Globalization, State Sovereignty, And The Development Of International Criminal Law, Milena Sterio
Law Faculty Articles and Essays
"Today, virtually all nation-states have gradually become enmeshed in and functionally a part of a larger pattern of global transformations and global flows. Transnational networks and relations have developed across virtually all areas of human activity. Goods, capital, people, knowledge, communications, and weapons, as well as crime, pollutants, fashions and beliefs, rapidly move across territorial boundaries. Far from being a world of "discrete civilizations, "or simply an international society of states, it has become a fundamentally interconnected global order, marked by intense patterns of exchange as well as by clear patterns of power, hierarchy and unevenness."
"To speak of globalization …
Promoting Corporate Diversity: The Uncertain Role Of Institutional Investors, Jill Fisch
Promoting Corporate Diversity: The Uncertain Role Of Institutional Investors, Jill Fisch
Seattle University Law Review
Two developments are having an impact on corporate decisions. One is the increased engagement by institutional intermediaries and a shift in the focus of that engagement from corporate governance to environmental and social issues. The other is a heightened societal awareness of diversity, equity, and inclusion (DEI) issues, particularly the importance of diversity in corporate leadership. This Article considers the intersection between the two. It describes how institutional investors have focused their attention on increasing diversity in corporate leadership, the potential motivations for that focus, and the impact of that focus, to date. It highlights the tensions that result from …

America’S Hidden Citizens: The Untold Stories Of The Unconscionable Deportations Of Its International Adoptees, Halley Cody
Seattle University Law Review
This Note addresses how the U.S. should rectify the harms it has perpetrated on non-citizen adoptees by amending the current deportation statutes to prevent their deportation. Part I addresses the history of adoption in the U.S. and related effects on immigration law. Part II highlights the stories of Adam Crapser and Philip Clay, who were adopted by American families who failed to naturalize them as minors, and who were subsequently deported after they sustained criminal records. Part III examines the policy goals behind deportation as a consequence of criminal convictions, as well as remedies instituted to prevent unwarranted deportation and …

The Road To Brackeen: Defending Icwa 2013-2023, Kathryn Fort
The Road To Brackeen: Defending Icwa 2013-2023, Kathryn Fort
American University Law Review
From 2013 to 2023, the Indian Child Welfare Act (ICWA) was challenged in the courts more than the Affordable Care Act. This Article lays out the history of the fight over ICWA from Baby Girl to Haaland, from my perspective as a clinical professor who has been involved with every major ICWA case since 2013, as well as my observations about why ICWA was so vulnerable to an organized litigation attack despite continued bipartisan and widespread support of the law.

Paper Gowns, Cold Hands, Or Something Else? Black Women's Barriers To Gynecologic Screening, Nadia Ayesha Sesay
Paper Gowns, Cold Hands, Or Something Else? Black Women's Barriers To Gynecologic Screening, Nadia Ayesha Sesay
Theses and Dissertations--Communication
Cervical cancer mortality burden is carried disproportionately by African American women. Early indicators of cervical cancer are identified through prevention screening, a procedure typically performed by a gynecologist. Ideally, the patient group with the most severe mortality would likewise be the group with the most robust communication exchange with their physician to prevent cervical cancer incidence. However, a slew of factors contributes to continued mortalities among Black women. This study uses semi-structured interviews (n=10) and the health belief model to examine one barrier to Black women’s prosocial behaviors regarding routine gynecologic care—awkwardness, which here is conceptualized as social anxiety. The …
Cold Calling In The Classroom: Exploring Student Perceptions Of Instructor Communication Using The Face Negotiation Theory, Cynthia Chinazo Nnagboro
Cold Calling In The Classroom: Exploring Student Perceptions Of Instructor Communication Using The Face Negotiation Theory, Cynthia Chinazo Nnagboro
Theses and Dissertations--Communication
Using face negotiation theory (Ting-Toomey, 1988) as a theoretical framework, this dissertation sought to determine students’ perceptions of instructor communication during classroom discussions where instructors use cold calling tactics. According to FNT, students perceived that self-construal determines their face concern as either self, other/mutual face. Therefore, an instructor must determine the best facework strategies to prevent face loss during classroom discussions to maintain optimal student outcomes in communication satisfaction and motivation to participate. This was accomplished by using 8 hypothetical vignettes, a pilot test and an experiment that measured face threat, face support, student communication satisfaction and motivation, intention to …
The Influence Of Instructor Immediacy Beyond The Classroom: An Experimental Investigation Of Relational Messages During Office Hours, Adam Tristan
Theses and Dissertations--Communication
This dissertation examines instructor relational messages during office hours. Office hours are one of the few pedological tools where instructors can engage with their students outside the classroom. Office hours, in general, are widely adopted at many US higher education institutions, yet the context is under-researched and, thus, worthy of exploration. According to rhetorical and relational goals theory (Mottet et al., 2006), some students prefer building relationships with their instructors; others prefer task-focused interactions. To acknowledge the students' relational needs while also addressing students’ academic concerns, instructors could employ instructor immediacy behaviors to achieve simultaneous goals. A 2 x 2 …
‘It’S Like Flipping A Switch’: Understanding The Challenges, Expectations, And Identity Of High School Wrestlers, Aubree Herman
‘It’S Like Flipping A Switch’: Understanding The Challenges, Expectations, And Identity Of High School Wrestlers, Aubree Herman
Theses and Dissertations--Communication
This study aims to understand the challenges and expectations of high school wrestlers, and how they are managing their social identities within the parameters of the sport. The rise of female wrestlers within the last decade and the hegemonic masculine roots of the sport show how imperative it is that research shed light into the unique experiences of high school wrestlers. Social identity theory was used as a theoretical framework and participants answered interview questions that discussed the three components of their social identity (i.e., cognitive, affective, and evaluative). They also identified challenges that they faced, the kind of expectations …
In-Between Space: Latinas Sharing Their Stories Of Cultural Integration, Maria Elena Fuster
In-Between Space: Latinas Sharing Their Stories Of Cultural Integration, Maria Elena Fuster
Art Therapy | Doctoral Dissertations
This study explores how an art-based narrative allows Latinas to explore their own experiences of cultural integration in a way that honors their lived experience. The women used art materials to help them explore their identities and, through this process, discovered new truths about themselves through their stories of living between, within, and outside of both cultures. The art acted as a catalyst to express feelings the women had never before questioned or recognized in themselves and, in doing so, allowed them to create meaning and discover parts of their identities they had never explored before. This further allowed the …
Leadership In Nonprofit Organizations: Best Practices For Volunteer Retention, Jennifer Lawrence
Leadership In Nonprofit Organizations: Best Practices For Volunteer Retention, Jennifer Lawrence
DSW Capstone Projects
While there is a significant amount of research focusing on organizational leadership in business and for-profit organizations, comparatively little data has been collected and studied to address the role of leadership in volunteer organizations. By closing this gap in research and providing context around leadership, nonprofit organizations can enhance leadership, culture and climate, and volunteer engagement and retention. Fewer Americans are engaging in volunteerism in their community than any other time in the past twenty years. The Systemic Literature Review will aid in recognizing and addressing this decline which is important as volunteer organizations provide needed services to people and …

