An Evaluation Of The Rural Gobabygo Program At West Virginia University, Shayna Rexrode, Alexa Morgan, Haleigh Parsons, Holly Raines Jan 2024

An Evaluation Of The Rural Gobabygo Program At West Virginia University, Shayna Rexrode, Alexa Morgan, Haleigh Parsons, Holly Raines

Graduate Student Scholarship

The GoBabyGo program is a powered mobility program for young children with mobility and/or cognitive deficits that aims to increase their social participation, environmental exploration, and overall play abilities. This study aims to evaluate the rural GoBabyGo program at West Virginia University through caregiver and therapist perceptions. Traditionally, the GoBabyGo program process occurs primarily in person and includes consultation, builds, modifications, and delivery. Due to the rural nature of West Virginia, environmental barriers have led to the use of virtual services with the GoBabyGo program at West Virginia University. Evaluating these novel services is essential to successfully continuing the GoBabyGo …

Attributing Ai Authorship: Towards A System Of Icons For Legal And Ethical Disclosure, Joseph J. Avery, Patricia S. Abril, Alissa Del Riego

Articles

Over the past year, the pervasive role of large language models (LLMs) and artificial intelligence (Al) in text generation has precipitated concerns about ethical usage, authorship, and transparent attribution. This has been true in legal practice, academia, and the corporate world, as well as in countless other arenas. In this Article, we identify the gap that has opened between those demanding proper disclosure (we should know when and to what extent Al is an author) and those struggling to respond to these demands. Part of the problem is that there is no system in place, no lingua franca, no set …

Israel, Palestine, And The Trolley Problem: On The Futility Of The Search For The Moral High Ground, Jack Russell Weinstein Jan 2024

Israel, Palestine, And The Trolley Problem: On The Futility Of The Search For The Moral High Ground, Jack Russell Weinstein

Digital Press Books

Arguments about Israel and Palestine are almost always accusatory and polemical. Rather than learning from one another, opponents jockey for the moral high ground trying to find that one attack they believe proves their side to be completely on the right, without compromise. This means Israel’s advocates dismiss Palestinian land claims without due consideration and Pro-Palestinian voices falsely accuse Israel of the most heinous modern crimes: colonialism, genocide, and apartheid. None of this is productive or healthy.

In Israel, Palestine, and the Trolley Problem: On the Futility of the Search for the Moral High Ground, philosopher Jack Russell Weinstein interweaves …

The Muslims Of Darürrahat, Ismail Gaspirali Jan 2024

The Muslims Of Darürrahat, Ismail Gaspirali

Digital Press Books

In Ismail Gaspirali’s 1890s story The Muslims of Darürrahat, (the Peaceful Country) the not entirely intrepid narrator Mullah Abbas Efendi arrives in the imaginary land of Darürrahat. He has been led there by mysteriously appearing guides, who take him from Alhambra palace in Andalusia through an underground tunnel, where he emerges in Darürrahat to find a Muslim utopian country filled with progressive people and dotted with beautiful Islamic architecture and technologically advanced cities. As in most works of utopian imagination which are also aimed squarely at social critique of the author’s present day, there is nothing simple about this …

No Excuses: The Effect Of Absentee Voting System On Voter Turnout, Tigerlily Harrington, April Johnson Jan 2024

No Excuses: The Effect Of Absentee Voting System On Voter Turnout, Tigerlily Harrington, April Johnson

The Kennesaw Journal of Undergraduate Research

The COVID-19 Pandemic caused a significant change in the way people voted 2020. Many Americans chose to absentee vote out of safety concerns. However, this process was not the same experience for all voters because some states require an excuse to absentee vote while others do not. This study analyzes whether there is a difference in voter turnout between states with no-excuse absentee voting and those without it. While reviewing voter turnout data for the 2016 and 2020 General Elections, this research finds evidence that turnout was higher in states with no-excuse absentee systems than those that require an excuse. …

Trust Relationships: Tales From The Web, Magdoleen Ierlan Jan 2024

Trust Relationships: Tales From The Web, Magdoleen Ierlan

Atlantic Marketing Journal

Trust is an important component of any purchasing situation. In an online setting, trust becomes even more important as buyer and seller are not able to directly interact with one another. Compounding the situation is the fact that the consumer cannot directly experience the product under consideration. Organizations have attempted to address this shortcoming by allowing third parties to offer reviews of the product in question. This paper addresses how consumers process these product reviews.

