The Prison To Homelessness Pipeline: Criminal Record Checks, Race, And Disparate Impact, Valerie Schneider Apr 2018

The Prison To Homelessness Pipeline: Criminal Record Checks, Race, And Disparate Impact, Valerie Schneider

Indiana Law Journal

Study after study has shown that securing housing upon release from prison is critical to reducing the likelihood of recidivism,1 yet those with criminal records— a population that disproportionately consists of racial minorities—are routinely denied access to housing, even if their offense was minor and was shown to have no bearing on whether the applicant would be likely to be a successful renter. In April of 2016, the Office of General Counsel for the United States Department of Housing and Urban Development (HUD) issued much anticipated guidance dealing directly with the racially disparate impact of barring those with criminal records …

The Fight Over Encryption: Reasons Why Congress Must Block The Government From Compelling Technology Companies To Create Backdoors Into Their Devices, Shannon Lear Apr 2018

The Fight Over Encryption: Reasons Why Congress Must Block The Government From Compelling Technology Companies To Create Backdoors Into Their Devices, Shannon Lear

Cleveland State Law Review

Advances in technology in the past decade have blurred the line between individuals’ privacy rights and the government’s ability to access information. How should this issue be handled in a manner that balances the privacy rights of individuals and the government’s access to information in the interest of national security?

This Note proposes a bright-line rule that would continue to allow the government to obtain specific information from a data service provider without forcing the company to circumvent its own security features. Under this rule, a company shall relinquish specific information in its control or possession only by court order …

"Safety In Numbers" And Bicycle Safety: A Detailed Analysis Of The Denver Metropolitan Area, Rachael Thompson Panik Apr 2018

"Safety In Numbers" And Bicycle Safety: A Detailed Analysis Of The Denver Metropolitan Area, Rachael Thompson Panik

All Theses

Recently across the US, there has been a push to accommodate and encourage the viability of alternative modes of transportation—especially bicycling. Leaders across all levels of government, trade groups, advocacy and policy groups, and others are promoting different methods to make urban areas more bikeable. Now, as planning practice is moving towards implementing a transportation system that serves different types of travelers, the US faces challenges involved with retrofitting existing automobile-oriented streets.

While implementing bicycle safety initiatives is becoming a popular movement among municipalities, there have been differing opinions on the best way to make cities more bikable in academic …

How Do Native American Women Win Elections In Non-Native Districts?, Opalina Peralta Apr 2018

How Do Native American Women Win Elections In Non-Native Districts?, Opalina Peralta

Political Science Theses and Capstones

In light of the recent tensions between Native American tribes and non-tribal elected leaders over such issues as environmental protection and treaty violations, caused in part by the United States' disproportionately Caucasian electoral representation, I aim to bring light the obstacles that Native Americans face in electoral politics. I analyze state legislative elections in which Native American candidates win. Using the data from the 2016 National Census and from University of North Dakota, Professor Mark Trahant. I hypothesize that the reason many Native American candidates win is because they are tied to non-native elements of the community. The two candidates …

Legalizing Assisted Dying: Cross Purposes And Unintended Consequences, Emily Jackson Apr 2018

Legalizing Assisted Dying: Cross Purposes And Unintended Consequences, Emily Jackson

Dalhousie Law Journal

In the UK, assisted dying continues to be unlawful, and pro-legalization campaigners have made use of human rights based applications for judicial review and Private Members Bills in order to try to change the law. Interestingly, however, the proposed statute would not offer an assisted death to many of the litigants who have sought to force Parliament's hand. This article considers whether this a one-off peculiarity, or whether there might be other mismatches between what the law can achieve and what matters most to people who are seeking an assisted death for themselves. It also explores what seems to be …

The Stakes In Steak: Examining Barriers To And Opportunities For Alternatives To Animal Products In Canada, Angela Lee Apr 2018

The Stakes In Steak: Examining Barriers To And Opportunities For Alternatives To Animal Products In Canada, Angela Lee

Dalhousie Law Journal

This Article considers some of the different food innovations being presented as potential solutions to the myriad problems associated with conventionalmodels of industrial agriculture. Specifically,in vitro meat (IVM) and plant-based alternatives to animal products-and their corresponding regulatory and market structuresare compared and contrasted. Examining the idiosyncrasies around Canada's approach to regulating these products reveals that the respective degrees of scrutiny may not be commensurate with the respective degrees of risk, due in part to the influence of powerful industry actors who wish to maintain the status quo. Given the significance and scope of the problems implicated by the industrial food …

A Critical Analysis Of The ‘Broken Windows’ Policing In New York City And Its Impact: Implications For The Criminal Justice System And The African American Community, Ngozi C. Kamalu, Emmanuel C. Onyeozili Apr 2018

A Critical Analysis Of The ‘Broken Windows’ Policing In New York City And Its Impact: Implications For The Criminal Justice System And The African American Community, Ngozi C. Kamalu, Emmanuel C. Onyeozili

