Root And Branch: The Thirteenth Amendment And Environmental Justice, Mehmet K. Konar-Steenberg

Forty years since the birth of the environmental justice movement, environmental injustice persists. One reason is the failure to identify a viable constitutional root for environmental justice doctrine in either the Fourteenth Amendment or Commerce Clause. Accordingly, this essay argues that the Thirteenth Amendment might provide a fertile environment for a flourishing law of environmental justice.
Part I will describes how environmental justice’s distributive justice vision was at odds with environmental law’s positivist, proceduralist core, and how that difference helps to account for the constitutional difficulties that followed. The Case For Streamlining Emergency Declaration Authorities And Adapting Legal Requirements To Ever-Changing Public Health Threats, Gregory Sunshine

This Article makes the case for streamlining emergency declaration authority and creating an adaptable legal system. Part I describes the utility of emergency declarations, but gives examples of how that utility can be diminished when states divide specific emergency powers across various types of declarations. Part II explores gubernatorial emergency powers to suspend or waive laws as an adaptable solution for removing legal barriers to an efficient and effective emergency response. Space debris is a growing public safety problem. As described by the Kessler Syndrome, the increasing accumulation of debris will soon hinder and eventually preclude access to outer space unless the trend is swiftly reversed. The Inter-Agency Space Debris Coordination Committee’s (IADC) Space Debris Mitigation Guidelines, as adopted by the United Nations (UN) Committee for the Peaceful Uses of Outer Space (COPUOS), are voluntary but are enforced as mandatory regulations by major space powers; however, the guidelines only apply to new debris. When a person is forced to flee their home due to violence or the fear of persecution, they must seek refuge elsewhere – either within the borders of their home country or in a new country. Those who travel to another country in search of safety and protection are known as refugees, and as world conflicts continue, the number of refugees around the world is steadily increasing. As refugees integrate into their new communities, they often receive support from nonprofit organizations once government assistance has ceased. This background study focuses on the right to freedom of movement of refugees. It reviews the law pertaining to this freedom from the perspective of the spatial journey of refugees. This focus on the law means that extralegal considerations will not be taken into consideration. The analysis will not proceed from any perceived need for limits that should be accepted as “a product of realism about the strains that migration, especially high-volume migration or sudden influxes, can bring to a society.”

American attitudes toward immigration shift with changes in the nation's economic and political climate. While waves of immigration to the United States are motivated by various factors, the extent to which immigrants are welcomed in the country does not consider these motivations. Rather, American perspectives of immigration vary by region and are informed by local economies and ideological majorities. Thus, while some localities work closely with federal immigration officials to facilitate federal regulatory schemes, other localities adopt policies that prohibit cooperation with federal immigration law, becoming "sanctuary cities" for undocumented immigrants. 6,083 Dogs Shot And Killed: The Unknown Puppycide Epidemic In America, Genette Gaffney
Animal Law Review
Wrongful police killings of companion dogs is gaining attention on local and national levels. Efforts to hold officers accountable are often stalled by a qualified immunity provided to officers under the Fourth Amendment and the lack of state laws and policies providing protection to domesticated animals. This article examines case law on qualified immunity—and state statutes offering canine protection—and suggests different policies that may be implemented to afford better protection to our pets and citizens. Part I provides a brief background on why dog shootings persist and provides examples of dogs shot and killed by police. Part II discusses and …
