Pfas Litigation And Industry “Science”: Combating Deceptive Industry Practices, Dayna Smith Jan 2025

Pfas Litigation And Industry “Science”: Combating Deceptive Industry Practices, Dayna Smith

Western New England Law Review

PFAS have become a hot spot of litigation due to their growing notoriety as one of the greatest chemical threats of our time. Yet, due to concerted efforts by the PFAS industry, PFAS cases are likely to face a significant hurdle in the courtroom. Historically, industry groups have funded studies to lend support to their products, leading to a high risk of bias that has potentially far-reaching consequences. Further, there is mounting evidence that the PFAS industry actively used funding to manipulate science, while also engaging in other deceptive practices to hide potential health risks. This industry “science” then makes …

Duty To Protect: Updating Law Enforcement Tort Liability To Align With Contemporary Standards, Nicholas Emanuel, Lauren Loeb, Gavin Partington Jan 2025

Duty To Protect: Updating Law Enforcement Tort Liability To Align With Contemporary Standards, Nicholas Emanuel, Lauren Loeb, Gavin Partington

Western New England Law Review

Can civil tort law make law enforcement services safer and more effective? The purpose of tort law is to protect the public by imposing an obligation to act responsibly and avoid causing harm to others. But tort law is generally inapplicable to the profession of policing because of the public duty doctrine, the theory that police owe a duty only to the public at large, not to any individual. That doctrine and similar rules render police immune from civil liability even in cases of egregious failure to protect the public. Public safety—and confidence in law enforcement—suffer as a result.

Dc To Ac Voltage Source Converter Control System, Mohummad Tark Elgassier, Jordan M. Reichhardt, Brayden Richard Young

Electrical Engineering

The Voltage Source Converter Control System integrates a control system for a 2-phase half-bridge voltage source converter (VSC) utilizing a TMS320F2837xD Dual-Core Real-Time Microcontroller. VSCs are critical for the integration of power production into the power grid. They allow for accurate control over DC-AC energy conversion. Additionally with the improvement of renewable energies VSCs play a critical role in controlling the flow of these environmentally controlled and more unpredictable sources of energy. The control system regulates the output current and voltage, regulates switching patterns, and maintains power stability under varying loads. Within the control system Digital control systems, PWM generation, …

Administrative Forum Shopping, Amy L. Stein Jan 2025

Administrative Forum Shopping, Amy L. Stein

Fordham Law Review

Allowing private parties in litigation to stack the deck in their favor through forum shopping is standard fare in the United States. But not everyone realizes that public legislators engage in a similar exercise when they stack the deck in one party’s favor through “jurisdiction-stripping” or “jurisdiction-channeling” provisions. Congress can strip federal courts of all or some of its jurisdiction, channel jurisdiction over a particular class of cases into one particular court, and even strip the U.S. Supreme Court of its appellate jurisdiction. Understandably, this last category has received the most attention, as scholars are drawn to the penultimate conflict …

Pressing Charges: Criminal Fees And The Excessive Fines Clause, Annemarie Foy Jan 2025

Pressing Charges: Criminal Fees And The Excessive Fines Clause, Annemarie Foy

Minnesota Law Review Vols. 106:2 onward (2021-present)

Millions of people owe money to the government as a consequence of a criminal charge. But while some of that debt is tied to fines or restitution, much of it is levied as fees, or payments owed to the government for the administration of a defendant’s criminal proceedings. Criminal fees can include costs assessed for pretrial detention, a public defender, a jury, a court appearance, filing a document, electronic monitoring, and more. They are assessed at every stage of a criminal case and for all types of offenses. While state and local governments claim that criminal fees are necessary to …

Informing Choice: The Role Of Adoption In Women’S Pregnancy Decision-Making, Elizabeth R. Kirk, Ryan Hanlon Jan 2025

Informing Choice: The Role Of Adoption In Women’S Pregnancy Decision-Making, Elizabeth R. Kirk, Ryan Hanlon

