A tenant of a NYCHA apartment plagued by severe roach, spider, and mice infestations won a temporary relocation, rent abatement, and violation order against the landlord (NYCHA). Citing the uninhabitable conditions and breach of habitability warranty, the court ruled for: tenant's relocation to eradicate the infestation, complete rent abatement until the apartment is habitable, immediate NYC Housing Maintenance Code violation repair orders, and reporting of the situation to the Consent Decree monitor overseeing ongoing improvements at NYCHA. This case highlights tenant rights to safe and healthy housing and the landlord's responsibility to maintain those conditions.

Distilling a lively two days, they asked: what are the most critical challenges now facing US legal education and, by extension, lawyers and the communities they serve? Their agreements and disagreements were striking, so much so that Professors Hibbitts and Weisberg invited those four to extend their …

Delaware Beware, Anat Alon-Beck

Faculty Publications

While the scholarly spotlight has predominantly shone on publicly traded giants, this article daringly delves into uncharted territory, unraveling the intricate incorporation and governance decisions of privately held “unicorns”—those elusive venture capital-backed behemoths that silently shape the economic landscape.

By unraveling the decision-making processes of where these economic powerhouses incorporate, the article challenges prevailing assumptions on …

Antitrust & Ai Supply Chains, Maurice E. Stucke, Ariel Ezrachi

Scholarly Works

Will AI technology disrupt the current Big Tech Barons, foster competition, and ensure future disruptive innovation that improves our well-being? Or might the technology help a few ecosystems become even more powerful?

To explore this issue, our paper outlines the current digital market dynamics that lead to winner-take-most-or-all ecosystems. After examining the emerging AI foundation model supply chain, we consider several potential antitrust risks that may emerge should certain layers of the supply chain become concentrated and firms extend their power across layers. But the anticompetitive harms are not inevitable, as several countervailing factors might lessen or prevent these antitrust …

This report describes a multifaceted, trauma-informed initiative developed to address racial/ethnic maternal and infant health inequities in Washington, D.C.

Description

Structural racism and systemic oppression of marginalized communities have played a critical role in maternal and infant health inequities in the United States. Black birthing individuals are exponentially more likely to experience adverse birth outcomes, including preterm birth, low birth weight and maternal mortality. In response to these statistics, the Safe Babies Safe Moms (SBSM) initiative was developed to support patients of marginalized identities and improve health outcomes. Is The Juridical Field Of Environmental Law In India Gendered? A Study Of Environmental Justice In Goa Through An Ecofeminist Lens, Shweta Dilip Singh Sinha

Theses and Dissertations

The aim of this study is to examine whether the “juridical field,” as defined by Bourdieu, of environmental law in India (Goa), is gendered. As per Bourdieu, the legal field is neither as neutral nor as autonomous as the legal profession asserts it is. It relies heavily on the juridical practices of universalization, appropriation, and naming or categorization in order to constantly reimagine and negotiate its own boundaries. This study examines these juridical practices including acts of symbolic violence committed in the process of ‘naming’ or ‘defining’ within legal terms extra-legal concepts, mainly environmental toponyms, such as, ‘“forest,” “CRZ” (Coastal …

Incorporating Unicorns: An Empirical Analysis, Anat Alon-Beck

Faculty Publications

There is a growing concern among regulators and academics about how to regulate unicorns - entities large enough to have a public impact yet remaining in the private domain. An examination of corporate charters within a selected sample of unicorn firms reveals an important finding: 97% of these entities are incorporated in Delaware. This concentration provides Delaware with significant leverage to shape regulatory frameworks, especially concerning the protection of parties who may lack the ability to safeguard their interests through contractual means.

This groundbreaking discovery on the dominance of Delaware showcases a substantial deviation from incorporation trends in other business …
