Lee Kong Chian School Of Business Year In Review 2021-2022, Singapore Management University
Lee Kong Chian School Of Business Year In Review 2021-2022, Singapore Management University
SMU Corporate Reports
As Singapore and the world reopens, this has led to changes, especially as people feel safe to travel abroad again. This has impacted us of course. We have seen an 8.9 percent drop in undergraduate applications from our 2022 high. This decline is due in no small part to the relaxation of travel restrictions. However, despite the drop, the quality of applications this year is similar or maybe even slightly better than the year before. In the end, we matriculated 884 students, above our target. This includes 38 scholarship recipients who accepted our offer, representing a record yield. We have …

Mysteerio: Multi-Regional Environmentally Extended Input-Output Model For United States, Yash Srivastava
All Theses
This research work titled My State Environmentally Extended Regional Input-Output (MYSTEERIO) is based on the concept of multi-regional environmentally extended input-output (MREEIO), which is a combination of lifecycle thinking and economics principles. Numerous studies have highlighted the advantages of using this methodology to determine the environmental impacts associated with economic activities for a region. However, no prior attempt has been made to conduct a state-level analysis for the US. This research work thus tries to estimate the impacts embodied due to the consumption of goods and services at the state level by using the MREEIO principles. Extensive coverage of the …
Let's Get Real: Weak Artificial Intelligence Has Free Speech Rights, James B. Garvey
Let's Get Real: Weak Artificial Intelligence Has Free Speech Rights, James B. Garvey
Fordham Law Review
The right to free speech is a strongly protected constitutional right under the First Amendment to the U.S. Constitution. In 2010, the U.S. Supreme Court significantly expanded free speech protections for corporations in Citizens United v. FEC. This case prompted the question: could other nonhuman actors also be eligible for free speech protection under the First Amendment? This inquiry is no longer a mere intellectual exercise: sophisticated artificial intelligence (AI) may soon be capable of producing speech. As such, there are novel and complex questions surrounding the application of the First Amendment to AI. Some commentators argue that AI …
Lost In The Fire: Reflections On The Tulsa Race Massacre Centennial, Alina Ball
Lost In The Fire: Reflections On The Tulsa Race Massacre Centennial, Alina Ball
UC Law Constitutional Quarterly
The Tulsa Race Massacre centennial, occurring on the heels of the Movement for Black Lives and its historic national spotlight on racial inequity, provides a rare moment to be reflective about how transactional lawyering can advance racial and economic justice. This Essay examines the Greenwood District to not only explain the continuing economic disenfranchisement of people of color, but also provide transactional lawyers a case study through which they can critically examine their efforts to move beyond the rhetoric of economic development to rooting out racial violence and oppression that threatens not merely minority-owned businesses, but the lives of people …
“The Times They Are A-Changin’:” A Dedication To The Past, Present, And Future Of Mercer Law Review, Cathy Cox
“The Times They Are A-Changin’:” A Dedication To The Past, Present, And Future Of Mercer Law Review, Cathy Cox
Mercer Law Review
Longtime readers of Mercer Law Review’s Annual Survey of Georgia Law likely know that Mercer Law School is steeped in history. It is the first American Bar Association-accredited law school in the state of Georgia, having earned that distinction in 1925—more than fifty years after the law school was actually founded in 1873. In the same vein, the Mercer Law Review was founded in 1949 and remains the oldest continuously-published law journal in Georgia.
When I became a student at Mercer Law School, I knew little about Mercer Law’s history or heritage, or for that matter, about lawyers or law …
Liberty And Justice For Y’All: Allowing Legal Paraprofessionals To Practice Law To Reduce The Effects Of Legal Deserts In Rural Georgia, Amanda Claxton
Liberty And Justice For Y’All: Allowing Legal Paraprofessionals To Practice Law To Reduce The Effects Of Legal Deserts In Rural Georgia, Amanda Claxton
Mercer Law Review
The lack of attorneys in rural America is not merely a social or cultural problem—it is a legal problem that officers of the courts cannot continue to ignore. Legal deserts are geographical areas where legal services are widely unavailable. Particularly in rural Georgia, legal deserts are a substantial issue. Attorneys and nonprofit organizations have attempted to ease the detrimental effects of legal deserts in a variety of ways; for various reasons, those efforts have been insufficient, and rural counties struggle to attract lawyers. Still, there is one method of resolving legal deserts that Georgia has yet to attempt: creating an …

