Providing Education And Resources To Staff Working With Adult Victims Of Intimate Partner Violence Experiencing Homelessness, Jillian Edling, Courtney Schultze, Sarah Scott

Homelessness impacts over half a million individuals in the United States and increases the risk of physical, emotional, social, and financial distress, potentially leading to violence, abuse or harm. Individuals experiencing intimate partner violence (IPV) are at an increased risk of becoming homeless. Homeless shelters in Duluth, MN, without specific IPV focus, do not have formal IPV training in place. The goal of this project was to educate staff and volunteers at a warming center in Duluth, MN on how to identify IPV, implement an evidence-based screening tool, and provide appropriate resource referrals to victims of IPV.

Abolishing The Evidence-Based Paradigm, Erin Collins

The belief that policies and procedures should be data-driven and “evidence-based” has become criminal law’s leading paradigm for reform. This evidence-based paradigm, which promotes quantitative data collection and empirical analysis to shape and assess reforms, has been widely embraced for its potential to cure the emotional and political pathologies that led to mass incarceration. It has influenced reforms across the criminal procedure spectrum, from predictive policing through actuarial sentencing. The paradigm’s appeal is clear: it promises an objective approach that lets data – not politics – lead the way and purports to have no agenda beyond identifying effective, efficient reforms. …

Law schools are the gatekeepers to the legal profession, and there are multiple social barriers that impact access to a legal education across a proportionally diverse range of people. This article will first rely on existing literature to demonstrate why diversity in the legal profession is an access to justice issue and to illustrate the current homogeneity that exists within the profession. This article will then argue that two primary factors prevent law schools from attracting a more diverse student body. As Americans live longer, the prevalence of Alzheimer’s disease and related dementias will increase. Caregivers are critical to the care and life quality of people with dementia. Yet, dementia caregivers are at increased risk for health issues, social isolation, and financial challenges. To help educators with the University of Kentucky Cooperative Extension Service work with their local Alzheimer’s Association and the University of Louisville to better support dementia families, we explored caregiver needs and service utilization using an online survey. Our findings highlighted the need for counseling/support, care management skills, resource education, self-care strategies, and legal services. Extension Service Educators …

The Google Shopping case has provided significant lessons that reach beyond antitrust enforcement. ‘Enabling and discovery tools’ create a layer that serves as a gateway to the Internet ecosystem. Therefore, on the one hand, they play a key role in ensuring the openness of the Internet ecosystem, and on the other hand, they exercise a primary influence on consumer experiences and their cognitive processes, which in turn determine online consumer transactions. Every year, millions of Americans struggle with serious mental illness. Of them, thousands experience civil, or involuntary, commitment—that is, hospitals invoke the coercive power of the state to force these individuals into psychiatric hospitals against their will. Whether someone requires hospitalization is a complex question of psychology, medicine, and substantive law.
But the process of civil commitment itself is troubling. Across the board, states fail to afford those facing civil commitment meaningful procedural protections. Current state laws subject individuals facing commitment to extended periods of confinement with little to no judicial intervention. Indeed, individuals facing commitment may wait weeks or …

Navigating Beyond The Lodestar: Borrowing The Federal Sentencing Guidelines To Provide Fee-Shifting Predictability, Matthew Ahn

The lodestar has been the dominant calculation method for fee-shifting awards for nearly 40 years. But the lodestar has numerous persistent issues: it leads to extra litigation and judicial effort, it results in highly variable fee awards, and it incentivizes plaintiffs’ attorneys to bill extravagantly and reject settlement. This Article argues that these issues with the lodestar, along with many others, result from a mismatch between the lodestar and the purpose of the underlying fee-shifting statutes, which is to encourage attorneys to bring suits that would not normally be economically viable. One predictor of intimate partner violence (IPV) occurring in the home is pet abuse. The high prevalence of pet cruelty among IPV relationship can create a significant barrier to seeking help due to the inability to bring the pet or concern for the pet’s wellbeing. This human-animal bond is a more common source of emotional support among victims with experiences of pet abuse, as opposed to women whose pets had not been abused. This article explores the question of legal education in micro jurisdictions using the case of Jersey, a British Crown Dependency, positioned geographically, historically and culturally between two larger jurisdictions, France and the UK. It analyses how Jersey’s legal training is pulled towards those large “big neighbours,” rather than focusing on what makes its specificity and attraction. It questions how legal education in micro-jurisdiction is actually linked to ideology. The article starts with the following question: are we taking micro jurisdictions seriously? Acculturation has been widely studied as a post-migration phenomenon that individuals face when coming in contact with their new recipient culture and environment. The different experiences, tasks, and requirements that newcomers must endure upon arrival may lead to their suffering prolonged periods of discomfort. This moderate, intermediate, or acute feeling of uneasiness is defined as acculturative stress. In it, the continued exposure to stressors such as adjusting to a new culture, rules, behavioral patterns, a second language, finding housing, and obtaining an education and employment can lead to trauma. Throughout the United States during the past few decades, there have been problems with the use of drugs. There has and always have been issues with drug addiction and drug crimes in terms of how to address those problems. From the harsh consequences of the Rockefeller Drug laws in 1973 to the establishment of the first drug court in 1989, there have been reforms to the drug laws to reduce the severity for punishments of drug offenses. For this dissertation, I conduct an ethnography of three antitrafficking programs; interview 38 activists and survivors of trafficking; and analyze organizational texts, websites, and social media. I examine the history of the antitrafficking movement. Among the three organizations, activists provide housing; food, clothing, and hygiene items; medical services; mental health services and counseling; mentorship; education for survivors; a 24-hour hotline; outreach; case management and referrals; training for law enforcement; a drop-in center; and education and awareness events. On the 21st of October 2020, the world woke to images and video clips of the bloodied, broken bodies of Nigerians shared across social and traditional media. The night before, young Nigerians protesting police brutality were met with a government-sanctioned, combined police and military onslaught; Nigerias decades-long struggle with police dysfunction was brought to a head with the massacre of its citizens at the Lekki toll gate on the evening of October 20, 2020. Significant change in the counseling field begins in counselor education programs. Concerns of biased, incompetent, and ineffective counseling services for culturally diverse clients plague the mental health profession (ACA, 2021; Sue & Sue, 2016). There has been a lack of research on how work participation policies have impacted child development through their influences on family decisions. The purpose of this qualitative research study was to explore the perspectives of families toward TANF work participation policies, discover how those policies have influenced family behaviors, and analyze how those policy-behavior phenomena have impacted child development. First, the literature review showed that families with chronic welfare dependency had negative impacts on child development. The research showed that when TANF work participation policies were unenforced or income limits were too low, some recipients worked less and persisted in …
