Fair Use And First Amendment: Without Fair Use, What Would You Freely Speak About?, Adam Blaier
Fair Use And First Amendment: Without Fair Use, What Would You Freely Speak About?, Adam Blaier
Pace Intellectual Property, Sports & Entertainment Law Forum
The question this paper tries to answer is: Without fair use, what would you freely speak about? This paper will seek to demonstrate that the Copyright Clause’s Fair Use doctrine, and the First Amendment are cousins who help each other, rather than enemies sworn to destroy each other as some believe. First I will give a brief overview and history of each doctrine. Next I will speak about three areas where I believe fair use and the First Amendment cross paths extensively. These areas are: (1) school/education; (2) social media and news; and (3) sports images/broadcasting. Finally, I will demonstrate …

With Major Professional Sports Franchises On Their Way Into Las Vegas, The Problems With The Professional And Amateur Sports Protection Act (Paspa) Need To Be Addressed, Anthony J. Sanfratello
Pace Intellectual Property, Sports & Entertainment Law Forum
This note will set out to prove why PASPA is no longer effective and why reform is needed. With the state of New Jersey leading the fight, change is on the horizon. First, the history of gambling laws in the United States will be covered. Next, the legal and other supplemental arguments for and against PASPA will be discussed. Additionally, the pivotal role that each major professional sports league plays in the arguments for and against reform, with specific focus on professional teams moving to Las Vegas, will be examined. Lastly, the current state of gambling laws in this country …
Improving The Indigent Defense Crisis Through Decriminalization, Bryan Altman
Improving The Indigent Defense Crisis Through Decriminalization, Bryan Altman
Arkansas Law Review
“The Sixth Amendment stands as a constant admonition that if the constitutional safeguards it provides be lost, justice will not still be done.” The constitutional right to the assistance of counsel in criminal prosecutions is one of the many safeguards contained within the Sixth Amendment designed to protect the fundamental human rights of life and liberty. Unfortunately, for indigent defendants that safeguard of life and liberty operates as a mere platitude today. Stephen Bright, founder of the Southern Center for Human Rights, has bleakly summarized the crisis of indigent defense, noting that while the right to counsel is widely celebrated, …

Civil Society And Cybersurveillance, Andrew Mccanse Wright
Arkansas Law Review
There is no such thing as benign surveillance. It always comes with costs because of the chill it visits upon conduct, education, associations, and expression. Government surveillance has been magnified by cybersurveillance in the Digital Age to a degree unimaginable by the Founders of the United States of America.

Regulation of occupational licensing has garnered national attention. During the last sixty years, the number of occupations regulated by governmental entities has notably increased. As the number of regulated occupations increases, employment opportunities and wages for individuals who cannot afford or otherwise meet licensing requirements decrease.

Space Traffic Management Conference
UTM, ATM, STM… slices of the sky?
This paper will examine the functional differences between Unmanned Aircraft Traffic Management Systems, Air Traffic Management Systems, and Space Traffic Management. Understanding both the similarities between the systems and the different functional requirements of each concept is critical in the discussion and development of STM. While there are many commonalities in each area, it is important to understand how the different environments affect the ability to develop policies, procedure and technologies to manage the vehicles operating in the distinct environment. Both technical and legal frameworks will be discussed.

Pretrial Risk Assessment Tool Developed For Alaska, Cravez N/A
Vols 31-36 (2014-2019)
Beginning January 1, 2018, judicial officers, defense attorneys, and prosecuting attorneys in all Alaska courts began to receive information from a new pretrial risk assessment tool that calculates whether a defendant is at low, moderate, or high risk for failure to appear at trial or to commit another crime if the defendant is released pretrial. The tool, incorporated in Alaska’s new bail statute, aids in the judicial officer’s decision regarding pretrial bail conditions. This article looks at risk assessment tools in general and describes the development of Alaska’s pretrial risk assessment tool.

Expanded View Of Recidivism In Alaska, Valle N/A
Vols 31-36 (2014-2019)
This article describes findings on recidivism over an eight-year period for individuals released from Alaska Department of Corrections facilities in 2007. These findings emerged from the Alaska Results First (RF) analysis released by Alaska Justice Information Center (AJiC) in October 2017. In general, the RF findings corroborate previous analyses which examined recidivism patterns one to three years after release, but by following offenders for eight years, AJiC is expanding our understanding of recidivism patterns in Alaska for a large group of offenders, beyond any prior study.

Acta of Turin Polytechnic University in Tashkent
For selection and design of the precise parameters of shear cutting area of ERA GLONASS system, it is crucial to know the values of acceptable force, energy and speed. Accurate values of shearing force and energy can only be obtained from the actual force-penetration characteristics for specific applications. Actual force-penetration characteristics for all varieties of metal having different compositions and in use at various temperatures are not always available. The paper describes control system (closed loop) for shear cutting are of ERA GLONASS system and their correlations. The objective is this processes are impart a desired curvature to a workpiece …

The Slippery Slope Of "Unique", Daniel J. Julius
The Slippery Slope Of "Unique", Daniel J. Julius
Journal of Collective Bargaining in the Academy
That higher education may not be considered unique by various courts, labor boards, arbitrators, law firms, and others who facilitate (control) the labor relations process is a decidedly unpopular notion among many academic leaders, faculty, and others. I would argue that universities are organizations providing important individual and societal outcomes which can be measured, but may not be unique for the purposes of labor relations.

U.S. Vs. Europe In Higher Education, Aldemaro Romero Jr.
Publications and Research
Last week, while in Spain, I had the chance to speak with several higher education officials about how academia compares between Europe and the U.S. As someone who received his under-graduate degree in Europe and his graduate education in the U.S. many years ago, I was very intrigued. And this is what I found out.
When I went to college at the Universitat de Barcelona in Spain, European undergraduate degrees were five years. During those five years, all the subjects that you took were both a year long, and also were all related to your field of study. The advantage …
