Forming A More Perfect Union With Blockchains And Nfts: Why The United States Should Embrace An E-Government, Alexandria Labaro
Fordham Intellectual Property, Media and Entertainment Law Journal
This Note analyzes blockchain and non-fungible token (“NFT”) technology in the government, emphasizing the benefits of technological integration for improved data security and streamlined bureaucratic processes. It follows the growing popularity of “e-government” practices across the globe and considers factors associated with integrating blockchain and NFT technology in U.S. governmental procedures.
Good Readers, Good Writers, And Ai: Tool, Collaborator, Author?, Katherine Jung
Good Readers, Good Writers, And Ai: Tool, Collaborator, Author?, Katherine Jung
Fordham Intellectual Property, Media and Entertainment Law Journal
Artificial Intelligence (“AI”) systems have revolutionized the world of creative writing. Beyond providing simple grammar or spelling assistance, the most advanced of these systems can now play a collaborative role in the writing process, increasing productivity while pushing content in new and surprising directions. AI-generated creativity raises compelling questions in the context of copyright law, which has long been predicated on the assumption of human authorship. The capacity of AI to one day generate writing at a level of mastery on par with human beings complicates traditional notions of creativity, the protection of which the entire copy …
Algorithmic Dead Hands: What Is Dead May Never Die, Zachary L. Catanzaro
Algorithmic Dead Hands: What Is Dead May Never Die, Zachary L. Catanzaro
Fordham Intellectual Property, Media and Entertainment Law Journal
Can we transcend death? By harnessing large language models and the invasive data harvesting of surveillance capitalism, AI systems now offer testators unprecedented posthumous control over property and heirs. These algorithmic ‘dead hands’ promise a seductive form of digital immortality, but if left unchecked, they threaten to spawn a novel breed of perpetuities. This technology risks birthing a digitized techno-feudal Necrocracy marked by inalienable property, extreme wealth consolidation, and the dead’s perpetual dominion over the living.
While modern reforms have weakened the common law’s traditional hostility to dead hand control, these reforms failed to anticipate technologically embodied intentionality persisting beyond …
Connection In An Age Of Connectivity: An Evaluation Of Synchronous And Asynchronous Law Classrooms, Mary Kate Kearney, Miranda E. Thompson
Connection In An Age Of Connectivity: An Evaluation Of Synchronous And Asynchronous Law Classrooms, Mary Kate Kearney, Miranda E. Thompson
Western New England Law Review
As the world was thrust into a global pandemic, legal education was forced to confront the evolution of technological teaching modalities. While these technological advances allowed legal education to prosper in the short-term emergency education situation, their continued use creates barriers between the student and teacher which diminishes a student’s ability to develop critical lawyering skills. Based on our own roles as professor and student, we agree that deviating from in-person education will have detrimental effects for teachers and students and will undermine the collaborative relationship of the classroom. Legal institutions have refined in-person teaching methods, such as the Socratic …
The Problem With The Performance Of Alternative Or Military Service Of Ukrainian Adventists In War Conditions, Valentyna Kuryliak Dr
The Problem With The Performance Of Alternative Or Military Service Of Ukrainian Adventists In War Conditions, Valentyna Kuryliak Dr
Occasional Papers on Religion in Eastern Europe
The article discusses the lack of legal documentation faced by Ukraine in defending its borders and national interests, taking into account its historical experience. Attention is drawn to the issues encountered by Protestant churches, especially, but not exclusively, the Seventh-day Adventist Church. A proposal has been made to utilize the volunteer non-combatant potential of churches, regulating it legislatively without involving the Ukrainian court system. The question of alternative (non-combatant) service during mobilization and in times of war in Ukraine is analyzed. The author argues the necessity of preserving the right to alternative service for church members, which according to the …

Factors Contributing To Self-Medication And Quality Of Life Of Myanmar Immigrants In The Covid-19 Pandemic Situation, Su Myat Thin
Chulalongkorn University Theses and Dissertations (Chula ETD)
Background: Due to numerous difficulties in accessing necessary healthcare and standard medication, immigrants might be more likely to rely on self-medication to solve health problems they suffered. Although it might provide immediate relief, it could also bring some risks such as adverse drug reactions, antimicrobial resistance progression, drug side effects, and toxicity. This study aimed to identify the healthcare service accessibility and self-medication of immigrants in Thailand for COVID-19. Additionally, this study also aimed to evaluate the effect of immigrants’ COVID-19 perception on their self-medication uses and quality of life. This study had two phases in which the first phase …

