Past, Prologue, And Constitutional Limits On Criminal Penalties, Maria Hawilo, Laura Nirider
Past, Prologue, And Constitutional Limits On Criminal Penalties, Maria Hawilo, Laura Nirider
Journal of Criminal Law and Criminology
Most criminal prosecutions occur at a level that is both neglected by many legal scholars and central to the lives of most people entangled in the criminal legal system: the level of the state. State v. Citizen prosecutions, which encompass most crimes ranging from robbery to homicide, are governed both by the federal constitution and by the constitution of the prosecuting state.
This is no less true for sentences than for prosecutions. When it comes to sentences, state courts are bound by the Eighth Amendment to the United States Constitution, which famously proclaims that no American shall be subjected to …

"The Clearest Proof": Constitutional Concerns Surrounding The Illinois Sexually Violent Persons Commitment Act, Ethan Solomon
Journal of Criminal Law and Criminology
The Illinois General Assembly enacted the Sexually Violent Persons Commitment Act (SVPCA) in 1998, allowing the State to petition for the indefinite detention of those who have committed sexually violent crimes if those individuals have mental illnesses that predispose them to commit further crimes in the future. Although the United States Supreme Court has upheld similar state statutes as constitutional in the past, the SVPCA does not comport with the Court’s basic requirements for such statutes because it is functionally punitive and implicates traditional goals of punishment. Moreover, § 40(b)(5) of the SVPCA, which pertains to conditional release, violates two …
A New Theory Of Gun Control: A Federal Regulatory Blueprint To Hold America's Firearms Industry Accountable For Mass Shootings, Carl Stier
Journal of Criminal Law and Criminology
In 2005, President George W. Bush signed the Protection of Lawful Commerce in Arms Act (PLCAA) into law, granting the firearms industry near-perfect legal immunity. PLCAA shifted the risk of firearm production, distribution, marketing, and injuries to the public. Two decades ago, mass shootings were anomalies. Today, they are alarmingly common. From 2021 to 2023, the United States averaged 663 yearly mass shootings, and from 2004 to 2022, active shooter events spiked 1,150%. The larger gun violence epidemic now costs taxpayers over $550 billion annually, forcing Congress to seek solutions with increasing desperation. However, new state laws and lawsuits targeting …
Abolition Of What?, Christopher Lewis, Adaner Usmani
Abolition Of What?, Christopher Lewis, Adaner Usmani
Journal of Criminal Law and Criminology
This Article defends a structural theory of the brutality of the carceral state. We argue that American penal systems are destined to be inhumane, barring sweeping changes to the social and economic order of the United States; and that prison and police abolition are neither sufficient nor necessary to bring these kinds of changes about.
This theory stands on two premises. First, we defend The Principle of Less Eligibility, which holds that it is politically infeasible for capitalist democracies to permit the incentives to defy the law to exceed those to obey it. As we show, the Principle of Less …
Excessive Force In Prison, Sharon Dolovich
Excessive Force In Prison, Sharon Dolovich
Journal of Criminal Law and Criminology
Any time a correctional officer (CO) physically assaults someone in prison, their conduct demands an especially compelling justification and robust ex post scrutiny. Instead, governing Eighth Amendment doctrine almost entirely defers to COs’ own judgments as to the need for force. This highly deferential approach is especially ill advised given the institutional culture of the modern American prison, which systematically demonizes and dehumanizes people in custody and thus primes COs to use violence unnecessarily. Even a standard of “objective unreasonableness” would not suffice to prevent case outcomes from reflecting a callous indifference to the safety of people in prison. What …
Legislatures And Localized Resentencing, Ronald F. Wright, Kay L. Levine
Legislatures And Localized Resentencing, Ronald F. Wright, Kay L. Levine
Journal of Criminal Law and Criminology
Recent legislation, exemplified in statutes from California and Washington, creates new methods for resentencing defendants in old cases. These laws place controlling authority for resentencing in the hands of local officials, especially local prosecutors, and invite variation at the county level.
While some new procedural channels for reducing the sentences of people convicted of past crimes are mandatory, in that they entitle certain defendants to resentencing if they were convicted of certain crimes or were subject to certain penalty enhancements that are no longer valid, other statutes create discretionary resentencing channels. In the discretionary channels, the chief local prosecutor has …

