Hitting The ‘Reset Button’: The Role Of Digital Reorientation In Successful Turnarounds, Michael A. Abebe, Chanchai Tangpong, Hermann Ndofor Feb 2024

Hitting The ‘Reset Button’: The Role Of Digital Reorientation In Successful Turnarounds, Michael A. Abebe, Chanchai Tangpong, Hermann Ndofor

Management Faculty Publications

Seismic shifts in industries brought about by radical technological innovations usually lead to a misalignment between the capabilities of many incumbent firms and the requisites of their new environment, and eventually, organizational decline. The current turnaround literature, while emphasizing operating and strategic responses to organizational decline that focus on efficiency and fine tuning product/market strategy respectively, ignores such organizational decline that requires fundamental reengineering of the whole firm and its value chain. This paper introduces the concept of digital reorientation as a long term turnaround strategy to respond to situations in which a firm’s environment has been fundamentally restructured. Digital …

Putting Trust In Voluntary Demand Management: How And Why Wyoming Should Encourage The Development Of A Water Trust, Colton Edwards Feb 2024

Putting Trust In Voluntary Demand Management: How And Why Wyoming Should Encourage The Development Of A Water Trust, Colton Edwards

Wyoming Law Review

The development of water trusts in the American West has followed a similar concept to the land trust model of conservation. Climate change has raised concerns among Colorado River Basin states about their water rights being curtailed. A key avoidance measure taken by states has been to focus on demand management, reducing the amount of water diverted from the river system through voluntary water transactions. While governments have made some investments in water conservation, more money is needed to keep adapting to a changing climate; water trusts can provide such money through investment from private sources. But the legal regime …

Zf Automotive V. Luxshare: The Supreme Court’S New Gloss On 28 U.S. Code § 1782 And What It Means For International Commercial Arbitration, Madina Lokova Feb 2024

Zf Automotive V. Luxshare: The Supreme Court’S New Gloss On 28 U.S. Code § 1782 And What It Means For International Commercial Arbitration, Madina Lokova

Journal of Dispute Resolution

The federal statute 28 U.S.C. § 1782 (“Section 1782”) allows litigants in foreign proceedings to obtain discovery in the United States, under the broad US discovery rules, for use in such proceedings. Although Section 1782’s use by parties to foreign proceedings has been expanding, there was a split in authority regarding whether the statute was broad enough to permit United States’ courts to authorize discovery for use in private arbitration proceedings overseas.

Sunny Days Ahead: Using Adr To Fuel The Future Of Green Energy, Matthew Graham Feb 2024

Sunny Days Ahead: Using Adr To Fuel The Future Of Green Energy, Matthew Graham

Journal of Dispute Resolution

The energy landscape in the United States (“U.S.”) has undergone significant changes in the last few centuries. Energy consumption has increased dramatically as more energy sources have been developed. As one of the world’s leading energy consumers, the U.S. has a large incentive to develop energy solutions that are both sustainable, dependable, and independent of foreign powers. For these reasons, Congress has spent the last few decades passing numerous pieces of legislation encouraging investment in energy solutions that will benefit the U.S. for centuries. With the enactment of the Inflation Reduction Act (“IRA”) of 2022, the U.S. has made its …

Climate Diplomacy: Can Mediating Climate Considerations Into Peace Agreements Create A Sustainable Future?, Kayla Fowler Feb 2024

Climate Diplomacy: Can Mediating Climate Considerations Into Peace Agreements Create A Sustainable Future?, Kayla Fowler

Journal of Dispute Resolution

The Earth’s temperature has risen on average 0.14 degrees Fahrenheit per decade since 1880—a total of 2 degrees. Since 1981, the rate of warming has been over twice as fast at 0.32 degrees Fahrenheit per decade. 2022 was the sixth-warmest year on record, and the 10 warmest years have all occurred since 2010. These long-term shifts in temperature exemplify the changes to our climate due to the increasing accumulation of gases caused by human activity on Earth, more commonly referred to as climate change. While it is abundantly clear that climate change is negatively affecting our environment, it is also …

Why Removing Institutional Discretion And Applying Restorative Justice To Mediation Could Prove Beneficial To Title Ix Dispute Resolution, Clare Hensley

Journal of Dispute Resolution

University students have often voiced concern that their institution did not do enough in addressing sexual assaults on campus. There is a perception among students and potential victims that there is a culture of ignoring and underreacting to sexual violence on campus. As many as one in five female undergraduate students experience sexual violence during college, but few feel confident enough to report it.

After The Demise Of Affirmative Action, Ensuring Equitable Access To Educational Opportunities, Anna Gorman-Huang, Peter Henry Huang Feb 2024

After The Demise Of Affirmative Action, Ensuring Equitable Access To Educational Opportunities, Anna Gorman-Huang, Peter Henry Huang

UC Law Journal of Race and Economic Justice

On June 29, 2023, the United States Supreme Court held in two related cases that race-based affirmative action in college admissions is unconstitutional, because it violates the Equal Protection Clause of the 14th Amendment. What is next in (higher) education after the Supreme Court’s rulings in two related cases brought by Students for Fair Admissions? The decisions may dramatically transform college admissions and even how universities think about allocating their resources and about their role in a democratic society. Even now, the Court’s holdings are rippling past highly selective college campuses to corporate boardrooms, non-profits, and state legislatures.

