Lawyers Have Two Approaches To Higher Ed, Aldemaro Romero Jr. Oct 2017

Lawyers Have Two Approaches To Higher Ed, Aldemaro Romero Jr.

Publications and Research

After decades of a culture of social isolationism, we see how colleges and universities have gradu- ally become the battlegrounds of national issues such as race, religion, sexual assault, gun control and free speech. Over the last 50 years more than 120 cases related in one way or another to higher education have been heard by the U.S. Supreme Court. Hundreds of other cases have been filed, only for the justices to deny hearing them.

However, most colleges and universities are not well prepared to deal with litigation. For one thing institutions of higher education have had for decades a …

Raton Walkability Workshop Report, University Of New Mexico Prevention Research Center Oct 2017

Raton Walkability Workshop Report, University Of New Mexico Prevention Research Center

Walking Guides and Reports

Ramblin’ Round Raton (RRR) coordinated a walkability workshop for members of the community to come together at the Center for Sustainable Community and assess different parts of the city for pedestrian friendliness. The group modeled the event after a similar workshop in the Village of Cuba in 2009. Prior to the workshop, RRR identified six areas of focus. They chose the locations because they are popular pedestrian thoroughfares, close to schools, or thought to be confusing areas for pedestrians.

Journal of Marine Science and Technology–Taiwan

This paper presents a framework involving the use of remote sensing imagery and image processing techniques to analyze a 2014 super typhoon, Typhoon Nuri, and the cold occlusion that occurred in the northwestern Pacific Ocean. The purpose of this study was to predict the tracks and profiles of Typhoon Nuri and the corresponding association with the induction of cold front occlusion. Three-dimensional typhoon profiles were implemented to investigate the in-depth distribution of the cloud top from surface cloud images. The results showed that cold fronts and southwesterly airflow accompanied by warm air masses occurred at the front ends of the …

Can Local Actors Foster A More Inclusive And Sustainable Model Of Economic Development? The Role Of Business Improvement Areas In The “New” Industrial Policy, Matias De Dovitiis, Juan Gomez, Rafael Gomez Oct 2017

Can Local Actors Foster A More Inclusive And Sustainable Model Of Economic Development? The Role Of Business Improvement Areas In The “New” Industrial Policy, Matias De Dovitiis, Juan Gomez, Rafael Gomez

Osgoode Hall Law Journal

A growing body of evidence links differing managerial practices, specifically ones addressing environmental sustainability and the management of people, to variations in performance observed across firms and countries. Firms (and by extension jurisdictions) that invest in better environmental policies (sustainability) and that empower workers (inclusivity) tend to outperform, over the long run, those that do not. Despite the gains associated with these inclusive and sustainable management techniques, large differences in the adoption of even the most basic management practices persist. We premise this article on an institution that can lower the costs of gaining best practice knowledge and help in …

Funding Justice: The Budget Of The Maine Judicial Branch-We Did Get There From Here, Leigh I. Saufley Oct 2017

Funding Justice: The Budget Of The Maine Judicial Branch-We Did Get There From Here, Leigh I. Saufley

Maine Law Review

The budget for the administration of justice in the State of Maine is a study in contrasts. During the last two decades, the lack of sufficient dollars appropriated to Maine Judicial Branch and the impact that this underfunding has had on people seeking access to justice have created consistent concerns for leaders in the Judicial Branch as well as for those in the Executive and Legislative Branches. Despite these challenges, however, the administrative structure of the Maine Judicial Branch stands as a model for states across the country. Understanding the genesis of this contrast will be critical to planning for …

An Exposition Of The Effectiveness Of And The Challenges Plaguing Maine's Juvenile Drug Treatment Court Program, Jason E. Rayne Oct 2017

An Exposition Of The Effectiveness Of And The Challenges Plaguing Maine's Juvenile Drug Treatment Court Program, Jason E. Rayne

Maine Law Review

Since 1989, trial courts across the United States have been developing and implementing the drug court model. Drug courts are treatment-based programs that are considered less adversarial than traditional methods of adjudication. By early in the new millennium, drug courts had “achieved considerable local support and [had] provided intensive, long-term treatment services to offenders with long histories of drug use and criminal justice contacts, previous treatment failures, and high rates of health and social problems.” Drug courts were developed in part to quell the trend of prison overcrowding associated with America’s increased “war on drugs” during the 1980s. Courts were …

Maine's Sex Offender Registry And The Ex Post Facto Clause: An Examination Of The Law Court's Unwillingness To Use Independent Constitutional Analysis In State V. Letalien, Lauren Wille

Maine Law Review

In 1996, Eric Letalien pleaded guilty to the gross sexual assault of a thirteen year-old girl, an offense he committed when he was nineteen years old. At the time of his sentencing in August of 1996, Letalien was subject to Maine’s Sex Offender Registration and Notification Act of 1995 (SORNA of 1995). Pursuant to SORNA of 1995, Letalien was required to register his address with the State Bureau of Identification (SBI) and update his address in the event he moved. This registration requirement was to be in effect for fifteen years from the time he was released from incarceration. After …