Constructing And Evaluating A Predictive Model For Cardiovascular Disease Based On Brfss Data, Hongyi Xu
Public Health Theses
Background Cardiovascular disease (CVD) is one of the leading causes of morbidity and mortality worldwide. There are several studies researching the risk factor of cardiovascular diseases based on BRFSS data in recent years, but there is still a lack of comprehensive research and further discussion is needed for the prediction of CVD. This study aims to provide a systematic CVD prediction model based on BRFSS survey data
Method In this study, the subjects’ characteristics factors will be summarized in tables separated by different aspects and CVD groups. Two-thirds of the records will be randomly selected as the training set to …

Trauma-Informed Digital Health Interventions: A Scoping Review, Amelea Lowery
Public Health Theses
Background: Trauma exposure is a pervasive issue around the world and the impacts of trauma can be long lasting and detrimental to individual and population health outcomes. Trauma responses can influence and determine an individual or community’s approach in seeking supportive resources. Given the critical role of supportive resources and the prevalent use of technology and internet use, it is essential to understand how digital health interventions contribute to addressing trauma explicitly. This scoping review aims to explore the landscape of trauma-informed digital health interventions for adults, assess their outcomes, and identify their measurable impacts across various settings. Methods: A scoping …
Association Of Immune Checkpoint Inhibitor Approval On Suicide Rates Among Patients With Cancer: A Pre-Post Analysis With Seer, Rachel Wang
Public Health Theses
Objective: Patients with cancer are at elevated suicide risks compared to the general population, and patients diagnosed with advanced cancers have higher suicide risks compared to those diagnosed with early-staged cancers. Immune Checkpoint Inhibitors (ICIs) were initially approved to treat metastatic melanoma, non-small cell lung cancer (NSCLC), and renal cell carcinoma (RCC), and an unpublished study observed a decreased suicide risk in patients with these cancers at all stages. This study evaluates suicide risks in patients with breast, colorectal, liver, pancreatic, and prostate cancer, of which ICIs have limited effects on, to assess if the lower suicide rates observed previously …
Exploring The Factors Of Sleep Quality: An Integrated Analysis Of Data From Questionnaires And Environmental Sensor Data, Jiaqian Xu
Public Health Theses
Sleep quality plays a crucial role in human health, but its determinants remain incompletelyunderstood. This integrated analysis investigates the relationships of demographic characteristics, living habits, as well as psychological factors on sleep quality. It also ranks the importance of sleep discomfort and examines the effect of bedroom air quality on sleep quality. Results showed stress had a significant negative correlation (r = -0.66) with sleep quality. Furthermore, nocturnal bathroom usage was the most influential predictor, contributing approximately 17.5% to sleep quality ratings using random forest classification. Air quality measures, including carbon dioxide (CO2) levels, temperature, relative humidity, and particulate matter …

Proximal Discourses In Residential Facility Care Providers’ Sense-Making Of Their Communication With Family Members Of A Loved One With Alzheimer’S Disease, Aimee E. Miller-Ott, Tristin Evans
Faculty Publications - Communications
Families often stay involved in the care of a loved one with Alzheimer’s disease even after relocation to a residential care facility, and through this transition, communication between the residential care providers and families becomes integral to keeping family informed and providing good care to the patient. However, care providers of people with Alzheimer’s living in residential facilities find themselves overwhelmed by expectations related to their caregiving role and struggle with making sense of their experiences. Fifteen care providers of people with Alzheimer’s disease living in a residential facility participated in qualitative, semi-structured interviews. Using relational dialectics theory as the …

Raising The Bar In Child Welfare Law, Diane M. Sumoski
Raising The Bar In Child Welfare Law, Diane M. Sumoski
SMU Law Review
This article explores the unique opportunities arising from child welfare law practice in clinical legal education. While training law students for lawyering in all practice areas, the clinic can also inspire experienced child welfare practitioners to raise the level of their practice. The article provides an overview of the child welfare practice in Texas, the various roles of lawyers in the system, the special training required for these lawyers, and how the lawyers are employed and paid. The article proposes that the clear impact of child welfare legal practice on clients, combined with its interdisciplinary complexity, creates an ideal combination …