African Journal of Criminology and Justice Studies

The broken windows approach is an aggressive crime fighting strategy instituted in New York City in the 1990s, emphasizing mass arrest of perpetrators of major as well as minor offenses. The impact resulted in disproportionate arrest of Black and Hispanic youths in comparison with Caucasians. Critics of broken windows strategy maintain that its success is exaggerated and oversold. They argue that the decline in crime in the city was not a consequence of the strategy, but due to improved economy, declining numbers of teenage males, and the decline in crack cocaine use. The broken windows strategy in fact yielded unintended …

Preparedness Of First Responders In Gwinnett County, Georgia: Barriers To Preparedness And The Impact Of Cognitive Biases, Jeffrey Lee Smith Apr 2018

Preparedness Of First Responders In Gwinnett County, Georgia: Barriers To Preparedness And The Impact Of Cognitive Biases, Jeffrey Lee Smith

Dissertations

While it is important for the public to be prepared for emergencies and disasters, it is perhaps more important for first responders, as members of the public, to be prepared for emergencies and disasters, so they may do the job the public expects of them. This study explores the preparedness of first responders in a large, diverse, and heavily populated metro-Atlanta county. It also investigates impediments to these first responders being better prepared and the role cognitive biases play in preparedness for this group. The study finds that the study population, as a whole, is underprepared. The research also reveals …

Fourth Amendment Constraints On The Technological Monitoring Of Convicted Sex Offenders, Ben A. Mcjunkin, Jj Prescott Apr 2018

Fourth Amendment Constraints On The Technological Monitoring Of Convicted Sex Offenders, Ben A. Mcjunkin, Jj Prescott

Law & Economics Working Papers

More than forty U.S. states currently track at least some of their convicted sex offenders using GPS devices. Many offenders will be monitored for life. The burdens and expense of living indefinitely under constant technological monitoring have been well documented, but most commentators have assumed that these burdens were of no constitutional moment because states have characterized such surveillance as “civil” in character — and courts have seemed to agree. In 2015, however, the Supreme Court decided in Grady v. North Carolina that attaching a GPS monitoring device to a person was a Fourth Amendment search, notwithstanding the ostensibly civil …

The Surveillance Gap: The Harms Of Extreme Privacy And Data Marginalization, Michele Gilman, Rebecca Green Apr 2018

The Surveillance Gap: The Harms Of Extreme Privacy And Data Marginalization, Michele Gilman, Rebecca Green

Faculty Publications

We live in an age of unprecedented surveillance, enhanced by modern technology, prompting some to suggest that privacy is dead. Previous scholarship suggests that no subset of the population feels this phenomenon more than marginalized communities. Those who rely on public benefits, for example, must turn over personal information and submit to government surveillance far more routinely than wealthier citizens who enjoy greater opportunity to protect their privacy and the ready funds to secure it. This article illuminates the other end of the spectrum, arguing that many individuals who may value government and nonprofit services and legal protections fail to …

Unforeseen Land Uses: The Effect Of Marijuana Legalization On Land Conservation Programs, Jessica Owley Apr 2018

Unforeseen Land Uses: The Effect Of Marijuana Legalization On Land Conservation Programs, Jessica Owley

Journal Articles

This Article explores the tension between land conservation and marijuana cultivation in the context of legalization. The legalization of marijuana has the potential to shift the locations of marijuana cultivation. Where cultivation need no longer be surreptitious and clandestine, growers may begin to explore sanctioned growing sites and methods. Thus, the shift to legalization may be accompanied by environmental and land-use implications. Investigating commercial-scale marijuana cultivation, this Article details how, in some ways, legalization can reduce environmental impacts of marijuana cultivation while also examining tricky issues regarding tensions between protected lands and marijuana cultivation. If we treat cultivation of marijuana …

New Mexico Tribal Cannabis: Policy, Politics, & Guidance For Government-To-Government Cooperation In State-Tribal Cannabis Compacting, Matthew Ramírez

Natural Resources Journal

The purpose of this article is three-fold. First, it aims to provide a systematic review of international, United States, state, and federal Indian law and policy surrounding cannabis cultivation, possession, and use in Indian Country. Second, it argues that the 2017 New Mexico tribal medical cannabis bills (SB 345 & HB 348), which were introduced in the first regular session of the New Mexico State Legislature and would have permitted the state to enter into intergovernmental agreements (or compacts) with tribes who choose to implement the state’s medical cannabis program on tribal lands, contained legal vulnerabilities likely to hinder their …

Whose Fault In An Aging World?: Comparing Dementia-Related Tort Liability In Common Law And Civil Law Jurisdictions, Trevor Ryan, Wendy Bonython Apr 2018

Whose Fault In An Aging World?: Comparing Dementia-Related Tort Liability In Common Law And Civil Law Jurisdictions, Trevor Ryan, Wendy Bonython

Washington International Law Journal

Age-related dementias have been identified as a global health priority, based on their rapidly rising incidence and associated economic burden. Behaviors symptomatic of dementias, such as wandering, potentially expose sufferers to increased likelihood of experiencing harm or causing harms to others. Yet what jurisprudence and case law exists on the issue of tortious liability of people with dementia is largely derived from the broader principles governing tortious liability of those with mental illness or otherwise impaired capacity. Those principles are themselves problematic, reflecting absolutist models of either personal liability (common law jurisdictions) or statutory personal immunity accompanied by imposition of …