Here’S Your Number, Now Please Wait In Line: The Asylum Backlog, Federal Court Litigation, And Artificial Intelligence In Agency Adjudication, Youssef Mohamed
University of Chicago Law Review
Asylum seekers are individuals who flee to other countries to find sanctuary from the persecution suffered within the borders of their home countries. The U.N. High Commissioner for Refugees estimated that by mid-2021 there were nearly 4.4 million individuals actively seeking asylum worldwide, and the most recent data available surprisingly suggest that the United States granted asylum to only 31,429 persons in 2020.
The asylum system that is with us today was created when Congress enacted the Refugee Act with the goal of “respond[ing] to the urgent needs of persons subject to persecution in their homelands” and “provid[ing] a permanent …
Rules Vs. Standards In Private Ordering, Tomer S. Stein
Rules Vs. Standards In Private Ordering, Tomer S. Stein
Buffalo Law Review
The tradeoff between bright-line rules and general standards is one of the bedrocks of law design. This tradeoff determines how legal norms are composed. The tradeoff between rules and standards pervasively affects private ordering as well: it determines how contractual norms are composed. Yet, scholars exploring the rule vs. standard dichotomy have either entirely overlooked the tradeoff taking place in private orderings or equated it with the public tradeoff that dominates lawmaking.
This Article is the first to systematically examine the rule vs. standard tradeoff in private orderings. The Article carries out this task by identifying and analyzing the fundamental …

The George Harris Show August 08, 2022, Part 5 Spanish To English Translation, Jonathan Gerweck
Honors College Theses
This thesis is an attempt at a Spanish-to-English translation of part of a comedy skit by Venezuelan American comedian George Harris performed on October 11, 2022, in Miami, Florida. As an academic, I have been captivated by foreign languages since a young age and have studied German up to the collegiate level. After moving to New York and studying at Pace University, an educational institution that does not offer German, I decided to teach myself Spanish. I reached the Advanced level of the language within my second semester of officially studying it at Pace University. I believe that the future …
An Access And Equity Ranking Of Public Law Schools, Christopher L. Mathis
An Access And Equity Ranking Of Public Law Schools, Christopher L. Mathis
Grantee Research
Over the past few decades, several comprehensive ranking systems, including the influential U.S. News and World Report’s Best Law Schools rankings, have emerged to provide useful information to prospective law students seeking to enroll in law school. These ranking systems have defined what is measured as “quality” and what outcomes law schools focus on to gain a better position in the ranking. These rankings fail to measure what many law schools claim to be one of their longstanding goals—diversity, access, and equity.
One of the problematic and shocking reasons U.S. News cites for not including diversity measures in the …

Campos Seguros In Santa Cruz County, Patricia Barajas Villasenor
Campos Seguros In Santa Cruz County, Patricia Barajas Villasenor
Capstone Projects and Master's Theses
Monarch Services is a non-profit organization within Santa Cruz county. The agency provides services for domestic violence, sexual assault, and human trafficking. Campos Seguros focuses on providing resources and advocacy to vulnerable populations, specifically Campesinos (farmworkers). Violence and abuse perpetrated against farm workers is an issue that demands more public attention and advocacy. Campesinos are highly vulnerable because of different contributing factors, these include immigration status, work uncertainty, and language barriers. Consequences include trauma, lack of reporting, and vulnerability to labor trafficking. Sexual abuse is highly prevalent within the agricultural realm; many employers can take advantage of Campesino’s vulnerable position. …

