The COVID-19 pandemic has greatly affected human behavior, creating a need for individuals to be more cautious about health and safety protocols. People are becoming more aware of their surroundings and the importance of minimizing the risk of exposure to potential sources of infection. This shift in mindset is particularly important in indoor environments, especially hospitals, where there is a greater risk of virus transmission. The implementation of route planning in these areas, aimed at minimizing interaction and exposure, is crucial for positively influencing individual behavior. Accurate maps of buildings help provide location-based services, prepare for emergencies, and manage infrastructural …
State Sequestration: Federal Policy Accelerates Carbon Storage, But Leaves Full Climate, Equity Protections To States, Gabriel Pacyniak
State Sequestration: Federal Policy Accelerates Carbon Storage, But Leaves Full Climate, Equity Protections To States, Gabriel Pacyniak
Faculty Scholarship
Abstract
The Intergovernmental Panel on Climate Change—the UN’s expert science panel—has repeatedly found that limiting climate change to prevent catastrophic harms will require at least some use of carbon capture and sequestration (CCS), and may entail substantial deployments of this technology. There is significant uncertainty, however, about the level of lifecycle greenhouse gas (GHG) reductions achievable in practice from varying CCS applications; some applications could even lead to net increases in emissions. In addition, a number of these applications create or maintain other harms, especially those related to fossil fuel extraction and use. For these reasons, many environmental justice advocates …

A Vague, Overconfident, And Malleable Approach To Constitutional Law, Michael L. Smith

In New York State Rifle & Pistol Association, Inc. v. Bruen, the Supreme Court overturned a century-old firearms licensing scheme that required people seeking concealed carry permits to demonstrate that they had a special need for self-defense. The Court did so by applying a “historical tradition” approach to determine the scope of Second Amendment protection. Under this approach, where the Second Amendment’s plain text covers an individual’s conduct, a law restricting that conduct must be consistent with “the Nation’s historical tradition of firearm regulation.” At first glance, the historical tradition approach may seem objective and easier than an empirical analysis …

Adding Women To The Conversation On Safe Consumption Sites: A Qualitative Interview Study With Poor And Marginalized Women Who Use Illicit Substances, Kaitlin Waechter
Theses and Dissertations (Comprehensive)
Women’s erasure from discourses pertaining to substance use and safe consumption sites (SCSs) means harm reduction efforts are developed through the male lens. This research seeks to discover why women do (or do not) access SCSs so as to determine if and how SCSs address the unique gendered needs of women who use illicit substances. Semi-structured qualitative interviews were conducted with 14 women-identified individuals who use illicit substances. Participants were recruited from a non-profit organization that offers harm reduction, but is not itself a SCS in order to capture a full range of perspectives on the SCS in their community. …

Common Sense Or Sensibility: Vaccine Hesitancy, Parens Patriae, And The Common Good, George P. Smith Ii

Contending with national emergencies that develop into transnational catastrophes gives rise inevitably to concerns raised by libertarians and utilitarians over the extent to which the government — state, local, and federal — can restrict or redirect personal conduct to contain, if not resolve, any existing emergency condition. Using its parens patriae powers to protect the common good — especially the communal benefits of health and safety — government must endeavor to establish health care policies, and here, mandate vaccinations to combat the COVID-19 pathogen, against the benefits that are accruing to the general public. The conclusion drawn from this Article …

