No one seriously questions that an improved and decarbonized energy supply system is a key component of climate change mitigation, but the United States’ system of federalism complicates the siting of utility-scale renewable energy facilities. The new Biden Administration presents the United States with an opportunity to reimagine how this country regulates renewable energy siting, allowing for substantial national progress in reducing greenhouse gas emissions. Currently, primary siting authority for renewable energy projects rests with state and local governments, which generally exercise that authority through zoning and land use planning, while the federal government approves most interstate energy delivery systems. …

Background: Hepatitis C virus (HCV) is a blood-borne pathogen that can cause severe liver disease, cancer, and death and is a significant source of morbidity and mortality in the United States. Several academic medical centers including University of Kentucky Healthcare have implemented routine HCV screening for patients presenting to the emergency department (ED) and have discovered a large viral burden amongst patients who are often symptomatic.

Abstract

BACKGROUND: Prisoners who are detained in jails and detention centers have higher rates of Severe Mental Illness (SMI) compared to the general population. However, SMI is often unidentified in this population, largely due to lack of assessment using effective SMI screening tools and lack of knowledge among prison staff about the prevalence of SMI and the importance of identification in the correctional setting. Prisoners with SMI often act out violently against others and themselves. Current standard practice for SMI screening varies significantly across jails. วิทยานิพนธ์ฉบับนี้มุ่งศึกษาปัญหาในการใช้ดุลพินิจของเจ้าหน้าที่ตำรวจในการดูแลการชุมนุมสาธารณะในประเทศไทย และการตรวจสอบการใช้ดุลพินิจเจ้าหน้าที่ตำรวจโดยองค์กรตุลาการ โดยศึกษาเปรียบเทียบกับกฎหมายต่างประเทศประกอบกับหลักการดูแลการชุมนุมสาธารณะของกติการะหว่างประเทศว่าด้วยสิทธิพลเมืองและสิทธิทางการเมือง (ICCPR) และความเห็นทั่วไปฉบับที่ 37 (General comment) ของคณะกรรมการสิทธิมนุษยชน ซึ่งสามารถนำมาใช้ในฐานะตัวอย่างการใช้ดุลพินิจในการดูแลการชุมนุมสาธารณะและตัวอย่างการตีความกฎหมายให้กับเจ้าหน้าที่ตำรวจและองค์กรตุลาการ ตลอดจนศึกษาปัญหาการตรวจสอบดุลพินิจเจ้าหน้าที่ตำรวจในการดูแลการชุมนุมสาธารณะโดยองค์กรตุลาการภายใต้หลักความจำเป็นสำหรับสังคมประชาธิปไตยและความได้สัดส่วน และการตรวจสอบดุลพินิจที่ผิดพลาด อย่างไรก็ตาม เมื่อพิจารณากฎหมายต่างประเทศ ได้แก่ ประเทศฝรั่งเศส อังกฤษ และเกาหลีใต้ประกอบกับหลักสากล พบว่าโครงสร้างกฎหมายการชุมนุมสาธารณะในเรื่องดุลพินิจกลับบัญญัติขอบเขตในการใช้ดุลพินิจไว้อย่างชัดเจน อีกทั้งยังมีกระบวนการตรวจสอบโดยองค์กรตุลาการที่เข้ามามีบทบาทในการสร้างกลไกหรือแนวทางการใช้ดุลพินิจให้กับเจ้าหน้าที่ตำรวจภายใต้หลักความจำเป็นและหลักความสัดส่วนทำให้สิทธิมนุษยชนของประชาชนได้รับความคุ้มครอง จากการศึกษาพบว่า การใช้ดุลพินิจของเจ้าหน้าที่ตำรวจในการดูแลการชุมนุมสาธารณะในประเทศไทยถูกใช้ไปอย่างไม่มีมาตรฐานตามหลักสากล และมิได้เป็นไปตามเจตนารมณ์ของกฎหมายการชุมนุมสาธารณะ อีกทั้ง ยังพบปัญหาโครงสร้างทางกฎหมายของพระราชบัญญัติการชุมนุมสาธารณะในเรื่องดุลพินิจของเจ้าหน้าที่ตำรวจ ในขณะที่การตรวจสอบการใช้ดุลพินิจของเจ้าหน้าที่ตำรวจโดยองค์กรตุลาการยังมีบทบาทน้อยมาก กล่าวคือ องค์กรตุลาการยังมีบทบาทไม่เพียงพอในการนำหลักความจำเป็นและหลักความได้สัดส่วนมาใช้ตรวจสอบดุลพินิจเจ้าหน้าที่ตำรวจ และปัญหาการตรวจสอบดุลพินิจที่ผิดพลาดซึ่งศาลยุติธรรมมักจะมองข้ามการนำมาพิจารณาดุลพินิจ ด้วยเหตุเหล่านี้จึงส่งผลให้การใช้เสรีภาพในการชุมนุมของประชาชนชาวไทยถูกลิดรอนเกินสมควร