Undergraduate Honors Theses
This thesis discusses Crimmigration—the convergence of criminal policies and immigration law—in a post-9/11 world as it relates to Latin American Immigrant women seeking asylum in the United States. Utilizing case law, legislation, and legal scholarship, I situate these policies in the broader context of immigration law both nationally and internationally, focusing on key post-9/11 legislation and policies such as Operation Streamline, Operation Liberty Shield, and Title 42, as well as key post-9/11 case law dealing with Latin American women seeking asylum in the United States. With these foundational understandings, I provide possible solutions that would lessen the harms presented to …

Perceptions On Detracking Secondary Mathematics Classes And Individual And Collective Teacher Efficacy Beliefs For Teaching In Heterogeneous, Inclusive Classes, Melissa A. Dudic
Graduate Research Theses & Dissertations
The purpose of this study was to explore secondary mathematics teachers’ perceptions of detracking including benefits, challenges, and needed support as well as their individual and collective efficacy beliefs for teaching in a detracked class. Shifting to heterogeneous and inclusive secondary mathematics classes is a significant shift from past practice, and thus, teachers’ beliefs about their individual efficacy for such a change can impact the success of detracking reform. By understanding the areas of strength and areas for growth through the lens of individual and collective teaching efficacy, leaders can better understand the professional learning and support needed to sustain …
Methods For Investigating Geo-Stem Learning Ecosystems: A Case-Study Of Illinois Earth Science Teachers, Cheryl L.B. Manning
Methods For Investigating Geo-Stem Learning Ecosystems: A Case-Study Of Illinois Earth Science Teachers, Cheryl L.B. Manning
Graduate Research Theses & Dissertations
The complex interactions between people and resources in communities that foster innovation can be thought of as ecosystems. These ecosystems have the potential to broaden participation in the geoscience community if we invest in collaborations that map out long-term solutions and career pathways for young community members. Geo-STEM learning ecosystems (GLE) engage local communities in sustainable programs that promote geoscience literacy and inspire people to learn the geosciences. A goal of GLE is to leverage existing social systems and accelerate geo-STEM solutions for society. Thus far, few studies in the geosciences have interrogated what is meant by a “learning ecosystem” …

