Government Speech And The War On Terror, Helen Norton
Government Speech And The War On Terror, Helen Norton
Fordham Law Review
This Article examines how the government’s speech in the War on Terror can threaten free speech, equal protection, and due process values. It focuses primarily on the constitutional harms threatened by the government’s speech itself (what some call a form of “soft law”), rather than on situations in which the government’s speech may be evidence of a constitutionally impermissible motive for its “hard law” actions.
Terrorizing Advocacy And The First Amendment: Free Expression And The Fallacy Of Mutual Exclusivity, Martin H. Redish, Matthew Fisher
Terrorizing Advocacy And The First Amendment: Free Expression And The Fallacy Of Mutual Exclusivity, Martin H. Redish, Matthew Fisher
Fordham Law Review
Traditional free speech doctrine is inadequate to account for modern terrorist speech. Unprotected threats and substantially protected lawful advocacy are not mutually exclusive. This Article proposes recognizing a new hybrid category of speech called “terrorizing advocacy.” This is a type of traditionally protected public advocacy of unlawful conduct that simultaneously exhibits the unprotected pathologies of a true threat. This Article explains why this new category confounds existing First Amendment doctrine and details a proposed model for how the doctrine should be reshaped.

Employer-Mandated Vaccination Policies: Different Employers, New Vaccines, And Hidden Risks, Teri Dobbins Baxter
Employer-Mandated Vaccination Policies: Different Employers, New Vaccines, And Hidden Risks, Teri Dobbins Baxter
Utah Law Review
Although debates about access to healthcare and healthcare financing have been in the headlines for years, attention has only sporadically focused on new and resurgent health challenges in the form of outbreaks of contagious diseases. One obvious weapon in the fight against outbreaks is vaccination. Many vaccines have been proven safe and highly effective, but vaccine opponents have been vocal and influential; even some who work in healthcare facilities distrust vaccines. The tension between employees who distrust vaccines and employers who want to encourage or require vaccination has led many healthcare policy and legal scholars to explore the legal and …
Addressing Utah’S School To Prison Pipeline, Tyler B. Bugden
Addressing Utah’S School To Prison Pipeline, Tyler B. Bugden
Utah Law Review
Utah’s STTP problem needs to be resolved. Zero tolerance policies, the limited constitutional rights of students, the police power of school administrators, the injection of SROs into our schools without clear job responsibilities and training, and the imbalance of power between students and state actors all contribute to Utah’s biased STPP. To address the STPP, researchers encourage: the expansion of legal protections for juveniles; the re-training of SROs and employment contracts that clearly define SROs’ responsibilities; the use of restorative justice practices and other evidence-based alternatives to the juvenile justice system; and reforming the discretionary power of state actors to …

Rationing Criminal Justice, Richard A. Bierschbach, Stephanos Bibas
Rationing Criminal Justice, Richard A. Bierschbach, Stephanos Bibas
Michigan Law Review
Of the many diagnoses of American criminal justice’s ills, few focus on externalities. Yet American criminal justice systematically overpunishes in large part because few mechanisms exist to force consideration of the full social costs of criminal justice interventions. Actors often lack good information or incentives to minimize the harms they impose. Part of the problem is structural: criminal justice is fragmented vertically among governments, horizontally among agencies, and individually among self-interested actors. Part is a matter of focus: doctrinally and pragmatically, actors overwhelmingly view each case as an isolated, short-term transaction to the exclusion of broader, long-term, and aggregate effects. …
The Role Of Social Anarchism And Geography In Constructing A Radical Agenda: A Response To David Harvey, Martha A. Ackelsberg, Myrna Margulies Breitbart
The Role Of Social Anarchism And Geography In Constructing A Radical Agenda: A Response To David Harvey, Martha A. Ackelsberg, Myrna Margulies Breitbart
Study of Women, Gender, & Sexuality: Faculty Publications
David Harvey’s response to Simon Springer (2014) raises important questions about the places from which to draw ideas for a radical geography agenda. Nevertheless, Harvey ignores critical contributions that social anarchists (including social geographers) have made to understanding both the theory and practice of social transformation. We draw on studies of the anarchist movement in Spain before and during the Spanish Civil War to explore some of what social anarchism has to contribute to geography and contemporary struggles for a more equitable society.
Algorithmic Jim Crow, Margaret Hu
Algorithmic Jim Crow, Margaret Hu

