Effects Of Social Activities On Labor Participation Among Middle-Aged And Older Adults In China, Shixun Yuan
Chulalongkorn University Theses and Dissertations (Chula ETD)
This paper empirically explores how social activities affect the labor force participation of middle-aged and older adults using data from the 2018 China Health and Retirement Longitudinal Study (CHARLS). Based on 2SLS and IV-probit regression analyses, where social participation is endogenized, there are three key discoveries. First, social activity is negatively associated with labor force involvement and, when instrumental variables are used to minimize endogeneity bias, the negative effect of social participation is found to be stronger. Second, helping others is the only form of social participation that is positively related to labor participation. Finally, the effect of social engagement …

Challenges Of An Implementation And Enforcement Of Child Safety Seat Law In Thailand, Narisara Pan-Ngam
Chulalongkorn University Theses and Dissertations (Chula ETD)
In Thailand, car accidents are the second leading cause of death among children. According to the Child Safety Promotion and Injury Prevention Research Center (CSIP), in 2019, automobile accidents killed approximately 2500 children aged 1 to 14 years old per year, or 250 children each month on average. Most of the children who died in auto accidents were not wearing seat belts at the time of the crash.Generally, essential safety devices in the car are seatbelts and airbags, which will protect the passengers from fatal injuries when the car crashes. Unfortunately, seatbelt only grants the appropriate protection for adult passengers …

A License To Play: Regulating Location-Based Augmented Reality Gameplay On Public Property, Kate Johnson, Evan Ringel, Amanda Reid

This novel research sits at the intersection of augmented reality gameplay and government licenses for use of public property. Governments have long used licensing schema to assure public safety and order. Augmented reality gameplay on public lands presents a new, contested use of public property. Under our proposed licensing scheme, those wishing to engage in location-based augmented reality (LoBAR) gameplay on public lands would need a license. This proposal is akin to how governments—federal, state, and municipal—have authorized permit schema for use of public property, including rock climbing, geocaching, street performing, and film photography. Our Article offers sample legislation for …
Pitfalls Of Progressive Prosecution, Carissa Byrne Hessick
Pitfalls Of Progressive Prosecution, Carissa Byrne Hessick

This Essay examines the political vulnerabilities facing the progressive prosecution movement, arguing that two core features of its public brand—emphasizing a fundamental break from traditional prosecution and pledging to “do less” by shrinking the criminal justice footprint—have inadvertently exposed reform‑oriented prosecutors to intensified backlash. Drawing on recent examples, the Essay shows how framing progressive prosecution as radically different obscures the long-standing prosecutorial tools these offices still rely on, enabling critics to portray routine exercises of discretion as unprecedented or dangerous. It further explains how decarceral commitments make progressive prosecutors easy targets when crime or disorder rises, both because voters may …

In New York State Rifle & Pistol Ass’n v. Bruen, the Supreme Court held that the constitutionality of modern gun laws must be evaluated by direct analogy to history, unmediated by familiar doctrinal tests. Bruen’s novel approach to historical decision-making purported to constrain judicial discretion but instead enabled judicial subjectivity, obfuscation, and unpredictability. Those problems are painfully evident in courts’ faltering efforts to apply Bruen to laws regulating 3D-printed guns, assault weapons, large-capacity magazines, obliterated serial numbers, and the possession of guns on subways or by people subject to domestic-violence restraining orders. The Court’s recent grant of certiorari in United …

Since the Founding era, governments have banned guns in places where weapons threaten activities of public life. The Supreme Court reaffirmed this tradition of “sensitive places” regulation in District of Columbia v. Heller, and locational restrictions on weapons have become a central Second Amendment battleground in the aftermath of New York State Rifle & Pistol Association v. Bruen. Liberals have criticized Bruen for requiring public safety laws to mimic founding practice, while conservatives have criticized it for licensing regulatory change not within the original understanding. In this Article we argue that Bruen’s analogical method looks to the past to guide …

Alexander Hamilton And Administrative Law: How America’S First Great Public Administrator Informs And Challenges Our Understanding Of Contemporary Administrative Law, Rodger D. Citron
Scholarly Works
Alexander Hamilton’s recognition and reputation have soared since the premiere of “Hamilton,” Lin-Manuel Miranda’s musical about him in 2015. For lawyers, Hamilton’s work on the Federalist Papers and service as the nation’s first Treasury Secretary likely stand out more than other aspects of his extraordinary life. Politics and economics were fundamental concerns addressed by the Framers in a number of ways, including what we now refer to as administrative law—the laws and procedures that guide government departments (or, as we say today, agencies). Indeed, “Hamilton” reminds us that questions of administration and administrative law have been with us since the …

