The Effects Of Voluntary And Presumptive Sentencing Guidelines, Stephen Rushin, Griffin Sims Edwards, Josph Colquitt Jan 2019

The Effects Of Voluntary And Presumptive Sentencing Guidelines, Stephen Rushin, Griffin Sims Edwards, Josph Colquitt

Faculty Publications & Other Works

This Article empirically illustrates that the introduction of voluntary and presumptive sentencing guidelines at the state-level can contribute to statistically significant reductions in sentence length, inter-judge disparities, and racial disparities.

For much of American history, judges had largely unguided discretion to select criminal sentences within statutorily authorized ranges. But in the mid-to-late twentieth century, states and the federal government began experimenting with sentencing guidelines designed to reign in judicial discretion to ensure that similarly situated offenders received comparable sentences. Some states have made their guidelines voluntary, while others have made their guidelines presumptive or mandatory, meaning that judges must generally …

Public Policy Under The New York Convention - Bridges Between Domestic And International Courts And Private And Public International Law, Anthony E Cassimatis Jan 2019

Public Policy Under The New York Convention - Bridges Between Domestic And International Courts And Private And Public International Law, Anthony E Cassimatis

National Law School of India Review

Controversy continues over the “public policy” exception set out in the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards. Claims are still made regarding the sharpness of distinctions between national and international law and private international law and public international law. Populist assertions of sovereignty have given these supposed distinctions even greater salience. A closer assessment of national and international law suggests, however, that the distinctions are not as sharp as some have contended.

Pilot Scale Evaluation Of E. Coli Filtration Removal From Stormwater Using Recycled Steel, Jason Neville Jan 2019

Pilot Scale Evaluation Of E. Coli Filtration Removal From Stormwater Using Recycled Steel, Jason Neville

Electronic Theses and Dissertations

Microbial pathogens are considered one of the most important pollutants in regards to surface waters such as coastal waters, rivers and urban estuaries. Escherichia Coli (E. coli) is a bacterial microorganism found in the guts of humans and some animals that if ingested can cause diarrhea, severe stomach cramps, and vomiting. E. coli carried by stormwater runoff can deteriorate water quality of receiving bodies of water. It is necessary to develop technologies to remove E. coli from stormwater runoff to protect surface waters and public health. The use of steel byproducts as an adsorption technology is an emerging stormwater treatment …

Affects Of Mental Health Limitations, Leadership Interactions, And Generational Diversity On The Morale Of Paramedics In Public And Private Emergency Medical Services, Mari Hadas

CUP Ed.D. Dissertations

Emergency Medical Services (EMS) employees are the individuals first on scene to care for people who are having the worst day of their lives. But, while they do that job and the hours after leaving that job are the meaningful moments that affect EMS employees. The purpose of this exploratory qualitative case study was to educate EMS senior leaders on the needs of their employees. The research question that guided this study was: How do mental health limitations, leadership interactions, and generational diversity affect the morale of paramedics in public and private emergency medical services? The sample consisted of 16 …

The Itunes Of Downloadable Guns: Firearms As A First Amendment Right, Sandra Sawan Lara Jan 2019

The Itunes Of Downloadable Guns: Firearms As A First Amendment Right, Sandra Sawan Lara

Catholic University Journal of Law and Technology

As society becomes more technology driven, legal issues continue to arise around the world. From privacy to national security, technology develops at a rate the law simply cannot keep up with. In the United States, one of the biggest legal issues is how the new risks technology brings will interfere with our individual liberties.

