Esg, Public Pensions, And Compelled Speech, Mark R. Kubisch Dec 2023

Esg, Public Pensions, And Compelled Speech, Mark R. Kubisch

Texas A&M Law Review

Investing based on Environmental, Social, and Governance (“ESG”) principles has dramatically increased in recent years. Many institutional investors— including public pension funds funded by mandatory contributions from government employees—now incorporate ESG principles into their investment and engagement strategies even though certain aspects of ESG, such as investing to reduce carbon emissions, are politically controversial. Over this same period, courts have reaffirmed that the First Amendment protects individuals from being compelled to associate with or to subsidize the speech of third parties. Indeed, applying this compelled speech doctrine, the Supreme Court recently overruled a forty-year-old precedent that allowed states to force …

Without someone else being chosen to handle end of life care decisions and funeral arrangements, these decisions go to the person’s legal next of kin. Many people are not close with their next of kin, such as their parents, siblings, or children. Spouses are also legal next of kin. There are many reasons not to want your next of kin making these important decisions, one of which may be that you are not close with or do not trust that person.

For many transgender people, bad relationships with their families can mean violence and transphobia, even after death. Transgender people …

Improving Lawyers & Lives: How Immigrant Justice Corps Built A Model For Quality Representation While Empowering Recent Law School And College Graduates And The Immigrant Communities Whom They Serve, Jojo Annobil, Elizabeth Gibson

Fordham Law Review

The late Judge Robert A. Katzmann of the U.S. Court of Appeals for the Second Circuit formed a study group in 2008 called the Study Group on Immigrant Representation to assess the scope of the problem and find a solution. The study group determined that the representation crisis was an issue “of both quality and quantity” and that the two most important variables for a successful outcome in a case were having counsel and not being detained. To address this need, the study group established two innovative programs: the New York Immigrant Family Unity Project (NYIFUP), the first public defender …

Judicial Diversity In Colorado: Increasing Representation Through Innovation, Monica M. Marquez Honorable, Sumi Lee Dec 2023

Judicial Diversity In Colorado: Increasing Representation Through Innovation, Monica M. Marquez Honorable, Sumi Lee

Denver Law Review

Research documents that diversity on the bench improves judicial decision-making, improves access to justice, and strengthens the rule of law. However, until 2019, no formal programs to increase judicial diversity existed within the Colorado Judicial Branch. In 2019, Colorado enacted legislation establishing an innovative, full-time judicial diversity outreach program that utilizes data and research to develop pipeline programs and amplify its impact through increased community engagement. Now, five years later, Colorado’s state court bench is more diverse than ever before. This Article discusses the development of the Judicial Diversity Program in Colorado and best practices for other states interested in …

In the past two decades, the issue of human trafficking has grown more prominent around the world (Mollema, 2015). According to the Polaris Project, a nonprofit organization dedicated to fighting human trafficking as well as educating the world on the dangers of human trafficking analyzed data from the Human Trafficking Hotline found that in the year 2021, there were roughly 10,359 cases of human trafficking in the United States with about 16,554 victims (Polaris Project,2022). Out of these cases, approximately 72% (7,498) of them were related to sex trafficking, with the top type of trafficking out of all cases being …

Public Enforcement And Disability: A United States-South Korea Comparison, Joonghan (Joseph) Jo Dec 2023

Public Enforcement And Disability: A United States-South Korea Comparison, Joonghan (Joseph) Jo

UC Law Journal

The Americans with Disabilities Act (ADA) was enacted with the hope that it would solve issues regarding discrimination against the disabled. However, the outcome fell short of its aspirations. Many people with disabilities still suffer from ongoing discrimination. This Note argues that the ADA’s heavy reliance on private enforcement is the main reason for this shortcoming. This Note analyzes the effectiveness of public enforcement in South Korea under the Act on the Prohibition of Discrimination Against Persons with Disabilities, Remedy Against Infringement of Their Rights (Korean Disability Discrimination Act. This Note then argues that civil law country-style public enforcement based …

Swimming Together Upstream: How To Align Mlp Services With U.S. Healthcare Delivery, William M. Sage, Keegan D. Warren

Faculty Scholarship

Medical-legal partnership (MLP) embeds attorneys and paralegals into care delivery to help clinicians address root causes of health inequities. Notwithstanding decades of favorable outcomes, MLP is not as well-known as might be expected. In this essay, the authors explore ways in which strategic alignment of legal services with healthcare services in terms of professionalism, information collection and sharing, and financing might help the MLP movement become a more widespread, sustainable model for holistic care delivery.