By rooting this paper in trust and uncertainty reduction theory, a testable model was developed. The model was tested, and in general, more helpful reviews, …

Making A Case For A Digital Marketing Concentration: An Analysis Of Traditionally Generalized Online Mba Programs, Paige Gardiner, Maureen Andrade

Atlantic Marketing Journal

Over the last decade, business schools have added online MBA programs to meet student demand for access, price, and geographic convenience while trying to ensure a solid tuition revenue base. Online MBA programs have been forced to waive the GMAT and reduce the number of credits required for graduation while seeking ways to bring additional value to their online programs. This research examines whether offering online MBA students a specialized marketing concentration in digital marketing will make students marketable to businesses. The research examines this conjecture and provides a recommendation for MBA stakeholders. Study 1 shows the industry demand for …

School of Natural Resources: Faculty Publications

The Platte River/High Plains Aquifer (PR/HPA) region is characterized by cropland, pastures, and grasslands that are faced with changing climatic conditions and agricultural intensification. The PR/HPA Long-Term Agroecosystem Research (LTAR) site is located in Eastern Nebraska with the goal of improving resilience, sustainability, and profitability of agroecosystems through enhancing ecosystem services and environmental quality, developing strategies for efficient agricultural production, and mitigating and adapting to climate change. To meet this goal, a common experiment and five ancillary experiments have been developed to evaluate prevailing regional practices in grain crop production systems compared to alternative practices in rain-fed and irrigated systems. …

Students For Fair Admissions Through The Lens Of Interest-Convergence Theory: Reality, Perception, And Fear, Robert A. Garda Jr. Jan 2024

Students For Fair Admissions Through The Lens Of Interest-Convergence Theory: Reality, Perception, And Fear, Robert A. Garda Jr.

SMU Law Review

In two cases, Students for Fair Admissions, Inc. v. President & Fellows of Harvard College and Students for Fair Admissions, Inc. v. University of North Carolina (SFFA), the Supreme Court held that Harvard and UNC violated the Equal Protection Clause of the Fourteenth Amendment and Title VI of the Civil Rights Act in their use of race in their admissions process. This Article examines the SFFA decision through the lens of interest-convergence theory.

This Article is novel in three respects. It is the first article to explain the SFFA decision in-depth. The opaqueness of the decision has led to significant …

The Post-Racial Deception Of The Roberts Court, Cedric M. Powell Jan 2024

The Post-Racial Deception Of The Roberts Court, Cedric M. Powell

SMU Law Review

Students for Fair Admissions v. Harvard/UNC (SFFA) is a post-racial deception unmoored from precedent and societal reality. SFFA deceives the polity and signals an all out assault on anti-discrimination law. To preserve its institutional legitimacy, the Roberts Court promotes doctrinal and conceptual distortions—post-racial deceptions of cognizable injuries advanced through reverse discrimination claims of white plaintiffs; racial proxy claims of discrimination proffered by Asian-Americans; and the fairness rationale of the Court’s circular post-racial edict that “the way to stop discrimination on the basis of race is to stop discriminating on the basis of race.” Chief Justice Roberts’s majority opinion discards the …

Racial Classifications In Higher Education Admissions Before And After Sffa, David E. Bernstein Jan 2024

Racial Classifications In Higher Education Admissions Before And After Sffa, David E. Bernstein

SMU Law Review

Hundreds of law review articles have discussed the legality of affirmative action programs. Virtually all of them begin with the implicit assumption that the racial classifications used in these programs are legitimate and uncontroversial (an assumption I challenge in my 2022 book, Classified: The Untold Story of Racial Classifications In America). That assumption has been undermined by Students for Fair Admissions, Inc. v. President and Fellows of Harvard College (“SFFA”).

Chief Justice Roberts, writing for a 6–3 majority, asserted that the underlying classifications are “imprecise in many ways” and “opaque.” He quoted Justice Gorsuch’s concurring opinion, which criticized the classifications …

From The Body To The Screen | Wintersession 2024 Syllabus, Azadeh Ahmadi, Movement Lab

2023-24 Azadeh Ahmadi

In this course, students make a brief cinematic piece inspired by movement exercises. Each session starts with a 45-minute movement exercise, guiding students to reflect on the nuances of emotions, memories, and ideas evoked during the activity. Taking notes at the exercise's conclusion, students transform these reflections into source material for their final projects. The course features technical demonstrations covering camera work, editing, and sound. The primary emphasis is on movement's pivotal role, serving as the anchor connecting these skills and molding creative concepts. The curriculum encompasses crucial elements, including: Visual composition, color, and camera movements, highlighting their significance in …

Video Through | Wintersession 2024 Syllabus, Maxime Cavajani, Movement Lab

Course Materials

This course is entitled video through because it aims to question how video allows us to think through time and through space simultaneously. In this course we will consider video as space, material, and matter. In an approach that prioritizes experimentation in space, we will work in a non-linear fashion: fabricating video in space and fabricating space with video _ a constant back and forth. From those experiments we will learn how to use the properties of video editing, video-making, shooting, projecting/screening as interconnected tools that deny a singular trajectory of making.