Technologies like three-dimensional (“3D”) printing have transformed everything from lifesaving surgeries to gun manufacturing. This technology has led to a whole new way of communicating via computer coding, with the online open source movement leading innovation by allowing for the sharing and editing of files freely. …

Accountability Of Algorithms In The Gdpr And Beyond: A European Legal Framework On Automated Decision-Making, Céline Castets-Renard Jan 2019

Accountability Of Algorithms In The Gdpr And Beyond: A European Legal Framework On Automated Decision-Making, Céline Castets-Renard

Fordham Intellectual Property, Media and Entertainment Law Journal

Automated decision systems appear to carry higher risks today than they ever have before. Digital technologies collect massive amounts of data and evaluate people in every aspect of their lives, such as housing and employment. This collected information is ranked through the use of algorithms. The use of such algorithms may be problematic. Because the results obtained through algorithms are created by machines, they are often assumed to be immune from human biases. However, algorithms are the product of human thinking and, as such, can perpetuate existing stereotypes and social segregation. This problem is exacerbated by the fact that algorithms …

Fuzzy Inference System Framework To Prioritize The Deployment Of Resources In Low Visibility Traffic Conditions, Luz C. Ortega, Luis Daniel Otero, Carlos Otero

Mathematics and System Engineering Faculty Publications

Tasks related to traffic and safety operations under low visibility conditions remain a challenge for transportation agencies nationwide. Transportation managers are required to model weather and road variables to make operational decisions, while simultaneously prioritizing the deployment of available resources. This research presents a fuzzy inference system (FIS) framework to assist transportation managers with prioritizing the deployment of resources to areas of low visibility originated by fog. The framework is composed of three fuzzy systems that characterize fog occurrence, road risk conditions, and deployment of resources. Fuzzy logic is considered a decision-making technique that could be effectively applied when dealing …

Extradition, Assurances And Human Rights: Guidance From The Supreme Court Of Canada In India V. Badesha, Joanna Harrington

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

In recent years, the Supreme Court of Canada has granted leave to appeal in a surprising number of extradition cases concerning individuals in Canada who are wanted for trial elsewhere. Leave has been granted in 18 cases since the 2001 unanimous decision of “The Court” in United States v. Burns, which made extradition from Canada conditional on the receipt of assurances from a foreign state that a death penalty will not be imposed and thus, in substance, overturned the position taken by a divided Court 10 years earlier. Many intuitively connect extradition with criminal law, with extradition being a process …

Mclachlin’S Law: In All Its Complex Majesty, Jamie Cameron

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

No other judge has had as distinguished a career on the Supreme Court of Canada as Beverley McLachin. She was an exemplary Chief Justice, one of Canada’s finest, and is deeply respected as a jurist. Yet she remains an enigma, perplexing us still, in large part because her jurisprudence defied characterization throughout her 28-year tenure on the Court. This article seeks insight into her core commitments – what was sacred to Beverley McLachlin in judging – by drawing on her extra-curial reflections and writings and by sampling from her jurisprudence. The analysis shows that Justice McLachlin’s decision making was driven …

Why We Need Police, Justin Mccrary, Deepak Premkumar Jan 2019

Why We Need Police, Justin Mccrary, Deepak Premkumar

Faculty Scholarship

This chapter discusses the essential role that the police have in deterring and reducing crimes, particularly the most violent and costly ones to society, such as murder. We begin by providing a brief overview of deterrence theory before discussing the empirical evidence on the efficacy of police staffing and various policing strategies on crime reduction. Using a framework developed in Weisburd and Eck (2004), we quickly evaluate the model of standard policing and then mainly focus on evidence behind three current policing practices: hot spots, problem- oriented, and proactive. Finally, we use the empirical evidence of police staffing to provide …

Police Contact And The Legal Socialization Of Urban Teens, Jeffrey A. Fagan, Amanda Geller Jan 2019

Police Contact And The Legal Socialization Of Urban Teens, Jeffrey A. Fagan, Amanda Geller

Faculty Scholarship

Contemporary American policing has routinized involuntary police contacts with young people through frequent, sometimes intrusive investigative stops. Personal experience with the police has the potential to corrode adolescents’ relationships with law and skew law-related behaviors. We use the Fragile Families and Child Wellbeing Study to estimate how adolescents’ experiences with the police shape their legal socialization. We find that both personal and vicarious police contact are associated with increased legal cynicism. Associations are present across racial groups and are not explained by teens’ behaviors, school settings, or family backgrounds. Legal cynicism is amplified in teens reporting intrusive contact but diminished …

