Movement Lawyering In The Time Of The Climate Crisis, Camila Bustos Oct 2022

Movement Lawyering In The Time Of The Climate Crisis, Camila Bustos

Pace Environmental Law Review

While climate litigation has emerged as a tool to tackle rising emissions and its devastating consequences, climate litigation as a strategy and movement has yet to be thoroughly analyzed through the lens of movement lawyering. Thus, this paper seeks to draw from existing literature on movement lawyering to explore the relationship between climate litigation and movement lawyering principles, addressing separate yet related questions: What does it mean to be a movement lawyer working on climate change? How do principles of climate justice shape movement lawyering and thus, climate litigation? How do lawyers think about accountability to their clients and the …

Applying Universal Design In The Legal Academy, Matthew L. Timko

College of Law Faculty Publications

Too often barriers to access in the form of physical, technological, and cognitive environments play a large role in keeping many people out of law school. While federal and state laws address these barriers, universal design provides the clearest policy change for law schools to remedy these issues.

Comparing The Scottish National Party (Snp) And The Basque Nationalist Party (Eaj-Pnv)’S Social Policies Towards Refugees And Asylum Seekers, Emily Woodruff Oct 2022

Comparing The Scottish National Party (Snp) And The Basque Nationalist Party (Eaj-Pnv)’S Social Policies Towards Refugees And Asylum Seekers, Emily Woodruff

Independent Study Project (ISP) Collection

In 2022, countries and territories across Europe experienced a sharp increase in the number of people seeking asylum, mainly due to the war in Ukraine. Over 3,5000 Ukrainians have sought refuge in the Basque Autonomous Community (BAC) and as of July 2022, over 7,000 Ukrainians have sought refuge in Scotland (“3.587 refugiados de Ucrania”, 2022 and The Scottish Government, 2022). This increase is on top of the over 250,000 foreigners living in the BAC and the thousands of refugees already resettled throughout Scotland (Ikuspegi, Observatorio Vasco de Inmigración, 2022 and “Refugee resettlement”, 2022). Given the large number of refugees and …

Medical Ethics: How Resource Distribution Affects The Decision Making Of Doctors In Rural India: An Explorative And Comparative Study In Jamkhed, Maharashtra, Jared Yee

Independent Study Project (ISP) Collection

Using rural Mahrasthra as a case study, I was able to explore the medical ethics and common dilemmas that occur in Rural India. Through a collection of interviews and articles, I was able to piece together my understanding of some common ethical challenges that India faces, emphasizing ones that were unique to the location and circumstance. Using observations I made through my work in the hospital, I learned that limited resources effects all sides of ethics in the medical field, with a significant effect on economics, hospital structure, and clinical protocol. In an attempt to source the aspects of Indian …

Greening Criminal Legal Deserts In Rural Texas, Pamela R. Metzger, Claire Buetow, Kristin Meeks, Blane Skiles, Jiacheng Yu Oct 2022

Greening Criminal Legal Deserts In Rural Texas, Pamela R. Metzger, Claire Buetow, Kristin Meeks, Blane Skiles, Jiacheng Yu

Deason Center Reports

Texas’ rural communities urgently need more prosecutors and public defense providers. On average, Texas’ most urban areas have 28 lawyers for every 100 criminal cases, but rural areas only have five. Many rural prosecutor’s offices cannot recruit and retain enough staff. The Constitution’s promise of equal justice for all remains unfulfilled. Rural Texans charged with misdemeanors are four times less likely to have a lawyer than urban defendants. In 2021, only 403 rural Texas lawyers accepted an appointment to represent an adult criminal defendant. In 65 rural counties, no lawyer accepted an appointment. And the problem is getting worse. Since …

Legal Perspectives On The Streaming Industry: The United States, Irene Calboli

Faculty Scholarship

In the past decade, streaming has become one of the most popular formats of “consuming” entertainment and other content—from music to videos, and concerts, sports, conferences, and other events. In the United States, the majority of consumers subscribe to one or more streaming services today. Popular streaming services include famous platforms such as Spotify, Netflix, Apple Music, or Apple TV, Pandora, YouTube, and more. Beside subscription-based services, several of these platforms offer “freemium,” or ad-paid version of their services, which allow users to access content with advertisements for free. As elaborated in several industry reports and other publications, the rise …

The Amazing Carrie Menkel-Meadow And What Wins When Passions Collide, Lela Love Oct 2022

The Amazing Carrie Menkel-Meadow And What Wins When Passions Collide, Lela Love

Articles

Carrie Menkel-Meadow (sometimes referred to as “Carrie” herein) is famous in the dispute resolution world as one of the field’s founders. Her prolific writing on dispute resolution—negotiation, mediation, arbitration, and the variants of these major processes—evidences an unrivaled passion for the subject. A renaissance thinker, her intellectual explorations also extend to other areas such as women’s rights and restorative justice for victims of egregious wrongs.

Her multiple passions sometimes create dynamic tensions. For example, what happens if mediation norms threaten a woman’s rights? Or if mediators divert the focus of a dispute resolution process to the future, neglecting a horrific …

Latinas’ Use Of Spirituality As A Coping Mechanism, Ashley Lauren Faytol Oct 2022

Latinas’ Use Of Spirituality As A Coping Mechanism, Ashley Lauren Faytol

Dissertations (1934 -)

Intimate partner violence (IPV) is a widespread public health concern with consequences that negatively impact many areas of survivors’ functioning (Centers for Disease Control and Prevention [CDC], 2017, 2019; Ellsberg et al., 2008; Gorde et al., 2004; Kelly, 2010a). The negative impacts of IPV are more severe for Latinas than their White counterparts (e.g., Bonomi et al., 2009; Kelly, 2010b; Stockman et al., 2015), causing IPV to be considered a health disparity within the Latina community (Caetano et al., 2005). While spirituality has been shown to be an effective coping mechanism for many stressors in Latinas’ lives, it has not …

The Various Problems And Instabilities With The Implementation Of The Special Immigrant Juvenile Status Statute, Calli Schmitt

Cardozo Journal of Equal Rights & Social Justice

The note examines the Special Immigrant Juvenile Status (SIJS) statute, highlighting its purpose to protect vulnerable immigrant children who have been abused, neglected, or abandoned. However, the implementation of SIJS faces significant challenges, including inconsistent state court interpretations, political interference, and visa backlogs, which undermine its humanitarian goals. The note proposes reforms to address these issues and ensure that SIJS beneficiaries receive the protections and pathways to permanent residency intended by Congress.
