Displacement And Preemption Of Climate Nuisance Claims, Jonathan H. Adler
Displacement And Preemption Of Climate Nuisance Claims, Jonathan H. Adler
Faculty Publications
New York City and other municipalities have filed state-law-based nuisance suits against fossil fuel companies seeking compensatory damages for the consequences of climate change. Previous nuisance claims, filed under federal common law, were held to be displaced by federal environmental statutes. Defendants have argued that state-law-based claims should likewise be preempted. Yet while the enactment of federal regulatory statutes displaces federal common law actions for interstate pollution, such enactments do not necessarily preempt state common law actions, even where pollution crosses state boundaries, as it is more difficult to preempt state common law than it is to displace federal common …

Barry Hoffman Nazi Postcard Collection, Robyn Conroy, Lamisa Muksitu
Strassler Center Archival Collection Finding Aids
This collection is comprised of postcards that are connected to the Nazi Party in Germany. The Nazi Party, officially the National Socialist German Workers' Party (German: Nationalsozialistische Deutsche Arbeiterpartei or NSDAP), was a political party in Germany active between 1920 and 1945 that created and supported the ideology of Nazism. Its precursor, the German Workers' Party (Deutsche Arbeiterpartei; DAP), existed from 1919 to 1920. The Nazi Party emerged from the extremist German nationalist, racist and populist Freikorps paramilitary culture, which fought against the communist uprisings in post–World War I Germany. The party was …

As an urban university nestled in a bustling city, VCU is committed to having all members of the community feel safe in public spaces. The Whistles Against Street Harassment (WASH) initiative aims to improve the safety of our VCU community by (1) providing a whistle, a practical and easyto- use tool that the target or bystanders can use to disrupt street harassment, and (2) raising awareness and dialogue related to street harassment and public safety. RAINN defines street harassment as “unwanted comments, gestures, or acts directed at someone in a public space without their consent.”1 Street harassment is not …

In the aftermath of George Floyd’s murder, abolitionists were repeatedly asked to explain what they meant by “abolish the police”—the idea so seemingly foreign that its literal meaning evaded interviewers. The narrative rapidly turned to the abolitionists’ secondary proposals, as interviewers quickly jettisoned the idea of literally abolishing the police. What the incredulous journalists failed to see was that abolishing police and prisons is not aimed merely at eliminating the collateral consequences of other social ills. Abolitionists seek to build a society in which policing and incarceration are unnecessary. Rather than a society without a means of protecting public safety, …

Mitigating Weight Stigma In The Medical System: Self-Compassion For Nursing Students, Ellen C. Joseph
Mitigating Weight Stigma In The Medical System: Self-Compassion For Nursing Students, Ellen C. Joseph
Electronic Theses and Dissertations
Weight stigma is a form of oppression that has been shown to have a detrimental impact on the well-being of people with higher weight. Healthcare providers are one of the most common sources of weight stigma, and their stigmatizing beliefs have been found to be associated with differential care for patients with “obesity”. The current study aimed to explore the feasibility of the loving-kindness meditation (LKM) as a brief intervention that reduces weight bias in nursing students by increasing self-compassion, positive, other-focused emotions, and cognitive flexibility, in order to improve compassionate care for patients with higher weight. Participants (189 nursing …

Putting The "P" In Pfa: The Electronic Monitoring Of Protection From Abuse Respondents In Pennsylvania, Cameron Kehm
Putting The "P" In Pfa: The Electronic Monitoring Of Protection From Abuse Respondents In Pennsylvania, Cameron Kehm
Duquesne Law Review
Domestic violence violently claimed Alina Sheykhet's life, despite alleged "protection" from a Protection from Abuse Order ("PFA").1 Far from being an exception, Alina's story is yet another example among many cases that show how traditional protective order systems fail those who need protected most.2 However, Alina's Law can protect PFA holders through a new remedy: the electronic monitoring of PFA respondents.3 Although Alina's Law failed to make it out of committee consideration during the 2019-2020 term,4 with three modifications, legislators can reintroduce Alina's Law in a passable form that would protect Pennsylvania's most vulnerable citizens.

