Surviving Covid19 (Increased Domestic Violence, Marginalized Communities, And Innovative Solutions), Anjerrika R. Bean
Journal of Family Strengths
Surviving COVID19 (Increased Domestic Violence, Marginalized Communities, and Innovative Solutions) Domestic violence generally refers to violence occurring between residences within one single location. Intimate partner violence is domestic violence by a current or former spouse or partner in an intimate relationship against the other spouse or partner. IPV can take several forms, including physical, verbal, emotional, economic, and sexual abuse. According to the Center for Disease Control, 1 in 4 women and 1 in 9 men experience severe intimate partner physical violence, intimate partner contact sexual violence, and/or intimate partner stalking with impacts such as injury, fearfulness, post-traumatic stress disorder, …
Entropic Interactionist Theory: Reading Social Constructionism Through Thermodynamics And Samuel Beckett, Brie Barron
Entropic Interactionist Theory: Reading Social Constructionism Through Thermodynamics And Samuel Beckett, Brie Barron
Criterion: A Journal of Literary Criticism
This essay aims to explain the breakdown of social constructs through the concept of Entropic Interactionist Theory. EIT argues that it is the nature of creations to be vulnerable to the same forces as their creator, and that social constructions (like identity, for example) are subject to the very same physical forces that give rise to humanity’s creative impulse. At its core, EIT is informed by social constructionism and Nietzschean sociological theory, but it names the second law of thermodynamics and the concept of entropy as the driving force behind societal disintegration. The complication with this theory is that it …

Cultural Healing Practices: Incorporating Cultural Healers Into Minnesota's Mental Health Care System, Raymond Shoup, Allyson Endersbe, Nayeli Hernandez Moctezuma, Patty Balderas-Johnson
Master of Social Work Student Policy Advocacy Briefs
Minnesota’s approach to health and mental health is based on western cultural traditions of illness, help seeking behaviors, healing and wellness. This approach does not work for many of the cultural communities in Minnesota, especially those with a deep history of generational trauma, oppression, and discrimination. We need to make mental health a priority for Minnesotans by expanding the availability of holistic approaches rooted in the cultural traditions of Minnesota’s diverse cultural communities. We must address the impact of generational trauma and work to lessen the harm by incorporating cultural healing practices into our mental health care system, including the …

The Effect Of Ebook Reading On Overall Literacy Development, Beth Bosman Acosta
Doctoral Dissertations and Projects
This study examined the effect of eBook reading, in contrast to traditional print reading, on developing overall literacy in lower elementary school students. It focused on student motivation, phoneme awareness, word recognition, and comprehension as they pertain to student achievement. This research study is important since it investigated a unique way to implement technology to assist both early and struggling readers. The study was designed to examine the effect of using an eBook application (Raz-Kids) instead of the traditional reading curriculum to engage the students through the interactive activities. The study involved 106 lower elementary school students in a private, …
The Original Meaning Of “Due Process Of Law” In The Fifth Amendment, Max Crema, Lawrence B. Solum
The Original Meaning Of “Due Process Of Law” In The Fifth Amendment, Max Crema, Lawrence B. Solum
Faculty Scholarship
The modern understanding of the Fifth Amendment Due Process of Law Clause is dramatically different from the original meaning of the constitutional text. The Supreme Court has embraced both substantive due process—a jurisprudence of unenumerated rights—and procedural due process—a grab bag of doctrines that touch upon almost every aspect of administrative and judicial procedures. We demonstrate that the original meaning of the Clause is much narrower. In 1791, “due process of law” had a narrow and technical meaning: the original sense of the word “process” was close to the modern sense that the word has when used in the phrase …

This article is the first to explore legal needs in the Rio Grande Valley of Texas––a region that is predominantly Latinx and has both rural and urban characteristics. There are few legal needs assessments of majority Latinx communities, and none that examine needs in areas that are also U.S. border communities. Access to justice studies often overlook this area of the U.S. and this segment of the population despite their unique qualities. Latinos are projected to constitute the largest ethnic group in the country by 2060, making it imperative that we study access to justice-related assets, needs, opportunities, and barriers …

Transplanting Anti-Suit Injunctions, Peter K. Yu, Jorge L. Contreras, Yu Yang
Faculty Scholarship
When adjudicating high-value cases involving the licensing of patents covering industry standards such as Wi-Fi and 5G (standards-essential patents or SEPs), courts around the world have increasingly issued injunctions preventing one party from pursuing parallel litigation in another jurisdiction (anti-suit injunctions or ASIs). In response, courts in other jurisdictions have begun to issue anti-anti-suit injunctions, or even anti-anti-anti suit injunctions, to prevent parties from hindering the proceedings in those courts. Most of these activities have been limited to the United States and Europe, but in 2020 China emerged as a powerful new source of ASIs in global SEP litigation. The …