On April 19 and 20, 2023, Professors Bernard Hibbitts and Richard Weisberg convened a conference at the University of Pittsburgh School of Law titled “Disarmed, Distracted, Disconnected, and Distressed: Modern Legal Education and the Unmaking of American Lawyers.” Four speakers concluded the event with a spirited conversation about themes expressed during the proceedings. Distilling a lively two days, they asked: what are the most critical challenges now facing United States legal education and, by extension, lawyers and the communities they serve? Their agreements and disagreements were striking, so much so that Professors Hibbitts and Weisberg invited those four to extend …

A Perfect Storm For Legal Education: Privatization, Polarization, And Pedagogy, Rachel F. Moran

Faculty Scholarship

Today, the legal profession faces new challenges to its integrity and legitimacy due to technological change, rising political polarization, and a stratified bar. In this Article, I first explore how technological innovations are undermining lawyers’ claims to a unique monopoly based on expert professionalism. These technologies are designed to transform routinized law practice in ways that improve efficiency. With little focus on attorneys’ obligations to serve the greater good, technology entrepreneurs emphasize practical advantages over traditional forms of representation. These proponents promise reduced costs and superior results through a single-minded commitment to market dynamics. Those promises in turn depend on …

Dentistry And The Law: Requiring Proof Of Adoption/Retaining Orthodontic Models, Dan Schulte Jd

The Journal of the Michigan Dental Association

In this Dentistry and the Law column, a dentist seeks guidance on handling a situation where racial differences between a child and an accompanying adult raised concerns during an examination, leading the dentist to request proof of adoption. The response clarifies that asking for proof of adoption is not illegal, citing relevant Michigan adoption statutes. The column advises adopting an office policy, emphasizing human trafficking training. Additionally, a dentist inquires about retaining orthodontic models and X-ray films. The answer recommends assuming orthodontic models are part of dental records, subject to a 10-year retention period. Patients can be given their models, …

Integrating Lawyers Into Perinatal Care Teams To Address Unmet, Health-Harming Legal Needs, Loral Patchen, Roxana Richardson, Asli Mccullers, Vicki W. Girard

Georgetown Law Faculty Publications and Other Works

Across the United States, historically imposed structural, social, and environmental variables are intimately connected to poor obstetric outcomes and high maternal and infant mortality rates among Black pregnancy-capable people. Efforts to diminish the effect of these variables include integrating screening for social determinants of health during the perinatal period and treating them with social services, mental health support, and other referrals, including connections to community-based resources. Although helpful, some of these social determinants cannot be overcome without legal advocacy. Medical–legal partnerships, which integrate lawyers into health care, fill this gap. This commentary by an interprofessional team of authors relies on …

Reviving The Greenbook In The Context Of Failure To Protect: Assessing Risk Of Harm In Domestic Violence Situations To Best Assist Battered Mothers And Their Children, Nikki Viavant Dec 2023

Reviving The Greenbook In The Context Of Failure To Protect: Assessing Risk Of Harm In Domestic Violence Situations To Best Assist Battered Mothers And Their Children, Nikki Viavant

UC Law SF Journal on Gender and Justice

This paper examines the typical responses and approaches our child welfare agencies and juvenile courts take when handling dependency cases involving families experiencing domestic violence that fall under California Welfare and Institutions Code section 300(b). All too often, when a child is exposed to domestic violence, their mothers, survivors of the domestic abuse, are adjudged to have acted negligently for “failing to protect” their children adequately from domestic violence. Unfortunately, jumping rashly to this jurisdictional finding results in the removal of countless children from their battered yet otherwise fit mothers, and, in some instances, can ultimately lead to the termination …

Identifying Heirs’ Property: Extent And Value Across The South And Appalachia, Ryan Thomson, Conner Bailey

Journal of Rural Social Sciences

A database of property tax records was used to locate and quantify the extent of heirs’ property across 11 states (Alabama, Florida, Georgia, Kentucky, Louisiana, Mississippi, North Carolina, South Carolina, Tennessee, Virginia, and West Virginia). Based on previously published work, an index of four variables was then developed to estimate the likelihood that a given parcel was heirs’ property. The authors conservatively estimate that there are at least 496,994 parcels of heirs’ properties with a combined total area of 5.3 million acres and a market value of $41.9 billion in these states.
