Climate Change, Policy Paralysis, And A Nuclear Waste Island? Exploring Perceptions Of Risk, Trust, And Community Agency In Navigating Uncertain Futures Facing Humboldt Bay's Spent Nuclear Fuel Storage Site, Alexander Brown Jan 2024

Climate Change, Policy Paralysis, And A Nuclear Waste Island? Exploring Perceptions Of Risk, Trust, And Community Agency In Navigating Uncertain Futures Facing Humboldt Bay's Spent Nuclear Fuel Storage Site, Alexander Brown

Cal Poly Humboldt theses and projects

Climate and coastal hazards threaten the long-term viability of indefinite in-situ nuclear waste storage in the U.S., especially at vulnerable “stranded” sites like Humboldt Bay, California. The national policy framework is fundamentally incompatible with emergent climate realities and does not adequately accommodate uncertainty, localized hazard conditions, and the sociocultural and political dynamics that manifest in diverse and contested public arenas. I interviewed 21 community-experts working at the intersection of climate change and nuclear waste, and co-facilitated three scenario planning workshops to gather insights on how to responsibly manage Humboldt Bay’s nuclear waste in a climate-altered world. Qualitative findings indicate variation …

From Rights To Justice: Perspectives On Access To Disability Justice In Britishcolumbia (Attorney General) V. Council Of Canadians With Disabilities, C. Tess Sheldon, Karen R. Spector, Ruby Dhand Jan 2024

From Rights To Justice: Perspectives On Access To Disability Justice In Britishcolumbia (Attorney General) V. Council Of Canadians With Disabilities, C. Tess Sheldon, Karen R. Spector, Ruby Dhand

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

Relying on the Supreme Court of Canada’s decision in British Columbia (Attorney General) v. Council of Canadians with Disabilities as illustration, this paper aims to broaden perspectives about the availability of disability rights and disability justice. The first section considers the access to justice concerns that flow from the initial decision to deny standing to the Council of Canadians with Disabilities. Second, it addresses the barriers to accessing justice for persons with disabilities that grounded the case and the disproportionate impact of the impugned mental health legislation on equity-denied communities. The final section evaluates the persistence of procedural and substantive …

Exploring The Intersectional And Spatial Implications Of The Police Power To Search Dwellings Incident To Lawful Arrest: A Comment On R. V. Stairs, Danardo S. Jones Jan 2024

Exploring The Intersectional And Spatial Implications Of The Police Power To Search Dwellings Incident To Lawful Arrest: A Comment On R. V. Stairs, Danardo S. Jones

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

This paper examines whether the Supreme Court of Canada’s decision in R. v. Stairs to alter the baseline police power to conduct searches incident to lawful arrest adequately addresses issues of intersectionality and spatiality. The paper’s principal focus is on race and class, which is analyzed through the lens of critical theories around race and space/spatialization, drawing on Black geographies and Critical Race Theory (“CRT”). It will also consider critical legal theories that urge us to conduct a distributional analysis of the differential impacts of legal standards. Importantly, the paper considers how courts do and should conceptualize privacy and domesticity …

Speaking Like A Judge: Using Artificial Intelligence To Empirically Assess Judicialspeech In Supreme Court Of Canada Hearings By Language Spoken And Gender Of The Speaker, Simon Wallace Jan 2024

Speaking Like A Judge: Using Artificial Intelligence To Empirically Assess Judicialspeech In Supreme Court Of Canada Hearings By Language Spoken And Gender Of The Speaker, Simon Wallace

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

So much is known about SCOTUS oral hearings, so little is known about SCC oral hearings. Why? The answer at least partly turns on the availability of evidence: Americans have ready access to transcripts of Supreme Court hearings and Canadians do not. This project addresses that challenge by introducing an artificial intelligence-based approach to transcribe the SCC’s 2021-2022 oral arguments, enabling detailed empirical analyses of some of the speaking patterns of justices. To demonstrate potential research avenues, it explores two questions: which judges speak the most and which of the two offıcial languages do they speak? The research here shows …