Factors Of Persistence In Multilingual Abe Secondary Credential Participants, Sherry Smith
School of Education and Leadership Student Capstone Theses and Dissertations
The research question addressed in this study is What factors contribute to multilinguals’ persistence in adult secondary credential programs? ABE participants in general have a high rate of stopping out of programs. For those trying to earn a secondary credential in a second language, the goal of earning a secondary credential may be more complex. There was little research focusing on this population of ABE participants with this goal. This mixed methods retrospective case study examines which factors supported the persistence of three multilingual participants in Adult Basic Education (ABE) who earned their GED®. The supports are categorized into individual, …

Medical Accreditation For Foreign-Educated Refugees: An Undue Burden, Katherine Jolley, Alex Hansen
Medical Accreditation For Foreign-Educated Refugees: An Undue Burden, Katherine Jolley, Alex Hansen
Brigham Young University Prelaw Review
Historically, the United States has maintained a policy of robust assistance to refugees that enter the country. Refugee relief includes short-term health coverage and employment services. Unfortunately, many international medical graduates who come as refugees face excessive barriers to join the healthcare industry when they arrive. In light of emergency adjustments to the accreditation processes during the COVID-19 pandemic, this article proposes that the accreditation process for foreign-educated healthcare workers poses an undue burden on refugees.

Developing Critical Cultural Awareness In The Elt Classroom, Akiko Takagi, Aleidine J. Moeller
Department of Teaching, Learning, and Teacher Education: Faculty Publications
In the current age of globalization, migration, and immigration, integrating interculturality into language instruction is essential in order to prepare language learners to become competent intercultural speakers (Byram, 2020), described as competent communicators (Byram & Zarate, 1996) who engage with complexity and multiple identities and who “avoid the stereotyping which accompanies perceiving someone through a single identity” (Bryam et al., 2002, p. 5). Intercultural speakers are successful not only in communicating information but also in developing human relationships with people of other languages and cultures with whom they live and work. In contrast to monolingual native speakers (NSs), intercultural speakers …

What is the relationship between one's own religious beliefs and their everyday colloquial diction choices? Moreover, why is the subfield that encompasses the intersection of sociolinguistics, education, and religious studies one that has gained little scholarly interest in recent years, where one could argue the importance of religious belief, and other socio-political beliefs in education have come center stage in the heart of American political debate? This article will tackle this broad range of topics through a case study focusing on my primary research question: How does a teacher’s own religious identity affect the religious language utilized in their classroom …
Language Barriers In The U.S.: Exploring The Protection Of Human Trafficking Victims Whose Native Language Is Spanish, Rachel Klien-Hart
Language Barriers In The U.S.: Exploring The Protection Of Human Trafficking Victims Whose Native Language Is Spanish, Rachel Klien-Hart
Honors College Theses
Human trafficking exists as a multi-billion-dollar industry that impacts millions of people around the world, mainly targeting vulnerable populations. In the United States, one vulnerable population includes non-English speaking victims trafficked for labor, agriculture, domestic, or sex purposes. Protecting trafficking victims involves providing justice, medical assistance, identification, therapy, rehabilitation, and reintegration tools which often falls within the purview of nonprofit organizations. Research on human trafficking has underscored language barriers as a key obstacle in the protection of trafficking victims. However, little is known about the role of language barriers in the nonprofit sector, and specifically the experiences of nonprofit organizations …
Implicit Bias Training: Improving Racial/Ethnic Disparities In Maternal Care, Marilyn Mapp
Implicit Bias Training: Improving Racial/Ethnic Disparities In Maternal Care, Marilyn Mapp
Doctor of Nursing Practice Projects
Background: Racial and ethnic disparities persist in the United States leading to adverse maternal outcomes. Nationally, the maternal mortality rates in black women are two to three times higher than white women. Implementing implicit bias training, recommended by the Council on Patient Safety in Women’s Health, is a key intervention that may help to reduce these disparities.
Objectives: This quasi-experimental/mixed methods project evaluated the effectiveness of training on implicit bias to increase awareness of implicit bias among a convenience sample of registered nurses in labor and delivery and postpartum units at two community hospitals.
Methods: Quantitative data was analyzed with …
The Relationship Between State Capacity And Internal Armed Conflict, Rodrigo L. Cotto-Abreu
The Relationship Between State Capacity And Internal Armed Conflict, Rodrigo L. Cotto-Abreu
Student Publications
This paper seeks to evaluate the impact that state capacity has had on the annual incidences of internal armed conflicts in the post-WWII period. This paper proposes that the state’s coercive, administrative, and extractive capabilities are the most effective tools at its disposal when attempting to decrease the likelihood of the onset of internal civil conflict. This paper hypothesizes that the higher the level of state capacity in a given nation-state is, the lower the number or occurrences of internal armed conflict will be. The key finding this paper presents is a statistically significant result linking state capacity to the …

