for Spaceflight & Autonomy (VISA), Virginia Innovation Partnership Corporation (VIPC), and DroneUp. The partners worked together to address access, safety, reliability and sustainability for medical and emergency response package delivery via drone, specifically, where the use of aerial drones could lead to better patient outcomes and improved safety and emergency response.

This article exposes how the unregulated data broker industry fuels violence by selling detailed personal information gathered from public records, social media, and private sources. Drawing on the Minnesota assassinations and other cases, it shows how such data enables stalking, harassment, and targeted attacks. The piece critiques state and federal laws like California’s DELETE Act and New Jersey’s Daniel’s Law for leaving victims to navigate slow, fragmented removal processes. Part 4: Is It Better To Give Than Receive? Exploring The Distributional Dimension Of Virginia's Budget, Dragas Center For Economic Analysis And Policy, Old Dominion University
State of the Commonwealth Reports
This chapter focuses on the distribution of intergovernmental finances in Virginia. Specifically, it analyzes the distribution of state-level public resources in the Commonwealth of Virginia that takes place as a result of state-to-local intergovernmental transfers. The analysis suggests that, as a result of the manner in which state revenues are collected and allocated back to localities, some Virginians contribute significantly more to the Commonwealth budget in taxes than they receive back in local benefits, while other state residents receive more in benefits than they pay in taxes.

Working with clients at risk of, or experiencing, homelessness teaches personal and professional humility like few other experiences in law school or the practice of law. Yet such sensitive work also provides an opportunity for law students to develop both a keener understanding of their own professional identity—with its capacities and limitations—and critical counseling skills.

Cash bail, once a tool intended to ensure appearances in court, has evolved into a system that disproportionately incarcerates marginalized and economically disadvantaged communities. This national reckoning with the failures of the cash bail system necessiates a critical reevaluation of pretrial justice in the United States. The United States criminal justice system is at a transformative time, with growing public support for reforms that prioritize rehabilitation over punishment. In response to this shift, prosecutor-led diversion programs are being introduced in areas where they were previously absent and expanded with increased resources in regions already established across the United States. This dissertation measures the effectiveness of these programs in three ways and uses data from six diverse U.S. jurisdictions. In the first chapter, I focus on how age-based eligibility criteria shape participation in diversion programs and its effectiveness in reducing recidivism. To do this, I examine data …

States resist federal encroachments on their sovereignty. This recalcitrance has been buoyed by the renewed federalism jurisprudence of the Rehnquist and Roberts Courts. Research into state sovereignty typically arranges recalcitrance actions by the policy issue under discussion. This article takes a novel approach and instead evaluates state recalcitrance according to common strategies employed by political actors across the political spectrum. State recalcitrance strategies are categorized into four menu options: (1) Ignore It Exists, (2) Sanctuary Jurisdictions, (3) Pick a Fight, and (4) Political Posturing. This thesis explores the role of community in restorative justice through both the criminologist and practitioner perspectives. Through investigating the limitations of the U.S. penal system, which ranks highest globally in incarceration rates yet fails to ensure public safety, the research investigates restorative justice as a victim-cantered, harm-driven alternative. It emphasizes how restorative justice redefines crime by focusing on healing and accountability rather than punishment of the criminals/harm-doers. This thesis examines how communities are essential to restorative processes and how restorative justice, in turn, helps to build communities. Are Cities Still Liberal? An Analysis Of Post-Pandemic Political Change In American Cities, Olivia Mundy

This thesis investigates whether American cities are experiencing a political shift to the right in the wake of the COVID-19 pandemic, as suggested by recent media narratives. Drawing on an original national survey of 2,385 respondents conducted in early 2025, the study examines attitudinal and demographic changes among urban residents, with a particular focus on ideology, trust in local government, economic perceptions, and views on race and immigration. Despite anecdotal evidence of conservative gains in urban elections, the findings show no significant trend toward conservatism among urban residents overall. The role of policing in American society is more pervasive (and less visible) than many acknowledge. Police do not just patrol, arrest, and keep peace – they also gatekeep. Many and varied ostensibly non-criminal processes rely on police fact-finding to adjudicate claims, establish eligibility for resources, and take adverse action against individuals. This Article examines the phenomenon of police gatekeeping, both as a practical barrier to resources and remedies and as a hegemonic mechanism to construct the social conception of truth.

Harmful Algal Blooms (HABs), known as red tides, have long impacted Florida’s coastal ecosystems. Caused by the toxic dinoflagellate Karenia brevis, these blooms are named based on the characteristic red discoloration of coastal waters. Negative impacts of K. brevis range from fish kills, neurotoxic shellfish poisoning, and respiratory irritation in humans. Traditionally, K. brevis monitoring has been conducted weekly by Florida Fish and Wildlife Conservation Commission’s Fish and Wildlife Research Institute (FWC-FWRI) using light microscopy for cell identification and enumeration of collected water samples. However, this method is time-consuming, costly, and relies on deep taxonomic expertise for proper cell …
