Referral Pathways And Service Connections Among Heirs’ Property Owners In South Carolina, Jennie L. Stephens, Jasmine Simington

Journal of Rural Social Sciences

Researchers, practitioners, and policymakers interested in alleviating heirs’ property ownership precarity have long sought to connect these owners to titling and land management resources, but there is limited scholarly evidence on successful interventions. Using administrative data from the Center for Heirs’ Property Preservation® (CHPP®), this article explores the demographic characteristics, types of direct legal services received, and referral pathways of landowners seeking legal assistance from CHPP® between 2017 and 2021. We find that applicants are primarily elderly, Black women, referred through four main pathways: (1) owners’ personal networks, (2) CHPP® Outreach efforts, (3) CHPP® partner organizations—including public, private, and nonprofit …

This Article discusses Supreme Court of Virginia and, for the first time, Court of Appeals of Virginia analysis of procedural issues. The Article further discusses revisions to civil procedure provisions of the Code of Virginia and Rules of the Supreme Court of Virginia in the last year.

The Article first addresses opinions of the supreme court and court of appeals, then new legislation enacted during the 2023 General Assembly Session, and finally revisions to the Rules of the Supreme Court of Virginia.

California State University, Monterey Bay (CSUMB) students are severely impacted by high priced housing costs. This paper will demonstrate how imperative it is that Basic Needs implements a separate housing infrastructure to help support students with their housing needs during and upon graduation. CSUMB currently houses over 55% of their students and still many students have housing insecurities. To assess the micro-level housing insecurity problem; CSUMB students work with case managers to evaluate their needs. This capstone project delves into the persistent issue of homework perpetuating inequalities among low-income families. Drawing on insights from North American public school teachers who have shared their perspectives and experiences, this research employs a combination of literature reviews, teacher interviews, and anonymous surveys. The collective evidence underscores the unsettling fact that homework drives educational disparities. Consequently, it calls for a broader acknowledgment among educators and schools that homework often hinders rather than enhances a student's academic achievements.

This research is motivated by the industry and academic needs to corroborate a holistic understanding of preferred service brand status and customer service brand engagement (CSBE). The study investigates the impact of achieving preferred university brand status and how different touchpoints in higher education influence the CSBE outcomes of host universities, as seen from the perspective of international students. Data was collected from 22 American Universities with at least 1,000 international student enrollments using an online survey. Fifty years ago, in San Antonio Independent School District v. Rodriguez, the Supreme Court failed to address one of the preeminent civil rights issues of our generation—substandard and inequitable public education—by holding that the federal Constitution does not protect a general right to education. Real property transferred over generations without a proper will or other transfer device, heirs’ property and heirs’ property owners are vulnerable to a range of challenges, from limited productive land use to the actual loss of land. Model Of Evidence-Based Practice: Children Experiencing Domestic Violence In Rural Areas, Linden Sutton, Mckenzie Kurtz

Domestic violence is often something that occurs between an abuser and a victim. However, children are also deeply affected by any type of abuse that they witness or experience. More specifically, children in rural areas face more challenges and barriers preventing them from experiencing the freedom to simply be a child. This study examined theories and interventions to treat children experiencing domestic violence. The researchers developed a treatment curriculum based on solution-focused brief therapy to address this population. Overall, solution-focused brief therapy is an effective treatment for children who have either witnessed or experienced domestic violence in a rural setting.

A Year Of Learning: Educating The Philanthropic Community About Racialized And Stigmatized Nonprofits, Shariq Siddiqui, Rafeel Wasif, Abdul Samad

Islamophobia and a lack of legitimacy heavily impact Muslim-led nonprofits and limit their relationships with philanthropy in the United States, resulting in an anemic, continually underfunded sector. This article explores that disconnect within a discussion of the Year of Learning, a unique series of virtual workshops that brought together foundations and nonprofits serving the Muslim American community.

Among the barriers to more effective relationships that emerged from the workshops were the presence of Islamophobia within society at large and philanthropy in particular, a hesitance among U.S. foundations to fund faith-based work, and a lack of capacity among Muslim-led nonprofits. Also …

This study extends the literature by exploring the role of pro bono tax clinics within the social impact ecosystem with a focus on the experiences of women in financial distress who are otherwise unable to access professional tax advice. Using clinic data derived from a pro bono tax advisory clinic, this article finds that 58 per cent of financially vulnerable women seeking pro bono tax services have experienced domestic and family violence (DFV), confirming again the link between financial stress and economic abuse. The U.S. immigration system is exceedingly complex, and access to legal representation is the primary determinant in obtaining a just immigration outcome. Immigrants must navigate a byzantine, burdensome, and high-stakes legal process, conducted in a language they often do not speak. They often must do so without any legal representation. Unlike criminal defendants, immigrants are not entitled to government-funded lawyers. Legal services organizations, such as Legal Services Corporation, that receive any federal funding are prohibited from providing legal representation to most immigrants. Underlying motion for summary judgment argued that landlord was unable to maintain the proceeding because the tenant is rent stabilized without a current lease. Judge denied motion, finding that landlord’s acceptance of ERAP payment constituted a lease and/or agreement. Motion for reargument argued that the proceeding was commenced in November 2022 and landlord did not accept ERAP payment until December 2022, therefore at the time that the proceeding was commenced there was no lease and/or agreement in effect.

The legal profession has long embraced what is called the “standard conception” of legal ethics, the prevailing model guiding the social and professional norms of American lawyers since at least the 1970s. The standard conception requires lawyers to promote their clients’ interests vigorously within the bounds of law and urges lawyers to be morally neutral toward lawful client ends, regardless of even the predictable consequences of their representations, including any harms inflicted on third parties or the public at large. Half of the people currently detained in New York City jails have a mental health diagnosis. Since 2020, the number of incarcerated people with a serious mental illness in New York City jails has nearly doubled—from 672 to 1,207 people. The medical support offered to those in jail suffering from mental illness, however, has not seen corresponding growth. The number of medical appointments missed by those incarcerated in New York City is staggering: “the monthly number of missed medical visits has spiked by 21%, from 9,259 in August 2022 to 11,176 in June 2023, outpacing growth in the jail population.” …

Conduct Relating To The Practice Of Law: Aba Model Rule 8.4(G) And Its History In Light Of The Constitution, Nathan Moelker

St. Mary's Journal on Legal Malpractice & Ethics

The ABA adopted a revision to the Model Rules in 2016, prohibiting harassment and discrimination against a list of protected classes. The Rule, while well-intentioned and targeted at a serious problem, was broadly phrased to include a large category of protected speech and behavior. The Rule has already faced extensive and well-crafted challenges from the perspective of the Free Speech Clause. This article argues that two additional provisions of the First Amendment—the Free Exercise Clause and Freedom of Association—further illustrate the failure of the Rule and the alarmingly wide-ranging effects of such a prohibition on attorney conduct.

An extraordinarily number of Americans either cannot afford or cannot find lawyers to assist them on civil legal matters. And an increasing number of Americans turn either to on-line apps or to nonlawyer professionals whose practices may overlap in whole or in part with what lawyers do. Although individuals receive much needed assistance, these alternative providers often confront allegations of committing the unauthorized practice of law.