Scholarly Articles

In the wake of the Supreme Court’s opinion in Dobbs v. Jackson Women’s Health Organization, the authors of this Article offer a practical, collaborative response to a seemingly intractable, divisive issue. Kirk and Hanlon draw on their academic expertise in law and social science, respectively, to address the paradox of the general esteem for the institution of adoption alongside the rarity with which adoption is chosen. In this Article, they examine social science data and literature on women’s pregnancy decision-making in order to explain the need for laws and policies that promote informed choice. They introduce never-before-published survey data and …

Associational Rights Versus Nonprofit Transparency: Information Reporting In The Internet Age, Roger Colinvaux Jan 2025

Associational Rights Versus Nonprofit Transparency: Information Reporting In The Internet Age, Roger Colinvaux

Scholarly Articles

For decades, the nation’s charitable and nonprofit organizations have been required to file an information return, known as the Form 990, with the Internal Revenue Service. Congress mandates that the return be made publicly available. Such information reporting, both to the IRS and to the public, is the cornerstone of the federal government’s approach to assuring that nonprofit organizations are legally compliant. The Supreme Court’s decision in Americans for Prosperity Foundation v. Bonta (APF), however, casts a shadow on the constitutionality of nonprofit reporting requirements. In APF, the Court held unconstitutional California’s effort to require charities to …

A More Luminous Beacon, William M.M. Kamin Jan 2025

A More Luminous Beacon, William M.M. Kamin

Scholarly Articles

Over the Supreme Court’s past four Terms, federal post conviction habeas corpus has been placed on the chopping-block. Its fate hangs in the balance of an historical debate over the maxim, oft recited by the Court between 1830–1953, that post conviction habeas reaches only “jurisdictional defects” — as opposed to “mere error” — on the part of the convicting court. Justices Gorsuch and Thomas maintain that “jurisdiction” carried then the same narrow meaning it does now: power ab initio over the offense charged and the defendant’s person. Justices Kagan and Jackson contend that, in this context, “jurisdictional defect” was understood …

Cities In Transition: Insights From Three Latin American Cities On Urban Growth, Governance, And Sustainable Development, Abby Barahona Jan 2025

Cities In Transition: Insights From Three Latin American Cities On Urban Growth, Governance, And Sustainable Development, Abby Barahona

Scripps Senior Theses

In 2015, the Inter-American Development Bank reported that nearly 80 percent of the Latin American population lived in cities, a figure projected to reach 90 percent by 2040. In addition to being the most urbanized region in the world, Latin America is also the most unequal. This research explores the challenges and possibilities of equitable urban development in Latin America by evaluating how cities perform across four key dimensions: functionality, inclusivity, environmental sustainability, and aesthetic value. Drawing from historical context and case studies of El Alto (Bolivia), Brasília (Brazil), and Medellín (Colombia), this thesis examines patterns of urban growth shaped …

Human Masters/Robot Servants: Highly Automated Vehicle Design, Intoxicated Drivers & Vicarious Liability, William H. Widen, Marilyn C. Wolf Jan 2025

Human Masters/Robot Servants: Highly Automated Vehicle Design, Intoxicated Drivers & Vicarious Liability, William H. Widen, Marilyn C. Wolf

Articles

A traditional engineering role is to design a safe product. Safety engineering is an exercise in harm avoidance ex ante. In contrast, liability attribution is an exercise to compensate for loss post hoc — traditionally viewed as a legal matter. We observe that, when a natural person incurs liability for a loss that exceeds insurance coverage, economic ruin can follow. Neither engineering nor law focus on the loss suffered by defendants considering law as a "safety risk." The highly automated vehicle (HAV) design space, however, provides an opportunity to prevent this kind of economic harm from occurring ex ante just …

