Constitutional Interpretation As Problem Solving: How The Modalities Work, Jack M. Balkin

The standard forms of constitutional argument—the modalities—are central to one of the most important approaches to constitutional interpretation: constitutional pluralism. Both originalists and non-originalists use the modalities. This Essay explains how they work. The modalities of constitutional argument are shared cultural tools for thinking about the Constitution, analyzing legal problems, and formulating arguments to resolve them. Constitutional interpretation is a kind of problem solving, and the modalities are our legal culture’s toolkit for analyzing and solving constitutional problems.
Our use of the modalities presumes that at any point in time, some arguments are better than others. This assumption is central …

Contrary to what historians and legal scholars have often assumed, originalism has played an important role in American free speech history. During the 1950s, originalist interpretations of the First Amendment as prohibiting the crime of seditious libel became popular in legal argumentation, court rulings, and in popular culture more generally. The reason for the popularity of these arguments was the Red Scare. Liberal lawyers, judges, and scholars deployed originalist arguments in their battles against government anti-Communist measures. One of the most compelling and generative aspects of Jack Balkin’s Memory and Authority: The Uses of History in Constitutional Interpretation is its synthesis of constitutional theory, history, and the growing field of the “politics of memory,” and especially the concept of the “memory entrepreneur.” The book project itself is entrepreneurial, if you will, in its cultivating, connecting, and building from different disciplines, academic languages, and national narratives (in that the “politics of memory” is already such an international and interdisciplinary field itself).

INTRODUCTION: Integrated vascular surgery residency (IVSR) programs have grown increasingly competitive. However, the factors influencing successful matching remain unclear. This study evaluates the impact of medical school and applicant characteristics on IVSR match outcomes.
METHODS: A list of ACGME-accredited IVSRs was obtained from the Society for Vascular Surgery, and resident data from the 2019-2023 match cycles were collected from publicly available sources. Applicant characteristics consisted of additional graduate degrees, Alpha Omega Alpha (AOA) status, and research productivity. Medical school characteristics consisted of ranking, research funding, vascular surgery interest group (VSIG) presence, and vascular surgery faculty size. Logistic regression models were …

This study examines the phenomenon of Malaysia's orangutan diplomacy as part of public diplomacy and cultural diplomacy in the face of international pressure on the palm oil industry, particularly from the European Union. Inspired by animal diplomacy practices such as China's panda diplomacy, Malaysia in 2024 initiated a plan to make the orangutan a diplomatic symbol to build a positive image and strengthen trade relations with partner countries. The construction of syntactically correct sentences plays an important role in conveying messages clearly and accurately during communication. Therefore, this study discusses the ability of fourth-semester students of the Dutch Studies Program at Universitas Indonesia in the 2024/2025 academic year to arrange rest elements, such as direct objects, indirect objects, adverbs of time, frequency, quantity, instrument, and place. The dissolution of the Koninklijk Nederlands-Indisch Leger (KNIL) following the recognition of Indonesian sovereignty created serious problems for KNIL soldiers from Ambon, particularly with regard to their legal status, security, and place of demobilization. This study examines the 49th anniversary speech of the Green March (Masirat Al-Hadraa) as an ideological instrument within the political framework of the Kingdom of Morocco. The research reveals that the historical narrative of the Green March is reproduced not merely as collective memory, but as a strategic mechanism to consolidate monarchical legitimacy and assert territorial sovereignty over Western Sahara. Male participation in contraceptive use in Indonesia remains very low, while women continue to bear a disproportionate reproductive burden, including mental health impacts from contraceptive side effects. This study aims to examine the effect of husbands’ contraceptive use on wives’ mental health. The analysis utilizes data from the fifth wave of the Indonesia Family Life Survey conducted in 2014. Wives’ mental health is measured using the Center for Epidemiologic Studies Depression Scale - 10. The results of the binary logistic regression model indicate that husbands’ contraceptive use lowers the likelihood of wives experiencing depression. Additionally, being aged 25-49, having good …

Stand-up comedy can challenge dominant discourses and dismantle stereotypes. This research focuses on an Indonesian female stand-up comedian, Sakdiyah Ma’ruf. Using textual analysis, the study investigates recorded performances available on YouTube between 2014 and 2025. Sakdiyah addresses critical social issues, including religious fundamentalism, terrorism, sexism, and gender-based violence. The study explores how she constructs her comedic persona through narratives of personal identity and social critique, and how she employs humor to negotiate sensitive topics while remaining acceptable to diverse audiences. This article examines the role of the Japanese newspaper Yomiuri Shinbun in covering the great East Japan disaster on March 11-13, 2011. This study uses a quantitative and qualitative approach, with content analysis methods and Gunther-Kress multimodal critical discourse analysis methods on 98 photos published by the newspaper. The results show that the newspaper published a special edition twice, with photos that did not show photos of the deceased victims, creating a distance between the reader and the subject. Most of the photos were taken from a distance, indicating a lack of interaction and showing that the victims did not …

Art archives hold a crucial role in the production of knowledge and the writing of art history. In Indonesia, however, the management and accessibility of art archives remain uneven, resulting in significant gaps within art historiography. This article examines how art archives function not merely as repositories of documentation, but as cultural practices and public knowledge infrastructures that shape the conditions of art history writing. This study examines the deconstruction of female gender stereotypes through the character Yuna in the game Ghost of Tsushima. The analysis employs a qualitative approach that explores narrative, visual, and gameplay aspects. The theoretical framework draws on Judith Butler’s gender performativity, Marie-Laure Ryan’s digital narrative theory, and Stuart Hall’s representation theory to identify forms of resistance to traditional gender norms reflected in the game industry. The findings indicate that Yuna emerges as an active agent who influences the protagonist’s ideological development, plays a significant role in shaping the overall narrative direction, and avoids visual objectification. This article offers a reinterpretation of the Kutika manuscript from a Buginese ethnoecological perspective. Departing from a philological study of the Lontara’ Kutika text in the National Library of Indonesia (PNRI) collection (code VT 129), this research examines how Buginese communities articulate their interaction with nature through this manuscript. The phenomenon of cross-border marriages between Vietnamese women and Chinese men is often reduced by mainstream media to simplified stereotypes—depicting them as victims of human trafficking, impoverished women seeking economic escape, or submissive "imported brides." Such depictions obscure the everyday realities through which these women confront and negotiate social stigma in a foreign socio-cultural environment. Since COVID-19, Zoom has become the primary distance communication platform integrated with automatic transcription tools such as Otter and Descript. However, meetings involving non-native French speakers can generate sound interference that reduces transcription accuracy. This study compares the automatic French transcription quality of both tools in corporate online meetings affected by interference from native Indonesian speakers. Alienation as a novelty in archaeological research which in this study aims to explain how mentally illness patients are buried at Lawang Mental Hospital as an alienation and how the representation of the graves of patients with mentally illness. Alienation is a form of experience by individuals who are marginalized from society, one of which is people with mentally illness. Alienation in mentally illness does not only occur during their lifetime, but continues until they die.