Biometrics And An Ai Bill Of Rights, Margaret Hu
Biometrics And An Ai Bill Of Rights, Margaret Hu
Duquesne Law Review
This Article contends that an informed discussion on an Al Bill of Rights requires grappling with biometric data collection and its integration into emerging Al systems. Biometric Al systems serve a wide range of governmental purposes, including policing, border security and immigration enforcement, and biometric cyberintelligence and biometric-enabled warfare. These systems are increasingly categorized as "high-risk" when deployed in ways that may impact fundamental constitutional rights and human rights. There is growing recognition that high-risk biometric AI systems, such as facial recognition identification, can pose unprecedented challenges to criminal procedure rights. This Article concludes that a failure to recognize these …

Comparison Of Effects Of Sleep Fragmentation On Pro-Inflammatory Cytokine Il-1Β Of Male And Female Adult Mice, Manzar Rzayeva
Mahurin Honors College Capstone Experience/Thesis Projects
Sleep plays an essential role throughout the body by affecting the physiological function and regulation of many systems. One of these systems that receives effects as a result of the adequacy of sleep is the immune system. Previous studies have demonstrated effects of sleep fragmentation upon the immune system; however, sexual differences of these effects have not been studied in depth. To analyze these variances amongst the genders, male and female adult mice were subjected to acute sleep fragmentation (SF) for 24 hours in an automated SF cage that includes a bar sweeping across the cage every two minutes. Meanwhile, …

Nebraska Rural Poll
Rural Nebraskans are less positive about the current change and expected future change in their communities this year. The proportion believing their community has changed for the better has typically been greater than the proportion believing it has changed for the worse. However, last year the proportion believing their community changed for the worse was slightly more than the proportion believing it had changed for the better (similar to what occurred in 2003 and 2009). This year, that gap widened a bit.
Despite that, rural Nebraskans are positive about their community by many different measures. Most rural Nebraskans rate their …
Psilocybin Psychotherapy With Acceptance And Commitment Therapy: A Potential Treatment For Social Anxiety Disorder, Elliot Sandberg
Psilocybin Psychotherapy With Acceptance And Commitment Therapy: A Potential Treatment For Social Anxiety Disorder, Elliot Sandberg
[Archive] Belmont University Research Symposium (BURS)
Individuals diagnosed with social anxiety disorder are in need of a more effective therapeutic intervention. Due to the nature of SAD, individuals tend to not seek care for their treatment, leading to the continuation of avoidance behaviors that significantly impact their daily existence. Psilocybin psychotherapy has the potential to lead to significant changes in the personality structure of individuals as well as reducing anxious responses to their environment in a relatively short period of time. Acceptance and commitment therapy can serve as the ideal therapeutic backing to psilocybin as it emphasizes mindfulness and psychological flexibility, both of which aid in …

Refugees Under Duress: International Law And The Serious Nonpolitical Crime Bar, David Baluarte
Refugees Under Duress: International Law And The Serious Nonpolitical Crime Bar, David Baluarte
Scholarly Articles
Congress intended that the serious nonpolitical crime bar under United States asylum law have the same meaning and scope as the 1F(b) Refugee Convention exclusion clause. The Supreme Court has repeatedly held that it was the intent of Congress to not only replicate the language of the provisions of the Refugee Convention in United States law, but to incorporate the full extent of the meaning of such language and bring the United States into compliance with its treaty obligations. Accordingly, when Congress reproduced exactly the language of the Article 1F(b) exclusion clause in the INA, it intended for that provision …
The Constitutional Guarantee Of Criminal Justice Transparency, Aliza Plener Cover
The Constitutional Guarantee Of Criminal Justice Transparency, Aliza Plener Cover
Articles
This Article identifies and explores a transparency guarantee that permeates the Constitution's criminal procedure provisions. This guarantee protects multiple dimensions of transparency - which I categorize as participatory, informational, and corporal--through overlapping structural safeguards and individual rights, and through protections afforded to both the public and the accused. Despite the strength and pervasiveness of the overarching transparency guarantee, the discrete provisions from which it is derived are often peripheral in today's criminal justice system, which is dominated by plea bargaining and incarceration rather than trials and public-square punishment. And, because the constitutional transparency protections are viewed in clause-bound isolation, modern …
