Paving A Path Between The Campus And The Chapel: A Revised Section 501(C)(3) Standard For Determining Tax Exemptions, John B. Parker

Emory Law Journal

Section 501(c)(3) of the Internal Revenue Code grants an exemption from federal income taxes to organizations that are formed for religious purposes. While religious tax exemptions are a deep-rooted principle long embodied in U.S. tax law, issues can arise when a tax-exempt institution engages in discrimination which conflicts with national public policy. The most famous example of this is the case of Bob Jones University v. United States, in which the Supreme Court revoked the tax-exempt status of a religious university for its racially discriminatory policies. The Court found that, because the government had expressed a unified opposition to race …

A Peek Under The Hood: Why Lawmakers Should Strengthen The Current Dmca Exemption For Security And Safety Research Into Car Software, Holden Benon

UC Law Business Journal

In the last five years, society has witnessed advancements in automobile technology that Henry Ford himself could not have dreamed. Vehicle software now allows cars to drive themselves; indeed, as of December 2017, close to four dozen vehicle manufacturers have received permits from the California Department of Motor Vehicles for autonomous testing. Many of the advancements in automobile technology involve copyright law, the primary body of law that protects computer source code. Essentially, each line of vehicle source code is protected the same way a film script is protected. Just as camera directions in the script are hidden from movie-goers, …

Searching For Humanitarian Discretion In Immigration Enforcement: Reflections On A Year As An Immigration Attorney In The Trump Era, Nina Rabin Jan 2019

Searching For Humanitarian Discretion In Immigration Enforcement: Reflections On A Year As An Immigration Attorney In The Trump Era, Nina Rabin

University of Michigan Journal of Law Reform

This Article describes one of the most striking features of the Trump Administration’s immigration policy: the shift in the way discretion operates in the legal immigration system. Unlike other high-profile immigration policies that have been the focus of class action lawsuits and public outcry, the changes to the role of discretion have attracted little attention, in part because they are implemented through low-visibility individualized decisions that are difficult to identify, let alone challenge systemically. After providing historical context regarding the role of discretion in the immigration system before the Trump Administration, I offer four case studies from my immigration practice …

What Can The Child Welfare System Learn In The Wake Of The Floyd Decision?: A Comparison Of Stop-And-Frisk Policing And Child Welfare Investigations, Michelle Burrell

City University of New York Law Review

This article will examine the history of the stop-and-frisk policy in New York City, the similarities and differences between the child welfare system and the criminal legal system, and suggest ways that we can combat the misconceptions around safe parenting and the assumed need for child protective intervention.

Evaluating The Military Police Corps' Active Shooter Preparedness Plan, Robert Lee Harris Jan 2019

Evaluating The Military Police Corps' Active Shooter Preparedness Plan, Robert Lee Harris

Walden Dissertations and Doctoral Studies

The Military Police Corps' active shooter preparedness plan is inadequate because several updated tactics, techniques, and procedures that have been developed over the past 20 years and implemented by civilian law enforcement agencies have not been incorporated, leaving the Corps less prepared during active shooter events. The purpose of this phenomenological study was to examine how Military Police Corps leaders trained their law enforcement and support personnel to respond to an active shooter event. The institutional analysis and development framework was used to analyze the day-to-day operational decisions within the Military Police Corps. Data for the qualitative case study were …

Ethics In 21st Century Art Conservation: Confederate Monuments, Kate L. Hoffman

Honors Theses

This paper explores the ethics surrounding the conservation of damaged confederate monuments, specifically as educational tools for understanding their place in society and memory over time. Much of this research has been conducted through the use of contemporary news sources and memory studies scholarship on account of the recent influx of interest towards the monuments and their controversies in the 21st century. The ultimate purpose of this paper is to provide an unbiased source of material for future scholarship in memory studies towards confederate monuments, for if damages dealt to the monuments are repaired, that portion of their physical history …

Harm, Sex, And Consequences, India Thusi Jan 2019

Harm, Sex, And Consequences, India Thusi

Articles by Maurer Faculty

At a moment in history when this country incarcerates far too many people, criminal legal theory should set forth a framework for reexamining the current logic of the criminal legal system. This Article is the first to argue that “distributive consequentialism,” which centers the experiences of directly impacted communities, can address the harms of mass incarceration and mass criminalization. Distributive consequentialism is a framework for assessing whether criminalization is justified. It focuses on the outcomes of criminalization rather than relying on indeterminate moral judgments about blameworthiness, or “desert,” which are often infected by the judgers’ own implicit biases. Distributive consequentialism …

