Approaches To Communicating Flooding Information In Hampton Roads: Results From Surveys Of Local Government Staff, Ashley M. Gordon, Michelle Covi
Presentations, Lectures, Posters, Reports
The objectives of this report are to identify current communication strategies regarding coastal flooding and present opportunities for improvement and collaboration within the Hampton Roads region. The Hampton Roads Planning District Commission partnered with Old Dominion University to design two surveys of local government staff, the first regarding flooding outreach and the second regarding flooding notification methods. This report summarizes the results of each survey and synthesizes challenges described by respondents. Opportunities and resources, including local initiatives and guides developed by federal agencies and emergency notification providers, are highlighted to assist local government staff in addressing challenges related to flooding …
The American Deep State, Jon D. Michaels
The American Deep State, Jon D. Michaels
Notre Dame Law Review
This Article, written for the Notre Dame Law Review Symposium on Administrative Lawmaking in the Twenty-First Century, considers the notion of bureaucratic depth and what it means in the American context. In what follows, I argue that the American deep state has very little in common with those regimes usually understood to harbor deep states; that, far from being shadowy or elitist, the American bureaucracy is very much a demotic institution, demographically diverse, highly accountable, and lacking financial incentives or caste proclivities to subvert popular will; that demotic bureaucratic depth of the American variety should be celebrated, not feared; …
Snake Oil Speech, Jane R. Bambauer
Snake Oil Speech, Jane R. Bambauer
Washington Law Review
Snake oil is dangerous only by way of the claims that are made about its healing powers. It is a speech problem, and its remedy involves speech restrictions. But First Amendment doctrine has struggled to find equilibrium in the balance between free speech and the reduction of junk science. Regulation requires the government to take an authoritative position about which factual claims are “true” and “false,” which is anathema to open inquiry. As a result, free speech jurisprudence overprotects factual claims made in public discourse out of respect for any remote possibility that the scientific consensus might be wrong but …

Heller‘S Collateral Damage: As-Applied Challenges To The Felon-In-Possession Prohibition, Carly Lagrotteria
Heller‘S Collateral Damage: As-Applied Challenges To The Felon-In-Possession Prohibition, Carly Lagrotteria
Fordham Law Review
A longstanding firearm regulation in the United States prohibits individual convicted of felonies and certain misdemeanors from possessing a firearm. Following the U.S. Supreme Court’s decision in District of Columbia v. Heller, waves of litigation challenged, among other laws, the felon-in-possession prohibition. Due to the lack of clarity in Heller and the Court’s refusal to address it, there is an unsettling circuit split over whether and how an individual can mount an as-applied challenge to the felon-in-possession prohibition. A decade after Heller, the Third Circuit upheld the first successful asapplied challenge while four circuits have denied the permissibility …

Crumpling Effects And Specific Absorption Rates Of Flexible Amc Integrated Antennas, Sima Noghanian, Ala Alemaryeen
Crumpling Effects And Specific Absorption Rates Of Flexible Amc Integrated Antennas, Sima Noghanian, Ala Alemaryeen
Electrical Engineering Faculty Publications
This study presents the design of a wearable textile-based monopole antenna integrated with a flexible artificial magnetic conductor (AMC). The proposed design covers the industrial, scientific, and medical 2.45 GHz band. An AMC reflector is utilised to isolate the human body from undesired electromagnetic radiation and to improve the antenna radiation characteristics. A monopole antenna was backed with an AMC reflector and tested in free space and on human body models. The inclusion of an AMC reflector increases the front-to-back ratio and antenna gain in free space. On the human body models, the AMC antenna provides stable performance and a …

What's The "Use": Vehicle Maintenance Liability Barred By Sovereign Immunity Amendment Intended To Promote Waiver, Clayton Kendrick
What's The "Use": Vehicle Maintenance Liability Barred By Sovereign Immunity Amendment Intended To Promote Waiver, Clayton Kendrick
Mercer Law Review
Local government is an active participant in most communities. It picks up trash weekly, keeps tap water clean, and keeps citizens safe. Local government is the cog that keeps communities running smoothly, and as such, is afforded certain protections. One of those protections is the protection from lawsuits brought by citizens. This is known as the doctrine of sovereign immunity. While local government reaches out into the community to keep citizens comfortable and safe, sovereign immunity keeps citizens from reaching in and exposing the government to liability. At times, however, these protections can seem unjust. In 2002, the Georgia General …
Fifty Shades Of Gray Infrastructure: Land Use And The Failure To Create Resilient Cities, Jonathan Rosenbloom
Fifty Shades Of Gray Infrastructure: Land Use And The Failure To Create Resilient Cities, Jonathan Rosenbloom
Washington Law Review
Land use laws, such as comprehensive plans, site plan reviews, zoning, and building codes, greatly affect community resilience to climate change. One often-overlooked area of land use law that is essential to community resilience is the regulation of infrastructure on private property. These regulations set standards for infrastructure built by private developers. Such infrastructure is completed in conjunction with millions of commercial and residential projects and is necessary for critical services, including potable water and energy distribution. Throughout the fifty states, these land use laws regulating infrastructure constructed by private developers encourage or compel “gray infrastructure.” Marked by human-made, engineered …
Sentiment Analysis Of Twitter Data, Evan L. Munson
Sentiment Analysis Of Twitter Data, Evan L. Munson
Theses and Dissertations
The rapid expansion and acceptance of social media has opened doors into users’ opinions and perceptions that were never as accessible as they are with today's prevalence of mobile technology. Harvested data, analyzed for opinions and sentiment can provide powerful insight into a population. This research utilizes Twitter data due to its widespread global use, in order to examine the sentiment associated with tweets. An approach utilizing Twitter #hashtags and Latent Dirichlet Allocation topic modeling were utilized to differentiate between tweet topics. A lexicographical dictionary was then utilized to classify sentiment. This method provides a framework for an analyst to …