Death By Stereotype: Race, Ethnicity, And California’S Failure To Implement Furman’S Narrowing Requirement, Catherine M. Grosso, Jeffrey A. Fagan, Michael Laurence, David C. Baldus, George W. Woodworth, Richard Newell

Faculty Scholarship

This Article examines the possible racial and ethnic implications of California’s expansive death penalty statute in light of the Eighth Amendment’s requirement that each state statute narrow the subclass of offenders on whom a death sentence may be imposed. The narrowing requirement derives from the holding in Furman v. Georgia over forty-five years ago, when the U.S. Supreme Court ruled that existing death penalty statutes violated the Eighth Amendment’s prohibition against cruel and unusual punishments. Citing statistics demonstrating arbitrary and capricious application of capital punishment, a majority of the Justices concluded that a death sentencing scheme is unconstitutional if it …

The End Of Intuition-Based High-Crime Areas, Ben Grunwald, Jeffrey A. Fagan Jan 2019

The End Of Intuition-Based High-Crime Areas, Ben Grunwald, Jeffrey A. Fagan

Faculty Scholarship

In 2000, the Supreme Court held in Illinois v. Wardlow that a suspect’s presence in a “high-crime area” is relevant in determining whether an officer has reasonable suspicion to conduct an investigative stop. Despite the importance of the decision, the Court provided no guidance about what that standard means, and over fifteen years later, we still have no idea how police officers understand and apply it in practice. This Article conducts the first empirical analysis of Wardlow by examining data on over two million investigative stops conducted by the New York Police Department from 2007 to 2012.

Our results suggest …

Driving Toward Autonomy? The Fbi In The Federal System, 1908-1960, Daniel C. Richman, Sarah Seo Jan 2019

Driving Toward Autonomy? The Fbi In The Federal System, 1908-1960, Daniel C. Richman, Sarah Seo

Faculty Scholarship

This paper explains the growth of the FBI (“Bureau”) in the United States at a time when criminal justice was largely a local matter by reframing the criminal justice “(eco)system” in terms of informational economy, rather than jurisdictional authority. It argues that the Bureau came to occupy a key position in the national law enforcement ecosystem by providing an informational infrastructure that enabled it to cultivate relationships with local police agencies. This history offers two insights about the nature of American state and federalism in the twentieth century. First, the Bureau’s particular strategy for enlarging its capacity beyond its small …

Stakeholder Input To The Development Of The Santa Clara County Lgbtq-Focused Shelter: A Process And Policy Analysis, Anthony Montalvo Jan 2019

Stakeholder Input To The Development Of The Santa Clara County Lgbtq-Focused Shelter: A Process And Policy Analysis, Anthony Montalvo

Master's Projects

Due to elevated homelessness and growing hate crimes, an LGBTQ-focused shelter was developed and implemented by Office of Supportive Housing (OSH), along with the OLGBTQ (Office of Lesbian, Gay, Bisexual, Transgender, Queer). The following research investigated whether the process to design the LGBTQ-focused shelter program in Santa Clara county took the necessary steps to ensure that the program represents the community it intends to serve. Using process evaluation to identify the problem and proposed solutions, and policy analysis to examine the alternative solutions, the research answered the question: Did the approved design of the LGBTQ-focused shelter represent the stakeholder planning …

Seismic Monitoring And Baseline Microseismicity In The Rome Trough, Eastern Kentucky, N. Seth Carpenter, Andrew S. Holcomb, Zhenming Wang, John B. Hickman, Edward W. Woolery

Report of Investigations--KGS

In the central and eastern United States, felt earthquakes likely triggered by fluid injection from oil and gas production or wastewater disposal have dramatically increased in frequency since the onset of the unconventional shale gas and oil boom. In the Rome Trough of eastern Kentucky, fracture stimulations and wastewater injection are ongoing and occur near areas of historical seismic activity. Unlike in surrounding and nearby states (Ohio, West Virginia, and Arkansas), in Kentucky, no seismic events related to subsurface fluid injections have been reported as felt or detected by regional seismic networks, including the Kentucky Seismic and Strong-Motion Network.