Mechanics And Historical Evolution Of Sea Level Blowouts In New York Harbor, Praneeth Gurumurthy, Philip Orton, Stefan A. Talke, Nickitas Georgas, James F. Booth Jan 2019

Mechanics And Historical Evolution Of Sea Level Blowouts In New York Harbor, Praneeth Gurumurthy, Philip Orton, Stefan A. Talke, Nickitas Georgas, James F. Booth

Civil and Environmental Engineering Faculty Publications and Presentations

Wind-induced sea level blowouts, measured as negative storm surge or extreme low water (ELW), produce public safety hazards and impose economic costs (e.g., to shipping). In this paper, we use a regional hydrodynamic numerical model to test the effect of historical environmental change and the time scale, direction, and magnitude of wind forcing on negative and positive surge events in the New York Harbor (NYH). Environmental sensitivity experiments show that dredging of shipping channels is an important factor affecting blowouts while changing ice cover and removal of other roughness elements are unimportant in NYH. Continuously measured water level records since …

Computational Modeling And Simulations Of Condition Deterioration To Enhance Asphalt Highway Pavement Design And Asset Management, Zul Fahmi Bin Mohamed Jaafar Jan 2019

Computational Modeling And Simulations Of Condition Deterioration To Enhance Asphalt Highway Pavement Design And Asset Management, Zul Fahmi Bin Mohamed Jaafar

Electronic Theses and Dissertations

A nation’s economy and prosperity depend on an efficient and safe transportation network for public mobility and freight transportation. A country’s road network is recognized as one of the largest public infrastructure assets. About 93 percent of 2.6 million miles of paved roads and highways in the United States (U.S.) are surfaced with asphalt. Longitudinal roughness, pavement cracking, potholes, and rutting are the major reasons for rehabilitation of asphalt roads. Billions of dollars are required annually for the maintenance and rehabilitation of road networks. If timely maintenance and rehabilitation are not performed, the pavement damages inflicted by heavy traffic repetitions …

Insurmountable Burdens And Slippery Slopes: A Solution For Pleading Toxic Torts In The Plausibility Era, Zachry Sandifer Jan 2019

Insurmountable Burdens And Slippery Slopes: A Solution For Pleading Toxic Torts In The Plausibility Era, Zachry Sandifer

Southern Illinois University Law Journal

With its decisions in Bell Atlantic Corp. v. Twombly and Ashcroft v. Iqbal in 2007 and 2009, the Supreme Court ushered in a new era of federal pleading standards. The old system of notice pleading was replaced by what has become known as plausibility pleading. In order to avoid dismissal, plaintiffs must now craft their complaints so that all nonconclusory allegations, taken as true, give rise to a claim that is plausible on its face. Immediately after the Court’s decision in Twombly, a heated debate arose in the legal community over many aspects of the new pleading standard. Did it …

Return To Rehabilitation: Illinois’ Evolving Juvenile Sentencing Practices In Light Of Miller V. Alabama, Brad Taylor Jan 2019

Return To Rehabilitation: Illinois’ Evolving Juvenile Sentencing Practices In Light Of Miller V. Alabama, Brad Taylor

Southern Illinois University Law Journal

In Miller v. Alabama, the U.S. Supreme Court held that the Eighth Amendment requires a court to, prior to sentencing juveniles to life-without-parole, consider mitigating factors attendant to youth. The Court noted that a life-without-parole sentence was only appropriate punishment for a juvenile when the juvenile’s act reflected true incorrigibility. Given the transient nature of youthful characteristics, like impetuosity, true incorrigibility is vanishingly rare. As such, after Miller, the imposition of life-without-parole sentences for juveniles should be similarly rare.

As the birthplace of the juvenile justice system, Illinois holds a special place in the history of the American …

A Masterpiece Of Simplicity: Toward A Yoderian Free Exercise Framework For Wedding-Vendor Cases, Austin Rogers Jan 2019

A Masterpiece Of Simplicity: Toward A Yoderian Free Exercise Framework For Wedding-Vendor Cases, Austin Rogers

Marquette Law Review

The Free Exercise Clause was enacted to protect diverse modes of religious

practice. Yet certain expressions of free exercise have entailed concomitant

harm to those outside the religious community, especially LGBTQ persons.