The classroom will become a site. We are …

The Myth Of Children’S Online Privacy Protection, Stacey B. Steinberg Jan 2024

The Myth Of Children’S Online Privacy Protection, Stacey B. Steinberg

SMU Law Review

Digital technology has changed the landscape young people face as they come of age. It has changed how children interact with their parents, schools, community organizations, and the state. Despite many benefits, digital technologies that employ data collection, algorithms, and artificial intelligence pose significant risks for the next generation. Private businesses can collect, use, and sell a child’s data in ways never imagined by their families. Information collected by third parties with good intentions can be stolen through data breaches. Through faulty algorithms, websites can make inaccurate assumptions about young people’s interests, teachers can make inaccurate assumptions about a student’s …

Growing Tensions: Consumer Privacy And Corporate Disclosures, Megan Wischmeier Shaner Jan 2024

Growing Tensions: Consumer Privacy And Corporate Disclosures, Megan Wischmeier Shaner

SMU Law Review

Data privacy and data security have become key issues for legislators, regulators, and individual citizens. Roughly two-thirds of Americans believe their data is being regularly tracked, monitored, and collected by companies and the government. A majority of U.S. adults also believe their data is less secure today than five years ago, expressing concerns that they have little control over how their personal information is being used and that the entities who control their data are not responsible stewards. In the absence of comprehensive federal regulation, a continuous stream of privacy statutes have been proposed at the state level. Beginning with …

Can Criminal Defense Attorneys Be Victim-Centered?, Natalie Nanasi, Demetrice Lopez-Loftis

SMU Law Review

Attorneys defending those accused of intimate partner violence, like all lawyers, owe duties of zealous advocacy and confidentiality to their clients. But is there a place within these ethical obligations for them to also consider the safety of the victim? Defense counsel are often uniquely situated—by virtue of their relationships with their clients and victims—to help mitigate potentially serious harm. This article explores the spaces where defending an accused perpetrator of domestic violence and taking actions to limit further harm to a survivor are compatible. It also identifies areas where defense attorneys can obtain additional resources and data to inform …

75 Years Of Clinical Legal Education: Celebrating The Past While Looking To The Future, Mary Spector Jan 2024

75 Years Of Clinical Legal Education: Celebrating The Past While Looking To The Future, Mary Spector

SMU Law Review

In October 2023, the Clinical Program at SMU Dedman School of Law celebrated its 75th anniversary. The occasion provided an opportunity to celebrate seventy-five years of free legal services to thousands of clients over the years: real people with real problems without the means to hire a lawyer. Among the legal services provided were ones that ensured families had safe and affordable places to live, protected the rights of those in the criminal justice system, safeguarded seniors’ financial stability, assisted taxpayers in navigating disputes with the IRS, and ensured that employees obtain the benefits to which they are entitled.

During …

The War[Hol] Between Artistic Creativity And Commercial Use Within The Fair Use Defense, Morgan Houghtlin Jan 2024

The War[Hol] Between Artistic Creativity And Commercial Use Within The Fair Use Defense, Morgan Houghtlin

SMU Law Review

In May 2023, the Supreme Court decided Andy Warhol Foundation for the Visual Arts, Inc. v. Goldsmith, articulating the standard for the “fair use” defense under a copyright infringement claim. The Court’s decision significantly narrowed the first factor of the fair use analysis, characterizing “purpose and use” in terms of the commercial nature of a secondary work with little consideration of the art’s creative value. This opinion deviates from the broader conception of “fair use” articulated in Campbell v. Acuff-Rose Music, Inc. (1994) and introduces various implications for modern-day artists and content creators. Specifically, Justice Sotomayor’s majority opinion and …

Third-Party Bankruptcy Releases And The Separation Of Powers: A Stern Look, Henry Reynolds Jan 2024

Third-Party Bankruptcy Releases And The Separation Of Powers: A Stern Look, Henry Reynolds

Emory Bankruptcy Developments Journal

In the last few years, bankruptcy scholars and professionals have criticized mass tort debtors’ use of chapter 11 bankruptcy as a litigation forum. One such criticism concerns mass tort debtors’ use of third-party releases: provisions in chapter 11 reorganization plans that enjoin creditors’ claims against non-debtor third parties. If a bankruptcy court approves such releases, creditors lose claims against the released third parties, which often include the debtor’s directors, insurers, or employees.

Third-party releases have troubled many. Critics and courts have said that third-party releases violate (1) the Bankruptcy Code, (2) bankruptcy policy, (3) the constitutional right to due process, …

Part 1: Virginia's Economy Grows, Will Consumers Remain Unhappy?, Dragas Center For Economic Analysis And Policy, Old Dominion University

State of the Commonwealth Reports

By many measures, Virginia will set several records in 2024. Economic activity across the state will surpass that observed in 2023 and will represent the fourth consecutive year of economic growth. More Virginians will have been at work or looking for work than in any other year. Yet, if one asks Virginians about the state of the economy, their views are decidedly more pessimistic.

Part 4: Rising Disability Rates (Or Not): A Sign That We Care Or An Epidemic Problem In The Commonwealth?, Dragas Center For Economic Analysis And Policy, Old Dominion University

State of the Commonwealth Reports

In this chapter, we examine one particular corner of a much larger disability story --- those individuals who have a work history and subsequently seek to receive income from the Social Security Administration because of that disability. Contrary to what many people believe, both the number of applications for worker disability and rates of approval of those applications have trended downward in recent years. We examine how worker disability rates have changed over time across the nation and Commonwealth.