This Article contends that current immigration- and security-related vetting protocols risk promulgating an algorithmically driven form of Jim Crow. Under the “separate but equal” discrimination of a historic Jim Crow regime, state laws required mandatory separation and discrimination on the front end, while purportedly establishing equality on the back end. In contrast, an Algorithmic Jim Crow regime allows for “equal but separate” discrimination. Under Algorithmic Jim Crow, equal vetting and database screening of all citizens and noncitizens will make it appear that fairness and equality principles are preserved on the front end. Algorithmic Jim Crow, however, will enable discrimination on …

Crimmigration-Counterterrorism, Margaret Hu

The discriminatory effects that may stem from biometric ID cybersurveillance and other algorithmically-driven screening technologies can be better understood through the analytical prism of “crimmigrationcounterterrorism”: the conflation of crime, immigration, and counterterrorism policy. The historical genesis for this phenomenon can be traced back to multiple migration law developments, including the Chinese Exclusion Act of 1882. To implement stricter immigration controls at the border and interior, both the federal and state governments developed immigration enforcement schemes that depended upon both biometric identification documents and immigration screening protocols. This Article uses contemporary attempts to implement an expanded regime of “extreme vetting” to …
Terrorist Incitement On The Internet, Alexander Tsesis
Terrorist Incitement On The Internet, Alexander Tsesis
Fordham Law Review
I organized this symposium to advance understanding of how terrorist communications drive and influence social, political, religious, civil, literary, and artistic conduct. Viewing terrorist speech through wide prisms of law, culture, and contemporary media can provide lawmakers, adjudicators, and administrators a better understanding of how to contain and prevent the exploitation of modern communication technologies to influence, recruit, and exploit others to perpetrate ideologically driven acts of violence. Undertaking such a multipronged study requires not only looking at the personal and sociological appeals that extreme ideology exerts but also considering how to create political, administrative, educational, and economic conditions to …
Free Speech And The Confluence Of National Security And Internet Exceptionalism, Alan K. Chen
Free Speech And The Confluence Of National Security And Internet Exceptionalism, Alan K. Chen
Fordham Law Review
In this Article, I argue that, notwithstanding these contemporary developments, the Court got it mostly right in Brandenburg. Or, I want to at least suggest that it is premature to reconstruct the Brandenburg test to address perceived changes in our global environment. For the most part, Brandenburg has succeeded in mediating the balance between protecting political or ideological advocacy and enabling the government to regulate actual incitement, even in the contemporary era. Moreover, I argue that society should be especially wary of calls to narrow Brandenburg’s speech-protective standard because such changes might be significantly influenced by the confluence of two …