Protecting Subsistence Lands While Boosting The Bottom Line: The Enhanced Federal Tax Incentive Available To Alaska Native Corporations For Donations Of Conservation Easements, Timothy Troll, Konrad Liegel
Alaska Law Review
Alaska Native corporations face a dilemma. They own land of immense and significant cultural and ecological value. Their lands are critical for maintaining the Alaska Natives' subsistence needs. But they are also corporations established under the law to maximize the economic value of their land holdings to provide financial dividends to their Native shareholders. This paper explores the enhanced federal tax incentive for donations of perpetual conservation easements that became available in 2015 to Alaska Native corporations. The tax incentive offers Alaska Native corporations a way to protect the aboriginal lands conveyed to them under the Alaska Native Claims Settlement …
The Prison Mailbox Rule: Can Represented Incarcerated Litigants Benefit?, Nico Corti
The Prison Mailbox Rule: Can Represented Incarcerated Litigants Benefit?, Nico Corti
Fordham Law Review
In 1988, the U.S. Supreme Court created the “Prison Mailbox Rule,” which assesses the timeliness of incarcerated litigants’ filings based on the day they hand them to prison authorities. The rule reduces the structural barriers to filing while imprisoned. Although Houston v. Lack highlighted the unique challenges that pro se incarcerated litigants face, the Prison Mailbox Rule’s subsequent federal codifications did not limit its benefits to pro se litigants, despite purportedly “reflecting” the Houston decision. Federal circuit courts of appeal today are split on whether represented people in prison can benefit from the Prison Mailbox Rule, leaving both litigants and …
Dentistry And The Law: Employee Vs. Independent Contractor, Dan Schulte Jd
Dentistry And The Law: Employee Vs. Independent Contractor, Dan Schulte Jd
The Journal of the Michigan Dental Association
This month’s Dentistry and the Law column discusses hiring a dentist as an employee or an independent contractor. Employing a dentist as an independent contractor offers advantages such as avoiding compliance with various employment laws and not having to withhold taxes. However, there is uncertainty regarding whether tax and other authorities will recognize the independent contractor relationship. Factors like supervision and control play a significant role in this determination. To mitigate uncertainty, practices can contract with an entity owned by the dentist, providing a potential solution. Legal counsel is recommended for setting up such arrangements.

Donor-Advised Funds And Impact Investing: A Practitioner’S View, Sam Marks
Donor-Advised Funds And Impact Investing: A Practitioner’S View, Sam Marks
The Foundation Review
Any discussion of foundations embracing impact investing must include some discussion of one of the largest — and growing — sources of philanthropic capital: donor-advised funds. These philanthropic accounts allow donors of all sizes to access many of the functions of a private foundation, including the potential to invest for impact. Sponsors of these funds, however, face unique challenges in catalyzing impact investments.
Like the larger institutional foundations that have led the way as mission investors, sponsors must often educate and inspire governance boards and investment committees. Unlike foundations with professional program staff, decisions regarding philanthropic resources at sponsors of …
"Keep To The Code”: A Global Code Of Conduct For Third-Party Funders, Victoria Sahani
"Keep To The Code”: A Global Code Of Conduct For Third-Party Funders, Victoria Sahani
Faculty Scholarship
Global commercial third-party funding has given rise to wide-ranging regulatory approaches worldwide. Consequently, funders can engage in cross-border regulatory arbitrage by exploiting regulatory gaps within and among nations. This Article argues that the global community of nations should articulate a universal approach to the behavioral expectations of third-party funders operating transnationally, independent of local laws regarding the technical business of funding. It asserts that the key to fostering the ethical development of the third-party funding industry is to develop a globally applicable but locally enforced code of conduct or professional responsibility for the industry. Moreover, a successful regime for funder …
Shaping New Interregionalism: The Eu-Singapore Free Trade Agreement And Beyond, Pasha L. Hsieh
Shaping New Interregionalism: The Eu-Singapore Free Trade Agreement And Beyond, Pasha L. Hsieh
Research Collection Yong Pung How School Of Law
The article examines the theoretical concept of interregionalism in the context of the evolving framework between the European Union (EU) and the Association of Southeast Asian Nations (ASEAN). As the EU's first free trade agreement (FTA) with an ASEAN country, the EU-Singapore FTA is a pathfinder agreement that signifies a new phase of interregionalism and the EU's new Asia strategy after the Treaty of Lisbon. The article argues that the innovative designs of the EU-Singapore FTA will shape the normative development of EU-ASEAN relations in the post-pandemic era. It also cautions that a comparative analysis of EU and US agreements …

Teaching And Learning Social Change, Amie Thurber, Helen Buckingham, Jordenn Martens, Rebecca Lusk, Darrylann Becker, Stacey Spenser
School of Social Work Faculty Publications and Presentations
How can social work courses prepare students to be scholars of social movements, and also to act in solidarity with movements for social justice? How can graduate programs reimagine the professional socialization of social work students from aspiring for expertise toward a stance of life-long learning? How can instructors more deeply leverage our teaching practice to advance justice in our communities? This paper traces one attempt to answer these questions through a three-quarter graduate social work course designed to deepen students’ skills and knowledge in practices for social transformation, while amplifying existing social justice movements. Drawing on reflections from the …
