Neither Trumps Nor Interests: Rights, Pluralism, And The Recovery Of Constitutional Judgment Of Constitutional Judgment, Paul Linden-Retek

Journal Articles

A longer, unedited version of this article is available via the 'Additional Files' link at the bottom of the page.

This Article develops a novel framework for the adjudication of rights in an age of partisan and societal polarization. In so doing, it defends judicial review in a divided polity on new grounds. The Article makes two broad interventions.

First, the Article cautions against recent calls to shift rights adjudication in the United States from Dworkinian categoricalism toward proportionality analysis. Such calls correctly identify how categoricalism, by embracing the absolute nature of rights as “trumps,” pits citizens harshly against one …

Egyptian Reuse Standards Of Treated Wastewater For Irrigation: "A Comparative Study Of Physico-Chemical And Agronomic Controls"., Ahmed Abdella Ahmed, Moussa Shalaby, Osama Negim, Talaat Abdel-Wahed

Mansoura Engineering Journal

One of the most important issues and challenges nowadays in Egypt is how to provide enough water for current and future needs. The great population growth, agricultural consumption, climate change, limited freshwater resources, and welfare lifestyle require more water. All these factors push the Egyptian policy to search for additional water resources. One of the considerable water resources is the treated wastewater that has been used in irrigation under some restrictions. However, the use of treated wastewater for agricultural irrigation may have negative health effects if its properties were deviated from the allowable standards. This study considers Egyptian standards, regulations, …

Spatial And Temporal Distribution And Habitat Selection Of Native Yellowstone Cutthroat Trout And Nonnative Utah Chub, Darcy K. Mccarrick, Jeffrey C. Dillon, Brett High, Michael C. Quist

United States Geological Survey: Staff Publications

Henrys Lake, Idaho, is a renowned trophy trout fishery that faces an uncertain future following the establishment of Utah Chub (UTC) Gila atraria. Utah Chub were first documented in the lake in 1993 and have become abundant over the past two decades. Little is known about the ecology of UTC, but they typically have negative effects on salmonids in systems where they have been introduced. We sought to fill knowledge gaps in UTC ecology and provide insight on potential interactions with Yellowstone Cutthroat Trout (YCT) Oncorhynchus clarkii bouvieri. Ninety-four YCT and 95 UTC were radio-tagged in spring 2019 …

Individual Trophic Niche Specialization In American Beaver (Castor Canadensis), Jimmy Taylor, Robert Francis, Scott Rush, Bronson Strickland, Guiming Wang

United States Department of Agriculture Wildlife Services: Staff Publications

The American beaver (Castor canadensis) has been described as a choosy generalist at the species/population scale, yet observational studies have shown little variation in diet among individuals. We compared isotopic values of δ13C or δ15N taken from hair of 32 beaver, representing seven colonies in northern Alabama, USA to determine 1) if colonies of beaver show overlap in isotopic niche width as a result of the similar use of food resources and 2) if individual trophic niche specialization occurs within colonies. Total Trophic Niche Width varied across the wetland with the widest being twice …

Examining Bacteriophage Reliance On The Tola Protein Of Escherichia Coli, Ellen Davis Apr 2022

Examining Bacteriophage Reliance On The Tola Protein Of Escherichia Coli, Ellen Davis

Honors Projects

With the ever-growing crisis of antibiotic resistant bacteria, bacteriophage provide an important potential alternative therapy to treat infections when antibiotics are ineffective. For this reason, it is important to understand the mechanisms bacteriophage use to enter their bacterial host cell. The cellular envelope of the gram-negative bacterium E. coli contains a protein system known as Tol-Pal, which utilizes energy from the Proton Motive Force to carry out several cellular functions, including some associated with cellular division and outer-membrane stability. Certain bacteriophage take advantage of the energy produced by this system to cross the bacterial cell membrane. One important protein of …

Covid-19 Impact On The Hospitalization Rates For Eating Disorders, Jennifer Ess

Honors Theses

The COVID-19 pandemic has had an impact in a variety of ways. With the quarantine restrictions placed during this time, many individuals had turned to social media as an outlet to cope with the loss of intimate time with friends and outside family. This increase in social media use, especially Tik Tok and Instagram, can negatively impact a person's outlook on certain situations. Throughout this pandemic, mental health issues, specifically eating disorders, have shown a rise in cases during this time. Current research shows that numbers have more than doubled during pandemic times, and also shows many different factors that …

Awareness Of Racial Disparities In Healthcare: An Analysis Of Undergraduate Science Students’ Perceptions, Liz Bleyer

