The Constitutional Guarantee Of Criminal Justice Transparency, Aliza Plener Cover Jan 2022

The Constitutional Guarantee Of Criminal Justice Transparency, Aliza Plener Cover

Articles

This Article identifies and explores a transparency guarantee that permeates the Constitution's criminal procedure provisions. This guarantee protects multiple dimensions of transparency - which I categorize as participatory, informational, and corporal--through overlapping structural safeguards and individual rights, and through protections afforded to both the public and the accused. Despite the strength and pervasiveness of the overarching transparency guarantee, the discrete provisions from which it is derived are often peripheral in today's criminal justice system, which is dominated by plea bargaining and incarceration rather than trials and public-square punishment. And, because the constitutional transparency protections are viewed in clause-bound isolation, modern …

Center for Technology in Government

Cybersecurity threats to our governments cannot be understated.Hackers are are sending emails to local government employees, they are looking for vulnerabilities in websites and they are looking for ways into databases. They want to disrupt work, destroy systems, exploit data and hold it ransom for payment.Almost everything that local governments do today rely on some type of information technology system including but not limited to email, public health programs and services, social service case management, elections, highway and road and road maintenance, public safety, snow removal, mental health care, financial management, court and judicial operations, and many other functions. Adapting To A 4°C World, Clifford Villa Jan 2022

Adapting To A 4°C World, Clifford Villa

Faculty Scholarship

The Paris Agreement’s goal to hold warming to 1.5°-2°C above pre-industrial levels now appears unrealistic. Profs. Robin Kundis Craig and J.B. Ruhl have recently argued that because a 4°C world may be likely, we must recognize the disruptive consequences of such a world and respond by reimagining governance structures to meet the challenges of adapting to it. In this latest in a biannual series of essays, they and other members of the Environmental Law Collaborative explore what 4°C might mean for a variety of current legal doctrines, planning policies, governance structures, and institutions.

A Call To Dismantle Systemic Racism In Criminal Legal Systems, Cynthia J. Najdowski, Margaret C. Stevenson

Psychology Faculty Scholarship

Objectives: In October 2021, APA passed a resolution addressing ways psychologists could work to dismantle systemic racism in criminal legal systems. The present report, developed to inform APA’s policy resolution, details the scope of the problem and offers recommendations for policy and psychologists to address the issue by advancing related science and practice. Specifically, it acknowledges the roots of modern-day racial and ethnic disparities in rates of criminalization and punishment for people of color as compared to White people. Next, the report reviews existing theory and research that helps explain the underlying psychological mechanisms driving racial and ethnic disparities …

A Flexible Mixed-Data Model Applied To Claims Data For Post-Market Surveillance Of Prescription Drug Safety Behavior, Harris Butler, John D. Rice, Nichole E. Carlson, Elaine H. Morrato Jan 2022

A Flexible Mixed-Data Model Applied To Claims Data For Post-Market Surveillance Of Prescription Drug Safety Behavior, Harris Butler, John D. Rice, Nichole E. Carlson, Elaine H. Morrato

Parkinson School of Health Sciences and Public Health

We develop a new modeling framework for jointly modeling first prescription times and the presence of risk-mitigating behavior for prescription drugs using real-world data. We are interested in active surveillance of clinical quality improvement programs, especially for drugs which enter the market under an FDA-mandated Risk Evaluation and Mitigation Strategy (REMS). Our modeling framework attempts to jointly model two important aspects of prescribing, the time between a drug's initial marketing and a patient's first prescription of that drug, and the presence of risk-mitigating behavior at the first prescription. First prescription times can be flexibly modeled as a mixture of component …

Bad Publicity: The Diminished Right Of Privacy In The Age Of Social Media, Kirby Shilling Jan 2022

Bad Publicity: The Diminished Right Of Privacy In The Age Of Social Media, Kirby Shilling