Corporate Governance Speech, Sarah C. Haan Jan 2025

Corporate Governance Speech, Sarah C. Haan

Seattle University Law Review

The State has always regulated the intra-firm communications that make corporate governance possible, most commonly by mandating disclosures of information by a corporation to its shareholders. Some such laws are labeled “securities regulation,” but securities regulation is a broad category that extends to speech by actors who are outside the corporate enterprise as well. Also, the conventional securities regulation category does not capture all such laws; other examples, including informationforcing mandates, can be found in state corporate law. This Article uses the term “corporate governance speech” to describe the communications among shareholders, directors, and officers through which corporate governance is …

Analyzing Patterns In Chicago Motor Vehicle Crashes Using Time-Series Techniques, Christina Trotta Jan 2025

Analyzing Patterns In Chicago Motor Vehicle Crashes Using Time-Series Techniques, Christina Trotta

Senior Honors Theses and Projects

This project explores time series forecasting of daily traffic crash rates in Chicago from 2018 to 2024, with a focus on understanding how past crash patterns and external conditions influence future risk. The primary research question asks: To what extent does yesterday’s crash rate help predict today’s? Using a combination of Holt-Winters exponential smoothing, Prophet forecasting, and SARIMAX models, we assess the role of autoregression, seasonality, and exogenous variables such as weather and roadway conditions. Daily crash data was cleaned, aggregated, and enriched with engineered features including holiday indicators, weather metrics from O’Hare and Midway airports, and binary flags for …

The Effects Of Racial Gaslighting On Community Policing: An Exploration Of Contemporary Hermeneutical Injustice Within Marginalized Communities, Louise Missome Engohang Jan 2025

The Effects Of Racial Gaslighting On Community Policing: An Exploration Of Contemporary Hermeneutical Injustice Within Marginalized Communities, Louise Missome Engohang

Senior Honors Theses and Projects

This thesis critically examines the phenomenon of racial gaslighting within the context of community policing, focusing on its ethical and epistemological consequences for marginalized communities. Racial gaslighting—a process by which law enforcement and broader institutions invalidate or distort the lived experiences of racialized individuals—plays a pivotal role in undermining the trust and effectiveness of community policing models. By drawing on Miranda Fricker’s theory of hermeneutical injustice and Charles Mills’ analysis of racial epistemologies, the research explores how systemic denial of racial bias contributes to the erosion of public trust, the silencing of marginalized voices, and the perpetuation of inequality in …

Racial Capitalism: The Political Economy Of American Punishment, Naomi Barbour Jan 2025

Racial Capitalism: The Political Economy Of American Punishment, Naomi Barbour

Senior Honors Theses and Projects

This research examines how the criminal justice industrial complex and existing political incentives have shaped American penology, ultimately contributing to the disenfranchisement and unequal representation of marginalized groups. It identifies a significant historical shift in U.S. penal philosophy, moving from rehabilitation to retribution, arguing that this shift coincided with the rise of economic interests in the criminal justice system, facilitating the emergence of the criminal justice industrial complex. The research further examines the effects of this changing environment, arguing that the growing influence of profit-driven entities, including private prison companies, has played a crucial role in radicalizing criminal justice policies, …

Running For Understanding 5k Guide, Adelaide J. Roell

Senior Honors Theses and Projects

In April 2025, during Autism Awareness month, I organized an Autism Awareness 5K event on EMU’s campus, inviting the College Supports Program, Best Buddies, and other students from EMU, as well as members of the broader community to participate. The event aimed to raise awareness, promote inclusion, and support local students in special education. It also served as an opportunity for hands-on community advocacy and leadership in my future field of speech-language pathology. This project demonstrates many benefits of community inclusion outcomes (Cameron et al., 2022). This guide outlines the organization, how hosting community events ties to ASD, and the …

What’S Left Of The New Deal State?, Sandeep Singh Dhaliwal Jan 2025

What’S Left Of The New Deal State?, Sandeep Singh Dhaliwal

Michigan Law Review Online

A vast body of scholarship situates itself in the New Deal era. Another extensive collection explores the history of criminal justice in the United States. To date, however, there has been little effort to bring these conversations together. New Deal Law and Order, written by legal historian Anthony Gregory, fills this conspicuous gap. Gregory remarkably narrates the New Deal era through the lens of President Franklin Roosevelt’s “war on crime” (p. 1), challenging how we think about both the New Deal’s legacy and the foundations of the modern security state.

