Development Of On-Shore Behavior Among Polar Bears (Ursus Maritimus) In The Southern Beaufort Sea: Inherited Or Learned?, Kate M. Lillie, Eric M. Gese, Todd C. Atwood, Sarah A. Sonsthagen

United States Department of Agriculture Wildlife Services: Staff Publications

Polar bears (Ursus maritimus) are experiencing rapid and substantial changes to their environment due to global climate change. Polar bears of the southern Beaufort Sea (SB) have historically spent most of the year on the sea ice. However, recent reports from Alaska indicate that the proportion of the SB subpopulation observed on-shore during late summer and early fall has increased. Our objective was to investigate whether this on-shore behavior has developed through genetic inheritance, asocial learning, or through social learning. From 2010 to 2013, genetic data were collected from SB polar bears in the fall via hair snags …

Human–Black Bear Conflicts, Carl W. Lackey, Stewart W. Breck, Brian F. Wakeling, Bryant White Jan 2018

Human–Black Bear Conflicts, Carl W. Lackey, Stewart W. Breck, Brian F. Wakeling, Bryant White

United States Department of Agriculture Wildlife Services: Staff Publications

Most human–black bear (Ursus americanus) conflict occurs when people make anthropogenic foods like garbage, dog food, domestic poultry, or fruit trees available to bears. Bears change their behavior to take advantage of these resources and may damage property or cause public safety concerns in the process. Managers are often forced to focus efforts on reactive non-lethal and lethal bear management techniques to solve immediate problems, which do little to address root causes of human–bear conflict. As long as bears find easy access to garbage, bird feeders, urban fruit trees, and other food subsidies, conflicts are likely to continue. …

From The Dark Tower: Unbridled Civil Asset Forfeiture, Saleema Saleema Snow

Journal Articles

The Black Lives Matter movement reinforces that race dominates all aspects of the judicial system. Police officers are significantly more likely to stop African Americans than Whites. Even when a stop or arrest is unwarranted, law enforcement agencies can still profit from the property seized under the guise of forfeiture statutes. Various state and federal civil asset forfeiture statutes legitimize law enforcement seizing cash, homes, cars, and office equipment—all with nominal due process protections. Despite evidence of discriminatory police practices, the U.S. Supreme Court deems these forfeiture practices constitutional.

This article seeks to reignite the conversation about discriminatory policing and …

Predictive Analytics In The Criminal Justice System: Media Depictions And Framing, Kar Mun Cheng Jan 2018

Predictive Analytics In The Criminal Justice System: Media Depictions And Framing, Kar Mun Cheng

Honors Program Theses

Artificial intelligence and algorithms are increasingly becoming commonplace in crime-fighting efforts. For instance, predictive policing uses software to predetermine criminals and areas where crime is most likely to happen. Risk assessment software are employed in sentence determination and other courtroom decisions, and they are also being applied towards prison overpopulation by assessing which inmates can be released. Public opinion on the use of predictive software is divided: many police and state officials support it, crediting it with lowering crime rates and improving public safety. Others, however, have questioned its effectiveness, citing civil liberties concerns as well as the possibility of …

Entertainment As Crime Prevention: Evidence From Chicago Sports Games., Hannah S. Lacqueur, Ryan W. Copus Jan 2018

Entertainment As Crime Prevention: Evidence From Chicago Sports Games., Hannah S. Lacqueur, Ryan W. Copus

Faculty Works

The concern that mass media may be responsible for aggressive and criminal behavior is widespread. Comparatively little consideration has been given to its potential diversionary function. This paper contributes to the emerging body of literature on entertainment as a determinant of crime by analyzing Chicago by-the-minute crime reports during major sporting events. Sports provide an exogenous infusion of TV diversion that we leverage to test the effect of entertainment on crime. Because the scheduling of a sporting event should be random with respect to crime within a given month, day of the week, and time, we use month-time-day-of-week fixed effects …

Street Harassment: The Need For Criminal Remedies, Sonja Arndt Jan 2018

Street Harassment: The Need For Criminal Remedies, Sonja Arndt

UC Law SF Journal on Gender and Justice

This article shines light on the lack of street harassment laws in the United States, while outlining why there is an immediate need for these types of laws. The author seeks to develop a working legal definition of street harassment, while subcategorizing street harassment into three separate categories: catcalling, verbal sexual harassment, and verbal sexual assault. Lastly, the author puts forth a legal proposal which would criminalize verbal sexual harassment and verbal sexual assault.