Terror On Your Timeline: Criminalizing Terrorist Incitement On Social Media Through Doctrinal Shift, Zachary Leibowitz
Terror On Your Timeline: Criminalizing Terrorist Incitement On Social Media Through Doctrinal Shift, Zachary Leibowitz
Fordham Law Review
The United States faces a barrage of threats from terrorist organizations on a daily basis. The government takes some steps to prevent these threats from coming to fruition, but not much is being done proactively. Any person can log into a social media account to preach hate and incite violence against the United States and its citizenry, and sometimes these words result in action. When speakers are not held accountable, they can continue to incite the masses to violent action across the United States. This Note proposes a new incitement doctrine to prevent these speakers from being able to spread …
A Content Analysis Of The Portrayal Of Refugees In U.S. News Media, Tambi Farouk Issac
A Content Analysis Of The Portrayal Of Refugees In U.S. News Media, Tambi Farouk Issac
Theses and Dissertations
This content analysis examined the portrayal of refugees in the United States by comparing four online news outlets—two conservative outlets: Fox News and Breitbart; and two liberal outlets: CNN and The New Yorker. Fox News and CNN are the most popular outlets among conservatives and liberals, respectively, while Breitbart and The New Yorker are the most polar. The study explored whether the frames used by online U.S. news outlets differ based on the ideological leaning of the outlet, specifically in regards to stories about refugees. Media outlets can influence the public opinion by controlling what they publish and …
Designed To Fail: The President’S Deference To The Department Of Justice In Advancing Criminal Justice Reform, Rachel E. Barkow, Mark Osler
Designed To Fail: The President’S Deference To The Department Of Justice In Advancing Criminal Justice Reform, Rachel E. Barkow, Mark Osler
William & Mary Law Review
One puzzle of President Obama’s presidency is why his stated commitment to criminal justice reform was not matched by actual progress. We argue that the Obama Administration’s failure to accomplish more substantial reform, even in those areas that did not require congressional action, was largely rooted in an unfortunate deference to the Department of Justice. In this Article, we document numerous examples (in sentencing, clemency, compassionate release, and forensic science) of the Department resisting common sense criminal justice reforms that would save taxpayer dollars, help reduce mass incarceration, and maintain public safety. These examples and basic institutional design theory all …

Private Life Safety Provision In Digital Age, Olga Anatolyevna Kuznetsova, Natalia Bondarenko
Journal of Digital Forensics, Security and Law
Digital technology nowadays covers all the spheres of life of an individual and society’s activities. With this, it is not a secret that it can be used both for the benefit and to the detriment of the person. In digital age, private life is becoming most vulnerable to arbitrary interference. This article considers various violations of the rights to privacy, communication safety and inviolability of privacy security brought in by the digital revolution. The article concludes that the most important task in the sphere of private life safety is to find a balance of interests of the state, the society …
A Quantitative Examination Of The Relationship Between Servant Leadership And Age On Organizational Commitment In Faith-Based Organizations, Frank Deno
Doctoral Dissertations and Projects
Servant leadership has grown slowly over the past four decades as an organizational style of leadership. Servant leadership is an excellent style for developing followers into their full potential, as it focuses first on the individual, while simultaneously developing capacity to achieve organizational goals. The workforce is constantly circulating, with older workers retiring and younger workers coming into the workforce. There are many factors influencing workers’ commitment to their organization, age is one of these factors and perception of leadership is another. Younger workers have different needs and different motivations than older workers. Faith-based organizations are a smaller segment of …

The Legal Regulation Of U.S. Crowdfunding: An Organically Evolving Patchwork, Joan Macleod Heminway
The Legal Regulation Of U.S. Crowdfunding: An Organically Evolving Patchwork, Joan Macleod Heminway
Scholarly Works
The legal regulation of crowdfunding in the United States is neither well calibrated nor holistic. With the exception of specific securities regulation legislation, the regulation of crowdfunding under U.S. law exists as an extension of principles of pre-existing regulation to a specific new and continually changing Internet-based financing space. As a result, while some common consumer protection objectives can be identified, the legal regulatory approach to crowdfunding did not develop through deliberate, rational choice based on coherent public policy objectives. Instead, it arose and evolved by necessity in response to the spontaneous and natural origination and development of crowdfunding as …

Older Adult Knowledge And Behavior Change In The Stepping On Fall Prevention Program In A Community Setting, Jane Strommen, Sean E. Brotherson, Zhen Yang
Older Adult Knowledge And Behavior Change In The Stepping On Fall Prevention Program In A Community Setting, Jane Strommen, Sean E. Brotherson, Zhen Yang
Journal of Human Sciences and Extension
One out of every three Americans age 65 and over falls at least once annually. Fall-related injuries among older adults are a major public health concern, and prevention of falls has emerged as a key issue in avoiding the risks to mobility and health that exist due to falls. Stepping On is an evidence-based fall prevention program designed to help older adults take control of their fall risk factors, explore different behavioral steps, and reduce their fall risk. This study shares findings from evaluation efforts conducted with 182 older adult participants in Stepping On from 2013 to 2015. Older adults …