Despite the …

Humanitarian Task Force

The Uganda Humanitarian Violence Against Children Survey (HVACS), completed in 2022 in refugee settlements in Uganda, was the first of the Baobab Research Programme Consortium’s (RPC’s) series of studies to be implemented. As a landmark study, and the first-ever HVACS, it provided critical insights into the state of Violence Against Children (VAC) in refugee settlements in Uganda. Baobab conducted a collaborative radio dissemination activity in Uganda that was designed to take place during the 16 Days of Activism Against Gender-Based Violence (GBV) commemorated between 25 November and 10 December 2023, aligning with the global theme “Invest to prevent violence against …

The Gig Is Up: Examining Side Gig Income And Allowable Deductions, Bonnie R. Albritton, Renee Foshee, Amy Foshee Holmes, Kimberly J. Webb

School of Business Faculty Research

The expansion of the gig economy has provided opportunities and challenges for tax professionals. In this case study, a rideshare driver receives a Form 1099-K for side gig income and seeks tax advice from a friend, ultimately deciding to consult with a tax professional (the student) for income tax preparation. The friend provides a video that describes misleading information giving the students a chance to consider authoritative sources as they research appropriate reporting on an individual income tax return. The case learning objectives are: (1) distinguish between credible and noncredible sources of information; (2) evaluate expenses and income to determine …

‘To “Meddle Wi’ The Thistle”’: C. M. Grieve’S Scottish Chapbook, The Little Magazine, And The Dilemmas Of Scottish Modernism, Scott Lyall Feb 2024

‘To “Meddle Wi’ The Thistle”’: C. M. Grieve’S Scottish Chapbook, The Little Magazine, And The Dilemmas Of Scottish Modernism, Scott Lyall

Studies in Scottish Literature

Examines C. M. Grieve’s (Hugh MacDiarmid’s) most important journal enterprise, The Scottish Chapbook, which critics have assumed marks the beginning of a modernist Scottish renaissance. Against this view, this article argues that the range of contributions to the Chapbook were generally not modernist in their formal characteristics, many recalling the Victorian or fin-de-siècle periods. While the Chapbook’s brief lifespan (1922–23) was typical for modernist little magazines, the dilemmas encountered by Grieve’s periodical – restricted finances, lack of avant-garde contributors – are explained here as a side-effect of ‘localist modernism’, a concept defined by Eric B. White.

Computational Modelling Of A Triaxial Vibrating Sample Magnetometer, Leo Rodriguez, Arjun Sapkota, Jonathan Alvarado, Jitendra S. Tate, Wilhelmus J. Geerts Feb 2024

Computational Modelling Of A Triaxial Vibrating Sample Magnetometer, Leo Rodriguez, Arjun Sapkota, Jonathan Alvarado, Jitendra S. Tate, Wilhelmus J. Geerts

Mechanical Engineering Faculty Publications

Magnetic Field Assisted Additive Manufacturing (MFAAM) enables 3D printing of magnetic materials of various shapes which exhibit a complex anisotropy energy surface containing contributions generated from different origins such as sample, particle, and agglomerate shape anisotropy, flow and field induced anisotropy, and particle crystal anisotropy. These novel magnet shapes require the need to measure the x, y, and z components of the magnetic dipole moment simultaneously to fully understand the magnetic reversal mechanism and unravel the complex magnetic anisotropy energy surface of 3D printed magnetic composites. This work aims to develop a triaxial vibrating sample magnetometer (VSM) by adding a …

Sidewalk Government, Michael C. Pollack Feb 2024

Sidewalk Government, Michael C. Pollack

Michigan Law Review

This Article is about one of the most used, least studied spaces in the country: the sidewalk.

It is easy to think of sidewalks simply as spaces for pedestrians, and that is exactly how most scholars, policymakers, and laws treat them. But this view is fundamentally mistaken. In big cities and small towns, sidewalks are also where we gather, demonstrate, dine, exercise, rest, and shop. They are host to commerce and infrastructure. They are spaces of public access and sources of private obligation. And in all of these things, sidewalks are sites of underappreciated conflict. The centrality of sidewalks in …

Destined To Deceive: The Need To Regulate Deepfakes With A Foreseeable Harm Standard, Matthew D. Weiner Feb 2024

Destined To Deceive: The Need To Regulate Deepfakes With A Foreseeable Harm Standard, Matthew D. Weiner

Michigan Law Review

Political campaigns have always attracted significant attention, and politicians have often been the subjects of controversial—even outlandish—discourse. In the last several years, however, the risk of deception has drastically increased due to the rise of “deepfakes.” Now, practically anyone can make audiovisual media that are both highly believable and highly damaging to a candidate. The threat deepfakes pose to our elections has prompted several states and Congress to seek legislative remedies that ensure recourse for victims and hold bad actors liable. These recent attempts at deepfake laws are open to attack from two different loci. First, there is a question …

Reimagining The Criminal Legal System To Create A More Equitable Society, The Benjamin L. Hooks Institute For Social Change Feb 2024

Reimagining The Criminal Legal System To Create A More Equitable Society, The Benjamin L. Hooks Institute For Social Change

The Hooks Institute Policy Papers

The policy papers in this edition help us begin to answer Ruth Wilson Gilmore’s pertinent question: “Instead of asking whether anyone should be locked up or go free, why don’t we think about why we solve problems by repeating the kind of behavior that brought us the problem in the first place?” The series is arranged intentionally to engage with the criminal legal system from beginning to end—from its roots, to its policies and ideologies, to its lasting effects. Each paper focuses on one critical issue in the criminal legal system in the United States, and then presents a set …