Fordham Intellectual Property, Media and Entertainment Law Journal

The “public disclosure of private facts” tort involves determining if and when publication of truthful, albeit embarrassing, facts warrant liability. Such liability inherently runs into First Amendment concerns. This Note analyzes the background of this tort, its status, and its application in different jurisdictions. Scholarship and jurisprudence have traditionally balanced the right to privacy with First Amendment guarantees by looking at different factors, including whether the disclosed information is properly described as “private” and whether it is newsworthy or a matter of legitimate public interest. However, the line between “public” and “private” has become increasingly blurred with new technology and …

Immigration Public Defenders: A Model For Going Beyond Adequate Representation, Matthew Chang Jan 2022

Immigration Public Defenders: A Model For Going Beyond Adequate Representation, Matthew Chang

JCLC Online

What does adequate legal representation for noncitizen criminal defendants look like? After the Supreme Court decided the landmark case of Padilla v. Kentucky, criminal defense attorneys became responsible for advising clients if and when there might be immigration consequences that accompany acceptance of a guilty plea deal, such as a potential risk of deportation. Currently, the criminal and immigration representation are completely divided. This Comment argues that the Padilla mandate alone, while important, fails to adequately provide noncitizen criminal defendants their Fifth Amendment Due Process Right and Sixth Amendment Right to Counsel. Using the Supreme Court’s legal analysis in …

The Constitutional Issues Of Publishing Mugshots In The Age Of Screenshots And Digital Media, Ryan J. Mcelhose Jan 2022

The Constitutional Issues Of Publishing Mugshots In The Age Of Screenshots And Digital Media, Ryan J. Mcelhose

St. Thomas Law Review

This paper takes the position that American people’s Due Process rights are violated when their mugshots are digitally disseminated prior to a conviction. The press’s First Amendment rights are not violated by not having access to pre-conviction booking photos because the press can report on other publicly accessible information. The same conclusion can be made relating to private citizens and private companies who assert that their Freedom of Speech rights are violated by not having access to obtain, publish, and disseminate pre-conviction mugshots. Existing scholarship has addressed the issue of publishing mugshots with privacy arguments related to the Freedom of …

U.S. Drug Reform: A Cultural Shift, Leionah J. Noah Jan 2022

U.S. Drug Reform: A Cultural Shift, Leionah J. Noah

St. Thomas Law Review

When a human body ingests a lethal dose of heroin, the body goes through an enormous physiological transformation. The functions of the central nervous system begin to depress, breathing is shallowed, the pulse is weakened, and the skin turns blue or gray with dark lips and fingernails. An alert person must quickly administer naloxone, an opioid antagonist, to reverse the effects of a heroin overdose, as symptoms typically begin after ten minutes. For many, however, their lives end with an overdose, despite this outcome being preventable. This paper will establish that drug overdose deaths are preventable for an entirely different …

Traffickers’ Use Of Substances To Recruit And Control Victims Of Domestic Trafficking For Sexual Exploitation In The American Midwest, Erica Koegler, Claire Wood, Lilly Bahlinger, Sharon Johnston

Social Work Faculty Works

This paper describes how traffickers use substances to recruit and control victims of domestic trafficking for sexual exploitation, as reported by service providers working with trafficking survivors in the American Midwest. This data was derived from interviews with 15 service providers in a major metropolitan area. Findings revealed consistencies with previous literature and new insights into the trafficker- substance use dynamic. Traffickers’ use of substances with victims was pervasive when trafficking was for the purpose of sex but not other labour. There were several examples of how traffickers use substances for victim exploitation and recruitment. These include using substances to …

No-Knock Warrants: Unlawfully Legitimate, Isabel Pergande Jan 2022

No-Knock Warrants: Unlawfully Legitimate, Isabel Pergande

Mahurin Honors College Capstone Experience/Thesis Projects

On March 13, 2020, Breonna Taylor was fatally shot when officers of the Louisville Metro Police Department (LMPD) executed a search warrant at her apartment. Breonna Taylor’s case brought national attention to no-knock warrants (NKWs), which allow police to enter private residences unannounced. It is estimated that 20,000-80,000 NKWs are executed by American police each year. This thesis explores the development of NKWs as a common, yet controversial, police tactic. The increase in NKWs is largely attributed to the federal government’s War on Drugs, beginning with Richard Nixon’s 1968 presidential campaign. However, the Supreme Court laid the foundation for NKWs …

