Due to mandates of the Every Student Succeeds Act (ESSA), each state currently creates an individualized plan to narrow the gap. This study allowed for understanding of how the percentage of the total amount of received funds within different funding domains predict student achievement. This study specifically examined Comprehensive Support Improvement and Targeted Support Improvement allocated funds provided through federal Title 1 1003 funds mandated through ESSA within a state designated framework. Within this longitudinal, ex post …

Policing The College Campus: History, Race, And Law, Vanessa Miller, Katheryn Russell-Brown Jan 2023

Policing The College Campus: History, Race, And Law, Vanessa Miller, Katheryn Russell-Brown

Washington and Lee Journal of Civil Rights and Social Justice

The structure, impact, and historical roots of campus policing on the American college campus receives little academic attention. In fact, campus policing is often overlooked in legal analyses and research studies, including its relationship to race. Campus policing and race deserves a critical assessment from legal scholars because race is fixed to the ways the criminal-legal system presents itself on campus. The racialized implications of policing on campus are rooted in historical social and legal contexts that still exist today. However, the lack of research on campus policing is not surprising. American colleges and universities have successfully marketed themselves as …

High Anxiety: Racism, The Law, And Legal Education, Elayne E. Greenberg Jan 2023

High Anxiety: Racism, The Law, And Legal Education, Elayne E. Greenberg

Washington and Lee Journal of Civil Rights and Social Justice

Conspicuously absent from the United States’ ongoing discourse about its racist history is a more honest discussion about the individual and personal stressors that are evoked in people when they talk about racism. What if they got it wrong? The fear of being cancelled -- the public shaming for remarks that are deemed racist -- has had a chilling effect on having meaningful conversations about racism. What lost opportunities!

This paper moves this discussion into the law school context. How might law schools rethink their law school curricula to more accurately represent the role systemic racism has played in shaping …

Pandemic Silver Lining: Discovering The Reasonableness Of Remote Learning As An Accommodation Under The Ada, Kaitlyn Barciszewski Jan 2023

Pandemic Silver Lining: Discovering The Reasonableness Of Remote Learning As An Accommodation Under The Ada, Kaitlyn Barciszewski

Washington and Lee Journal of Civil Rights and Social Justice

As society returned to “normal” following the worldwide pandemic caused by the outbreak of COVID-19, higher education students around the world could be heard celebrating and warmly welcoming their return to in-person classes. With this return came the face-to-face social interactions most longed for through the worldwide lockdown with friends, classmates, and professors. Some may even feel that in-person learning is more effective than what had become the norm––Zoom university. At this moment, however, these institutions can and should evaluate the potential benefits and continued utility of this alternate way of doing higher education that was forced upon them for …

Hollywood At Home: Applying Federal Child Labor Laws To Traditional And Modern Child Performers, Shannon Kate Mcgrath Jan 2023

Hollywood At Home: Applying Federal Child Labor Laws To Traditional And Modern Child Performers, Shannon Kate Mcgrath

Washington and Lee Journal of Civil Rights and Social Justice

In the past few years there has been a rise in online influencers who gain money and fame from their online content, and in many cases these influencers are children. Although this can be seen as a “job,” federal child labor laws exempt all child performers from protections. This means traditional child actors and children who create online content must rely on state laws regarding child labor. While some states have protections for child performers, several states have no such laws in place. In addition, the current protections are not available to children who take part in online content. Without …

The Perils Of Privatization: Exploring The Side Effects Of Privatized Correctional Health Care In Favor Of A Public Delivery Model, Peyton Holahan Jan 2023

The Perils Of Privatization: Exploring The Side Effects Of Privatized Correctional Health Care In Favor Of A Public Delivery Model, Peyton Holahan

Washington and Lee Journal of Civil Rights and Social Justice

On July 16, 2020, Judge Roslyn Silver of the U.S. District Court for the District of Arizona set a trial between Arizona’s Department of Corrections and a class of Arizona’s prisoners alleging grossly inadequate health care in the state’s prison system. Arizona, like more than half of the states in the U.S., has outsourced prison health care to private correctional healthcare providers. While correctional healthcare providers win states over with promises of cost-effective care and limited liability, ever since the emergence of the correctional healthcare industry in the 1970s, problems with privatized health care in jails and prisons have persisted, …

Identification Of Precancerous Oral Lesions Using Minimally Invasive Sampling Techniques And Raman Microspectroscopy, Isha Behl Jan 2023

Identification Of Precancerous Oral Lesions Using Minimally Invasive Sampling Techniques And Raman Microspectroscopy, Isha Behl

Conference papers

The gold standard diagnosis of oral pre-cancer/cancer is an invasive biopsy followed by a histological examination, which may present psychological trauma and risk of infection to patients. Moreover, multiple biopsies are often required to monitor precancer lesions' progression. With the aim of reducing the need for multiple biopsies, this study was undertaken to identify pre-cancerous lesions using minimally invasive brush biopsy and saliva samples, analysed by Raman spectroscopy.

