Why (Jury-Less) Juvenile Courts Are Unconstitutional, Suja A. Thomas, Collin Stich Jan 2019

Why (Jury-Less) Juvenile Courts Are Unconstitutional, Suja A. Thomas, Collin Stich

Emory Law Journal

Juveniles should hold the right to a jury trial under the U.S. Constitution, but they do not. In most states, when a trial occurs, a single judge determines whether a youth loses their liberty, and that imprisonment can last for years. The United States Supreme Court has decided that the Sixth Amendment right to a jury is irrelevant; prosecution in juvenile court is not a criminal prosecution within the meaning of the Sixth Amendment because the purpose of the juvenile courts is a good one—to rehabilitate youth. The Court has also held that the right to a jury trial is …

Quieting The Court: Lessons From The Muslim-Ban Case, Avidan Cover Jan 2019

Quieting The Court: Lessons From The Muslim-Ban Case, Avidan Cover

Faculty Publications

The Supreme Court’s Muslim-ban decision in Trump v. Hawaii and the confirmation of Brett Kavanaugh to the Supreme Court call into question the civil rights litigation enterprise insofar as it challenges U.S. government’s national security and immigration policies. Litigants and advocacy organizations should employ an array of strategies and tactics to avoid the Court’s rulings that almost uniformly defer to, and thus validate, the government’s national security and immigration practices.

This article maintains that The Muslim-Ban Case was a predictable outgrowth of the Supreme Court’s national security-immigration jurisprudence that champions executive power at the expense of marginalized groups, in particular …

Algorithmic Surveillance: A Hidden Danger In Recognizing Faces, Lydia F. Venditti, Jim Fleming, Kara Kugelmeyer Jan 2019

Algorithmic Surveillance: A Hidden Danger In Recognizing Faces, Lydia F. Venditti, Jim Fleming, Kara Kugelmeyer

Honors Theses

The goal of this thesis is to present the current status and awareness of facial recognition technology and their use as part of video surveillance systems. Specifically, I intend to help readers develop a greater understanding of how facial recognition systems contain algorithms that perpetuate bias in their matching and recognition of faces. Current research demonstrates that algorithms differentially recognize faces from different races and genders. As a technology with substantive impacts for use and abuse, more scrutiny of facial recognition technology is necessary. This paper will also help readers understand the dangers of facial recognition as a biometric technology …

Developing A Predictive And Dynamic Moose-Vehicle Collisions Model In Maine, Yue Yu Jan 2019

Developing A Predictive And Dynamic Moose-Vehicle Collisions Model In Maine, Yue Yu

Honors Theses

Wildlife-vehicle collisions are a major form of human-wildlife conflict. Predictive animal-vehicle collision models have been developed to identify collision hotspots in Maine and guide mitigation strategies. However, most current models are static and unable to produce dynamic forecasts that incorporate changing climate and weather. The goal of my study was to develop a predictive and dynamic model of animal-vehicle collisions in Maine, USA. More than 6,700 moose-vehicle collisions (MVC) occurred from 2003 to 2017 in Maine, raising road safety, socio-economic, and wildlife conservation concerns. I sought to identify factors that contribute to a higher probability of MVCs by comparing two …

The Behavior Of Suas Under Explosive Loading Conditions And Implications For Safe Operating Procedures, Ashok Em Sudhakar Jan 2019

The Behavior Of Suas Under Explosive Loading Conditions And Implications For Safe Operating Procedures, Ashok Em Sudhakar

Doctoral Dissertations

"Drones are increasingly being used for tasks previously unimagined and the beneficial uses are evolving. The United States Congress has envisioned the possible uses of drones for both combating and conveying explosive threats and other harmful and destructive activities. Congress' intent is reflected in new laws (2018) and policies (2019).