Big Brother Is Scanning: The Widespread Implementation Of Alpr Technology In America’S Police Forces, Yash Dattani Jan 2022

Big Brother Is Scanning: The Widespread Implementation Of Alpr Technology In America’S Police Forces, Yash Dattani

Vanderbilt Journal of Entertainment & Technology Law

Automatic License Plate Readers (ALPRs) are an increasingly popular tool in police departments across the United States. At its core, ALPR technology functions in a relatively simple manner. The technology has two major components: the actual scanners, which record license plates, and the databases which collect, compile, and analyze this information for officers to access at the click of a button. Although this technology first came to the United States in 1998 as a form of rudimentary border security, its purpose and capabilities have rapidly grown. Now, in 2022, ALPR has evolved into a frighteningly powerful piece of technology, potentially …

Optimization-Based Uav Fleet Routing And Safety Assurance – Models, Algorithms, And Prototyping, Zhenyu Zhou Jan 2022

Optimization-Based Uav Fleet Routing And Safety Assurance – Models, Algorithms, And Prototyping, Zhenyu Zhou

Wayne State University Dissertations

Unmanned aerial vehicles (UAVs), especially multi-rotor drones, have been increasingly used in various scenarios in the last decade. With the reduced hardware costs, improved battery life, and enhanced processor performance, we can eventually allow all kinds of drones to automatically travel through the low-altitude airspace. The large-scale application of drones will extend the basic transportation facilities from the ground to the air and form 3D transportation networks for the future. Compared to current ground-vehicle and aircraft traffic systems, multi-UAV systems are far from well-developed. Most current multi-UAV systems are human-operated or pre-programmed to perform specific tasks. The current application of …

Racial Inequality: An Economic And Philosophical Approach, Isabel Nieves Jan 2022

Racial Inequality: An Economic And Philosophical Approach, Isabel Nieves

Theses & ETDs

I provide evidence that there is racial inequality in the criminal justice system, and that our criminal justice system is flawed. I look at the effects of the incarceration rates among different races, and how this has a domino effect into other aspects of the Black community. I look at how this affects mental health, segregation, and employment in Black communities. I look at why our criminal justice system is flawed through a John Rawlisan approach through his principles of justice, and Charles Mills' criticism of John Rawls, as well as Tommie Shelby. I look at policies in which we …

Covid-19 And The Carceral System: An Examination Of The Increasing Structural Inequities In Access To Healthcare In Sarasota And Manatee County Jails, Danielle Robbins Jan 2022

Covid-19 And The Carceral System: An Examination Of The Increasing Structural Inequities In Access To Healthcare In Sarasota And Manatee County Jails, Danielle Robbins

Theses & ETDs

The purpose of this thesis is to examine the impact of the COVID-19 pandemic on access to healthcare in Southwest Florida jails. The ongoing public health crisis has underscored the importance of examining these constructions in a cautious yet expeditious manner. While a considerable amount of research seeks to understand COVID-19 within prisons, there is limited information that contextualizes the novel virus within jails. This thesis aims to augment existing literature by taking a closer look at public health and disease prevention in jails. This project draws on data accumulated from nine ethnographic interviews dated from December of 2021 through …

Art As Politics? How Fox News Manufactures Its Hosts’ Performances To Acquire Cable Prestige, Matthew Mcguirk Jan 2022

Art As Politics? How Fox News Manufactures Its Hosts’ Performances To Acquire Cable Prestige, Matthew Mcguirk

The Graduate Review

Fox News is the most popular cable news network in the United States, drawing millions of conservative viewers who trust it more than any other outlet. Although many of the network’s claims are subject to controversy or rooted in falsities, these viewers continue watching, offering a never-before-seen devotion to the network. Using Fox’s coverage of the COVID-19 pandemic, as well as insight from Karl Marx and Walter Benjamin, this paper demonstrates how Fox manufactures its hosts’ performances to advance its fetishizing of the commodity of cable prestige.