The Legal Implications Under Federal Law When States Enact Biology-Based Transgender Bathroom Laws For Students And Employees, Marka B. Fleming, Gwendolyn Mcfadden-Wade

UC Law SF Journal on Gender and Justice

Recently, numerous states have considered enacting transgender bathroom laws based on the individual’s biological sex. In some cases, when these biology-based laws have been enacted, the results have been lawsuits filed by students and employees claiming violations of Title IX and Title VII. Actually, the legal rights of transgender students and employees when using public restrooms or facilities has become a hot topic of debate in recent times. In addressing this hotly debated topic, this article focuses on the transgender bathroom issue at the state level and provides insight into the attempts by states to turn policy into law. First, …

Clash Of The First And Second Amendments: Proposed Regulation Of Armed Protests, Katlyn E. Deboer Jan 2018

Clash Of The First And Second Amendments: Proposed Regulation Of Armed Protests, Katlyn E. Deboer

UC Law Constitutional Quarterly

The United States has strayed far from its traditional use of citizen militias to demand freedom from the British and has taken a deep dive into a practice of flaunting weapons at political protests as a display of bravado to provoke fear, chill opposition, and reap media attention. The recent "Unite The Right" rally in Charlottesville, Virginia, and its resulting violent pandemonium brought the issue of open carry protests to the forefront of public discourse. Armed protesters cling to their First and Second Amendment rights as shields to justify the semiautomatic firearms slung about their backs, but is this faith …

Hating Hate Speech: Why Current First Amendment Doctrine Does Not Condemn A Careful Ban, Rory K. Little Jan 2018

Hating Hate Speech: Why Current First Amendment Doctrine Does Not Condemn A Careful Ban, Rory K. Little

UC Law Constitutional Quarterly

In the wake of the 2017 Charlottesville protests and the recent revival of "white supremacy" rallies, some constitutional scholars have asserted once again that a "hate speech ban" is unconstitutional under the First Amendment. There are certainly strong policy and historical arguments to oppose such a ban, although the Supreme Court upheld such a ban in 1942 and has never overruled that precedent. The doctrinal objection to such a ban is based on a restrictive adoption of Brandenburg v. Ohio, and a failure to fully explicate the alternative ground for prohibition found in the Supreme Court's repeated definition of "fighting …

Proceed With Caution: Hate Speech Regulation In Japan, Junko Kotani Jan 2018

Proceed With Caution: Hate Speech Regulation In Japan, Junko Kotani

UC Law Constitutional Quarterly

The Diet of Japan enacted the Hate Speech Elimination Act in 2016 amid heated debates over the appropriate role that the government should play in confronting the vulgar racist hate speech that had been permeating the country. The Act, however, does not criminalize or make illegal hate speech and is thus criticized by Professor Craig Martin. This Article argues that while the principles of freedom of speech under the Constitution of Japan may tolerate criminalization of narrowly defined hate speech, one should be cautious in advocating for immediate criminalization of racist hate speech in the country. This Article provides an …

Understanding Administrative Sanctioning As Corrective Justice, Eithan Y. Kidron Jan 2018

Understanding Administrative Sanctioning As Corrective Justice, Eithan Y. Kidron

University of Michigan Journal of Law Reform

When should a regulator prefer criminal sanctions over administrative sanctions? What procedural protections should apply if a process is labeled civil but the sanctions are, in fact, criminal in type? And can the state justifiably conduct parallel proceedings for punitive sanctions against the same person or entity for the same conduct?

Throughout the years, judges and scholars alike have tried to understand and classify administrative sanctioning. Common to all of these conceptions is their failure to provide a complete normative framework for this unique body of law, which in turn makes it difficult to identify its practical limits and to …

Traffic Management For Drones Flying In The City, B.S. Ali Jan 2018

Traffic Management For Drones Flying In The City, B.S. Ali

Research Publications (2016 to 2020)

Air Traffic Management (ATM) is designed based on the notion of a pilot navigating an aircraft from within the aircraft. Increasing demand for Unmanned Aircraft Systems (UAS) usage and its safe integration into segregated/non-segregated airspace, on the other hand, have raised a question on the adoption of the current ATM for the UAS Traffic Management (UTM). The Procedures for Air Navigation Services-Air Traffic Management (PAN-ATM) and Procedures for Air Navigation Services - aircraft operations (PAN-OPS) rules are both developed for manned flight operations. Therefore, this work (i) defines the UTM system and describes its envisioned functionalities; (ii) performs an exploratory …

Design, Development And Testing Of A Novel Power Augmented Cross-Axis-Wind-Turbine, Wen Tong Chong, Wan Khairul Muzammil, Kok Hoe Wong, Lip Huat Bernard Saw, Yung Jeh Chu, Xiao Hang Wang, Chin Tsan Wang

Research Publications (2016 to 2020)

The horizontal-axis-wind-turbine (HAWT) is popular in the wind power industry nowadays due to its high power extraction capability. However, the HAWT has some complications due to high turbulent, low speed and changing direction of wind, which inhibits its full performance. Some vertical-axis-wind-turbine (VAWT) designs were able to function well under these wind conditions but they usually produce less power compared to HAWT. Thus, a new type of wind turbine design is proposed to overcome the weaknesses of HAWT and VAWT namely the cross-axis-wind-turbine (CAWT). The CAWT has three vertical and six horizontal blades, which interacts with horizontal and vertical wind. …