Towards Perceiving Teaching As A Joint Task In An Individualized Teaching Qualification Program For Mid-Level Academics At A German University Of Technology, Ulrike Bulmann, Nicole Podleschny

Practice Papers

Empowering teachers for facilitating modern engineering education is essential. Thus, universities put much effort in qualifying teachers in didactic training programs. Especially individualized programs have been positively evaluated in the Covid-19- year 2020 by participated teachers. However, participants missed (informal) networking opportunities. Two questions arise: How do participants perceive their qualification program in the coming years? And second, how can we design a program that balances the participants’ thirst for an individual program compilation while establishing university-wide networking opportunities among teachers? This paper presents participants’ perceptions on a qualification program at a German University of Technology for the years 2021 …

A Survey To Evaluate Laboratory Activities Across An Undergraduate Engineering Degree Programme: Data From Five Years Showing Repeatability And Sensitivity, Peter Johnson

Practice Papers

Laboratory activities are an essential part of an undergraduate engineering education. This paper focuses on evaluating the student experience of laboratory activities. We present a laboratory-specific survey used with large cohorts of students (200) about laboratory activities across an undergraduate Mechanical Engineering degree programme. The key question we try to answer is whether the results of the survey can be used to inform teaching decisions such as which activities need improvement; how to improve them; and to validate these interventions.

We present nine common questions that were used to evaluate activities across a programme. We present five years of data …

Teaching Sustainable Logistics As A Project-Based Learning Course, Carsten Deckert, Ahmed Mohya Jan 2023

Teaching Sustainable Logistics As A Project-Based Learning Course, Carsten Deckert, Ahmed Mohya

Practice Papers

Sustainable logistics combines the task of the 6R of logistics (right product, right place, right time, right condition, right cost) with social and environmental sustainability, especially low emissions and low resource consumption. This means that a problem that is already challenging, namely planning, executing, and controlling logistical processes, gets even more complex and requires aspects of systems thinking to incorporate environmental and social impacts. Classical approaches of teaching, e.g. lectures with presentations and short exercises on closed problems, do not do justice to the complexity and intricacies of the topic sustainability. In such a context, projectbased learning (PBL) where students …

Practice Papers

The under-representation of women studying engineering in higher education is gaining increasing attention in Universities throughout Europe and other jurisdictions. This has led to underrepresentation of women in many of the professions in the Science, Engineering and Technology fields also. Numerous initiatives and programmes are being developed in universities to gain more information about the embedded issues in these disciplines that inhibit female applicants or lead to unsuccessful outcomes in university programmes. One such initiative that has been developed and piloted in Technological University Dublin (Ireland) is a mentoring programme called ‘Equality in Science and Technology by Engaged Educational Mentoring …

Guest Editorial: Building Performance And Sustainable Infrastructure: Unsustainable Return To Practice, Christopher Gorse, Colin Booth, Lloyd Scott Jan 2023

Guest Editorial: Building Performance And Sustainable Infrastructure: Unsustainable Return To Practice, Christopher Gorse, Colin Booth, Lloyd Scott

Articles

The abrupt decline in global carbon emissions experienced during the pandemic was not sustainable. Overwhelmingly, this is evidenced by the advanced economies’ swift return to close to pre-pandemic levels and, of greater concern, the total global use of fossil fuels has rebounded to their highest level in history (IEA, 2021; Jackson et al., 2022). Unfortunately, post-pandemic, the anthropic life threating activities have resumed.

Rooted: Metaphors And Judicial Philosophy In Artis V. District Of Columbia, Richard L. Heppner Jr.

Law Faculty Publications

This article examines how the metaphors in judicial opinions reveal judicial theories of lawmaking and judicial philosophies, through a close reading of Justice Ginsburg’s majority opinion and Justice Gorsuch’s dissenting opinion in the Artis v. District of Columbia, 138 S. Ct. 594 (2018).

Artis was about what the phrase “shall be tolled” means in the federal supplemental jurisdiction statute, 28 U.S.C. §1367. Does a state-law claim’s statute of limitations pause or continue to run while the claim is in federal court? In holding that Congress used “stop the clock” tolling, an “off-the-shelf” legal device that pauses statute of limitations, …

ChatGPT has exploded into the popular consciousness in recent months, and the hype and concerns about the program have only grown louder with the release of GPT-4, a more powerful version of the software. Its deployment, including with applications such as Microsoft Office, has raised questions about whether the developers or distributors of code that includes ChatGPT, or similar generative pre-trained transformers, could face liability for tort claims such as defamation or false light. One important potential barrier to these claims is the immunity con-ferred by 47 U.S.C. § 230, popularly known as “Section 230.” In this Essay, we make …
