Our City has a serious vacant property challenge. To effectively address vacancy, we must understand and respond to the factors that cause and perpetuate it. Much of the story of vacancy in our city, like other cities, includes a legacy of racism, disinvestment, and disengagement that has led to a breakdown in trust. We know that vacancy can result from incomplete foreclosure, bankruptcy, prolonged probate or lack of proper probate, investors with little incentive to care, judgment proof owners, bank ownership, lack of resources to repair or redevelop, lack of value, the foreclosure crisis, sprawl and weak markets.1 In …

Numbers Of Human Fatalities, Injuries, And Illnesses In The United States Due To Wildlife, Michael R. Conover
Human–Wildlife Interactions
I reviewed published and unpublished papers, government reports, and websites to estimate how many people are injured or killed each year by wildlife or stricken by a zoonotic disease. Over 47,000 people annually in the United States sought medical attention after being attacked or bitten by wildlife, and approximately 8 people died annually. Most bites were by snakes, birds, rodents, and raccoons (Procyon lotor). Each year, wildlife–vehicle collisions resulted in >59,000 human injuries and >440 human fatalities, while wildlife–aircraft collisions added 16 more injuries and 10 fatalities. I also found that >68,000 people each year sought medical …

Criminal Clear Statement Rules, Carissa Byrne Hessick, Joseph E. Kennedy
Criminal Clear Statement Rules, Carissa Byrne Hessick, Joseph E. Kennedy

There is a broad consensus in the criminal justice community that our criminal statutes are a mess: They are imprecise, overly broad, and overly punitive. Legislatures write these laws because there are significant political incentives for them to be “tough on crime” and few incentives for them to write carefully crafted laws. The problems of over-criminalization thus seem to be both a predictable yet intractable consequence of the incentives that legislatures face. But this Article offers a novel solution: Judges should develop new clear statement rules to interpret criminal statutes. The Supreme Court has created clear statement rules to protect …

Health Risks Of Firearm Ownership: A Patient Screening And Education Intervention, Aaron Kahn
Health Risks Of Firearm Ownership: A Patient Screening And Education Intervention, Aaron Kahn
DNP Scholarly Projects
BACKGROUND
There is significant health risk associated with firearm ownership. To address this risk a primary care-based intervention was designed and implemented to screen for firearm ownership, educate patients on the risks of gun ownership, and provide patients with resources for reducing associated health risks.
METHODS
A mixed methods study design was employed. Four primary care providers (PCP) practicing in family health volunteered to participate in this intervention. Focus groups with participating PCPs were conducted prior to the intervention to solicit recommendations for intervention protocol and assess participating PCPs current understanding of the health risks of firearm ownership, and after …
Law Enforcement Officers' Perceptions Of Their Skill Development And Transfer Of Learning Post-Training, Jane Northup
Law Enforcement Officers' Perceptions Of Their Skill Development And Transfer Of Learning Post-Training, Jane Northup
Open Access Dissertations
This research examined how law enforcement officers who took a course in criminal investigative techniques developed their skill and transferred what was learned post-training. The data was collected using document reviews and interviews. The participants were ten law enforcement officers who expected to use their newly acquired skill after leaving a course in criminal investigations. As a result of the qualitative multiple case study data analysis, four constructs were revealed as aids to the participants in transferring what was learned in the course and further improving their skills. The constructs were supports, experience, reflection, and motivation. The constructs can serve …

Carceral Camouflage: Inscribing And Obscuring Neoliberal Penality Through New York City's Borough-Based Jail Plan, Katie Wilson
Honors Papers
This project seeks to interrogate the socio-spatial implications of New York City's contemporary criminal justice machine through mayor Bill de Blasio's ongoing jail reform plan to build new, "borough-based jails." In 2017, following decades of controversy over entrenched violence and horrific abuses on Rikers Island, New York's notorious island penal colony, de Blasio announced a 10-year plan to "to close Rikers Island and replace it with a smaller network of modern jails." While the plan claims to make jails in New York "smaller, safer, and fairer," this project analyzes the plan's strategies, its rhetoric, and its goals to understand the …

At a moment in history when this country incarcerates far too many people, criminal legal theory should set forth a framework for reexamining the current logic of the criminal legal system. This Article is the first to argue that "distributive consequentialism, " which centers the experiences of directly impacted communities, can address the harms of mass incarceration and mass criminalization. Distributive consequentialism is a framework for assessing whether criminalization is justified ft focuses on the outcomes of criminalization rather than relying on indeterminate moral judgments about blameworthiness, or "desert, which are often infected by the judgers' own implicit biases. Distributive …

Evaluating The After Effects Of Successful Hazard Mitigation: Calculating The Social Benefit Of London, Kentucky’S Post-Mitigation Creation Of Public Park Space, Christopher Greyson Evans
MPA/MPP/MPFM Capstone Projects
After receiving FEMA hazard mitigation grants to improve weather and water management infrastructure, many communities are able to complete additional capital improvement projects that would not have been possible without the improvements facilitated by FEMA grants. FEMA projects often convert tracts of land to greenspace, or stabilize flood-damaged lands. Many communities then build public parks on such lands as a direct result. Although these parks or greenspaces create a benefit for their communities, FEMA’s methods for post-project evaluation, known as “Loss Avoidance Studies,” do not typically take the costs and benefits of new parks or greenspaces into consideration. From 2011-2015, …