(2024) Different Maps, Same Territory: Dialogical Self Theory And Its Predecessors, David Kennedy
(2024) Different Maps, Same Territory: Dialogical Self Theory And Its Predecessors, David Kennedy
Collected Papers of David Kennedy
Dialogical Self Theory has not emerged in a historical vacuum. Its fore-runners, whether the Eastern Atman, the tripartite Platonic self with itsclear hierarchical relations, the Cartesian “ghost in the machine,” theFreudian ego-id hydraulic model or the Jungian topography of ego andunconscious, represent the theoretical grounding from which the dia-logical self has emerged and self-articulated as much as have WilliamJames, George Herbert Mead and Mikel Bakhtin. Most of them, includ-ing DST, center on developmental models, and see the self as intrinsi-cally oriented toward a more integrated sense of itself that Jung called“wholeness,” although their internal politics differ. Plato is an authoritar-ian, …
Adolescent And Young Adult Gun Violence In Baltimore, Maryland, Andrew Stewart
Adolescent And Young Adult Gun Violence In Baltimore, Maryland, Andrew Stewart
Selected Social Change Portfolios in Prevention, Intervention, and Consultation
Goal Statement: The goal of this social change portfolio is to raise awareness of the factors that contribute to adolescent gun violence in low socioeconomic communities by developing strategies on the grassroots level.
Significant Findings: Gun violence is the leading cause of death for African Americans aged 15 to 24 (American Public Health Association, 2020). The crude rate of gun violence in Maryland is higher than the national average (CDC, 2024b). Growing up in a neighborhood where violence is prevalent leads individuals to engage in more risky behavior (Maroufi, 1999; Milam et al., 2016).

Hypothetical Mistakes: Hedging Wrong Answers With Conditional Language., Jessica Sujata Chandras
Hypothetical Mistakes: Hedging Wrong Answers With Conditional Language., Jessica Sujata Chandras
UNF Faculty Research and Scholarship
This article analyzes American high school students hedging incorrect responses to teacher-initiated questions in IRE (Initiation-Response-Evaluation) format using conditional language and hypotheticals in ways that facilitate an affiliative stance between students and their teacher. Scholarship on hedging details its use to approximate responses as a shield against doubt and criticism or as collaborative communication, whereas stance is a grammatically encompassed expression of attitudes related to the content of a message. This study brings together theories of stance, hedging, and conditional language use to outline how errors can be a student-initiated pedagogical tool to deepen explanations and engagement. To broaden understanding …
Current Clinical Concepts: Nonoperative Management Of Shoulder Instability, Margie K. Olds, Timothy L. Uhl
Current Clinical Concepts: Nonoperative Management Of Shoulder Instability, Margie K. Olds, Timothy L. Uhl
Physical Therapy Faculty Publications
Nonoperative management after shoulder dislocation or subluxation remains a challenging and complex task. Accurate diagnosis of the condition and shared decision-making regarding operative and nonoperative management and timing of return to play is required. In this Current Clinical Concepts paper, we introduce a shoulder instability framework that addresses these fundamental clinical dilemmas. Valid clinical prognostic tools that can be used to predict recurrent shoulder instability are reviewed. The process of shared decision-making in the realm of shoulder instability is presented. Finally, a framework for progressive rehabilitation that addresses deficits in motor control, strength, and endurance in scapular and shoulder musculature …
Political Polarization And The Dynamics Between Actual Income And Perceived Income Inequality In The United States, 1987 To 2021, Cary Wu, Kriti Sharma, Edward Haddon, Francesco Duina
Political Polarization And The Dynamics Between Actual Income And Perceived Income Inequality In The United States, 1987 To 2021, Cary Wu, Kriti Sharma, Edward Haddon, Francesco Duina
All Faculty Scholarship
The rich often perceive lower levels of inequality than the poor. In recent decades, however, notions regarding the equality or inequality of our society have progressively taken on a more political nature. Consequently, people’s perceptions of income inequality may be less associated with their actual income status and more with their political ideology. The authors visualize this “political turn” using data from the U.S. General Social Survey (1987–2021). The analysis shows that historically actual income and perceived inequality had an inverse relationship, independent of political alignment. Yet since 2000, this has changed: whereas Republicans show a deepening inverse correlation after …
Therapeutic Play: Adult Puzzling And Hard Times, Anne D. Williams
Therapeutic Play: Adult Puzzling And Hard Times, Anne D. Williams
All Faculty Scholarship
The author examines the therapeutic value of puzzles for adults during two major crises in the United States, the Great Depression of the 1930s and the COVID-19 pandemic of the early 2020s. Each period saw a huge surge in jigsaw puzzling throughout the country, she finds, and in both cases people turned to home-based leisure activities, either for financial reasons or because of lockdowns. Contemporary accounts from the two periods form the basis for the discussion. In both cases, the surge in puzzling reflected both the demand by consumers and the relatively easy entry of new small-scale producers into this …