This trend has been acutely present in the recent onslaught of wedding-vendor

cases: LGBTQ persons seek the enforcement of statutorily protected rights,

while religious objectors seek refuge from state intrusion under constitutional

shelter. Consequently, wedding-vendor cases present an area of law in which

free-exercise jurisprudence and anti-discrimination jurisprudence have been

clashing.

However, despite the primacy of religious freedom and equal protection in

American jurisprudence, courts analyze wedding-vendor cases …

The Impact Program: Increasing Employability Skills Of High School Students Through Adventure Based Learning, Titina Finch Brown Jan 2019

The Impact Program: Increasing Employability Skills Of High School Students Through Adventure Based Learning, Titina Finch Brown

PCOM Psychology Dissertations

High school students face unique challenges following graduation such as the rising costs of post-secondary education, demands from employers for a highly skilled workforce, and the desire of employers to hire workers who are not only technologically proficient, but also effective communicators and team players. Soft skills have become a commodity to businesses. High schools find themselves more and more responsible for adequately preparing students for a rapidly changing economy. Engaging instruction in social motional learning (SEL) for secondary students is essential in preparing them for this transition. Research shows that Adventure Based Learning (ABL) could be the vehicle for …

The "Uncanny Valley" And The Verisimilitude Of Sexual Offenders--Part I: An "Ethorobotic" Perspective, Michael T. Flannery Jan 2019

The "Uncanny Valley" And The Verisimilitude Of Sexual Offenders--Part I: An "Ethorobotic" Perspective, Michael T. Flannery

Texas A&M Law Review

This Article is the first in a series of three articles in which I explain the cycle of misperception of sexual offenders that has encouraged the unconstitutional application of sexual offender laws, including civil commitment laws, in a false effort to quell public fear, protect children, and reduce sexual victimization. In this first Article of the series, I propose that this cycle of misperception and the resistance to the release of civilly committed sexual offenders may be, in part, the product of a novel phenomenon known as the “uncanny valley” effect.

Reefer Madness: The Constitutional Consequence Of The Federal Government's Inconsistent Marijuana Policy, Zachary Ford Jan 2019

Reefer Madness: The Constitutional Consequence Of The Federal Government's Inconsistent Marijuana Policy, Zachary Ford

Texas A&M Law Review

In the past twenty years, the United States has witnessed over half of its states create marijuana laws that expressly contradict the federal government’s complete ban of the drug. Nine states have completely legalized marijuana for recreational use in the past five years alone. Meanwhile, much of the country remains staunchly opposed to legalization in any form. This difference between state and federal law has the largest negative impact on noncitizens, namely lawful permanent residents whom reside in states that follow the federal government’s complete ban. Congress’s Immigration and Nationality Act broadly defines “conviction,” so even minor drug convictions under …

Preventing Tax-Exempt Propaganda: The Case For Defining The Second Prong Of The Methodology Test, Jordanne Miller Jan 2019

Preventing Tax-Exempt Propaganda: The Case For Defining The Second Prong Of The Methodology Test, Jordanne Miller

Catholic University Law Review

Under current Treasury Regulations, various propaganda groups throughout the United States are exempt from paying federal income tax. This is so because the current test used by the IRS to determine tax-exempt eligibility, the methodology test, is incapable of separating wild propaganda from viewpoints supported by facts.

The IRS created the methodology test in the late 1970s/early 1980s. Since then, groups denied tax-exempt status have repeatedly challenged its validity. The IRS has responded, and the test has evolved. However, the second prong of the test remains undefined—it is still unclear what it means for facts to be “distorted.” This Comment …

The Impact Of Prescription Pain Reliever Misuse And Heroin Use On Morbidity And Mortality By Level Of Urbanicity: 2002-2014, M. Fe Caces, Peter J. Delany, Michael A. Cala Jan 2019

The Impact Of Prescription Pain Reliever Misuse And Heroin Use On Morbidity And Mortality By Level Of Urbanicity: 2002-2014, M. Fe Caces, Peter J. Delany, Michael A. Cala

Contemporary Rural Social Work Journal

Non-medical use of prescription pain relievers (PPRs), heroin, and more recently fentanyl, continue to have major public health consequences in the United States. This article analyzes trends in PPR and heroin use, emergency department and hospital stays, substance use treatment services, and mortality to assess the relative impact of the opioid crisis on rural versus more urbanized counties in the United States. Our findings suggest that while more urbanized counties have had greater increases in opioid use, rural and less urbanized counties tended to be more negatively impacted than larger and non-rural counties. Disparities in service availability highlight the need …