วิทยานิพนธ์ฉบับนี้ได้ทำการศึกษา “มาตรการรอการกำหนดโทษและรอการลงโทษจำคุกเพื่อป้องกันสังคม” โดยมีวัตถุประสงค์เพื่อนำเสนอรูปแบบมาตรการรอการกำหนดโทษและรอการลงโทษจำคุกที่ควรจะเป็นเพื่อป้องกันสังคม จากการศึกษาพบว่า มาตรการรอการกำหนดโทษและรอการลงโทษจำคุกในส่วนของมาตรา 56 และมาตรา 57 แห่งประมวลกฎหมายอาญา และกรณีอื่น ๆ ยังไม่มีความสมดุลระหว่างประโยชน์ของผู้เสียหายและความปลอดภัยของสังคมกับสิทธิ เสรีภาพ และโอกาสของผู้กระทำความผิด โดยเฉพาะอย่างยิ่งยังไม่มีความสมดุลระหว่างความปลอดภัยของสังคมตามหลักป้องกันสังคม (social protection principle) กับสิทธิ เสรีภาพ และโอกาสของผู้กระทำความผิด สาเหตุหลักที่ทำให้เกิดปัญหาความไม่สมดุลดังกล่าวข้างต้นขึ้นมาคือ ณ ปัจจุบันกระบวนทัศน์หลัก (major paradigm) เกี่ยวกับมาตรการนี้ยังคงอยู่ในยุครัฐสวัสดิการ (welfare state era) ที่สิทธิ เสรีภาพ และโอกาสของผู้กระทำความผิดในกระบวนการยุติธรรมทางอาญาได้เฟื่องฟูเป็นอย่างมาก ซึ่งเป็นกรณีที่มาตรการนี้ได้คำนึงถึง “สิทธิ เสรีภาพ และโอกาสของผู้กระทำความผิด” เป็นสำคัญ ส่งผลให้มาตรการนี้ทั้งในด้านบทบัญญัติ (law) และการปรับใช้บทบัญญัติ (application of law) ตั้งอยู่บนฐานความคิดของสิทธิ เสรีภาพ และโอกาสของผู้กระทำความผิดเป็นหลัก สภาวะเช่นนี้จึงก่อให้เกิดผลกระทบที่สำคัญตามมาคือ “ความไม่ปลอดภัยแก่สังคม” วิทยานิพนธ์ฉบับนี้ได้ให้ข้อเสนอแนะว่า ควรปรับเปลี่ยนกระบวนทัศน์หลักเกี่ยวกับมาตรการรอการกำหนดโทษและรอการลงโทษจำคุกจากยุครัฐสวัสดิการสู่ยุคสังคมแห่งความเสี่ยง (social era of risk) ที่วงการนิติศาสตร์ได้มีการตั้งข้อสังเกต ตระหนัก และให้ความสำคัญกับความเสี่ยงอันเป็นผลมาจากการมีอยู่และการปรับใช้มาตรการนี้อย่างจริงจังเนื่องจากนักนิติศาสตร์มีความวิตกกังวลว่าผลที่เป็นภยันตราย (การประกอบอาชญากรรม) จากการมีอยู่และการปรับใช้มาตรการนี้จะเกิดขึ้นกับตนเอง ประชาชน และ/หรือสังคม ซึ่งเป็นกรณีที่มาตรการนี้ได้คำนึงถึง “ความปลอดภัยของสังคม” เป็นสำคัญ ส่งผลให้มาตรการนี้ทั้งในด้านบทบัญญัติและการปรับใช้บทบัญญัติจะตั้งอยู่บนฐานความคิดของการป้องกันสังคมตามหลักป้องกันสังคมเป็นหลัก เพื่อจำกัด ควบคุม และป้องกันไม่ให้เกิดการประกอบอาชญากรรมขึ้นในอนาคต สภาวะเช่นนี้ย่อมก่อให้เกิดผลดีตามมาคือ “ความปลอดภัยแก่สังคม” นอกจากข้อเสนอแนะดังกล่าวข้างต้นแล้ว วิทยานิพนธ์ฉบับนี้ได้นำเสนอรูปแบบมาตรการนี้ที่ควรจะเป็นเพื่อป้องกันสังคม ซึ่งหากมีการนำรูปแบบดังกล่าวข้างต้นไปปรับใช้ จะช่วยสร้างความปลอดภัยแก่สังคมมากยิ่งขึ้น