All civilian available Small Unmanned Aerial Systems sUASs (Drones), weighing less than 55 pounds, in the current market are not designed for operations in explosive environments. This first of a kind research focuses on further understanding of sUASs response to explosive loading and the public policy implications. This research measured …

Social Construction, Knowledge Utilization, And The Politics Of Poverty: A Case Study Of Washington State’S General Assistance Reform, Yu-Ling Chang Jan 2019

Social Construction, Knowledge Utilization, And The Politics Of Poverty: A Case Study Of Washington State’S General Assistance Reform, Yu-Ling Chang

The Journal of Sociology & Social Welfare

This paper addresses a gap in welfare reform literature by investigating the social constructions of poor people in state policymaking within the context of diminishing General Assistance (GA) after the Great Recession. Using Social Construction and Policy Design Theoryand thematic content analysis of Washington State’s legislative archives, I found that the negative constructions of GA recipients as deviants with undesired psychological and behavioral problems were associated with the reform direction toward a regulated, punitive model. These constructions, intersecting with the ideologies of personal responsibility and work ethic, contribute to the dismantling of the social safety net for the Washington’s poorest …

Interval Training Methods To Increase Performance Markers And Load Carriage In Tactical Professionals, Nathan D. Dicks Jan 2019

Interval Training Methods To Increase Performance Markers And Load Carriage In Tactical Professionals, Nathan D. Dicks

Health Nutrition and Exercise Science

Load carriage is an inherent part of the military and other tactical occupations (e.g., law enforcement, firefighters). Variation in load carriage ranges from 7-60 kg and can increase energy expenditure as well as lead to higher injury risk. Various novel training methods such as low-intensity interval training (LIT) in combination with blood flow restriction (BFR) as well as high-intensity interval training (HIT) aim at enhancing critical velocity (CV), aerobic fitness, and load carriage performance. Two investigations identified the feasibility of LIT with BFR and the use of HIT to increase performance and load carriage. Methods: Twelve male participants (21.8 +/- …

The Law Against Family Separation, Carrie F. Cordero, Heidi Li Feldman, Chimene Keitner Jan 2019

The Law Against Family Separation, Carrie F. Cordero, Heidi Li Feldman, Chimene Keitner

Faculty Scholarship

Most commentators assume that, except for the few restrictions expressly mentioned in the U.S. Constitution, the President's pardon power is unlimited. This Paper suggests that this common view is mistaken in at least one unexpected way. Presidential pardons must satisfy a modest procedural rule: they must list the specific crimes covered by the pardon. The "specificity requirement" means that vague and broadly worded pardons are invalid. This claim bears a significant burden of persuasion, since it runs so counter to accepted opinion. Nonetheless, that burden can be met. This Paper's argument rests on an originalist understanding of the constitutional text, …

A Higher Authority: Canada’S Cannabis Legalization In The Context Of International Law, Antonia Eliason, Robert Howse Jan 2019

A Higher Authority: Canada’S Cannabis Legalization In The Context Of International Law, Antonia Eliason, Robert Howse

Michigan Journal of International Law

Part I of this Article provides an overview of some of the key terms and provisions of Canada’s Cannabis Act. Part II looks at the Cannabis Act in the context of the International Drug Conventions, examining how the various convention provisions might apply, looking first at the Single Convention and then at the 1988 Convention and how that convention fits with Canadian constitutional provisions. Part III focuses on the international human rights framework and how the Cannabis Act might be viewed as compatible with international human rights law even where incompatible with the International Drug Conventions. This Part also offers …

The Administrative State: Congress's Role In Perpetuating It, Lindsey Martin Jan 2019

The Administrative State: Congress's Role In Perpetuating It, Lindsey Martin

Campbell Law Review

For many Americans, the rise of the administrative state signaled the deterioration of the framers' vision for American government. Gone are the days where the Legislative Branch primarily enacted laws, the Executive Branch enforced laws, and the Judicial Branch interpreted laws and adjudicated disputes. Today, the American form of government is an administrative state. Agencies possess legislative, executive, and judicial powers and wield those powers to administer critical government programs-often at the directive of the Executive Branch.

Scholars have repeatedly criticized the evolution of the administrative state as unlawful, unconstitutional, and have even gone so far as to call it …