“The Cruelty Is The Point”: Using Buck V. Bell As A Tool For Diversifying Instruction In The Law School Classroom, Tiffany C. Graham

Instructors who are looking for opportunities to expose their students to the ways in which intersectional forms of bias impact policy and legal rules can use Buck v. Bell to explore, for instance, the impact of disability and class on the formation of doctrine. A different intersectional approach might use the discussion of the case as a gateway to a broader conversation about the ways in which race and gender bias structured the implementation of sterilization policies around the nation. Finally, those who wish to examine the global impact of American forms of bias can use this case and the …

Grid Reliability In The Electric Era, Joshua Macey, Shelley Welton, Hannah Wiseman
Coase-Sandor Institute for Law & Economics Research Paper Series
The United States has delegated the weighty responsibility of keeping the lights on to a self-regulatory organization called the North American Electric Reliability Corporation (NERC). Despite the fact that NERC is one of the largest and most important examples of industry-led governance—and regulates in an area that is central to our economy and basic human survival— this unusual institution has received scant attention from policymakers and scholars. Such attention is overdue. To achieve deep decarbonization, the United States must enter a new “electric era,” transitioning many sectors to run on electricity while also transforming the electricity system itself to run …

People are speaking up on social media and in other virtual spaces, sometimes to spur the criminal process, sometimes in response to the criminal system’s perceived failures, and even sometimes completely indifferent to the criminal system. People are expressing moral condemnation. They are shaming, shunning, banishing, and canceling. What are the implications of punishment through virtual spaces, in lieu of the usual—and now seemingly antiquated—space of physical courtrooms? More broadly, when all the world can become a virtual courtroom, a “place” for judgment, what are the implications for how we think about crime itself? And perhaps most importantly, if social …

The theory of carceral abolition entered the mainstream during the 2020 global protests for Black lives. Abolition calls for divestment from carceral institutions like police and prisons in favor of the expansion of social and economic programs that ensure public safety and nurture community well-being. Although there is little scholarship explicitly linking abolition to international human rights, there are scholars and advocates who implicitly echo abolitionist theories by critiquing the international human rights regime's overreliance on criminal law. These critics argue that relying on carceral institutions to address impunity for human rights abuses and promote gender justice does little to …

The United States is the only country that elects its local prosecutors. In theory, these local elections could facilitate local control of criminal justice policy. But the academic literature assumes that, in practice, prosecutor elections fail to live up to that promise. This Article complicates that conventional wisdom with a new, national study of campaign contributions in prosecutor elections. The study offers a more complete empirical account of prosecutor accountability by analyzing contributions to local candidates as well as their election results. It details the amount of money in local prosecutor elections, including from interest groups, and the relationship between …

The Effect Of Place Attachment And Leisure Identity On Stewardship Participation In The Rattlesnake National Recreation Area And Wilderness, Elena Rene Thomas
Graduate Student Theses, Dissertations, & Professional Papers
As outdoor recreation participation increases in the U.S., and many communities in the American West are experiencing rising amenity migration, park and protected area managers face significant challenges to balance both providing for visitors’ desired experiences and protecting the natural resources on which these experiences depend. Confronted with declining management capacity, agencies are increasingly looking to engage both newer and established recreationists in stewardship behaviors to help maintain these areas and improve human-environment relationships. One barrier to community involvement in stewardship efforts is the need to better understand the connection between recreationists’ antecedent conditions and their motivations to steward. Past …
Guns And Times: Originalism And The United States Supreme Court Decision In New York State Rifle & Pistol Association, Inc. V. Bruen, 597 U.S. ___ (2022), Haven Gray
Harriet L Wilkes Honors College Theses 2020 - Present
The recent United States Supreme Court decision in New York State Rifle & Pistol Association, Inc. v. Bruen, 597 U.S. ___ (2022), written by Justice Clarence Thomas, established that states enacting restrictions on the Second Amendment right to keep and bear arms must now demonstrate that their restrictions are “consistent with the Nation’s historical tradition of firearm regulation”. The notion that the Supreme Court should defer to historical sentiments and the perceived original intent of the framers of the Constitution is known as originalism and is becoming increasingly prevalent in the decisions of the Court. Originalism fails in that it …