Introduction: In healthcare, normalized deviance is characterized by the steady transition away from standard practice toward variations in practice behaviors. This deviation presents minorly at first and is accepted to save time and increase efficiency. However, initial evaluations of innocuity do not represent actual safety. Introduction: More than 1 in 3 women and 1 in 4 men will experience some type of sexual violence in their lifetimes (NISVS | CDC, 2021). While a significant body of research exists on predictors of reporting behavior after sexual assault victimization, far less research has attended to factors that may contribute to perpetration, such as sexual self-concept. The current study investigates sexual self-concept and its relationship to health behavior and notions of sexual consent in a college student sample. This thesis explores Handschu v. Special Services Division, an ongoing federal class-action suit brought by New York activists in 1971 to challenge the NYPD's right to use covert tactics to monitor them and undermine their political projects. The Handschu plaintiffs originally hoped that the court would find the NYPD's covert activities unconstitutional and would intervene on behalf of all New Yorkers thus targeted. After the conservative Burger Court challenged the pro-activist decisions of the previous Warren Court, the plaintiffs abandoned their ambitious goals and settled with the defendants. Despite the recent growth in the Canadian literature on legal ethics for government lawyers, the leading conceptual models have yet to be applied to resolve many of the most important legal questions facing government lawyers. In this article, I identify four key situations where the obligations of government lawyers as lawyers appear to clash with their obligations as public servants. I provide both a doctrinal analysis of how the current law applies in those situations and proposals for how the law can be clarified and improved. Annually, in the United States, >1 million deer (Odocoileus spp.)–vehicle collisions are reported, resulting in losses of $4.6 billion in vehicle damage and medical expenses. Wildlife and transportation managers require better information about traffic volumes relative to seasonal and diurnal deer movement patterns to appropriately evaluate the risks associated with deer–vehicle collisions (DVCs). Sharks (Selachimorpha) have an important ecological function and are both valued and feared by people around the world. Shark bite incidents present a high consequence risk in terms of human health and safety. In Australia, shark interactions with humans are most frequently recorded for the white shark (Carcharodon carcharias), bull shark (Carcharhinus leucas), and tiger shark (Galeocerdo cuvier). As states pass reforms to reduce the size of their prison populations, the number of Americans physically incarcerated has declined. However, the number of people whose employment and related opportunities are limited due to their criminal records continues to grow. Wilson once famously framed the “problem of humanity”: “We have paleolithic emotions; medieval institutions; and god-like technology.” America’s greatest philosopher John Dewey similarly placed this yawning gap between rapidly expanding technological change and slowly evolving human emotions and institutions at the heart of what he called The Public and Its Problems. Does the First Amendment protect computer code from being compelled by the government? As society becomes more reliant on coded devices— like pacemakers, insulin pumps, and even some baby bassinets—courts will need to grapple with this question. In considering compulsions related to code, this Article concludes that intermediate scrutiny is almost always the appropriate standard of review. Rather than expressing a particular viewpoint, code generally constitutes a functional and neutral script. This Article considers methods by which state appellate court judges are selected. It focuses on the evolution of and rationale for the so-called merit-selection system, a hybrid approach that prevails in a substantial number of jurisdictions. Under merit selection, there is an initial gubernatorial appointment based on recommendations from a nominating committee and a retention election, which is limited to a single candidate and a single question: whether the initially appointed appellate judge should be retained so as to serve a new term. The racially disparate impact and individual and collective costs of stop and frisk, misdemeanor arrests, and pretextual traffic stops have been well documented. Less widely noticed is the contrast between Supreme Court case law permitting these practices and the Court's recent tendency to strictly regulate technologically enhanced searches that occur outside the street policing setting and that--coincidentally or not--happen to be more likely to affect the middle class. In recent years a small but influential group of locally elected prosecutors committed to criminal justice reform have openly refused to enforce various criminal laws—laws prohibiting marijuana possession, sentencing enhancements, laws authorizing the death penalty, and much more—because they see those laws as unjust and incompatible with core reform objectives. The debate continues as to which governance structure is most appropriate for collaborative disaster response, particularly between centralization and decentralization. This article aims to contribute to this debate by analyzing the structural characteristics of a multisectoral network that emerged and evolved under strong state control during the 2015 outbreak of Middle East respiratory syndrome-coronavirus (MERS) in South Korea. This study particularly focuses on the evolution of intra- and inter-sectoral collaboration ties in the network.
