International Journal on Consumer Law and Practice

State courts are the traditional and established place to resolve legal disputes. However, litigations are regularly criticized for being lengthy, costly and conducted in an analogue way (eg, by using outdated non-digital technology for communication). Consumers with small claims in particular often regularly refrain from seeking redress as the hurdles state court proceedings entail are disproportionate to the potential outcome. Purpose: The purpose of this study was two-fold and consisted of the development of a skills-based model for Case-by-Collaboration (CBC) and the collection of qualitative data from students and teachers aimed at answering the research question: What skills do individuals (students) apply during the completion of a hypothetical medical laboratory management-based Case-by-Collaboration capstone project? Method: A consensual qualitative research design was selected for this study. Ecological Systems Theory (Bronfenbrenner, 1979) can be used as a framework to examine the importance of communication and collaboration among parents and teachers as both are important stakeholders in the field of education. Parent-teacher relationships are critical for autistic students particularly due to individualized education plans and the provision of special education services (IDEA, 2004). The current study examined relationships between parent-teacher dyads in terms of congruence, the degree to which both parties are in agreement about their relationship. More broadly, the tools at the US government’s disposal— IEEPA, Congressional lawmaking authority, and CFIUS review—encourage the use of such flimsy rationale and a lack of transparency, which ultimately promotes such broad bans; and the costs of these bans are dear. There may be First Amendment implications, and at the very least, a chilling of speech. There are also significant impacts on American foreign policy, from legitimizing the Chinese strategy of cybersovereignty and government regulation, to the creation of incentives to localize data in a manner that might undermine American law enforcement efforts.

Since 2000s, Africa and India severally rejected the notion that UPOV’s 1991 standard of Plant Breeders Rights (PBRs) is the only route to fulfil their obligations under Article 27 of the TRIPs Agreement. Objecting to the exclusive focus of the UPOV regime on formal plant breeders, African countries insisted on a holistic approach to plant breeders’ rights to include protection for rights of communities, farmers and their indigenous knowledge, innovation and practices. This article introduces three ideas that are central to understanding the ways in which law and legal thinking are disrupted by emerging technologies and to maintaining a clear focus on the responsibilities of regulators. The first idea is that of a double disruption that technological innovation brings to the law. "Trying To Get Free": A Theoretical Centering Of Black Women's Post-Carceral Narratives Of Systemic Unfreedom, Geniece Crawford Mondé

"This article examines how Black justice involved mothers navigate the enduring unfreedom of post-imprisonment life. Drawing upon the analytical framework of Black Feminist Criminology (BFC), this paper argues that centering women’s narratives of unfreedom provides a context for understanding and critiquing systemic and structural oppression. Interviews with thirty-three Black formerly incarcerated mothers from two transitional organizations in New York and Massachusetts reveals how women a) Identify instances of structural oppression at the hands of the legal system and the labor market and b) Deploy individual responses that reframe their marginal status by subverting expectations of their roles as mothers and …

Grease Or Grit?: International Case Studies Of Occupational Licensing And Its Effects On Efficiency And Quality, Morris M. Kleiner Editor, Maria Koumenta Editor

The book provides a comprehensive approach to whether a dominant governmental institution in the labor market-occupational licensing-greases, which enhances, or on the other hand results in grit, which diminishes the efficient workings of labor and service markets in parts of Europe and the United States. The detailed case studies in the book indicate that an increase in the availability of service providers or enhanced competition does not have negative effects on the quality of the services provided, prices, or survey measures of consumer satisfaction.