Planning For An Age-Friendly Belmont, Jan Mutchler
Center for Social and Demographic Research on Aging Publications
Belmont is a primarily residential community of around 25,000 residents with a small commercial district. Public transit access to downtown Boston and neighboring Cambridge offers Belmont residents access to services, employment, and recreational activities outside of the town’s boundaries. With 22% of its population age 60 and older, Belmont is expecting to see an increase in the number of older residents in the coming years. Commissioned by the Belmont Council on Aging (COA), this report will serve to help the COA and Town to better understand Belmont’s current assets, potentials, and challenges and to plan for changing community needs.

Drought And Public Necessity: Can A Common-Law “Stick” Increase Flexibility In Western Water Law?, Robin Kundis Craig
Drought And Public Necessity: Can A Common-Law “Stick” Increase Flexibility In Western Water Law?, Robin Kundis Craig
Utah Law Faculty Scholarship
Drought is a recurring—and likely increasing—challenge to water rights administration in western states under the prior appropriation doctrine, where “first in time” senior rights are often allocated to non-survival uses such as commercial agriculture rather than to drinking water supply for cities. While states and localities facing severe drought have used a variety of voluntary programs to re-allocate water, these programs by their very nature cannot guarantee that water will in fact be redistributed to the uses that best promote public health and community survival.
Using the example of the Brazos River drought of 2010 to 2013, this Article explores …
Fast Times In Federal Court And The Need For Flexibility, K. Michael Moore
Fast Times In Federal Court And The Need For Flexibility, K. Michael Moore
Fordham Law Review
The shifting landscape of criminal prosecutions involving designer drugs presents several novel legal issues. There are different ways to address these issues when they are the result of the production, possession, or distribution of as-of-yet unregulated substances. One way is for the legislature to enact appropriate legislation as quickly as the need for regulation or criminalization arises—a lofty, if not unrealistic, goal. The other is to guide the courts with general principles of applicability—the approach adopted by Congress through the enactment of the Analogue Act. This small but unfortunately quickly expanding area of federal criminal law supports the notion that …
A (Partial) Defense Of Section 501(C)(4)'S “Catchall” Nature, Lloyd Histoshi Mayer
A (Partial) Defense Of Section 501(C)(4)'S “Catchall” Nature, Lloyd Histoshi Mayer
Journal Articles
Internal Revenue Code section 501(c)(4) provides exemption from federal income tax for “social welfare” organizations. The vagueness of this term and the failure of the Treasury Department and Internal Revenue Service to interpret it in a manner that would significantly limit that vagueness has led some commentators to criticize this section’s “catchall” nature. While much scholarly attention has been paid to this criticism with respect to the most visible section 501(c)(4) organizations, particularly those involved in political campaign activity and lobbying, almost no attention has been paid to the many less common types of section 501(c)(4) organizations that illustrate that …
Forecasting Lightning Cessation Using Dual-Polarization Radar And Lightning Mapping Array Near Washington, D.C., Nancy M. Holden
Forecasting Lightning Cessation Using Dual-Polarization Radar And Lightning Mapping Array Near Washington, D.C., Nancy M. Holden
Theses and Dissertations
Accurate forecasts of thunderstorms are important to space launch, aviation, and public safety. While prior studies have primarily focused on atmospheric conditions leading to lightning onset, less research has been dedicated to the challenging problem of predicting lightning cessation. This study verifies the probabilistic lightning cessation model developed by Joseph Patton (2017) at Florida State University for use by the U.S. Air Force's 45th Weather Squadron at Cape Canaveral Air Force Station (CCAFS) and the National Aeronautics and Space Administration (NASA) Kennedy Space Center (KSC). The Washington, D.C. greater metropolitan area, which presents a climate different to that of central …
