“What Were You Wearing?”: Victimization Of Sexual Assault Victims At Cal Poly, Joanna Birns Mar 2018

“What Were You Wearing?”: Victimization Of Sexual Assault Victims At Cal Poly, Joanna Birns

Cal Poly's History: Student Research Reports

This paper will argue that Cal Poly and San Luis Obispo place greater blame and responsibility on women victims of sexual assault than their perpetrators. Sexual assault and sexual assault prevention methods in local media will be examined, as will three recent Title IX cases of Cal Poly students. Placing abundant blame and responsibility on the victims of sexual assault creates a culture of victimization, which discourages victims from reporting their sexual assaults. Although this paper does not offer up suggestions of how we can better Cal Poly’s approach to sexual assault, it hopes to spark a conversation about improving …

The Current Predatory Nature Of Land Contracts And How To Implement Reforms, Stacy Purcell Mar 2018

The Current Predatory Nature Of Land Contracts And How To Implement Reforms, Stacy Purcell

Notre Dame Law Review

Because land contracts are frequently inequitable, advocates and legislators have called for enhanced regulation. This Note examines the imbalance of power between sellers and buyers during the formation of land contracts, the ways the law has attempted to lessen the inequality, and how to implement potential reforms. Part II discusses the history of land contracts and their recent resurgence since the 2008 housing crash. Part III explains that while current land contracts are often predatory, land contracts could potentially be a useful way for low-income individuals to become homeowners. Part IV outlines proposed national and state reforms. Part V makes …

Media Analysis Of City-Wide Local News Portrayals Of Youth Criminality: Worcester, Massachusetts, Andrea Boffice

Sustainability and Social Justice

This study consists of a comprehensive media analysis of local news in Worcester, Massachusetts that explores portrayals of youth criminality of an entire city’s local media landscape. It examines how local media portrayal of youth is primarily dominated by coverage of youth crime and youth victimization. As our nation is questioning our trust and reliability in ever-changing news, this study asks whether our local news, with the new platforms that are emerging, have been compromised in providing a fair portrayal of youth. Particularly, whether it fairly portrays Black and Latinx youth in representations of criminality proportional to crime occurring. During …

18 U.S.C. § 922(G)(1) Under Attack: The Case For As-Applied Challenges To The Felon-In-Possession Ban, Kari Lorentson

Notre Dame Law Review

Part I of this Note outlines the relevant statutory scheme governing the felon-in-possession ban, along with its applicable exceptions. Part II surveys landmark Supreme Court precedent related to the Second Amendment— namely, District of Columbia v. Heller and McDonald v. City of Chicago. In Part III, this Note conducts an overview of the current circuit split percolating in the courts of appeals. Part IV presents a rationale and justification for permitting judicial review of as-applied challenges to § 922(g)(1). Finally, Part V provides a critique of the Binderup analysis and puts forth an alternative standard to analyze similar cases.

The Preparedness Piñata: Knocking Out The Problems In Texas's Emergency Management Legal Framework To Enhance Performance At The Local Level, William S. Gribble Mar 2018

The Preparedness Piñata: Knocking Out The Problems In Texas's Emergency Management Legal Framework To Enhance Performance At The Local Level, William S. Gribble

Student Scholarship

Texas has a very comprehensive emergency management program that should be the envy of every state in the union. However, the manner in which we as a profession have achieved this may have inadvertently circumvented the proper administrative law procedures required in Texas. This has likely caused Texas to accidently engage in ad hoc rulemaking that--if left as is--could set the conditions to create a damaging friction between the state and municipal governments. That friction would erode the interoperability necessary to protect property and to save lives during a disaster. This Article provides: (1) a brief history of the development …

Solitary Troubles, Alexander A. Reinert Mar 2018

Solitary Troubles, Alexander A. Reinert

Notre Dame Law Review

Solitary confinement is one of the most severe forms of punishment that can be inflicted on human beings. In recent years, the use of extreme isolation in our prisons and jails has been questioned by correctional officials, medical experts, and reform advocates alike. Yet for nearly the entirety of American history, judicial regulation of the practice has been extremely limited. This Article explains why judges hesitate to question the use of solitary confinement, while also providing a path forward for greater scrutiny of the practice.

Incorrigible Students: A Criminal Oxymoron?, Shannon Lewry Mar 2018

Incorrigible Students: A Criminal Oxymoron?, Shannon Lewry

Notre Dame Law Review

The Note proceeds in two Parts. The remainder of the Introduction presents a closed door: the Supreme Court’s hesitancy, to date, to find juvenile- life-without-parole sentences unconstitutional under the Eighth Amendment. After exploring the contours of the closed Door, the Introduction turns to an open window: education law. This, I argue, may be wielded to attack the lawfulness of juvenile-life-without-parole sentences on wholly nonconstitutional grounds. The Introduction concludes with remarks regarding this Note’s relevance and timeliness. Part I tracks the Note’s central argument, premise by premise, that state compulsory education laws and juvenilelife- without-parole sentences are wholly incompatible. Part II …

Approaches To Communicating Flooding Information In Hampton Roads: Results From Surveys Of Local Government Staff, Ashley M. Gordon, Michelle Covi

Presentations, Lectures, Posters, Reports

The objectives of this report are to identify current communication strategies regarding coastal flooding and present opportunities for improvement and collaboration within the Hampton Roads region. The Hampton Roads Planning District Commission partnered with Old Dominion University to design two surveys of local government staff, the first regarding flooding outreach and the second regarding flooding notification methods. This report summarizes the results of each survey and synthesizes challenges described by respondents. Opportunities and resources, including local initiatives and guides developed by federal agencies and emergency notification providers, are highlighted to assist local government staff in addressing challenges related to flooding …

The American Deep State, Jon D. Michaels Mar 2018

The American Deep State, Jon D. Michaels

Notre Dame Law Review

This Article, written for the Notre Dame Law Review Symposium on Administrative Lawmaking in the Twenty-First Century, considers the notion of bureaucratic depth and what it means in the American context. In what follows, I argue that the American deep state has very little in common with those regimes usually understood to harbor deep states; that, far from being shadowy or elitist, the American bureaucracy is very much a demotic institution, demographically diverse, highly accountable, and lacking financial incentives or caste proclivities to subvert popular will; that demotic bureaucratic depth of the American variety should be celebrated, not feared; …

Snake Oil Speech, Jane R. Bambauer Mar 2018

Snake Oil Speech, Jane R. Bambauer

Washington Law Review

Snake oil is dangerous only by way of the claims that are made about its healing powers. It is a speech problem, and its remedy involves speech restrictions. But First Amendment doctrine has struggled to find equilibrium in the balance between free speech and the reduction of junk science. Regulation requires the government to take an authoritative position about which factual claims are “true” and “false,” which is anathema to open inquiry. As a result, free speech jurisprudence overprotects factual claims made in public discourse out of respect for any remote possibility that the scientific consensus might be wrong but …