Honors Scholars Collaborative Projects

General and systemic racial inequalities, including slavery, mass incarceration, and health disparities, have existed throughout the history of the United States. Recent public health issues, specifically the COVID-19 pandemic, have shed light on enduring health disparities, including the disproportionate impact on black communities and other racial minorities. A crucial first step towards a more equitable healthcare system is increasing general awareness of the presence and effects of racial disparities. Previous research has quantified and described the awareness of racial disparities in healthcare practitioners, including medical students and practicing physicians, but little research has been dedicated to understanding the perspectives of …

Does A Hypertrophying Muscle Fibre Reprogramme Its Metabolism Similar To A Cancer Cell?, Henning Wackerhage, Ivan J. Vechetti, Philipp Baumert, Sebastian Gehlert, Lore Becker, Richard T. Jaspers, Martin Hrabě De Angelis

Department of Nutrition and Health Sciences: Faculty Publications

In 1924, Otto Warburg asked “How does the metabolism of a growing tissue differ from that of a non-growing tissue?” Currently, we know that proliferating healthy and cancer cells reprogramme their metabolism. This typically includes increased glucose uptake, glycolytic flux and lactate synthesis. A key function of this reprogramming is to channel glycolytic intermediates and other metabolites into anabolic reactions such as nucleotide-RNA/DNA synthesis, amino acid-protein synthesis and the synthesis of, for example, acetyl and methyl groups for epigenetic modification. In this review, we discuss evidence that a hypertrophying muscle similarly takes up more glucose and reprogrammes its metabolism to …

High Condition Male Rhinoceros Beetles Transfer More Nutrients To Females During Mating, Contributing To Female Preference For Body Condition Rather Than Body Or Weapon Size, Morgan H. Radtke Apr 2022

High Condition Male Rhinoceros Beetles Transfer More Nutrients To Females During Mating, Contributing To Female Preference For Body Condition Rather Than Body Or Weapon Size, Morgan H. Radtke

University of Montana Conference on Undergraduate Research (UMCUR)

Males in many insect species transfer nutrients along with sperm in an enclosed package known as a spermatophore. Females utilize these spermatophores to increase their fecundity. However, not all males offer the same size spermatophore. This can drive female preference toward males who are able to provide the largest spermatophores. The largest males typically produce the largest spermatophore sizes, but this is not always the case. Adult insects with rigid exoskeletons may suffer drastic reductions in body condition that are not visible on the outside. In these taxa, females may select males in excellent physiological condition rather than simply choosing …

Intermittent Fasting As Adjuvant To Topical Therapy In The Management Of Mild To Moderate Psoriasis, Grace Queiroz

Yale School of Medicine Physician Associate Program Theses

Psoriasis is a common chronic inflammatory skin condition with no known cure. Intermittent fasting involves limiting caloric intake to designated time periods and decreases markers of systemic inflammation, but the clinical efficacy of intermittent fasting for patients with psoriasis remains unclear. We propose a randomized controlled clinical trial to investigate the clinical impact of adjunctive intermittent fasting on plaque psoriasis. Patients with mild to moderate plaque psoriasis will be managed with topical calcipotriene/betamethasone dipropionate cream and randomized to either practice daily intermittent fasting with an 8-hour eating window or practice a diet without time restriction. We hypothesize that patients engaging …

Review: The Effects Of Parental Phthalate Exposure On Newborn Defects, Tram Ha Pham Bich, Jonathon Reeck

2022 Undergraduate Research Showcase

Phthalates, or phthalate esters, are employed in the making of numerous products around the world, such as food containers, children’s toys, detergents, surfactants, household items, and even pharmaceutical tablets. With the flexibility, elasticity, and inexpensive price, companies started using phthalates without doubting their acute and chronic toxicity. Recent research suggests that phthalate esters are possible causes of asthma, obesity, type II diabetes, neurodevelopmental issues, heart diseases, cancer, and especially reproductive system issues. However, studies about the effects of phthalates on fetal development are rare. To summarize updated data on this field, this review poster covers the most prominent in vivo …

Alternating Pressure Overlay Systems, Maris Rathgeb Apr 2022

Alternating Pressure Overlay Systems, Maris Rathgeb

MSN Capstone Projects

Although preventable, pressure injuries are an overwhelming problem in the healthcare system and can lead to poor quality of life, increased length of hospitalization, and unsatisfactory patient outcomes. Many cardiac surgeries take anywhere from six to twelve hours, and patients are completely immobilized for the entire length of time. Alternating pressure overlays placed on the operating room table provide tissue offloading with inflating and deflating nodes, leading to micro-movements on high pressure bony prominences. The intervention PICO question to be answered in this paper is: In intraoperative patients (P), how does the use of an alternating pressure surface (I) compared …