Temporary Access And Permanent Consequences: The Misapplication Of Takings Jurisprudence To State Regulations That Benefit The Public Welfare, Maria Ceriotti
Temporary Access And Permanent Consequences: The Misapplication Of Takings Jurisprudence To State Regulations That Benefit The Public Welfare, Maria Ceriotti
Missouri Law Review
In 1975, California enacted the Agricultural Labor Relations Act. The Act, along with many regulations to aid in its enforcement, came after years of infighting between property owners and agriculture workers for fair pay and better treatment. Deplorable conditions included hourly wages at $0.90/hour, inadequate working standards such as a lack of toilets and segregated housing, and poor treatment from the growers. Cesar Chavez organized what is now the United Farm Workers labor organization, which helps agriculture workers across the country collectively bargain and secure their rights, fair pay, and adequate working conditions.
The Right To Remain Silent. . . Sometimes: Why § 1983 Claims For Miranda Violations Are Necessary To Fifth Amendment Protection, Logan Moore
Missouri Law Review
The police arrive at your workplace and ask to speak with you. Feeling embarrassed and confused, you agree to accompany them to an isolated room to answer questions. As you pass by the concerned looks and accusatory whispers of your co-workers, you wonder to yourself, “what did I do?” Once in the room, the feeling of helplessness becomes insurmountable. The officers have blocked the exit and begin to vehemently accuse you of a crime. Although you adamantly deny any involvement in or knowledge of the crime, the officers seem prepared to keep you in the room until you make a …

Climate Change And Modern State Common Law Nuisance And Trespass Tort Claims, Jack Wold-Mcgimsey
Climate Change And Modern State Common Law Nuisance And Trespass Tort Claims, Jack Wold-Mcgimsey
University of Colorado Law Review
This Comment examines the use of state common law tort claims to address climate change. The aim of this work is not to provide an in-depth examination of these issues, but rather to provide a contextualized and comprehensive overview of some of the most important issues in this field using modern cases actively being litigated. This Comment comes to the conclusion that the future of common law nuisance and trespass claims in the context of climate change is, for now, unclear. Given the national and global implications of climate change, courts may find that isolated states cannot set binding precedents …
Boulder Is For People: Zoning Reform And The Fight For Affordable Housing, Emma Sargent
Boulder Is For People: Zoning Reform And The Fight For Affordable Housing, Emma Sargent
University of Colorado Law Review
The city of Boulder and the Colorado state legislature are both examining potential housing policies to address the growing housing affordability crisis, which reflect similar discussions in other cities and states. Zoning reform must be a central aspect of these housing policy reforms because of its impact on affordability, environmental sustainability, racial desegregation, and the economic stability of cities and states. However, passing zoning reform measures is complicated by local political opposition and the potential for unintended consequences. The best approach to pass zoning reform while ensuring that cities and states truly address housing affordability is to craft zoning reform …
The Second Amendment's "People" Problem, Pratheepan Gulasekaram
The Second Amendment's "People" Problem, Pratheepan Gulasekaram
Publications
The Second Amendment has a “people” problem. In 2008, District of Columbia v. Heller expanded the scope of the Second Amendment, grounding it in an individualized right of self-protection. At the same time, Heller’s rhetoric limited “the people” of the Second Amendment to “law-abiding citizens.” In 2022, New York State Rifle & Pistol Ass’n v. Bruen doubled down on the Amendment’s self-defense rationales but, once again, framed the right as one possessed by “citizens.” In between and after the two Supreme Court cases, several lower federal courts, including eight federal courts of appeals, wrestled with the question whether the right …

Prevailing approaches to addressing environmental justice in Indian Country are inadequate. The dual pursuits of distributive and procedural justice do not fully account for the unique factors that make Indigenous environmental justice distinct—namely, the sovereign status of tribal nations and the ongoing impacts of colonization.
This Article synthetizes interdisciplinary approaches to theorizing Indigenous environmental justice and proposes a framework to aid environmental law scholars and advocates. Specifically, by centering Indigenous environmental justice in terms of coloniality and self-determination, this framework can better critique and improve environmental governance regimes when it comes to pollution in Indian Country.

State Medical Boards (SMBs) can take severe disciplinary actions (e.g., license revocation or suspension) against physicians who commit egregious wrongdoing in order to protect the public. However, there is noteworthy variability in the extent to which SMBs impose severe disciplinary action. In this manuscript, we present and synthesize a subset of 11 recommendations based on findings from our team's larger consensus-building project that identified a list of 56 policies and legal provisions SMBs can use to better protect patients from egregious wrongdoing by physicians.