The History Of Cardiopulmonary Resuscitation And Where We Are Today, Maren Downing, Eren Sakarcan, Kristen Quinn

General Surgery Resident Research

Cardiac arrest remains a leading cause of death worldwide and is a global health crisis. First described in the medical literature in the 18th century, modern cardiopulmonary resuscitation (CPR) with closed chest compressions has remained the standard of care since 1960. Despite exponential advances in basic science research and technological innovations, cardiac arrest survival remains a dismal 10%. The standard of care closed chest compressions provide only 20–30% of baseline cardiac output to the body. Have modern therapies plateaued in effectiveness? This article reviews the history of cardiac arrest, its therapies, and opportunities for future treatments. Through an exploration into …

Temporary/Forever: The Fissured Economy, Obstacles To Employment, And Regulating The Future Of Exploitation In Temp Work, Kevin Herrera

Loyola University Chicago Law Journal

Among workers in United States, contingent and temporary work arrangements have grown to represent a substantial segment of available jobs, with spikes in their predominance corresponding to major economic shake ups like the Great Recession and the COVID-19 pandemic. These arrangements are part of a larger trend of the “fissuring” of United States employment, wherein applicants are hired by one company and then sent to do their job at another, obscuring who actually employs the worker. Jobs through temp staffing agencies are a particularly dominant form of fissuring among low-wage workers and create conditions under which accountability for workplace abuses …

Legal Scholarship Through The Lens Of Generative Ai, Darkly, Andrew Martineau, Loren Turner Jan 2025

Legal Scholarship Through The Lens Of Generative Ai, Darkly, Andrew Martineau, Loren Turner

Articles

Unlike traditional search engines limited to connecting users to original source content, generative AI systems produce new, ad-hoc sources of information derived primarily from patterns in their training data and information fed into the system as context. As such, generative AI systems can play a mediating role between users and information sources, especially when these systems are integrated into databases and web search engines. This article examines how GPT-4 (ChatGPT) interacts with law review articles, revealing its unreliability in summarizing them independently but notable accuracy when provided with full-text input. Retrieval augmented generation (RAG) offers a potential solution for improving …

Evaluating The Effects Of Coastal Development On Sea Turtle Nesting Success Rates In Southwest Florida, Lydia Ubry Jan 2025

Evaluating The Effects Of Coastal Development On Sea Turtle Nesting Success Rates In Southwest Florida, Lydia Ubry

Theses & ETDs

The barrier islands of Sarasota County are one of the highest-density nesting areas for Caretta caretta (loggerhead sea turtle) and Chelonia mydas (green sea turtle) in Florida and the greater Gulf of Mexico region. Additionally, these islands (Lido Key, Siesta Key, Casey Key, and Manasota Key) are all highly developed with varying types of dominant structures on each key. This study aims to examine the different types of development on these islands over time (1974-2023) in conjunction with marine turtle nesting success rates. Findings include a higher number of nesting turtles overall, despite a great increase in development since the …

8,500 crossings happen on 800 North every day. In Provo last year, 57 car crashes involved pedestrians. A pedestrian’s view of the road is obstructed by cars parked on the right hand side of the road causing them to walk in the crosswalk to see if there is a car coming. Sidewalks on connecting streets are uneven and cracked. Multiple blocks on 800 North without a stop sign to slow drivers down. Currently no posted speed limit signs on 800 North. Drivers can’t see pedestrians crossing on 200, 300, 400, or 500 East because of inadequate lighting. Cars obstruct areas …