Denmark And Sweden: The Collision Between Welfare State Politics And Immigration, Amy Elizabeth Cantrell
Student Publications
The Scandinavian welfare states of Denmark and Sweden have famously similar socio-political and cultural systems, ones which have advanced the common perception of these nations as united in a common humanitarian and progressive global position. However there exists a significant divergence within either nation’s approach to immigration, asylum and integration policy, one indicative of the deeply ingrained deviations in popular understandings of national belonging and perspectives on greater European and global integration. By contextualizing the historical progressions of either nation and juxtaposing their individual responses to both the 2015 European refugee crisis and the contemporary Ukrainian conflict and resulting refugee …
Haunting Memories And Healing Stories: Grief And Catharsis In Eudora Welty’S The Optimist’S Daughter And Jesmyn Ward’S Sing, Unburied, Sing, Carleigh Rahn
Departmental Honors & Graduate Capstone Projects
In this senior seminar term paper, I compare Welty’s and Ward’s novels and their depictions of storytelling as a means of catharsis. In both novels, the protagonists struggle with the loss of their loved ones and must cope with their grief. I examine the ways that individual and collective, cultural memories affect the grieving process for the protagonists. In Welty’s novel, Laurel, the protagonist, struggles to release the memories of her late husband and father. In Ward’s, the treatment of Black Americans and their own ancestors haunts the central family and they must shake the ghosts in order to heal …
U.S. Muslim College Students' Spatialization Of Their Muslimness: An Exploration Of Muslim Linguistic And Cultural Identities Across Social Spaces, Ibrahim Demir
Language, Literacy, and Sociocultural Studies ETDs
ABSTRACT
The purpose of this multiple-case study was to explore how four US-born Muslim college students spatialized their linguistic and cultural identities within and across their social, academic, and religious spaces. The data were collected through detailed and in-depth data collection methods involving multiple sources of information: observations in the above-mentioned spaces, focus group interviews, autobiographies, drawings, images, and narratives. The data were analyzed through spatial analytical perspectives.
This study was drawn on Lefebvre's (1991) Spatial triad of perceived, conceived, and lived spaces, Soja's (1996) interpretation of spatiality and Thirdspace, and Bhabha's (2004) concept of Hybridity. This study presented how …

“We Are So Much Alike, But Nobody Wants To Admit It”: Reactions To A Critical Bernalillo Nuevomexicano Language And Culture Curriculum, Joseph Moreno
Language, Literacy, and Sociocultural Studies ETDs
This study gauges how adult Bernalillo Nuevomexicanos reacted to a critical curriculum that addresses how race, class, power, and identity influence Nuevomexicano language use, and an understanding of history and culture, with emphasis on the Bernalillo Matachines Dance, Las Fiestas de San Lorenzo and associated customs. In addition, the study aims to discover what elements they find positive, negative, and what they would revise about the curriculum. This study is an attempt to create agency through the creation of a critical curriculum unit by a community researcher, teaching the pilot unit to a group of community members, and gauging their …
“Any Lady Can Now Learn To Cut Perfect Fitting Dresses”: The Role Of Pattern Drafting Systems In The Production Of Women’S Dress, 1880–1900, Alyssa Smith
Department of Textiles, Merchandising and Fashion Design: Dissertations, Theses, and Student Research
This research conveys findings from my MA thesis research focused on pattern drafting systems for women’s garments developed between 1880 and 1900. The study builds on the seminal work of Claudia Kidwell, who divided these systems into three categories: proportional, hybrid, and direct measure. To date, the study of this textile technology and how it positioned women and sewing in both domestic and professional spheres has received little scholarly attention, but pattern drafting technology transformed the possibilities for pattern creation and proportionate measurements, especially for home sewers. It also aided in the paper pattern and ready-made clothing industries. This research, …

The American Bar Association Model Rules of Professional Conduct calls upon lawyers, as public citizens, to embrace a special responsibility for the quality of justice in the legal profession and in society. Yet, some law professors have historically adopted a formalistic and doctrinally neutral approach to law teaching that elides critical perspectives of law, avoids the intersection of law and politics, and tends to overlook the way law can construct the very social injustices that it seeks to contain. The objective, apolitical, and so-called “colorblind” jurisprudential stance in many law classrooms inflicts intellectual violence upon law students who discover a …