Beyond The Numbers: Statistical And Data Literacy, Domain Literacy And Supreme Court Of Canada Data Analytics, Jena Mcgill, Amy Salyzyn Jan 2024

Beyond The Numbers: Statistical And Data Literacy, Domain Literacy And Supreme Court Of Canada Data Analytics, Jena Mcgill, Amy Salyzyn

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

There is growing interest in using data analytics to identify patterns or trends in the work or behaviour of a court or judge. As more analytics-generated information about courts and judges is pumped into public discourse, questions arise about what it takes for stakeholders — both those producing or generating judicial analytics outputs, and those relying on and attempting to make sense of analytics outputs — to properly engage with that data. In this paper, we identify two related but distinct kinds of literacy required for meaningful and responsible engagement with judicial analytics outputs: (1) data and statistical literacy, that …

A Quantitative Analysis Of Leave Applications To The Supreme Court Of Canada In Constitutional Cases, Paul-Erik Veel Jan 2024

A Quantitative Analysis Of Leave Applications To The Supreme Court Of Canada In Constitutional Cases, Paul-Erik Veel

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

The requirement that a party must, in most cases, obtain leave to appeal in order to bring a case to the Supreme Court of Canada poses a significant barrier to cases being heard by that Court; indeed, the vast majority of cases are not granted leave to appeal. Because the leave process operates as a barrier, understanding the leave to appeal process and outcomes are in turn important to understanding the development of Canadian law. However, because the Supreme Court does not provide reasons for decision as to whether or not to grant leave in a particular case, conventional tools …

The Sixth Warfighting Domain?: Governing The Space-Cyber Nexus, Eytan Tepper, Scott Shackelford, James B. Romano, Sergei Dmitriachev Jan 2024

The Sixth Warfighting Domain?: Governing The Space-Cyber Nexus, Eytan Tepper, Scott Shackelford, James B. Romano, Sergei Dmitriachev

Georgia Law Review

This Article reviews the recent emergence of the space-cyber nexus as a distinct warfighting domain, solidified during the Russian invasion of Ukraine, and analyzes the (missing?) laws of space-cyber warfare. The Article further suggests a roadmap for the development of norms and rules under the constraints of contemporary geopolitics and difficulties in multilateral rulemaking. As space-based infrastructure became critical to modern militaries and economies, it has, as a result, become a prime target. While only four countries possess antisatellite missiles (United States, Russia, China, and India), cyberattacks require much less in terms of funds and technological sophistication and can also …

Statutory Solutions For Stealthing: How States Should Amend Their Laws To Address Nonconsensual Condom Removal, Lauren Harter Jan 2024

Statutory Solutions For Stealthing: How States Should Amend Their Laws To Address Nonconsensual Condom Removal, Lauren Harter

Georgia Law Review

In recent years, growing awareness of “stealthing”—a term used to describe the act of removing a condom before or during sex without a partner’s consent—has led to widespread condemnation of the act as a form of sexual assault. However, legislatures across the United States have been slow to amend or add to their laws to specifically address stealthing, leaving countless victims without recourse. To date, only four states have successfully amended their laws to create civil penalties for stealthing, and not one treats stealthing as a crime. In an age where bodily autonomy seems increasingly at risk, it is imperative …

Operation Lone Star: Laying To Rest The Notion That Immigration Is An Invasion, Anna Carolina Mares Jan 2024

Operation Lone Star: Laying To Rest The Notion That Immigration Is An Invasion, Anna Carolina Mares