Impact Of An Education Program On Screening For Non-Alcoholic Fatty Liver Disease In Patients With Type 2 Diabetes, Lauren Rucker
Impact Of An Education Program On Screening For Non-Alcoholic Fatty Liver Disease In Patients With Type 2 Diabetes, Lauren Rucker
Doctor of Nursing Practice Projects
Type 2 Diabetes Mellitus (T2DM) has the potential for multiple complications which include non-alcoholic fatty liver disease (NAFLD). The American Diabetes Association (ADA) updated its guidelines recommending screening of patients with T2DM for NAFLD (ADA, 2023). Screening is prompted by the increased incidence of NAFLD in patients with T2DM. Approximately 70% of people with T2DM suffer from NAFLD which can progress to hepatic steatosis or non-alcoholic steatohepatitis (NASH) (ADA, 2023). NALFD is a common diagnosis leading to the need for liver transplantation (Alkhouri et al., 2020). This project aims to determine if an education program for primary care providers and …
Health Consequences Of Racial Disparity In Access To Abortion: A Systematic Review, Lacy M. Frye, Calvin Odhiambo
Health Consequences Of Racial Disparity In Access To Abortion: A Systematic Review, Lacy M. Frye, Calvin Odhiambo
University of South Carolina Upstate Student Research Journal
Prior to the 2022 Dobbs decision, Black women already experienced negative maternal health outcomes at an alarmingly disparate rate in comparison to White women. Given that the Dobbs decision emboldens state power to enforce abortion restrictions or protections, there has been significant strides made in both directions. Nonetheless, within states where reproductive rights have been significantly eroded, the heightened abortion restrictions may compound the limited access that Black women previously had before Dobbs. This, in turn will exacerbate the already disparate negative maternal outcomes that Black women experience. However, research on the relationship between the lack of access to abortion …

Multifaceted Challenges And Opportunities: Concurrent Mixed Methods Research To Investigate Chinese Exchange Students' Experiences In The Us Transnational Online Learning Ecology, Xinyue Ren, Yi Zhou
STEMPS Faculty Publications
Transnational online education has become an emerging trend in promoting academic collaboration and exchange in higher education during and after the pandemic. Guided by the learning ecology framework, we conducted concurrent mixed methods research by distributing an online survey to Chinese students (N=51) to collect quantitative and qualitative data. This helped us deeply understand their experiences and perceptions of a cross-cultural online learning environment in the United States. We applied multiple regression and thematic analysis to analyze the data. The merging of both types of data analysis indicated the confirmation of the importance of discipline-based English learning environments, the transformation …

Reliability And Validity Of The Turkish Version Of The Infant Motor Activity Log In Infants With Upper Extremity Functional Asymmetry: How Often And How Well?, Kübra Seyhan Biyik, Cemi̇l Özal, Kivanç Deli̇oğlu, Mi̇ntaza Kerem Günel
Turkish Journal of Medical Sciences
Background/aim: Functional asymmetry in the upper extremities may occur in infants with neuromotor problems due to neurodevelopmental or musculoskeletal disorders. The aim of this study was to investigate the validity and reliability of the Turkish version of the Infant Motor Activity Log Scale (IMAL-T), which asks about the frequency (how often) and quality (how well) of the affected arm usage during activities in infants with functional asymmetry in the upper extremities.Materials and methods: The IMAL-T was administered face-to-face to parents of 102 infants (60 infants at high risk of cerebral palsy (CP) and 42 infants with brachial plexus birth injury …
The Private Law Of Self-Help, João Marinotti
The Private Law Of Self-Help, João Marinotti
Articles by Maurer Faculty
Individuals regularly take steps to protect themselves, their property, and their broader legal interests. They carry pepper spray, have guard dogs, and install fences. Such measures are colloquially deemed methods of self-help. Yet, despite its ubiquity, self-help as a legal concept has been chronically understudied. Consequently, American private law is missing a doctrinally coherent and prescriptively useful framework for self-help. As a matter of legal theory, this conceptual void is problematic in and of itself; the doctrinal incoherence stemming from this analytical gap decreases the law’s stability and undermines its predictability.
But the concern is not merely theoretical. The magnitude …

The Association Between Vigour And Flexibility With Injury And Alertness During Shift Work, Lee Di Milia, Janet L. Barnes-Farrell, Rick A. Laguerre, Simon Folkard
Management Faculty Research and Publications
Models of shift work and health suggest that individual differences in circadian rhythm characteristics may moderate the relationship between night shift work and injury, but this argument has not been directly tested. In this study, we tested the efficacy of two circadian rhythm characteristics—vigour and flexibility—as moderators of the path between shift work and injury. In addition, we aimed to replicate the association between vigour, flexibility, and alertness by time of day, and the measurement properties of the Circadian Type Inventory. We recruited 401 healthcare workers from Australia and Great Britain. After controlling for confounding variables, the results showed that …