Exploring Locus Of Control In Offender Cognition And Recidivism Paradigms, Anistasha Lightning, Danielle Polage
All Master's Theses
Working with four Washington State county jails to administer surveys to currently incarcerated inmates, we investigated locus of control and beliefs in the likelihood of continued legal involvement as possible antecedents to criminal recidivism. The surveys examined whether there was any connection between legal involvement frequency and the externalization of locus of control. We investigated external locus of control with specific respect to involvement with the law, the prospect of future incarceration, and feelings concerning the overall cause of original and/or sustained legal involvement utilizing the Revised Causal Dimension Scale (McAuley, Duncan, & Russell, 1992). We identified statistically significant interactions …

Access To Occupational Therapy Practice: A Review Of Current Licensing Processes In The United States, Melissa Groth, Martha Scoby
Occupational Therapy Capstones
Purpose This study was conducted to gain insight on the 50 United States and Washington D.C. occupational therapy (OT) licensure application process. This study sought to examine the accessibility of the OT licensure websites as well as the compliance each OT state licensure application has with the Americans with Disabilities Act (ADA). The researchers predicted that, while the profession of OT seeks inclusion for all individuals, there is discrimination prominent in the OT state licensure process for individuals living with disabilities.
Methodology A two-fold process was used to collect information regarding accessibility and accommodation within licensing processes for OT licensure …

Occupational Therapy Community Reintegration For Inmates With Co-Occurring Disorders, Miranda Hosking, Kara Moore
Occupational Therapy Capstones
A co-occurring disorder (COD) is the coexistence of a substance use disorder and mental health disorder (Substance Abuse and Mental Health Services Administration, 2016). The prevalence of inmates with COD in correctional facilities is disproportionately high (Grant, Stinson, & Dawson, 2004). Despite the high incidence, correctional facilities are not equipped to meet the complex needs of individuals with COD, which often leads these individuals to re-offending or re-incarceration (Sacks, Chaple, Sacks, McKendrick, & Cleland, 2012). The role of occupational therapy in this area of practice is not clearly distinguished. However, occupational therapy’s holistic, client-centered, and occupation-based principles position the profession …

Placing The Stateless Refugee: A Philosophy Of Statelessness, Nationality, And Rights, Ruby J. Gould
Honors Theses
In this thesis, I many related questions regarding the fluctuating relationships between national communities and outsiders, specifically in the case of refugees and stateless peoples. After discussing the meanings of these terms, such as the definition and identities of the refugee and the nation-state, I delve into a philosophical examination of individual rights, particularly rights that are defended by nation-states, and the relationships between national communities and those existing outside of those communities whose lives may depend on their acceptance into a nation-state. I philosophically outline the likely experiences of refugees as they are faced with statelessness, including what forces …
Contextualizing Sexual Assault Data Collection On College Campuses: A Socio-Technical Approach, Anushikha Sharma
Contextualizing Sexual Assault Data Collection On College Campuses: A Socio-Technical Approach, Anushikha Sharma
Honors Theses
Sexual assault is a rampant issue on college campuses in the United States. Colleges and universities use a variety of survey instruments to collect data regarding sexual assault as a means to improve campus culture, policies, and resources. These instruments contain a wealth of associated information in the form of metadata, that is, data about data.
This project takes a human-centered socio-technical approach to understanding the data collection processes associated with sexual assault, specifically, on the campus of Bucknell University. By identifying the underlying metadata within the data collection processes, this research contextualizes and critiques the process of data collection, …

City University of New York Law Review
The United States legislature has acted and will continue to act in ways that that will affect the transgender and non-binary communities in damaging ways. The outdated language they use has set a precedent for how the legal system interprets and constructs laws and policy around trans rights today. The trans community is fighting for more inclusive language5 through fashion, garments, and stores in an industry that is notoriously gendered, yet the legal system is not getting the hint. In this article, I give background information and theory on the transgender community and I argue that there is a direct …

A New Balance: Weighing Harms Of Hiding Police Misconduct Information From The Public, Cynthia Conti-Cook
City University of New York Law Review
Three New York City events in the past two years have demonstrated how hiding information related to police misconduct harms its residents. In April 2016, the New York Police Department (“NYPD”) eliminated public access to misconduct information by taking down a clipboard in the Deputy Commissioner of Public Information’s office that posted disciplinary summaries and removing decades worth of archives of those same summaries from City Hall. In September 2017, an Administrative Law Judge employed by the NYPD closed from the public a courtroom where a former officer was about to be impeached with his prior disciplinary record. In April …

More often than not, society’s attention is hyper-focused on the criminal justice system at the national level. The United States of America has been called out for leading the world in mass incarceration, and scholars like Michelle Alexander and Angela Davis, lawyer activists like Bryan Stevenson, and filmmakers like Ava DuVernay, have played integral roles in making our society collectively pause and take a critical look at our prison nation and the myriad of social inequities and injustices that manifest within it. Our nation is home to five percent (5%) of the global population but accounts for twenty-five percent (25%) …