"The Wrong Approach At The Wrong Time?": Maine Adopts Strict Liability For Abnormally Dangerous Activities In Dyer V. Maine Drilling And Blasting, Inc., Matthew M. Cobb Oct 2017

"The Wrong Approach At The Wrong Time?": Maine Adopts Strict Liability For Abnormally Dangerous Activities In Dyer V. Maine Drilling And Blasting, Inc., Matthew M. Cobb

Maine Law Review

In 2009, the Maine Supreme Judicial Court, sitting as the Law Court, held in Dyer v. Maine Drilling and Blasting, Inc. that strict liability should be applied to abnormally dangerous activities in accordance with the Restatement (Second) of Torts §§ 519-20. In doing so, the court expressly overruled its decision in Reynolds v. W.H. Hinman Co., which had rejected a strict liability approach to blasting cases in favor of a negligence-based standard. In Dyer, a majority of the Law Court vacated the trial court’s grant of summary judgment for Maine Drilling and Blasting, Inc. (Maine Drilling) and held that strict …

Comparative Perspectives On Specialized Trials For Terrorism, Sudha Setty Oct 2017

Comparative Perspectives On Specialized Trials For Terrorism, Sudha Setty

Maine Law Review

President Obama has made clear that the United States must grapple with questions of how to detain and try potentially dangerous terrorism suspects in a manner that maximizes national security while adhering to the rule of law. Yet the United States faces a serious quandary in terms of how to prosecute suspects who have been detained at Guantanamo Bay, Cuba, that puts at risk the reputation of the United States justice system and its adherence to rule of law. The question of what trial system to use for suspected terrorists requires an historical interrogation of how and to what effect …

Civility Needs To Return To Higher Education, Aldemaro Romero Jr. Oct 2017

Civility Needs To Return To Higher Education, Aldemaro Romero Jr.

Publications and Research

According to The Institute for Civility in Government, civility is “about more than just polite- ness, although politeness is a necessary first step. It is about disagreeing without disrespect, seeking com- mon ground as a starting point for dialogue about differences, listening past one’s preconceptions, and teaching others to do the same.”

If we go by current events in academia it seems that civility has all but been lost. We see students actively impeding or shouting out at outside speakers just because those guests do not adhere to a particular “party line,” a pure version of a particular ideology, or …

The Intelligible Principle: How It Briefly Lived, Why It Died, And Why It Desperately Needs Revival In Today's Administrative State, Meaghan Dunigan Oct 2017

The Intelligible Principle: How It Briefly Lived, Why It Died, And Why It Desperately Needs Revival In Today's Administrative State, Meaghan Dunigan

St. John's Law Review

(Excerpt)

This Note addresses the flaws in the current intelligible principle standard and proposes a new three-part standard that would better revitalize the intelligible principle as it was first articulated almost a century ago. This Note concedes that while legislative delegation in any form is a violation of the original meaning of the nondelegation doctrine, our society and the growth of administrative agencies removed any chance of having our laws created solely by Congress. What can happen, and what this Note proposes, is for the Supreme Court to adopt a new intelligible principle standard that scales back the amount of …

Estate Of Fortier V. City Of Lewiston: Is Maine's Tort Claims Act Unintelligible?, William I. Olver

Maine Law Review

In Estate of Fortier v. City of Lewiston, the Maine Supreme Judicial Court, sitting as the Law Court, was asked to decide if the City of Lewiston was “using” an aircraft under the Maine Tort Claims Act (MTCA) when it chartered a plane from Twin Cities Air Services (Twin Cities) as part of an Air Force Junior Reserve Officer Training Corp (AFJROTC) exercise. Tragically, the pilot and three AFJROTC cadets from Lewiston High School lost their lives when the plane crashed into Barker Mountain shortly after take-off. The families of the students brought suit against Lewiston, in part, alleging negligence …

The Prevalence Of Insomnia On School Principals And Superintendents In Missouri, Regina Johnson Williams Oct 2017

The Prevalence Of Insomnia On School Principals And Superintendents In Missouri, Regina Johnson Williams

Student Theses and Dissertations

Chronic insomnia can lead to depression, anxiety, cognitive difficulties, workplace absenteeism, underperformance, and high employee turnover as well as medical issues such as Alzheimer’s, hypertension, myocardial infarction, obesity, and diabetes. Researchers have argued that healthful sleep is the most important factor in predicting longevity over diet, exercise, and heredity. Previous studies consider insomnia but do not address the specific issue of the levels of insomnia experienced by school principals and superintendents in Missouri. The purpose of the study was to investigate the levels in school administrators based on gender, age, ethnicity, experience in the current role, the level of professional …