Is Special Education Effective? A Propensity Score Weighting Analysis In Elementary School, Moira Wendel
Graduate Research Theses & Dissertations
This study analyzed the effect of elementary special education receipt within the U.S. Given the nonrandomized nature of special education, the statistical method for measuring the effect of special education must adequately control for contextual factors that are associated with special education receipt. Propensity score weighting is a technique that can control for covariates to test outcomes of those receiving special education compared to those who have not received special education. Using propensity score weighting, this study analyzed the impact of special education status on academic skills (i.e., math, reading, and science), social-emotional functioning (i.e., internalizing and externalizing problem behaviors), …
University Faculty Perceptions Of Mandatory Online Training As Related To Training Self-Efficacy, Motivation, And Utility, Tori Austin
Graduate Research Theses & Dissertations
Organizations spend millions of dollars training employees in ways to improve their skills –recently through mandatory professional development delivered virtually or through online asynchronous platforms. This research investigated how social exchange theory and self-efficacy theory inform faculty participants’ motivation to transfer such knowledge and skills from mandatory online trainings into their workplace practices. Faculty who had attended mandatory online training were asked to complete a 25-item survey about their motivation to transfer information from the training into their workplace practice as well as their perceived utility of training and their training self-efficacy. This study examined the extent to which motivation …

Evaluating The Impact Of Examiner Variability On The Verbal Comprehension Index Of The Wisc-V, Brooke A. Butcher
Graduate Research Theses & Dissertations
The purpose of the current study was to: a) explore rater variability on the VCI, b) explore rater tendencies, and c) compare rater tendencies between graduate students and licensed and/or certified school psychologists. Considering the results of prior literature that has investigated scoring errors and inter-rater agreement on the WISC, it was hypothesized that examiners would be significantly different from one another (overall and between groups) in terms of their tendencies towards severity/leniency on the Vocabulary and Similarities subtests. Raters (N = 10) were comprised of two groups: a) graduate students in training to become school psychologists (n = 5) …

The Ambiguous Loss Of Alcohol Use Disorders For Affected Family Members: Can Al-Anon Involvement And Psychological Flexibility Make A Difference?, Giselle Hernandez Navarro
Graduate Research Theses & Dissertations
Alcohol Use Disorders (AUD) destroy the health of many afflicted people, as well as their affected family members (AFMs). The purpose of this quantitative dissertation was to explore relevant variables for AFMs based on ambiguous loss theory and relational frame theory. In this study, 310 AFMs completed online surveys through MTurk. Differences in AFMs’ Al-Anon involvement (i.e., no involvement, newcomer, member) were investigated relative to psychological flexibility, psychological inflexibility, boundary ambiguity, distress, and ambiguous loss resilience (i.e., ambiguity tolerance). Results indicated Al-Anon involvement was not a significant variable in relation to AFMs’ distress or ambiguity tolerance outcomes. Psychological flexibility, psychological …

The study elevated the voices of teachers who voluntarily left their schools due to various factors. It is incumbent upon them to review the data regarding their attrition rates and what teachers report about the structures and practices that push them to another school, district, or from the teaching profession altogether. The audiences that will benefit from this work are educational leaders and human resource teams as they create protocols for district support and …
Family Routines And Parental Warmth As Potential Protective Factors On The Relation Between Housing Instability And Child Outcomes, Joanna Keane
Graduate Research Theses & Dissertations
Housing instability is associated with numerous poor child outcomes in domains such as behavioral problems, emotional problems, and academic achievement. The impacts of housing instability on child outcomes are typically investigated in the context of sociodemographic risk; however, exploring the role of protective factors (e.g., family routines, parental warmth) in these contexts allows for a more thorough understanding of the effect of housing instability and how potential negative outcomes might be mitigated. The present study further explored the relation between early housing instability and child behavioral, emotional, and academic outcomes in middle-childhood in addition to the potential moderating role of …
Where Have All The Obgyns Gone? An Investigation Into The Effect Of Abortion Restrictions On Availability Of Women's Health Providers, Carlie Famiglietti
Where Have All The Obgyns Gone? An Investigation Into The Effect Of Abortion Restrictions On Availability Of Women's Health Providers, Carlie Famiglietti
Integrative Learning Experience (ILE) Theses
In 2022, the Supreme Court overturned its previous ruling in Roe v. Wade, effectively ending federal protections for abortion. Quickly after, many states enacted abortion restrictions or outright bans. Abortion bans are harmful public policies that are impacting the availability of OB-GYNs for many reasons, including the threat of criminal prosecution. This has led to a dearth of healthcare access for millions of women in 21 abortion-restricted states, as OB-GYNs move out of state and new medical residents choose to practice elsewhere. A literature review and interviews with three key informants were conducted to explore this issue. Key informant interviews …

Revisiting Your Inner Child: Increasing Fys Students’ Engagement And Sense Of Belonging, Melikabella Shenouda
UNLV Best Teaching Practices Expo
First time full time freshmen are exhibiting the desire to get involved on campus, yet much apprehension still remains. This may be attributed to the recent return of in person instruction after the impacts of the global coronavirus pandemic, as well as the palpable distance that lingered with remote learning. As such, students’ transition from fully asynchronous / web-live synchronous instruction back to in person education has been tumultuous to say the least. Freshmen continue to express written interest in campus involvement; however, several are anxious and hesitant when it comes to actually committing to group interactions, public speaking, and …