Georgia Law Review

Operation Lone Star, promoted by Texas as a border protection program, faces legal challenges for exceeding federal authority over immigration. In response to a federal lawsuit over the placement of buoys in the Rio Grande—a physical barrier aimed at deterring migrants—Texas defended its actions under the State War Power provision, asserting that it was “repelling an invasion” and required no congressional approval. This Note examines the rhetoric framing immigration as an invasion, beginning with an analysis of immigration powers and federalism before addressing the issues in United States v. Abbott. While the constitutionality of a state unilaterally declaring an …

Perfectionism Across Adolescence, W. Justin Dyer

BYU Studies

As a sixteen-year- old on my first date, I had such a nervous tightness in my stomach that, at one point, I ran to the bathroom to throw up. I’d always been somewhat nervous, but it had never bothered me much before. Yet from that time on through my teenage years, any time there was something new happening, I would inevitably have to throw up.

Observation, Reason, Faith, And Revelation, Dale G. Renlund

Religious Educator: Perspectives on the Restored Gospel

While some might believe that observation and reason are at odds with faith, they in fact support our ability to receive revelation. We can be deceived when we draw conclusions based on observation, reason, or faith alone, but when used in harmony, they facilitate revelation and enable the Holy Ghost to be our constant companion. Following this pattern of revelation increases the spiritual momentum in our lives.

Stephen Burnett Versus The Eight Witnesses An Exercise In Mature Historical Thinking, Neal Rappleye, Stephen O. Smoot Jan 2024

Stephen Burnett Versus The Eight Witnesses An Exercise In Mature Historical Thinking, Neal Rappleye, Stephen O. Smoot

Religious Educator: Perspectives on the Restored Gospel

This article critically examines the credibility of the claims made by Stephen Burnett about the experience of the Eight Witnesses of the Book of Mormon. A disaffected Latter-day Saint who lost his faith in Joseph Smith after the failure of the Kirtland Safety Society in 1837, Burnett wrote a scathing letter in early 1838 in which he claimed he heard Martin Harris admit that the Eight Witnesses did not physically see and handle the gold plates as claimed in their printed testimony. This article argues that Burnett is not a credible source for accurately understanding the experience of the Eight …

Ai Voice Enters The Copyright Regime: Proposal Of A Three-Part Framework, Prachi Patel Jan 2024

Ai Voice Enters The Copyright Regime: Proposal Of A Three-Part Framework, Prachi Patel

Fordham Intellectual Property, Media and Entertainment Law Journal

We are told that our voice is one of the most powerful tools we have. However, is it just as powerful if it can be replicated? Artificial intelligence has developed to the point where it can create an exact clone of a person’s voice. While there have been many advancements in this field, there are few laws that address artificial intelligence and its use. Artificial intelligence has been used to create artificial voices of well-known figures, both deceased and alive, some without their consent. This creates a need to balance the incentivization of technological development and the protection of an …

Publications and Research

Part 3: Does It Still Pay To Attend College In Virginia?, Dragas Center For Economic Analysis And Policy, Old Dominion University

State of the Commonwealth Reports

In 2022, more than 1 in 5 college graduates across the United States found themselves earning less than the national median income for high school graduates in the same graduating class year. In the same year, on average, 19.9% of graduates from four-year Virginia institutions of higher education earned less than the typical high school graduate 10 years after entry into college or university. In this chapter, we ask whether attending college is a ‘good deal’ for many Virginians.

6. More Is Less?: Using Generative Ai For Idea Generation And Diversification In Early Writing Processes, Franziska Tsufim, Lainie Pomerleau

Teaching and Generative AI: Pedagogical Possibilities and Productive Tensions

As writing teachers, we are strong proponents of process writing. At the same time, we are aware that early process work, especially in a group setting, can be time consuming and anxiety-inducing. Students may also self-censor when sharing work with peers especially if they are not confident in their ideas. Drawing on the process of nominal, electronic brainstorming, we created two different prompts that allowed students to incorporate generative Al into their idea generation process. This first activity improves the efficiency of individual idea generation, while the second exercise helps increase student confidence in their ideas in collaborative brainstorming situations. …