The Impact Of The Authority Gradient Created By Rank Imbalance On The Role Effectiveness Of U.S. Coast Guard Safety Officers, James Bernard Mccormack
Theses and Dissertations
Coast Guard air station commands have three department heads referred to as the Tri-P, consisting of the safety officer, operations officer, and engineering officer. The safety officer is generally junior in rank to the other members of the Tri-P despite what is advertised as an equal position within the command structure. The purpose of this study was to explore rank imbalance for Coast Guard safety officers at air stations throughout the United States by examining their perceptions in a quantitative survey. All current Coast Guard safety officers were eligible for participation in the survey. The survey revealed that safety officers …
An Investigation Of Change In Drone Practices In Broadacre Farming Environments, Hrishikesh S. Neetye
An Investigation Of Change In Drone Practices In Broadacre Farming Environments, Hrishikesh S. Neetye
Theses: Doctorates and Masters
The application of drones in broadacre farming is influenced by novel and emergent factors. Drone technology is subject to legal, financial, social, and technical constraints that affect the Agri-tech sector. This research showed that emerging improvements to drone technology influence the analysis of precision data resulting in disparate and asymmetrically flawed Ag-tech outputs. The novelty of this thesis is that it examines the changes in drone technology through the lens of entropic decay. It considers the planning and controlling of an organisation’s resources to minimise harmful effects through systems change. The rapid advances in drone technology have outpaced the systematic …

On The Appeal Of Drug Patent Challenges, Charles Duan
On The Appeal Of Drug Patent Challenges, Charles Duan
Scholarly Articles in Law Reviews & Journals
Administrative patent challenge proceedings, the most prominent form of which is inter partes review, have attracted much controversy. In particular, the pharmaceutical industry and its supporters have criticized the proceedings as unfairly biased toward canceling valuable drug patents. Yet there has been little study of the real-world, practical impact of these administrative proceedings on drug patents or pharmaceutical markets.
This Article reviews the universe of administrative challenges on drug patents that have proceeded through appeal to the Federal Circuit. The majority of patents challenged this way are deemed unpatentable at both the agency and appellate levels, and, that administrative cancellation …

Transformers have achieved great success in the task of time series long sequence forecasting (TLSF) in recent years. However, existing research has pointed out that over-parameterized deep learning models are in favor of low frequency and could be difficult to capture high-frequency information for regression fitting task, named spectral bias. Yet the effect of such bias on TLSF problem, an auto-regressive problem with a long forecasting length, has not been explored. In this work, we take the first step to investigate the spectral bias issues in TLSF task for state-of-the-art models. Specifically, we carefully examine three different existing time series …

Learning Through Business Unit Failure: A Study Of Individuals And Mid-Level Managers, Corinna Calhoun
Theses and Dissertations
Research on business failure focuses primarily on entrepreneurs and largely ignores individuals and mid-level managers who comprise most corporate populations. This study aimed to mitigate this gap by exploring how 15 individuals and mid-level managers working in a Fortune 50 technology company experienced failure and how their beliefs impacted their experience and learnings. Qualitative interview data were analyzed using a schema from the literature. The results suggested that emotional regulation, belief in personal agency, and separation of self from work supported learning and positive outcomes. Future research would create deeper insights into the social impacts on emotions and sensemaking and …

BACKGROUND: Financial toxicity (FT) reflects multi-dimensional personal economic hardships borne by cancer patients. It is unknown whether measures of FT-to date derived largely from English-speakers-adequately capture economic experiences and financial hardships of medically underserved low English proficiency US Hispanic cancer patients. We piloted a Spanish language FT instrument in this population.
METHODS: We piloted a Spanish version of the Economic Strain and Resilience in Cancer (ENRICh) FT measure using qualitative cognitive interviews and surveys in un-/under-insured or medically underserved, low English proficiency, Spanish-speaking Hispanics (UN-Spanish,
RESULTS: UN-Spanish Hispanic participants reported high acceptability of the instrument (only 0% responded that the …