Conceptualizing Language Ideologies About Education: Exploring Perceptions Of Multilingualism Among Marathi Speakers From India, Priya M. Dabak, Jessica Sujata Chandras
UNF Faculty Research and Scholarship
Perceptions of multilingualism have an impact on the educational choices of urban Indians and larger policy decisions around language in education in the Indian state of Maharashtra. By surveying 150 speakers of Marathi, the official language of the state and mother tongue, or first language of survey respondents, perceptions of multilingualism reveal conceptual assumptions and biases that can be uncovered through cognitive-linguistic analysis. Unprompted, survey respondents drew connections between multilingualism and education, underscoring language ideologies, or beliefs about languages which motivate urban Maharashtrians' educational decisions. Education is the stage upon which multilingual speakers in India express their aspirations and anxieties …
Collectivism And Efficacy: Relationship To Academic Performance In Early Adolescents, Richvinder Kaur
Collectivism And Efficacy: Relationship To Academic Performance In Early Adolescents, Richvinder Kaur
Selected Full-Text Master Theses 2021-
This study explored the mathematics efficacy beliefs of 270 South Asian (Indo American) immigrant and Anglo American nonimmigrant 7th grade students. Self-efficacy beliefs strongly predicted mathematics performance for both cultural groups, but there were differences between the 2 groups in the sources of self-efficacy, the predictiveness of the secondary motivation variables. It is argued that the Indo American students are more vertical or hierarchical than the Anglo-American students and that comparison with others strongly influences their motivation beliefs and the formation of their efficacy beliefs. Self-efficacy in some cultures may be more other-oriented than is typically seen in Western cultures. …
Illustrating The Fantastic: Cross-Writing Illustrations In British Children’S Literature Of The Golden Age, Stephanie Montalti
Illustrating The Fantastic: Cross-Writing Illustrations In British Children’S Literature Of The Golden Age, Stephanie Montalti
Theses and Dissertations
This dissertation argues that British children’s literature of the Golden Age addresses children and adults through their illustrations. It considers why the nineteenth century experienced a proliferation in fantasy and illustration, as well as why Golden Age children’s texts appeal to mixed-age audiences. Through an application of the term “cross-writing,” I argue that the Golden Age of children’s literature did not think of audiences in a binary manner, as some children’s literature scholars tend to assert. Instead, they used the dual mode of textual and visual narration to complicate the boundaries between childhood and adulthood. I also offer an original …

The Supreme Court concluded its 2023 decision barring affirmative action in university admissions with a qualification: although they may not give weight to “race qua race,” universities may consider individual applicants’ discussion of race-related life experience that bears on their strengths and potential. This “essay carveout” provides a potential path forward for universities (and other entities to which the affirmative-action ban may eventually apply). But the Court also warned against using it to enact “indirect” affirmative action, and legal advocates of colorblindness stand poised to challenge any use of essays that appears to stray over this line. So where is …

The Shadow Of The Law Of The Police, Adam Davidson
Public Law and Legal Theory Working Papers
Joanna Schwartz’s Shielded: How the Police Became Untouchable is, in many ways, a triumph. It catalogues the laws regulating police with a breadth and depth unexpected from a book targeted to a popular audience, and it does so in gripping style. Although her ability as a researcher is well known to those who have encountered her earlier work, it is Schwartz’s ability as a storyteller that sets Shielded apart and makes the stakes of these doctrinal discussions clear. Admittedly, for those lawyers, judges, and academics who come to Shielded already familiar with Schwartz’s academic work, there is little new analytical …

Global Communities: The Potential Of Street Art And The Public Space, Elena Picech
The Coastal Review
This paper highlights the significance of physical proximity and the potentiality of socio-spatial situations as tools to enrich study abroad programs. Particular attention is given to street art and the public space. While, studying on-site can be somewhat uncomfortable, it can potentially prompt unique reflections, enhance student’s learning and encourage introspection. Being on-site provides the opportunity to come into contact and to connect with the physical objects and their environment. It enables a multisensory and immersive embodied experience. Leveraging art for communicative educational activities can facilitate a participatory experience, promote critical thinking and enhance cultural understanding.
